which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize the National Computer Forensics Institute of the United States Secret Service, and for other purposes.</official-title></form><legis-body><section id="id520D3B6DC2E9480691C602CBF2BE22EC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Computer Forensics Institute Reauthorization Act of 2022</short-title></quote>.</text></section><section section-type="subsequent-section" id="id6511352EA17C4A59986D710ABA9C1841"><enum>2.</enum><header>Reauthorization of the National Computer Forensics Institute</header><text display-inline="no-display-inline">Section 822 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/383">6 U.S.C. 383</external-xref>) is amended—</text><paragraph id="id323e58f982ec4497a4847e8d3a11d217"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id865703ED532847EBBC4F51FC068179C4"><enum>(A)</enum><text>in the first sentence, by striking <quote>2017 through 2022</quote> and inserting <quote>2023 through 2028</quote>; and</text></subparagraph><subparagraph id="id549B985D226A4DCE94E9A98E1D818784"><enum>(B)</enum><text>by striking the second sentence;</text></subparagraph></paragraph><paragraph id="id2000dffe06904a1a825e25b4021ade90"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD60081079DBD4CF9BE58F3417D43A733"><subsection id="idB5B3AC06520B4700B087B1AF2D4B1EDC"><enum>(b)</enum><header>Functions</header><text>The Institute shall provide information and training to any State, local, Tribal, or territorial law enforcement officer, prosecutor, or judge, any officer or employee of any agency in any branch of the Federal Government, any member of the uniformed services, or any State, local, Tribal, or territorial employee who might reasonably assist in the investigation and prevention of cyber and electronic crime and related threats, on—</text><paragraph id="id1577B81F04944CC888C4CADC4145ECDA"><enum>(1)</enum><text>cyber and electronic crimes and related threats;</text></paragraph><paragraph id="idED76CA46A59A498F89EC0416FD6F5825"><enum>(2)</enum><text>methods for investigating cyber and electronic crime and related threats and conducting computer and mobile device forensic examinations;</text></paragraph><paragraph id="id2066BAB0444E42CDB6D80FE21E9016F4"><enum>(3)</enum><text>prosecutorial and judicial challenges related to cyber and electronic crime and related threats, and computer and mobile device forensic examinations; and</text></paragraph><paragraph id="id3F1D84D179C246328C15BA0DDD811D26"><enum>(4)</enum><text>methods to obtain, process, store, and admit digital evidence in court.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="ide5ce3c54fe0941f5807ffc491f793fe4"><enum>(3)</enum><text>in subsection (c), by striking <quote>State, local, tribal, and territorial law enforcement officers and prosecutors</quote> and inserting <quote>members and partners of the network of Cyber Fraud Task Forces of the United States Secret Service, and, when selecting participants for the training specified in subsection (b), the Institute shall prioritize, to the extent reasonable and practicable, State, local, tribal, and territorial law enforcement officers, prosecutors, judges, and other employees.</quote>;</text></paragraph><paragraph id="idc977c45fe52340bfa80d3636fe762bef"><enum>(4)</enum><text>in subsection (d), by striking <quote>State, local, tribal and territorial law enforcement officers</quote> and inserting <quote>the individuals listed in subsection (b)</quote>;</text></paragraph><paragraph id="id4f059a2dc47743e29352489d497aedad"><enum>(5)</enum><text>in subsection (e)—</text><subparagraph id="id3362A4B7B2A64787ACC1AA773F381511"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="section">Electronic Crime</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="section">Cyber Fraud</header-in-text></quote>;</text></subparagraph><subparagraph id="idB8C6CCCC4F074AADB7DCDA316BDCD691"><enum>(B)</enum><text>by striking <quote>Electronic Crime</quote> and inserting <quote>Cyber Fraud</quote>; and</text></subparagraph><subparagraph id="idBABB1097AEAD4EF9AEE38A6131D5D458"><enum>(C)</enum><text>by striking <quote>State, local, tribal, and territorial</quote>; and</text></subparagraph></paragraph><paragraph id="id1bc10996853f4429b82acda22a782be1"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id33664D2C12E841C7B54C57BEEF69B7C0"><subsection id="id360e81e2ee1d43e48be5042081de189b"><enum>(g)</enum><header>Expenses</header><text>The Director of the United States Secret Service may pay for all or a part of the necessary expenses of the training and information provided by the Institute under subsection (b), including travel, transportation, and subsistence expenses for recipients of the information and training.</text></subsection><subsection id="idee5f068889e64491962fec9e44d0d2e3"><enum>(h)</enum><header>Annual reports to Congress</header><paragraph id="idBB413D7EABD64F1CA4AB5CBA17409CEC"><enum>(1)</enum><header>In general</header><text>The Secretary shall include in the annual report required under section 1116 of title 31, United States Code, information regarding the activities of the Institute, including, where possible—</text><subparagraph id="id9FB9AD144D9E42618FB63523E1E4CE84"><enum>(A)</enum><text>an identification of jurisdictions with recipients of the education and training provided pursuant to subsection (b) during such year;</text></subparagraph><subparagraph id="idBA3C227BB8314E76A292B2F61BAA82F8"><enum>(B)</enum><text>information relating to the costs associated with that education and training;</text></subparagraph><subparagraph id="ida86139f70edf48688ddbd874c96005d3"><enum>(C)</enum><text>any information regarding projected future demand for the education and training provided pursuant to subsection (b);</text></subparagraph><subparagraph id="id3a775d635b08462ea7c1b496094ef8f0"><enum>(D)</enum><text>impacts of the activities of the Institute on the capability of jurisdictions to investigate and prevent cybersecurity incidents, electronic crimes, and related cybersecurity threats;</text></subparagraph><subparagraph id="id742610ee376e4ff086d84e53fb053068"><enum>(E)</enum><text>a description of the nomination process for potential recipients of the information and training provided pursuant to subsection (b); and </text></subparagraph><subparagraph id="id2eafb87852454aeeb9faf5898230104d"><enum>(F)</enum><text>any other issues determined to be relevant by the Secretary.</text></subparagraph></paragraph><paragraph id="id2848088326B342B78BB5FCF84F04281E"><enum>(2)</enum><header>Exception</header><text>Any information required under paragraph (1) that is submitted as part of the annual budget submitted by the President to Congress under section 1105 of title 31, United States Code, is not required to be included in the report described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
