which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that the Federal Communications Commission may not prevent a State or Federal correctional facility from utilizing jamming equipment, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cellphone Jamming Reform Act of 2022</short-title></quote>.</text></section><section id="idFBA81C4A8ACC49DA8D03812F34852B33"><enum>2.</enum><header>Limitation on FCC authority</header><subsection id="id30F40AC70D7340738E8184B9B5A4479A"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idF68A5E13D6FA47A898FC68A7F9A6E045"><enum>(1)</enum><text>the term <term>Commission</term> means the Federal Communications Commission;</text></paragraph><paragraph id="id60FB90C8A2734843A016788D191714A6"><enum>(2)</enum><text>the term <term>correctional facility</term> means a jail, prison, penitentiary, or other correctional facility; and</text></paragraph><paragraph id="id0B3B155B95834C71B8DA6A254B0EC54C"><enum>(3)</enum><text>the term <term>jamming system</term>—</text><subparagraph id="id6F83982780D64BCBAFD122D1C3E3E38C"><enum>(A)</enum><text>means a system of radio signal generating and processing equipment and antennas designed to disrupt, prevent, interfere with, or jam a wireless communication into, from, or within a correctional facility; and</text></subparagraph><subparagraph id="id299FF5AA6BBB48F2A5693952F6B0C3C2"><enum>(B)</enum><text>includes the components and functionality of a system described in subparagraph (A), such as—</text><clause id="id9DDA04A0F3A04946BE8076CDB9850C75"><enum>(i)</enum><text>antennas, cabling, and cable elements;</text></clause><clause id="id8ABA51F8181A42628BA209055F8D0EAD"><enum>(ii)</enum><text>the installation, interconnection, and operation of system elements, power levels, and radio frequencies carried on the cables or fed into antennas;</text></clause><clause id="id9A6B64FBC02C484AB57EBC29715A1AF5"><enum>(iii)</enum><text>the radiation pattern of the antennas; and</text></clause><clause id="idB94C2150F5CB4B2197FD3239A72643FE"><enum>(iv)</enum><text>the location and orientation of the antennas.</text></clause></subparagraph></paragraph></subsection><subsection id="id747C3D713C77447EAC57B3EA8D86ECC4"><enum>(b)</enum><header>Restriction</header><paragraph id="idFC83049C1260488FA6E796780FD94CD5"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law or regulation, and subject to paragraph (2), the Commission may not prevent a State or Federal correctional facility from operating a jamming system within the correctional facility to prevent, jam, or otherwise interfere with a wireless communication that is sent—</text><subparagraph id="idA083792782964806AB924551BD7B5D64"><enum>(A)</enum><text>to or from a contraband device in the facility; or</text></subparagraph><subparagraph id="id52C4471B84A0421598385F1AEE764F28"><enum>(B)</enum><text>by or to an individual held in the facility.</text></subparagraph></paragraph><paragraph id="idE7DD4CA63BC649C999053A623909ED90"><enum>(2)</enum><header>Requirements</header><text>With respect to a jamming system described in paragraph (1)—</text><subparagraph id="idD2F366FDEEE547F4A78AE08C1CBA5E54"><enum>(A)</enum><text>the operation of the system shall be limited to the housing facilities of the correctional facility in which the system is located;</text></subparagraph><subparagraph id="idD2EBD27F39D045508EF52DC0EDBF1CF1"><enum>(B)</enum><text>if the correctional facility that operates the system is a State correctional facility, the State that operates the correctional facility shall be responsible for funding the entire cost of the system, including the operation of the system; and</text></subparagraph><subparagraph id="id0F6BD1F1111A4494A0DE2A30CD630978"><enum>(C)</enum><text>the correctional facility that operates the system shall—</text><clause id="idFE49CD21D4004C069C12C9BDDE558A5D"><enum>(i)</enum><text>before implementing the system, consult with local law enforcement agencies and other public safety officials in the area in which the facility is located; and</text></clause><clause id="id911DBB8FE5404365BC3841482744E2BF"><enum>(ii)</enum><text>submit to the Director of the Bureau of Prisons a notification regarding that operation.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
