which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To promote a 21<superscript>st</superscript> century energy workforce, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2BA0FE1F36654BBB8F93E70CC197DB7F"><section section-type="section-one" id="H5F4BE57433AC487885472D60F46E4E86"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Energy Jobs Act of 2022</short-title></quote>.</text></section><section id="H567DD28C4C8E41BC8754A7B2B7628566"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H88D1257E40604E3EB5D3CF2967C9637E"><enum>(1)</enum><header>Displaced</header><text>The term <term>displaced</term>, with respect to an energy worker, means that the worker—</text><subparagraph id="idAB3C5A9C1F714C789471A267BF937DB1"><enum>(A)</enum><text>previously worked in an energy-related industry; and</text></subparagraph><subparagraph id="idF5F71DBAE7BB499E9656F18EFE2499A4"><enum>(B)</enum><text>is a dislocated worker (as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)).</text></subparagraph></paragraph><paragraph id="id363DC589C52649288DF6542E148629F8"><enum>(2)</enum><header>Educational institution</header><text display-inline="yes-display-inline">The term <term>educational institution</term> means—</text><subparagraph id="id5AE3A5739D2A49758AD03BA92146D56F"><enum>(A)</enum><text display-inline="yes-display-inline">a State educational agency (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>));</text></subparagraph><subparagraph id="id7164ED2E7CCA44DE845867A38B9844FF"><enum>(B)</enum><text display-inline="yes-display-inline">a local educational agency (as defined in that section); and</text></subparagraph><subparagraph id="id12E209A18F564184BA2C9DDFE9F76039"><enum>(C)</enum><text display-inline="yes-display-inline">an institution of higher education.</text></subparagraph></paragraph><paragraph id="H2DDA15A1831D4203AC09AC999CD8F54C"><enum>(3)</enum><header>Energy-related industry</header><text display-inline="yes-display-inline">The term <term>energy-related industry</term> includes each of the following industries:</text><subparagraph id="id620D04D6B2CA4E7897F38BD2FC60408F"><enum>(A)</enum><text display-inline="yes-display-inline">The energy efficiency industry.</text></subparagraph><subparagraph id="id1B3EA2AF5AF44CF3833CF83CAF218203"><enum>(B)</enum><text display-inline="yes-display-inline">The renewable energy industry.</text></subparagraph><subparagraph id="idED920FF498AD4800BC0A6B808201C82A"><enum>(C)</enum><text display-inline="yes-display-inline">The chemical manufacturing industry.</text></subparagraph><subparagraph id="idD3C4EFE5CF1F4D96B394DFBC69C1DB6A"><enum>(D)</enum><text display-inline="yes-display-inline">The utility industry.</text></subparagraph><subparagraph id="idAE19CDA7C7F74F538BD10A646C37C69E"><enum>(E)</enum><text display-inline="yes-display-inline">The alternative fuels industry.</text></subparagraph><subparagraph id="id534A7187B9244BBC8543FAEAF55DBAFC"><enum>(F)</enum><text display-inline="yes-display-inline">The pipeline industry.</text></subparagraph><subparagraph id="idA2870E55F15C424882B5D29404D1317E"><enum>(G)</enum><text display-inline="yes-display-inline">The nuclear energy industry.</text></subparagraph><subparagraph id="id80DA72F639984EC38795F08259EEEA5A"><enum>(H)</enum><text display-inline="yes-display-inline">The oil and gas industry.</text></subparagraph><subparagraph id="idC94AC2BE2CC24C16B1F31EBD92F39A4E"><enum>(I)</enum><text>The coal industry.</text></subparagraph><subparagraph id="idCBC34277EFD04651832A33FC9D012EB1"><enum>(J)</enum><text>The manufacturing industry, with respect to the manufacture of energy-related equipment.</text></subparagraph></paragraph><paragraph id="H2F5B03492A80415D8E35593D23479B34"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> means—</text><subparagraph id="id8980878E22D94175BA2F4207307D3D98"><enum>(A)</enum><text>an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)); and</text></subparagraph><subparagraph id="id61930129944943A2910D696A11533F73"><enum>(B)</enum><text>an institution of higher education described in section 102(a)(1)(B) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(a)(1)(B)</external-xref>).