which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide cybersecurity support for small business concerns through the small business development center program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Businesses Cybersecurity Act</short-title></quote>.</text></section><section id="id306D4E142D1246D68CAAC217F4B60C15"><enum>2.</enum><header>Small Business Cybersecurity Grants</header><text display-inline="no-display-inline">Section 21 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFEAAFDCEC21F46D2B1DF71585E4315B8"><subsection id="idDA7D814B75BE4F759496E9CC742B2C8B"><enum>(o)</enum><header>Cybersecurity Grants</header><paragraph id="idDA70E2057F5A4A5DA976C9997BE55C81"><enum>(1)</enum><header>Definitions</header><text>In this section:</text><subparagraph id="idAD4BAE7B03814A7DB4A38DC310130195"><enum>(A)</enum><header>Rural area</header><text>The term <term>rural area</term> has the meaning given the term in section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>).</text></subparagraph><subparagraph id="id9C7111E10FBA40C09BC0B9C5C69DBFC0"><enum>(B)</enum><header>Small State</header><text>The term <term>small State</term> means any State that is minimally funded by the funding formula of the Small Business Development Center Program under subsection (a)(4)(C).</text></subparagraph><subparagraph id="id9B120195AF2D44CD967936036984D9E1"><enum>(C)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, and any territory or possession of the United States.</text></subparagraph></paragraph><paragraph id="id43F4F4D61E534006B2431D0E1465BE50"><enum>(2)</enum><header>Grants</header><subparagraph id="id07FD123FACBB47FE8A9262CC55189470"><enum>(A)</enum><header>In general</header><text>The Administrator shall establish a grant program under which the Administrator may award grants on a noncompetitive basis to small business development centers to support the cybersecurity needs of the small business concerns served by the small business development centers.</text></subparagraph><subparagraph id="idD17697504AC84C61A1F2A6E46A3F7A35"><enum>(B)</enum><header>Grant criteria</header><text>In awarding grants under this subsection, the Administrator may consider the following criteria:</text><clause id="id72275d640f73487d9d38baaf0c73d423"><enum>(i)</enum><text>The plan of the small business development center for the use of the grant funds, including how funds would benefit small business concerns in rural areas.</text></clause><clause id="idd2faf0fefaea45c6ad5a3eebb7aa0e6a"><enum>(ii)</enum><text>Evidence submitted by the small business development center that the grant would increase the cybersecurity of the small business concerns that the small business development center serves, including evidence of past success in offering cybersecurity support to small business concerns.</text></clause></subparagraph><subparagraph id="id5E2835F1EFB54421A8163AE36A473172"><enum>(C)</enum><header>Applications</header><text>To be eligible for a grant under this subsection, a small business development center shall submit to the Administrator an application in such form, at such time, and containing such information as the Administrator determines is appropriate.</text></subparagraph><subparagraph id="id404A215A27FD4A97987633FC4342A080"><enum>(D)</enum><header>Use of Funds</header><text>A small business development center may use amounts received under a grant under this subsection to support the cybersecurity of the small business concerns served by the small business development center, including—</text><clause id="id58799ECD350046D692494354DB9D629F"><enum>(i)</enum><text>cybersecurity training for employees of the small business concerns;</text></clause><clause id="ida2bd874ce1864a539bc9f043038402c6"><enum>(ii)</enum><text>reviews of the cybersecurity policies, plans, and procedures used by the small business concerns, including tabletop exercises to test the policies, plans, and procedures;</text></clause><clause id="id7892CE66B11F493499ABE5DD4A1D1781"><enum>(iii)</enum><text>testing of the cybersecurity standing of the small business concerns, including via penetration testing; and</text></clause><clause id="id731B066FA1D34A04B97F55B5415417A5"><enum>(iv)</enum><text>hiring consultants to support the cybersecurity needs of the small business concerns.</text></clause></subparagraph><subparagraph id="id753D738A495C44BB9F98B479988ECE63"><enum>(E)</enum><header>Grant Amount</header><clause id="id40D28F00EAE64A43A4977C4EE31884C9"><enum>(i)</enum><header>Formula</header><text>The Administrator shall establish a 3-tier formula for grant funding distribution based on the locations of small business development centers in one of the following categories:</text><subclause id="idA68F21CBDB234BB490763EE7CC64B048"><enum>(I)</enum><text>Small States.</text></subclause><subclause id="id9F2CED4CE4934CD6824AD2006D1CF165"><enum>(II)</enum><text>Medium-sized States, as defined by the Administrator.</text></subclause><subclause id="id22E7C76B32A74EEDAE863CC0C25192B3"><enum>(III)</enum><text>Large States, as defined by the Administrator.</text></subclause></clause><clause id="idC85E791856204E2892AE567E43749B2E"><enum>(ii)</enum><header>Maximum Amount</header><text>The maximum amount of a grant under this subsection shall be, for a small business development center located in—</text><subclause id="idabab097af2274f9fab5d8b3fd1fd8e9d"><enum>(I)</enum><text>a small State, $200,000;</text></subclause><subclause id="id4ECDDD053805489B84BCBD447957BF33"><enum>(II)</enum><text>a medium-sized State, $300,000; or</text></subclause><subclause id="id003763C9A17B42589178C5E5E7E85D79"><enum>(III)</enum><text>a large State, $400,000.</text></subclause></clause></subparagraph><subparagraph id="id38DBD480AD614451B7825BFDC0544610"><enum>(F)</enum><header>Duration of Grant</header><text>The period of a grant under this subsection shall be 1 fiscal year.</text></subparagraph><subparagraph id="id0C569C6755E74B85A31EC06544296232"><enum>(G)</enum><header>Announcement of Grant Program</header><text>The Administrator shall make widely available to the public information on the grant program under this subsection.</text></subparagraph></paragraph><paragraph id="idEE7296F56A8C444987046234A04D50A1"><enum>(3)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this subsection $20,000,000 for fiscal year 2023 and each fiscal year thereafter, to remain available until expended. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
