which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Western Riverside National Wildlife Refuge, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H33314A46FD7C466C815F8176464B4FEA"><section section-type="section-one" id="H5FBD67774C2C4885BF8E82178914B727"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Western Riverside National Wildlife Refuge Act</short-title></quote>.</text></section><section id="id6949AC32805041B9BDAF8AB1EE6C5688"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id6AED6A7011B341A08D0975DD6C5FEBA7"><enum>(1)</enum><header>Additional reserve lands</header><text>The term <term>additional reserve lands</term> means the conserved habitat totaling approximately 153,000 acres that are needed to meet the goals and objectives of the Conservation Plan, of which—</text><subparagraph id="idB6E96429F5014652AB9478FB3E50F787"><enum>(A)</enum><text>56,000 acres are Federal and State acquisition and mitigation for State Permittees; and</text></subparagraph><subparagraph id="idC75CB079215C4C72ADE3CE3B0933192B"><enum>(B)</enum><text>97,000 acres were contributed by local Permittees.</text></subparagraph></paragraph><paragraph id="id11C319C9354F44E4978E426C52B39537"><enum>(2)</enum><header>Conservation Plan</header><text>The term <term>Conservation Plan</term> means the Western Riverside County Multiple Species Habitat Conservation Plan permitted by the United States Fish and Wildlife Service on June 22, 2004.</text></paragraph><paragraph id="id84E1DF07D5AA444BBF49BBADA67B9A3F"><enum>(3)</enum><header>County</header><text>The term <term>County</term> means Riverside County, California.</text></paragraph><paragraph id="idCACCF9B501B04D7585BB3A9B323E4EBC" commented="no"><enum>(4)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" id="id7AC7CE0BCE48430580C95152250D0D37"><enum>(5)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Western Riverside National Wildlife Refuge Acquisition Boundary as proposed by the Western Riverside National Wildlife Refuge Act</quote> and dated May 25, 2022.</text></paragraph><paragraph commented="no" id="id08C007EE4995453FBDD15C4F90D28BFF"><enum>(6)</enum><header>Permittee</header><text>The term <term>Permittee</term> means an entity identified as a permittee in the incidental take permit issued under section 10 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1539">16 U.S.C. 1539</external-xref>) that is associated with the Conservation Plan.</text></paragraph><paragraph commented="no" id="id68C1490B3ADE4B00996D6648C267EC41"><enum>(7)</enum><header>Regional Conservation Authority</header><text>The term <term>Regional Conservation Authority</term> means the Western Riverside County Regional Conservation Authority.</text></paragraph><paragraph id="id933303D053694A53AE10CE1C745843F9"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service.</text></paragraph><paragraph id="id8317A6AE80B84E218B2391520BE22915"><enum>(9)</enum><header>State</header><text>The term <term>State</term> means the State of California.</text></paragraph><paragraph id="idEA9A2B501B50452C80AC085F8DE17602"><enum>(10)</enum><header>Urban Partnership</header><text>The term <term>Urban Partnership</term> means a place-based partnership, established in accordance with United States Fish and Wildlife Service policy, to be carried out on partner-owned land, including the Urban Bird Treaties Program, Urban Wildlife Refuge Partnerships, and other partnership programs of the United States Fish and Wildlife Service.</text></paragraph><paragraph id="id28F11784C7874375B5C23F74428DEA21"><enum>(11)</enum><header>Urban Wildlife Refuge</header><text>The term <term>Urban Wildlife Refuge</term> means a unit of the National Wildlife Refuge System that is managed consistent with the Urban Wildlife Conservation Program of the United States Fish and Wildlife Service.</text></paragraph><paragraph id="id8FF953697DF84583B7934B71CC8FCFD7"><enum>(12)</enum><header>Wildlife habitat</header><text>The term <term>wildlife habitat</term> means the combination of food, water, shelter, or space that meet the needs of wildlife, including wildlife corridors, which are features of the landscape that provide ecological connectivity and allow for native species movement or dispersal as identified—</text><subparagraph id="id54509B79847946159B9C4E5E85904510"><enum>(A)</enum><text>by the Secretary; or</text></subparagraph><subparagraph id="id2A5859DD72DF484B8BC2407CD4387CAB" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>in section 3.2.3 of the Conservation Plan.</text></subparagraph></paragraph><paragraph id="idE85E7D48510B4B3AA5814BEE7B937C08" commented="no" display-inline="no-display-inline"><enum>(13)</enum><header>Wildlife Refuge</header><text>The term <term>Wildlife Refuge</term> means the Western Riverside National Wildlife Refuge established under section 3(a).