</text></subparagraph></paragraph><paragraph id="H3032B835E25447F7AF9588E6AB278467"><enum>(5)</enum><header>Labor organization</header><text display-inline="yes-display-inline">The term <term>labor organization</term> means—</text><subparagraph id="idF93011CD9DE341B496BEE1845653B646"><enum>(A)</enum><text display-inline="yes-display-inline">a labor organization (as defined in section 2 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152</external-xref>)); and</text></subparagraph><subparagraph id="id1405FD4FCDD844EEA387A096B3791A08" commented="no"><enum>(B)</enum><text>any similar organization, labor union, or other entity, as determined to be appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="HF173C62E40114BC29DD76BD4CAA40B91"><enum>(6)</enum><header>Local workforce development board</header><text display-inline="yes-display-inline">The term <term>local workforce development board</term> has the meaning given the term <quote>local board</quote> in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph><paragraph id="HBEFFEB72DBA94D478497C3F269DA95DF"><enum>(7)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means—</text><subparagraph id="H9E45CACC7A014ABFBFDB729C64D274BB"><enum>(A)</enum><text display-inline="yes-display-inline">a Hispanic-serving institution (as defined in section 502(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a(a)</external-xref>));</text></subparagraph><subparagraph id="H0DBCABEF1A4945A2BF362F5F99306EAD"><enum>(B)</enum><text>a Tribal College or University (as defined in section 316(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>));</text></subparagraph><subparagraph id="H7426AF84CA7E4E67B2C71116201D221A"><enum>(C)</enum><text>an Alaska Native-serving institution (as defined in section 317(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059d">20 U.S.C. 1059d(b)</external-xref>));</text></subparagraph><subparagraph id="HBAE2AD7D052242109B2269303871D8CB"><enum>(D)</enum><text display-inline="yes-display-inline">a Native Hawaiian-serving institution (as defined in section 317(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059d">20 U.S.C. 1059d(b)</external-xref>));</text></subparagraph><subparagraph id="HE61328D6C9234F48A99B83D181D861B4"><enum>(E)</enum><text>a Predominantly Black Institution (as defined in section 318(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059e">20 U.S.C. 1059e(b)</external-xref>));</text></subparagraph><subparagraph id="HCCC7FF0CE5644FC2A44BA6F8496A0472"><enum>(F)</enum><text>a Native American-serving, nontribal institution (as defined in section 319(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059f">20 U.S.C. 1059f(b)</external-xref>));</text></subparagraph><subparagraph id="H562B52F2B0EE4750BF1DE5C2A04B572E"><enum>(G)</enum><text display-inline="yes-display-inline">an Asian American and Native American Pacific Islander-serving institution (as defined in section 320(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059g">20 U.S.C. 1059g(b)</external-xref>)); and</text></subparagraph><subparagraph id="id31086C7C527E409E830D01B99FAC31BE"><enum>(H)</enum><text>a Historically Black College or University that is a part B institution (as defined in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>)).</text></subparagraph></paragraph><paragraph id="id97DF0BBF90194FB8B0DE6FF417ADE665"><enum>(8)</enum><header>Preapprenticeship program</header><text>The term <term>preapprenticeship program</term> means a program that prepares participants for, and articulates to, a registered apprenticeship program.</text></paragraph><paragraph id="id82A1CFEEEB2349FAA20039E57A273C31"><enum>(9)</enum><header>Registered apprenticeship program</header><text>The term <term>registered apprenticeship program</term> means an apprenticeship program registered with the Office of Apprenticeship of the Employment and Training Administration of the Department of Labor or a State apprenticeship agency recognized by the Office of Apprenticeship pursuant to the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>) (50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>).</text></paragraph><paragraph commented="no" id="H66B7DA38EF374B80A49719795E33BFA8"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H67AF090D66F444EEA5B76A93817567B3"><enum>(11)</enum><header>State workforce development board</header><text display-inline="yes-display-inline">The term <term>State workforce development board</term> has the meaning given the term <quote>State board</quote> in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idDCE7CA490F68479291372260ACC7E52B"><enum>(12)</enum><header>Underrepresented group</header><subparagraph display-inline="no-display-inline" commented="no" id="idD257D5DD22DF44ECA1EE516F3F521557"><enum>(A)</enum><header>In general</header><text>The term <term>underrepresented group</term> means a subset of the general population of the United States the representation of which within the workforce of an energy-related industry, measured as a percentage of the total workforce within that industry, is lower than the representation of that subset within the general population of the United States, measured as a percentage of that general population.