<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4646</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220727">July 27, 2022</action-date><action-desc><sponsor name-id="S307">Mr. Brown</sponsor> (for himself and <cosponsor name-id="S343">Mr. Boozman</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to shorten the timeframe for claims by beneficiaries and the payment of benefits under Department of Veterans Affairs life insurance programs, to improve the management of undisbursed life insurance benefits by the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H27F41D530CA9448D8B8951CA5E4BF159"><section section-type="section-one" id="H75A036C05924487680A0C3BF4A7B0475"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Faster Payments to Veterans’ Survivors Act of 2022</short-title></quote>. </text></section><section id="HBB24DBF771D543228B53ADE079595A23"><enum>2.</enum><header>Timeframe for claims by beneficiaries and payment of benefits under Department of Veterans Affairs life insurance programs</header><subsection id="HC74670DBCDB04B9288079CDC280B47BF"><enum>(a)</enum><header>National Service Life Insurance</header><text display-inline="yes-display-inline">Section 1917(f)(1) of title 38, United States Code, is amended—</text><paragraph id="H366C7DE8A08A4D1F96988FB77784BA26"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>two years</quote> and inserting <quote>one year</quote>; and</text></paragraph><paragraph id="H55DBD61F8F8144A1B122E06A41E16E51"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>four</quote> and inserting <quote>two</quote>. </text></paragraph></subsection><subsection commented="no" id="H0372EEFDEF9F4CCF85E5ED379F25BFE1"><enum>(b)</enum><header>United States Government life insurance</header><text>Section 1952(c)(1) of such title is amended—</text><paragraph commented="no" id="H186CEA7ACBE242688F43352A79AA24DB"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>two years</quote> and inserting <quote>one year</quote>; and</text></paragraph><paragraph commented="no" id="H037D0B3DF79947ABA858034DA7024B9C"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>four</quote> and inserting <quote>two</quote>. </text></paragraph></subsection><subsection id="H279A5C90DC484F42A51D1E9E58C1DF3E"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to the death of an insured person occurring on or after the date that is two years before the date of the enactment of this Act.</text></subsection></section><section display-inline="no-display-inline" id="H0AFEC37CFB764C1BB1839189D6A659D3"><enum>3.</enum><header>Process for designation of beneficiaries under Department of Veterans Affairs life insurance programs</header><subsection id="H21E03F7C5DE3483D8FC692E6D87D0315"><enum>(a)</enum><header>National Service Life Insurance</header><text display-inline="yes-display-inline">Section 1917 of title 38, United States Code, is amended by striking subsection (a) and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H48A48CCCA5344F8BAC0C496EA11F6B91"><subsection id="HA2B73A4A2A7C4F86848C6CCD469D06E7"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB3A42CE522CA45D18C2D830D3298F32D"><enum>(1)</enum><text display-inline="yes-display-inline">The insured may designate a beneficiary or beneficiaries of insurance maturing on or after August 1, 1946. The insured shall, subject to regulations, at all times have the right to change the beneficiary or beneficiaries of such insurance without the consent of such beneficiary or beneficiaries.</text></paragraph><paragraph id="H06004AEB38F8401396EF0FF5B0C3A38D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the insured does not designate a beneficiary under paragraph (1) before the insured dies, or if a designated beneficiary predeceases the insured, the Secretary shall determine the beneficiary in the following order:</text><subparagraph id="H473D8BAA1CA344DC813E4F12EA6DEADD"><enum>(A)</enum><text>The surviving spouse of the insured.</text></subparagraph><subparagraph id="H815151F50DFC41C2A053D0552D8A10CB"><enum>(B)</enum><text>The children of the insured and descendants of deceased children by representation.</text></subparagraph><subparagraph id="H4497E9D7D6B34CBFA2C7AD665DF41467"><enum>(C)</enum><text>The parents of the insured or the survivors of the parents.</text></subparagraph><subparagraph id="HBA8ACA9B42554A4C99B7CF0043F476D8"><enum>(D)</enum><text>The duly appointed executor or administrator of the estate of the insured.</text></subparagraph><subparagraph id="H76AD3DCB4889469EA95074E09FF01AF3"><enum>(E)</enum><text>Other next of kin of the insured entitled under the laws of domicile of the insured at the time of the death of the insured.</text></subparagraph></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H35078BF2A05F489F83B9571D0C29CB6A"><enum>(b)</enum><header>United States Government Life Insurance</header><paragraph id="id9BB3F5D158BA4297B7CD33A8238BCE64"><enum>(1)</enum><header>Change of beneficiary</header><text>Section 1949 of such title is amended by striking <quote>Subject to regulations</quote> and all that follows through the period and inserting the following: <quote>The insured may designate a beneficiary or beneficiaries of a United States Government life insurance policy. Subject to regulations, the insured shall at all times have the right to change the beneficiary or beneficiaries of a United States Government life insurance policy without the consent of such beneficiary or beneficiaries.</quote>.