</text></paragraph></section><section id="H9F36898EC0B84B34A64D3BB736932C22"><enum>3.</enum><header>Establishment of Western Riverside National Wildlife Refuge</header><subsection id="idC30DC878DEB6460B996FBF2B9EC43917"><enum>(a)</enum><header>Establishment</header><text>On the first acquisition by, or transfer to, the Secretary of any land, water, or any interest in land or water under subsection (h), the Secretary shall establish a unit of the National Wildlife Refuge System, to be known as the <quote>Western Riverside National Wildlife Refuge</quote>.</text></subsection><subsection id="H29015383922E4BCA95EDE8F17C57F011"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Wildlife Refuge are—</text><paragraph id="HDBE3FC4326AA4BD292DC18B6A57285C0"><enum>(1)</enum><text>to conserve, manage, and restore fish, wildlife, plants, and their habitats for the benefit of present and future generations of individuals in the United States; and</text></paragraph><paragraph id="H55838CB30C39426CB10D5FF53A67BCFE"><enum>(2)</enum><text>to support the conservation, recovery, and protection of—</text><subparagraph id="id188D0B2F0776437DAE0B9EF81F08B08D"><enum>(A)</enum><text>species listed as threatened species or endangered species under—</text><clause id="id9C7499B7F5614BEBAD18AB357AAEDA0A"><enum>(i)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></clause><clause id="id7B97AF7F9D2B4310B6E43C3FC275A752"><enum>(ii)</enum><text>the California Endangered Species Act (Chapter 1.5 of Division 3 of the California Fish and Game Code); and</text></clause></subparagraph><subparagraph id="idFD4C47F1F2E44FBEB93D6C7459467816"><enum>(B)</enum><text>covered species listed under the Conservation Plan.</text></subparagraph></paragraph></subsection><subsection id="id3267C71A04D94CBB936D3C44396A0F51"><enum>(c)</enum><header>Uses</header><text>The uses of the Wildlife Refuge shall include—</text><paragraph id="H67C2B9C48670429D9A237FCCC4C99AB3"><enum>(1)</enum><text>providing, to the extent compatible with the purposes described in subsection (b) and pursuant to the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>)—</text><subparagraph id="id8AFA7D12196C451D8196E81378F0EC5E"><enum>(A)</enum><text>opportunities for scientific research, environmental education, and fish and wildlife-oriented recreation; and</text></subparagraph><subparagraph id="idE801B43EAFB548EF8E683C7882D94C5C"><enum>(B)</enum><text>improved access to nature for communities; and</text></subparagraph></paragraph><paragraph id="id3411eaa6b806404d85bb7d627447b5e3"><enum>(2)</enum><text>engaging communities in fish and wildlife conservation, restoration, education, recreation, and outreach activities through the pursuit of Urban Partnerships.</text></paragraph></subsection><subsection id="idE500BD070C8B40CDA5AB182BB5C84C5F"><enum>(d)</enum><header>Urban Wildlife Refuge</header><text>The Wildlife Refuge shall be administered as an Urban Wildlife Refuge.</text></subsection><subsection id="H9D54BFCF1525436BA0845BDD21B2C9D4"><enum>(e)</enum><header>Notification of establishment</header><paragraph id="id72A9654777E14E7496E5920C504DC972"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date on which the Wildlife Refuge is established under subsection (a), the Secretary shall publish in the Federal Register notice of the establishment of the Wildlife Refuge.</text></paragraph><paragraph id="id2E945E46895A4CEBA2689E8F78B29C8B"><enum>(2)</enum><header>Map</header><text>The notice published by the Secretary under paragraph (1) shall include the Map.</text></paragraph></subsection><subsection id="HE79F16F185E84461AF8ACC4D14937C8D"><enum>(f)</enum><header>Acquisition boundary</header><paragraph id="idD670CA9C91584768811881430169CA19"><enum>(1)</enum><header>In general</header><text>The acquisition boundary of the Wildlife Refuge shall be coterminous with the boundary depicted on the Map.</text></paragraph><paragraph id="idE36B7CB5FA814907801C22FE6019EB27"><enum>(2)</enum><header>Boundary revisions</header><text>The Secretary may make such minor revisions to expand the acquisition boundary established under paragraph (1), as may be appropriate—</text><subparagraph id="id70F4D97C8561473A99ABFFD6E6479765"><enum>(A)</enum><text>to achieve the purposes of the Wildlife Refuge described in subsection (b); or</text></subparagraph><subparagraph id="id575DEDAB297E40EBADADFD31910337FF"><enum>(B)</enum><text>to facilitate the acquisition of property for the Wildlife Refuge under subsection (h).