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id6B413C6ABA9C43DCB11BC81CCA749598"><enum>(B)</enum><header>Inclusions</header><text>The term <term>underrepresented group</term> includes—</text><clause display-inline="no-display-inline" commented="no" id="id91E253C9285E42A29B46706E4B079ED6"><enum>(i)</enum><text>ethnic minorities;</text></clause><clause display-inline="no-display-inline" commented="no" id="id3B9DB4D06A8A409DB6F918A1AA6652B3"><enum>(ii)</enum><text>women;</text></clause><clause display-inline="no-display-inline" commented="no" id="id413DF7225C2549308D921161EB05A9BB"><enum>(iii)</enum><text>veterans;</text></clause><clause display-inline="no-display-inline" commented="no" id="id0224F483E1F5468090841FAEEA5B465D"><enum>(iv)</enum><text>individuals with disabilities;</text></clause><clause display-inline="no-display-inline" commented="no" id="id38DF01E4D491497DBC87FFCE67EF06C0"><enum>(v)</enum><text>unemployed energy workers; and</text></clause><clause display-inline="no-display-inline" commented="no" id="idE026DD49C75C4A228EBA91FA4BFEE784"><enum>(vi)</enum><text>socioeconomically disadvantaged individuals.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24DA2E1EB1674A66AAC1A6C96C3ED875"><enum>(13)</enum><header>Workforce development program</header><text>The term <term>workforce development program</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph></section><section id="HAE18B0C73BF9485BB1D4C0E578D41F8D"><enum>3.</enum><header>Energy workforce development program</header><subsection id="H12815E2EB85E4ED597E587B61A8565AA"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Labor and the Secretary of Education, shall establish and carry out a comprehensive and nationwide program (referred to in this section as the <quote>program</quote>) in accordance with this section to improve education and workforce development for jobs in energy-related industries (including jobs in manufacturing, engineering, construction, retrofitting, and research and development in energy-related industries) to increase the number of skilled workers prepared to work in energy-related industries.</text></subsection><subsection id="idD52021A4B0DF4F49A6F0BBFAAB225D5D"><enum>(b)</enum><header>Workforce development</header><paragraph id="id15138588833E473B92B3802873D51D84"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out the program, the Secretary shall—</text><subparagraph id="H69AC7AB423584F31A77C5E71F0EC7931"><enum>(A)</enum><text>encourage underrepresented groups to enter into science, technology, engineering, and mathematics fields;</text></subparagraph><subparagraph id="H31D05F8D90824A6FADF03F0EAEFBEAAC"><enum>(B)</enum><text display-inline="yes-display-inline">encourage educational institutions to provide students with mentors and equip students with the skills, preparation, and technical expertise necessary to fill the employment opportunities vital to managing and operating energy-related industries;</text></subparagraph><subparagraph commented="no" id="idB044BE5971C84D359B5B6E27E7C1974C"><enum>(C)</enum><text display-inline="yes-display-inline">provide internships, fellowships, traineeships, registered apprenticeships, and employment through existing programs at the Department of Energy, including at National Laboratories;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc294495f2a34c73b393a794f269cedc"><enum>(D)</enum><text>provide research grants and technical assistance to institutions of higher education, with priority given to minority-serving institutions;</text></subparagraph><subparagraph id="H3C8ADB3D53A74D16A1A631F6015FBCD9"><enum>(E)</enum><text display-inline="yes-display-inline">provide students and other candidates for employment with the necessary skills and certifications for skilled, semiskilled, and highly skilled jobs in energy-related industries;</text></subparagraph><subparagraph id="H8ABC9F6F7FF04B47BD8CF16FF7CB0B19"><enum>(F)</enum><text display-inline="yes-display-inline">ensure that the program is in alignment with Department of Energy initiatives to ensure minority participation in the energy workforce;</text></subparagraph><subparagraph id="id48DB485F987C46BBAC39F000DDBAE100"><enum>(G)</enum><text display-inline="yes-display-inline">engage with other programs and laboratories in the Department of Energy that are carrying out the Minorities in Energy Initiative of the Department of Energy; and</text></subparagraph><subparagraph commented="no" id="H90B724141BBA412D9874B9BDE6D17213"><enum>(H)</enum><text display-inline="yes-display-inline">to the maximum extent practicable—</text><clause commented="no" id="idA798524C62F04915BEBEC9A8CA40832B"><enum>(i)</enum><text display-inline="yes-display-inline">collaborate with and support workforce development programs to maximize the efficiency of the program;</text></clause><clause commented="no" id="id0A60267B0DFB4DD3A3F8E94EE3C500FF"><enum>(ii)</enum><text>collaborate with registered apprenticeship programs and preapprenticeship programs; and</text></clause><clause commented="no" id="id16DE10A676EB4DDEBA9519784CF89B0B"><enum>(iii)</enum><text>if requested by the Secretary of Labor, support the establishment of nationally recognized certifications by the Department of Labor in the energy-related industries described in subsection (j)(4).