<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4702</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220802">August 2, 2022</action-date><action-desc><sponsor name-id="S362">Mr. Kaine</sponsor> (for himself, <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>, <cosponsor name-id="S308">Mr. Cardin</cosponsor>, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, <cosponsor name-id="S327">Mr. Warner</cosponsor>, and <cosponsor name-id="S413">Mr. Padilla</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To impose limits on excepting competitive service positions from the competitive service, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HECCBD986270B47BA90CC776E37BF5118"><section section-type="section-one" id="H9C7791C9B3A04EFFBFED5EED9D4D9F38"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing a Patronage System Act of 2022</short-title></quote> or the <quote><short-title>PPSA Act of 2022</short-title></quote>. </text></section><section id="H0B9E5466F75F481196B798B0ED8E1E90"><enum>2.</enum><header>Limitations on exception of competitive service positions</header><subsection id="H8F6C9E5219D14F32B3AE4F3105EB2FAA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 3302 of title 5, United States Code, no position in the competitive service (as defined in section 2102 of that title) may be excepted from the competitive service unless that position is placed—</text><paragraph id="HDF4652B7F8B145A595988536408A6AB2"><enum>(1)</enum><text display-inline="yes-display-inline">in any of schedules A through E, as described in section 6.2 of title 5, Code of Federal Regulations, as in effect on September 30, 2020; and</text></paragraph><paragraph id="HDEDE978DB8E94F62ABD8BD0B3AE4991C"><enum>(2)</enum><text display-inline="yes-display-inline">under the terms and conditions under part 6 of title 5, Code of Federal Regulations, as in effect on September 30, 2020.</text></paragraph></subsection><subsection id="H12805E3446AB426EADACE282B6F92412"><enum>(b)</enum><header>Subsequent transfers</header><text>Notwithstanding section 3302 of title 5, United States Code, no position in the excepted service (as defined in section 2103 of that title) may be placed in any schedule other than a schedule described in subsection (a)(1).</text></subsection></section></legis-body></bill>
