<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4706</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220802">August 2, 2022</action-date><action-desc><sponsor name-id="S316">Mr. Whitehouse</sponsor> (for himself, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S353">Mr. Schatz</cosponsor>, and <cosponsor name-id="S361">Ms. Hirono</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 28, United States Code, to provide for the duration of active service of the Chief Justice of the United States and associate justices of the Supreme Court of the United States, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD406FB6882DE4710A4EF81334A6E7A81"><section section-type="section-one" id="HE63E3DC16FCC47229A74EAA4004B70B1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supreme Court Tenure Establishment and Retirement Modernization Act of 2022</short-title></quote>.</text></section><section id="H4ED85568ECD04E5088DFD4EB518642F7"><enum>2.</enum><header>Supreme Court terms of office</header><subsection id="HE3E86CB061E64A81B3F082AD381E261B"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/1">Chapter 1</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HB0B5C780519C49409CA170F987D158DD"><section id="H5E01C8D832A74A2B8A464FB242553865"><enum>7.</enum><header>Appointment</header><subsection id="H61C4DA839DEE4448AE5F77C731E3FF4A"><enum>(a)</enum><header>Regular appointment of justices</header><text>The President shall, during the first and third years after a year in which there is a Presidential election, nominate, and by and with the advice and consent of the Senate, appoint a Chief Justice of the United States or an associate justice of the Supreme Court of the United States.</text></subsection><subsection id="H60D14A00798C438DBFD797620AE33133"><enum>(b)</enum><header>Exclusive method of appointment</header><text>The President shall not appoint any Chief Justice of the United States or associate justice of the Supreme Court of the United States except as provided in this section.</text></subsection></section><section id="H52BC426905D64B5BBF3745663593DD9A"><enum>8.</enum><header>Duration of Active Service</header><subsection id="H6052F2FED21F47109D86AFA6C9564426"><enum>(a)</enum><header>New justices</header><text>A Chief Justice of the United States or an associate justice of the Supreme Court of the United States shall serve in regular active service for an 18-year period beginning on the date of the commission of the Chief Justice or associate justice, after which the justice shall be deemed to have retired from regular active service under section 371.</text></subsection><subsection id="H1D26E27D40D64AEEADEBF705951DF07D"><enum>(b)</enum><header>Current justices</header><text display-inline="yes-display-inline">Each Chief Justice of the United States and associate justice of the Supreme Court of the United States who was appointed before the date of enactment of this section and who is serving as the Chief Justice or associate justice, as applicable, on the date of enactment of this section shall, notwithstanding the period of service of the justice, in order of duration of service beginning with the justice who has served on the Supreme Court of the United States for the longest period of time, be deemed to have retired from regular active service under section 371(b) upon the date of commission of each new Chief Justice or associate justice, as applicable, as they are appointed under section 7.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H921D66931B4043679368D05C58AC737E"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/1">chapter 1</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H9F9F28A8605947AE865FD3E103A32E43"><toc regeneration="no-regeneration"><toc-entry level="section">7. Appointment</toc-entry><toc-entry level="section">8. Duration of Active Service</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H2EE8EEE3141142888219D3AAC0E7285D"><enum>3.</enum><header>Senior justices</header><text display-inline="no-display-inline">Section 294 of title 28, United States Code, is amended—</text><paragraph id="H0F1F19BC33664273A38A5DE472896EEC"><enum>(1)</enum><text>in subsection (d), by inserting <quote>, except as provided by subsection (e)</quote> before the period at the end;</text></paragraph><paragraph id="H8B98FA988F7E4D6BB61EA8DDBFA06992"><enum>(2)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph><paragraph id="H62CC6961ACC948EF81C5A333BEFDDB18"><enum>(3)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" id="H537EF4809D024A1296D96E87233E5FFB"><subsection id="H5FCB1234CFFB40D588E2F00E15850D23"><enum>(e)</enum><text>If number of justices of the Supreme Court of the United States falls below that provided in section 1 due to vacancy, disability, or disqualification, the Chief Justice or associate justice of the Supreme Court who has most recently retired from regular active service under section 371 but retained their office shall serve as an associate justice until the number of justices who have not retired from regular active service equals that provided in section 1.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