</text></clause></subparagraph></paragraph><paragraph id="H949107D3F7C047EA8C16F357F8865BDF"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">In carrying out the program, the Secretary shall prioritize the education and training of underrepresented groups, including low-income individuals, low-wage workers, and displaced workers, for jobs in energy-related industries.</text></paragraph></subsection><subsection id="H9AEFB2BDE26442DF8E6A38F9FD08938E"><enum>(c)</enum><header>Direct assistance</header><paragraph id="id57F3A61B82FD4C23A70C8E8261787590"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To carry out the program, the Secretary shall—</text><subparagraph id="idEA5F3BA0910B44758495180DB565B400"><enum>(A)</enum><text display-inline="yes-display-inline">provide direct assistance (including financial assistance awards, technical expertise, and guidance on internships) to educational institutions, local workforce development boards, State workforce development boards, nonprofit organizations, labor organizations, joint labor-management organizations, registered apprenticeship programs, and preapprenticeship programs; or</text></subparagraph><subparagraph id="id6BD790DA7A2A4A7781ECCFFC575D22D5"><enum>(B)</enum><text>work within existing programs of the Department of Energy (including programs of the National Laboratories).</text></subparagraph></paragraph><paragraph id="id60F3586489F4426C87F3EF98C83907FC"><enum>(2)</enum><header>Distribution</header><text display-inline="yes-display-inline">The Secretary shall distribute direct assistance under paragraph (1)(A) in a manner that—</text><subparagraph id="id3CB204F94E1D4C3BB14D6BAE93B9A48B"><enum>(A)</enum><text display-inline="yes-display-inline">is proportional to the needs of, and demand for jobs in, an energy-related industry; and</text></subparagraph><subparagraph id="id538E7E02629F473F871DFA0C7E4A38A5"><enum>(B)</enum><text display-inline="yes-display-inline">is consistent with the information obtained under subsections (e)(3) and (j).</text></subparagraph></paragraph></subsection><subsection id="H14294CDDE193451E8E47036F3AC6EBAE"><enum>(d)</enum><header>Resource center</header><paragraph id="idF930416607644C2A89C5716B057D11B9"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Secretary of Labor and the Secretary of Education, shall establish an online resource center to provide—</text><subparagraph id="id061307D47EEB41F2B0E5D8F99F1AA911"><enum>(A)</enum><text display-inline="yes-display-inline">competency models and career maps for jobs in energy-related industries; and </text></subparagraph><subparagraph id="idC545C913E37C41199AAF070B8A9C4653"><enum>(B)</enum><text display-inline="yes-display-inline">a tool to map skills across—</text><clause id="id4929A7D827B84B1F9476378F1D7C60A1"><enum>(i)</enum><text display-inline="yes-display-inline">different energy-related industries; and</text></clause><clause id="id64F0EAE0223A4BB9929597720C2E1091"><enum>(ii)</enum><text display-inline="yes-display-inline">different jobs in energy-related industries.</text></clause></subparagraph></paragraph><paragraph id="H88411F22A5024B858979D132340F4A0E"><enum>(2)</enum><header>Purpose</header><text display-inline="yes-display-inline">The Secretary shall establish the online resource center described in paragraph (1) to be a resource for educational institutions, local workforce development boards, State workforce development boards, nonprofit organizations, labor organizations, and registered apprenticeship programs that would like to develop and implement workforce development programs for the jobs described in that paragraph.