</text></paragraph><paragraph id="id866194FA0C4D4E72BD631C0ADCA51D21"><enum>(2)</enum><header>Payment to estates</header><text>Section 1950 of such title is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="H5A5A9EEE35BC4B18B79AF7D63B5A6E73"><section display-inline="no-display-inline" id="HBA9691FD42744C2CB3CE53EEA187F3DB"><enum>1950.</enum><header>Payment to estates</header><text display-inline="no-display-inline">If the insured does not designate a beneficiary under section 1949 of this title before the insured dies, or if a designated beneficiary predeceases the insured, the Secretary shall determine the beneficiary in the following order:</text><paragraph display-inline="no-display-inline" id="HCE7D2E50382542E28974DE4B2B71D05B"><enum>(1)</enum><text>The surviving spouse of the insured.</text></paragraph><paragraph id="HC5E2F01E00574088A2CBD8D1B55EDBD5"><enum>(2)</enum><text>The children of the insured and descendants of deceased children by representation.</text></paragraph><paragraph id="H095F244051694EE5B87B996FA4EAEA23"><enum>(3)</enum><text>The parents of the insured or the survivors of the parents.</text></paragraph><paragraph id="H019B9FD853C24EE39A642F629E2F9D9B"><enum>(4)</enum><text>The duly appointed executor or administrator of the estate of the insured.</text></paragraph><paragraph id="HF1177B2DBF86480EB09AD252F8FE1F99"><enum>(5)</enum><text>Other next of kin of the insured entitled under the laws of domicile of the insured at the time of the death of the insured.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" id="H7398152CAEAF4EB5BA38DC6F2828DD38"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to the death of an insured person occurring on or after the date that is two years before the date of the enactment of this Act.</text></subsection></section><section section-type="subsequent-section" id="H6249064AC6224FCCBDDA2A55753725B1"><enum>4.</enum><header>Department of Veterans Affairs improvement of management of undisbursed life insurance benefits</header><subsection id="HAD886BEBC62B4A589A41F926889D753C"><enum>(a)</enum><header>Improvement of processes</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall improve the processes and procedures of the Department of Veterans Affairs with respect to identifying, locating, and disbursing undisbursed life insurance benefits to hard-to-find beneficiaries of life insurance policies issued under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/19">chapter 19</external-xref> of title 38, United States Code, including by—</text><paragraph id="H9DB4B0D352214DA5AA4C93D3BA2C8698"><enum>(1)</enum><text>improving the search tools available on the website of the Department;</text></paragraph><paragraph id="HD112B404A1804E0098089D3D64E06BCF"><enum>(2)</enum><text>conducting outreach to veterans, veterans service organizations, and the general public with respect to such search tools;</text></paragraph><paragraph id="HDC69E72831BB407AA017E03CAF333260"><enum>(3)</enum><text>improving the processes for searching for information relating to potential recipients of undisbursed life insurance benefits through internal Department sources and sources available through other Federal agencies, State government agencies, and non-government entities; and</text></paragraph><paragraph id="HCB32350821F140F58AABAF262A882C4F"><enum>(4)</enum><text display-inline="yes-display-inline">ensuring the Department has sufficient dedicated staff whose primary responsibilities are identifying, locating, and disbursing undisbursed life insurance benefits to hard-to-find beneficiaries, with the goal of disbursing, by not later than two years after the date of the enactment of this Act, all funds that, as of the date of the enactment of this Act, are owed to a beneficiary of a life insurance policy issued under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/19">chapter 19</external-xref> of title 38, United States Code.</text></paragraph></subsection><subsection id="HFAA009B0441847028D3E73D36C64467C"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the Secretary of Veterans Affairs should work with interagency partners to determine the types of records, reports, and other materials that may be required to identify, locate, and disburse undisbursed life insurance benefits to hard-to-find beneficiaries.</text></subsection><subsection id="H2F90215D680C4AF1B3A1B6989A013FBD"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the progress of the Secretary in carrying out this section.</text></subsection><subsection id="H96067005D1284452AAFE394C129CF85F"><enum>(d)</enum><header>Undisbursed life insurance benefits defined</header><text>In this section, the term <term>undisbursed life insurance benefits</term>—</text><paragraph id="H04563599C5C64A3E96B9EA8AA0768893"><enum>(1)</enum><text>means any amount of money that—</text><subparagraph id="id7FE4AACE2F0949A095CC311C24F8D7BC"><enum>(A)</enum><text>is owed to a beneficiary of a life insurance policy issued under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/19">chapter 19</external-xref> of title 38, United States Code; and </text></subparagraph><subparagraph id="idC3F3486BD89340F0A25CCD5A8B401189"><enum>(B)</enum><text>has not been disbursed for a period of two years or longer; and</text></subparagraph></paragraph><paragraph id="HA300A9CA45D246C39A6ACCE147D0C981"><enum>(2)</enum><text>does not include any amount of money—</text><subparagraph id="H0080C64ED21F4D0DACE5D2FDEEFD75A9"><enum>(A)</enum><text>that has not been disbursed due to a contested claim; or</text></subparagraph><subparagraph id="HD03C1010618C49989572BF40A5110B18"><enum>(B)</enum><text>the entitled beneficiary of which is in dispute by two or more parties.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