</text></subparagraph></paragraph></subsection><subsection id="H40C70579230648F7BC3B705828D0E10E"><enum>(g)</enum><header>Administration of Wildlife Refuge</header><paragraph id="id011CBEA097E54526A41AA3D05829D39B"><enum>(1)</enum><header>In general</header><text>On the establishment of the Wildlife Refuge under subsection (a), the Secretary shall administer all land, water, and any interest in land or water that have been acquired by, or transferred to, the Secretary under subsection (h) for inclusion in the Wildlife Refuge in accordance with—</text><subparagraph id="id9648A0796446472FA9747A3DB843F047"><enum>(A)</enum><text>the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>); and </text></subparagraph><subparagraph id="id504836B0BEFA4DB2864A34709E658C17"><enum>(B)</enum><text>subsection (b).</text></subparagraph></paragraph><paragraph id="H7164B1D70EF844C9818BCE9AC231DE29"><enum>(2)</enum><header>Cooperative agreements with respect to non-Federal land</header><text>The Secretary may enter into cooperative agreements or other instruments, as appropriate, with the State, the County, the Regional Conservation Authority, or any other entity or person—</text><subparagraph id="HC9E01E7D8DB24AEFA352B738177AE78E"><enum>(A)</enum><text>for the management, in a manner consistent with this section, of land that is—</text><clause id="id6568C0DF477042C2B2E18CBB817CBAF0"><enum>(i)</enum><text>owned by the State, the County, the Regional Conservation Authority, or any other entity or person; and </text></clause><clause id="id5B8166795D98408AA906C27CF6F9A0D6"><enum>(ii)</enum><text>located within the acquisition boundary of the Wildlife Refuge established under subsection (f);</text></clause></subparagraph><subparagraph id="H743CFB00087843BB80C343FAF7C2E34D"><enum>(B)</enum><text>to promote public awareness of the natural resources of the area governed by the Conservation Plan; or</text></subparagraph><subparagraph id="H8A20F17F1A394C8B8E524FE9A04CAA60"><enum>(C)</enum><text>to encourage public participation in the conservation of resources in the Wildlife Refuge.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id1B148B09C28C4023A9881EB8F1B859DB"><enum>(3)</enum><header>Easements and rights-of-way</header><subparagraph display-inline="no-display-inline" commented="no" id="idA1493310A5A34ADBA30A3FED5BAECC14"><enum>(A)</enum><header>In general</header><text>Any property acquired by, or transferred to, the Secretary for inclusion in the Wildlife Refuge under subsection (h) shall be subject to any valid and existing right that existed on the property before the property was acquired by, or transferred to, the Secretary under that subsection.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id7F4B4E8AFF324C91BF95E42E0E004632"><enum>(B)</enum><header>Savings clause</header><text>Subject to compatibility requirements under the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>), nothing in this Act precludes the establishment of a new utility facility or right-of-way (including instream sites, routes, and areas) within the Wildlife Refuge if such a facility or right-of-way, as applicable, is necessary for public health and safety, electricity and water supply, or other utility services.</text></subparagraph></paragraph></subsection><subsection id="HC29E55C881394C438425CEFAC1307C88"><enum>(h)</enum><header>Acquisition and transfers of land and water for the Wildlife Refuge</header><paragraph id="H3E3E9296FDEA4B2E934BD463D3E80654"><enum>(1)</enum><header>Acquisitions</header><subparagraph id="id55375A2BCB1E43B2B522E4C281E5E00B"><enum>(A)</enum><header>In general</header><text>The Secretary may acquire, by donation, purchase, or exchange, land, water, or any interest in land or water (including conservation easements) within the acquisition boundary of the Wildlife Refuge established under subsection (f) that will achieve, in the determination of the Secretary, the purposes of the Wildlife Refuge described in subsection (b).</text></subparagraph><subparagraph id="id1A02CFA13A8446A386B2C86234561FC7"><enum>(B)</enum><header>Land, water, and interests owned by the State</header><text>Land, water, and any interests in land or water owned by the State, the County, or the Western Riverside County Regional Conservation Authority may only be acquired by donation.</text></subparagraph><subparagraph id="idF449E93D4D6F4E228AE611F939197919"><enum>(C)</enum><header>Acquisition of additional reserve lands</header><clause id="idA3806E60D4BF43C68547233DA4D7503F"><enum>(i)</enum><header>In general</header><text>In order to support the responsibilities of the Federal Government, as described in the Conservation Plan, the Secretary shall give priority to, when acquiring land, water, or any interest in land or water (including conservation easements) under subparagraph (A), additional reserve lands within the acquisition boundary of the Wildlife Refuge established under subsection (f).