</text></paragraph><paragraph id="id7C79B6B1CFB3462A97257FB85A80E4C3" commented="no"><enum>(3)</enum><header>Complementarity with existing resources</header><text>In carrying out paragraph (1)—</text><subparagraph id="idD45B747655B14628928250C7801A5C69" commented="no"><enum>(A)</enum><text>the Secretary may draw from or complement any existing resources of the Department of Labor or the Department of Education, as the Secretary determines to be appropriate; and</text></subparagraph><subparagraph id="idA2AAF285FF6847B7BFDA7DAC71DD047E" commented="no"><enum>(B)</enum><text>if the Secretary and the Secretary of Labor or the Secretary of Education, as applicable, agree, the appropriate Secretaries may—</text><clause id="id9482F3F8EF2C4BF9A5FA12E2EE44FB7D" commented="no"><enum>(i)</enum><text>integrate the online resource center established under that paragraph with any existing online resources of the Department of Labor or the Department of Education; or </text></clause><clause id="id25086495FFD44E1987368F4C658ACED6" commented="no"><enum>(ii)</enum><text>modify those existing online resources to ensure complementarity between those resources and the online resource center established under paragraph (1).</text></clause></subparagraph></paragraph><paragraph id="id6988D7052265474BBBD0BBA7D0617DF2" commented="no"><enum>(4)</enum><header>Complete integration with existing resources</header><subparagraph id="id066F56B950E44E089D7A2576306E7B48" commented="no"><enum>(A)</enum><header>In general</header><text>The online resource center described in paragraph (1) may be established entirely through the modification of 1 or more existing online resources of the Department of Labor or the Department of Education if—</text><clause id="id73BFF9FC09A645BE933E103E826B9BEB" commented="no"><enum>(i)</enum><text>the Secretary, in consultation with the Secretary of Labor and the Secretary of Education, determines that the modification of 1 or more existing online resources, rather than the establishment of a new online resource, would be an efficient and effective means of—</text><subclause id="id1AD5B24E04D94EDCA068C6D695FFCCF5" commented="no"><enum>(I)</enum><text>carrying out the purpose of the online resource center described in paragraph (2); and</text></subclause><subclause id="idC5B77A32DBD44D9D9F1D8DC61E0586E2" commented="no"><enum>(II)</enum><text>providing the models, maps, and tool described in subparagraphs (A) and (B) of paragraph (1); and</text></subclause></clause><clause id="id2EF721E9975043C5A61CA3FDB4EF68AB" commented="no"><enum>(ii)</enum><text>the Secretary of Labor or the Secretary of Education, as applicable, agrees to modify (or allows the Secretary to modify) the applicable online resources in a manner that carries out subclauses (I) and (II) of clause (i) to the satisfaction of the Secretary.</text></clause></subparagraph><subparagraph id="idDF7A2CAD14D34311AD72B5A0E3F777DB" commented="no"><enum>(B)</enum><header>Subsequent establishment of new resource</header><text>If the Secretary, in consultation with the Secretary of Labor and the Secretary of Education, determines at any time that it would be more appropriate to establish a new online resource center under paragraph (1), the Secretary may do so.</text></subparagraph></paragraph></subsection><subsection id="HF23DBCFB93AB4702B8277A4092AAB6F2"><enum>(e)</enum><header>Collaboration and report</header><text>In carrying out the program, the Secretary shall—</text><paragraph id="HB1BD4751A1354184BEF7CCD7195F2113"><enum>(1)</enum><text display-inline="yes-display-inline">collaborate with educational institutions, local workforce development boards, State workforce development boards, nonprofit organizations, labor organizations, registered apprenticeship programs, and energy-related industries;</text></paragraph><paragraph commented="no" id="HB5EE0BA01500464C8893AAD9DAB52C3D"><enum>(2)</enum><text display-inline="yes-display-inline">to facilitate the sharing of promising practices and approaches that best suit local, State, and national needs, encourage and foster collaboration, mentorship, and partnership between—</text><subparagraph commented="no" id="idB7ECBE2FC088400AB2DE4FDEE0787BDD"><enum>(A)</enum><text display-inline="yes-display-inline">industry, local workforce development boards, State workforce development boards, nonprofit organizations, labor organizations, and registered apprenticeship programs that provide effective workforce development programs for jobs in energy-related industries; and</text></subparagraph><subparagraph commented="no" id="id7A5F340A1BA24CCBA9D4B55B6ED0D0C5"><enum>(B)</enum><text display-inline="yes-display-inline">educational institutions that seek to establish those programs; and</text></subparagraph></paragraph><paragraph id="H3EED8D27ED424E4F940220B43AAA6C0A"><enum>(3)</enum><text display-inline="yes-display-inline">collaborate with the Commissioner of the Bureau of Labor Statistics, the Secretary of Labor, the Secretary of Education, the Secretary of Commerce, the Director of the Bureau of the Census, and energy-related industries—</text><subparagraph id="H07494F7C4BE04C3B945DFB0468ECB981"><enum>(A)</enum><text>to develop a comprehensive and detailed understanding of the workforce needs of, and job opportunities in, energy-related industries and labor organizations, by State and by region; and</text></subparagraph><subparagraph id="HA2E0471B85074DA9BD2A16BEF2B9FD91"><enum>(B)</enum><text>to publish an annual report on job creation in the areas identified by the Secretary under subsection (j)(1)(A), including any areas identified pursuant to a periodic review carried out under subsection (j)(3) as being among those areas with the greatest demand for workers.</text></subparagraph></paragraph></subsection><subsection id="H08AC683D07B1409B9BC57E65B106F339"><enum>(f)</enum><header>Guidelines for educational institutions</header><paragraph id="H94FD197733B544BEA5E29A5F40B0437E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in collaboration with the Secretary of Education, the Secretary of Commerce, the Secretary of Labor, and the Director of the National Science Foundation, shall develop and provide to educational institutions voluntary guidelines or promising practices for providing graduates with skills necessary for jobs in energy-related industries (including skills for manufacturing, engineering, construction, retrofitting, and research and development in energy-related industries).</text></paragraph><paragraph id="H3F55F8EC3FAF4C9D958BD0EF0147281C"><enum>(2)</enum><header>Input from industry and labor organizations</header><text>In carrying out paragraph (1), the Secretary shall solicit input from energy-related industries and labor organizations.</text></paragraph><paragraph commented="no" id="H0D193D0794DB4C3F9DA2AF0106916E18"><enum>(3)</enum><header>Energy efficiency and conservation initiatives</header><text display-inline="yes-display-inline">The voluntary guidelines or promising practices developed under paragraph (1) shall include grade-specific guidelines for teaching students, families, and communities about energy efficiency technology, manufacturing efficiency technology, community energy resiliency, and energy conservation initiatives.</text></paragraph><paragraph id="HB81821F141084A0EBF00AEF340F0D9EF"><enum>(4)</enum><header>STEM education</header><text display-inline="yes-display-inline">The voluntary guidelines or promising practices developed under paragraph (1) shall promote education in science, technology, engineering, and mathematics as it relates to job opportunities in the areas identified by the Secretary under subsection (j)(1)(A), including any areas identified pursuant to a periodic review carried out under subsection (j)(3) as being among those areas with the greatest demand for workers.</text></paragraph></subsection><subsection id="HACC87D8414224413A6AFAE19DF752C76"><enum>(g)</enum><header>Outreach to minority-Serving institutions</header><text>The Secretary shall—</text><paragraph id="HEC19397430BF4916ACAEAEA64E614228"><enum>(1)</enum><text>give special consideration to increasing outreach to minority-serving institutions;</text></paragraph><paragraph id="H354C7BC2188143DA8CAE70B4EDA84DBE"><enum>(2)</enum><text display-inline="yes-display-inline">make resources available to minority-serving institutions to increase the number of skilled minorities and women qualified for jobs in energy-related industries (including with respect to skills for jobs in manufacturing, processing, engineering, construction, retrofitting, and research and development in energy-related industries);</text></paragraph><paragraph commented="no" id="H6B63C29558CB4259B02A1F4DEDBFE8FF"><enum>(3)</enum><text>encourage energy-related industries to improve opportunities for students of minority-serving institutions to participate in industry internships and cooperative work-study programs; and</text></paragraph><paragraph id="HAFD8C8C3C70D48859F200CF83F346080"><enum>(4)</enum><text>work with the laboratories of the Department of Energy to increase the participation of underrepresented groups in internships, fellowships, workforce development programs, and employment at those laboratories.