</text></clause><clause id="id0C367E0559B448368D1152CFE0ADA1D5"><enum>(ii)</enum><header>Priority</header><text>In acquiring additional reserve lands under clause (i), the Secretary shall give priority to additional reserve lands—</text><subclause id="id0D5811F0AB37410FA8B0225F7F1A6ACB"><enum>(I)</enum><text>located within criteria cells identified on the Map; and</text></subclause><subclause id="id55AC6980D8CC447396EE48F01457D959"><enum>(II)</enum><text>that have not been acquired by a Permittee, before the date of enactment of this Act, for the purpose of satisfying the conservation obligations of the Permittee under the Conservation Plan.</text></subclause></clause></subparagraph></paragraph><paragraph id="HF93469B827B944F8ACED7F50C67615E3"><enum>(2)</enum><header>Transfers</header><subparagraph id="H92E8CF7754B44580BEE42F1594A0542A"><enum>(A)</enum><header>Assessment</header><text>Not later than 1 year after the date of enactment of this Act, the head of any Federal department or agency, including any agency within the Department of the Interior, that has jurisdiction of any Federal property located within the acquisition boundary of the Wildlife Refuge established under subsection (f) shall submit to the Secretary an assessment of whether the property would be consistent with the purposes of the Wildlife Refuge described in subsection (b).</text></subparagraph><subparagraph id="H95DC58B0883446DC9593056ABF162F73"><enum>(B)</enum><header>Requirements</header><text>Any assessment submitted to the Secretary under subparagraph (A) shall include—</text><clause id="H9FAD1F7DD758454E9968FECE17FDAF56"><enum>(i)</enum><text>parcel descriptions and best existing land surveys for the property;</text></clause><clause id="HE59181C179954876A0B39AE513028A1D"><enum>(ii)</enum><text>a list of existing special reservations designations or purposes of the property;</text></clause><clause id="H078B7E1C52CC421F9E778A01C2496B33"><enum>(iii)</enum><text>an inventory of—</text><subclause id="id9DB2D3FDE7E6459DBABCC0750D7BD38C"><enum>(I)</enum><text>all known or suspected hazardous substance contamination of the property;</text></subclause><subclause id="id1836DEA32F434D149879DC037F78FBA9"><enum>(II)</enum><text>any facilities on the property; and</text></subclause><subclause id="id3980C7CF83F142009DC357672EAE620E"><enum>(III)</enum><text>any surface water or groundwater on the property;</text></subclause></clause><clause id="H37B295DE718F41989EBF44E8BAB126E3"><enum>(iv)</enum><text>the status of withdrawal of the property from—</text><subclause id="HA8F6619617CE4634B88E7E73E75BB19B"><enum>(I)</enum><text>the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>); and</text></subclause><subclause id="H0930BB6C504C463A901B520578D26A6A"><enum>(II)</enum><text>sections 2319 through 2344 of the Revised Statutes (commonly known as the <quote>Mining Law of 1872</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/30/22">30 U.S.C. 22 et seq.</external-xref>); and </text></subclause></clause><clause id="HC84D2E1AB9214718B29CC57154F1B3E5"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="id2E858C1C08D24FBBB566C2C14CFFB444"><enum>(I)</enum><text>a recommendation relating to whether the property would be consistent with the purposes of the Wildlife Refuge described in subsection (b); and</text></subclause><subclause id="idEA111F61EB094F688B2226B9F2141E91" indent="up1"><enum>(II)</enum><text>the reasons supporting that recommendation.</text></subclause></clause></subparagraph><subparagraph id="HD53984CAE89749DBA3FE65F0852987F1"><enum>(C)</enum><header>Transfer determination</header><clause id="HFEE4BD420A944C3884A4CACE2A1AE1E0"><enum>(i)</enum><header>In general</header><text>Not later than 180 days after the date on which the Secretary receives an assessment submitted under subparagraph (A), the Secretary shall determine whether the property described in that assessment shall be transferred to the Secretary for inclusion in the Wildlife Refuge.</text></clause><clause id="H867BDC7F096C498AA92E3994257A28E7"><enum>(ii)</enum><header>Property accepted for inclusion</header><text>If the Secretary accepts the transfer of a property described in an assessment submitted under subparagraph (A), that property shall be transferred to the Secretary for inclusion in the Wildlife Refuge without fee or reimbursement.