</text></paragraph></subsection><subsection id="H3E4889B2236C455793B57F083D0EAE41"><enum>(h)</enum><header>Outreach to displaced and unemployed energy workers</header><text>The Secretary shall—</text><paragraph id="H2E433D3309BE403F8DEF58012155C936"><enum>(1)</enum><text display-inline="yes-display-inline">give special consideration to increasing outreach to employers, labor organizations, and job trainers preparing displaced and unemployed energy workers for emerging jobs in energy-related industries (including jobs in manufacturing, engineering, construction, retrofitting, and research and development in energy-related industries);</text></paragraph><paragraph id="H0954921279584BF58598653D74B83D66"><enum>(2)</enum><text display-inline="yes-display-inline">make resources available to institutions that serve displaced and unemployed energy workers to increase the number of individuals prepared for jobs in energy-related industries (including jobs in manufacturing, engineering, construction, retrofitting, and research and development in energy-related industries); and</text></paragraph><paragraph commented="no" id="HCC9A49CC6BC94BBD8264E8459A0EAE8C"><enum>(3)</enum><text display-inline="yes-display-inline">encourage energy-related industries to improve opportunities for displaced and unemployed energy workers to participate in industry internships, registered apprenticeship programs, and cooperative work-study programs.</text></paragraph></subsection><subsection id="H86866EA207B34D5C9446792D0960106B"><enum>(i)</enum><header>Enrollment in workforce development and registered apprenticeship programs</header><text display-inline="yes-display-inline">The Secretary shall collaborate with industry, local workforce development boards, State workforce development boards, nonprofit organizations, labor organizations, and registered apprenticeship programs to help identify students and other candidates, including from underrepresented groups to enroll in quality preapprenticeship programs and registered apprenticeship programs for jobs in energy-related industries.</text></subsection><subsection commented="no" id="H44EAF8BFF2E9412096807B35A8212E79"><enum>(j)</enum><header>Guidelines To develop skills for an energy industry workforce</header><paragraph commented="no" id="idBD0A7467E8E24DDAB66C1DB545478526"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary—</text><subparagraph commented="no" id="H1D703E606EBB462A8C2D28074115B295"><enum>(A)</enum><text>in collaboration with energy-related industries and labor organizations, shall identify, within energy-related industries, the areas that have the greatest demand for workers; and</text></subparagraph><subparagraph commented="no" id="H9182C51D7F9B4F6E845194C8070C4A73"><enum>(B)</enum><text>in collaboration with energy related industries and labor organizations and in consultation with the Secretary of Labor, shall develop and maintain, in accordance with this subsection, guidelines for the skills necessary to work in those areas.</text></subparagraph></paragraph><paragraph commented="no" id="id9C14CD0D26A54509AED9D425E467E754"><enum>(2)</enum><header>Skills</header><text>In developing and maintaining guidelines under paragraph (1)(B), the Secretary, in collaboration with energy-related industries and labor organizations and in consultation with the Secretary of Labor, shall include levels of proficiency or certification in skills relevant to the applicable area, which may include, as applicable, 1 or more of the following:</text><subparagraph commented="no" id="id5D5F456300E949C994C519D26B90CAE7"><enum>(A)</enum><text>Electrical work.</text></subparagraph><subparagraph commented="no" id="id45481F20CA2E40F481EEA5638E588486"><enum>(B)</enum><text>Plumbing.</text></subparagraph><subparagraph commented="no" id="idCB3FE8768571407DBA43EFEA66AC77A0"><enum>(C)</enum><text>Welding.</text></subparagraph><subparagraph commented="no" id="id7593063EB33E4DCCA0C981218831032E"><enum>(D)</enum><text>Pipe fitting.</text></subparagraph><subparagraph commented="no" id="id1DA9081C34064EDCAFC62C440DA1869E"><enum>(E)</enum><text>Math.</text></subparagraph><subparagraph commented="no" id="id3F4382E920964769B28AF9BEB6193B38"><enum>(F)</enum><text>Engineering.</text></subparagraph><subparagraph commented="no" id="id1E92A9680E4D4E75A06CFA816DF30F21"><enum>(G)</enum><text>Chemistry.</text></subparagraph><subparagraph commented="no" id="id2980DE57B75A4F5794A35C928EC957D2"><enum>(H)</enum><text>Physics.</text></subparagraph><subparagraph commented="no" id="id900F503A805E41CE956F72F8CD829F3B"><enum>(I)</enum><text>Cybersecurity.</text></subparagraph><subparagraph commented="no" id="id6EDC2FDE8B7A4377A1298DEBB5ECE08E"><enum>(J)</enum><text>Facility security.</text></subparagraph><subparagraph commented="no" id="id19C4391A4A4A476C99CA1A585B5DE193"><enum>(K)</enum><text>Geology.</text></subparagraph><subparagraph commented="no" id="idE1DDE803922C48B59A71689D791FDBD7"><enum>(L)</enum><text>Mining.</text></subparagraph><subparagraph commented="no" id="id514EA4BE5C0B4A9CAEAA5F4A10610D2D"><enum>(M)</enum><text>Equipment operation.</text></subparagraph><subparagraph commented="no" id="id158D037DE4664739B8EC6A6913B9E992"><enum>(N)</enum><text>Sales.