</text></clause><clause id="H632401E72F5843C2A850CA374B61AE9E" commented="no"><enum>(iii)</enum><header>Property rejected for inclusion</header><subclause commented="no" id="idFC9FB548B10B478A9310234771FA92BC"><enum>(I)</enum><header>In general</header><text>If the Secretary rejects the transfer of a property described in an assessment submitted under subparagraph (A), that property shall not be transferred to the Secretary for inclusion in the Wildlife Refuge.</text></subclause><subclause commented="no" id="idB5C62F646DA74C62B2A884086E8C4CC6"><enum>(II)</enum><header>Consultation</header><text>If the property is not transferred to the Secretary under subclause (I), the Secretary may consult with the head of the department or agency that submitted the assessment under subparagraph (A)—</text><item commented="no" id="id657A743A4DA34BEC8DC5B5D7BA36DED6"><enum>(aa)</enum><text>to further deliberate whether that property is consistent with the purposes of the Wildlife Refuge described in subsection (b); and</text></item><item commented="no" id="id6DAE494CA353468CBDF53449DCA880A3"><enum>(bb)</enum><text>to determine what management activities can be taken for the Secretary to approve the eventual transfer of that property for inclusion in the Wildlife Refuge.</text></item></subclause><subclause commented="no" id="id19C35AF01C43495F8F0BD139270920D4"><enum>(III)</enum><header>Inclusion</header><text>If, on further deliberation between the Secretary and the head of the department or agency under subclause (II), the Secretary accepts the transfer of the applicable property, that property shall be transferred to the Secretary for inclusion in the Wildlife Refuge in accordance with clause (ii).</text></subclause></clause></subparagraph><subparagraph commented="no" id="id94ECDABC069A45F69975823A4C90FB4B"><enum>(D)</enum><header>Additional transfers</header><text>The Secretary, on completion of reviewing assessments submitted by the head of any Federal department or agency, including any agency within the Department of the Interior, under subparagraph (A), may commence additional assessments in accordance with subparagraphs (B) and (C) if the Secretary determines that—</text><clause commented="no" id="idD296ADB54D5D49D4BC2BC55D1960DDF8"><enum>(i)</enum><text>any Federal department or agency, including any agency within the Department of the Interior, has, or has acquired, jurisdiction over any Federal property located within the acquisition boundary of the Wildlife Refuge established under subsection (f); or</text></clause><clause commented="no" id="id488C33E58FD049A592014EE7F6D3FD04"><enum>(ii)</enum><text>property rejected by the Secretary under subparagraph (C)(iii) has been remediated and may now be suitable for inclusion in the Wildlife Refuge.</text></clause></subparagraph><subparagraph id="H5180CC9A11054B0EBD64E3A19232BE4B"><enum>(E)</enum><header>Public access</header><text>If property transferred to the Secretary under this paragraph allows for public access at the time of transfer, that access shall be maintained, unless that access, as determined by the Secretary— </text><clause id="H85C0EE08AC584C3085C6D92F24A4D3D5"><enum>(i)</enum><text>would be incompatible with the purposes of the Wildlife Refuge described in subsection (b) or the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>);</text></clause><clause id="HA8247CC462594FC3967AE8EBCF6FCAF0"><enum>(ii)</enum><text>would jeopardize public health or safety; or</text></clause><clause id="H723441D00A6345858B8A23CB142B65D8"><enum>(iii)</enum><text>must be limited due to emergency circumstances.</text></clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id4A39F854DB8A4F95A0C2667CC2B1B699"><enum>(3)</enum><header>Tribal cultural and religious uses</header><text>No acquisition or transfer of property under this subsection shall modify or revoke existing access to, or use by, affected Indian Tribes, unless that use or access, as determined by the Secretary—</text><subparagraph id="id8424b374561946febdeecad92c91f7af"><enum>(A)</enum><text>would be incompatible with the purposes of the Wildlife Refuge described in subsection (b) or the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>);</text></subparagraph><subparagraph id="idef2d55072b1b4bf3bbbd7aef2732bbf1"><enum>(B)</enum><text>would jeopardize public health or safety; or</text></subparagraph><subparagraph id="id485a6a3b75794a16990575d0eb37728c"><enum>(C)</enum><text>must be limited due to emergency circumstances.</text></subparagraph></paragraph><paragraph id="id14B43AE3070C4DA8B986BC51EA13095D"><enum>(4)</enum><header>Savings clause</header><text>Nothing in this subsection exempts or relieves a Permittee from the obligations of the Permittee under the Conservation Plan or any associated permit.</text></paragraph></subsection></section></legis-body></bill>