</text></subparagraph><subparagraph commented="no" id="idDD9E60F578634C12B5D8C2B5DA9910D5"><enum>(O)</enum><text>Construction.</text></subparagraph><subparagraph commented="no" id="id7FAE9462B64343E3B71560B015536BAC"><enum>(P)</enum><text>Installation.</text></subparagraph><subparagraph commented="no" id="idC25A9F7CBF9845F8AAAA1E41993E2D5D"><enum>(Q)</enum><text>Retrofitting.</text></subparagraph><subparagraph commented="no" id="idB479928A30E04ADF9FD329E91532B482"><enum>(R)</enum><text>Manufacturing.</text></subparagraph><subparagraph commented="no" id="id8CE102E4A62443A696E8026D26EE8CB4"><enum>(S)</enum><text>Any other skill that the Secretary, in collaboration with energy-related industries and labor organizations, determines to be appropriate.</text></subparagraph></paragraph><paragraph commented="no" id="id607D543180CE4E90A59BDE3671256FE3"><enum>(3)</enum><header>Focus</header><text>The Secretary, in collaboration with energy-related industries and labor organizations, shall—</text><subparagraph commented="no" id="id24BC450121C645578CFA62D59C45483C"><enum>(A)</enum><text>periodically review the areas identified under paragraph (1)(A), other areas within energy-related industries, and the energy market in general; and</text></subparagraph><subparagraph commented="no" id="id5F166E092E5D4CDBBAFA3915F94A0245"><enum>(B)</enum><text>shift the focus of the efforts carried out under this subsection to ensure that, as the energy market evolves, the guidelines developed and maintained under paragraph (1)(B) continue to address the areas with the greatest demand for workers.</text></subparagraph></paragraph><paragraph commented="no" id="id63BEB0F0392942878D8FCEDD9BCC764A"><enum>(4)</enum><header>Requirement</header><text>In carrying out paragraphs (1)(A) and (3), the Secretary shall review and consider, at a minimum, areas within the following energy-related industries:</text><subparagraph id="idb8ca5018c9ce4f4ba67edc91828258de"><enum>(A)</enum><text>The alternative energy generation and refining industries, including—</text><clause id="id93117457a63946c893d5fff3b41fc69a"><enum>(i)</enum><text>the renewable energy industry, including work relating to the development, engineering, manufacturing, production, and installation of—</text><subclause id="id406397A60F264F019C18E07DC66709E4"><enum>(I)</enum><text>technologies that generate renewable energy from sources such as solar, hydropower, wind, wave, and geothermal energy; and</text></subclause><subclause id="id34A562B0B47E4729B60CA25F5ED291E7"><enum>(II)</enum><text>technologies relating to hydrogen or other energy carriers that are generated from renewable sources;</text></subclause></clause><clause id="id585d6b2291c94469a7f840410c04708f"><enum>(ii)</enum><text>the bioenergy industry, including work relating to biomass, biofuel, and biochemical refining;</text></clause><clause id="ida46f08987b1a460099e61dfa7ce84d98"><enum>(iii)</enum><text>industries involving the extraction and refining of minerals that are critical to renewable energy storage and production; and</text></clause><clause id="id459524d0356248c0a03c8dba08375572"><enum>(iv)</enum><text>the nuclear energy industry, including—</text><subclause id="id78FD7ED5146B4ADFB62548169A96EE26"><enum>(I)</enum><text>discovery, extraction, refining, and power generation; and</text></subclause><subclause id="id0B103775FEA14E9C87F5367F9B486905"><enum>(II)</enum><text>production of hydrogen paired with nuclear energy generation.</text></subclause></clause></subparagraph><subparagraph id="id77461cd91871421b9f2ec51400c0829f"><enum>(B)</enum><text>The fossil energy extraction and refining industries, including—</text><clause id="idfc04e2e03b3d44e69a06cccdfbfa197e"><enum>(i)</enum><text>the oil and gas industry, including discovery, extraction, refining and power generation;</text></clause><clause id="id93334bd8a81143b7ae0f6766d544fab8"><enum>(ii)</enum><text>the petrochemical manufacturing industry, including hydrogen generation from fossil sources;</text></clause><clause id="id6a7e38de05bb45e8ae72a67c1d93fd96"><enum>(iii)</enum><text>the coal industry; and</text></clause><clause id="id13f19193f9864f988e3d8dbab9623e14"><enum>(iv)</enum><text>the carbon sequestration industry, including underground storage and longterm biological storage pools.</text></clause></subparagraph><subparagraph id="idb7177ce783074ff0bfdc9297752da3ba"><enum>(C)</enum><text>The energy storage industry, including the manufacture and installation of batteries, pumped hydro, and other forms of physical and chemical energy storage.</text></subparagraph><subparagraph id="iddfdbfaa7cc4341799507a89a69a87eee"><enum>(D)</enum><text>The energy conveyance industries, including—</text><clause id="ide0b8e1b8c6034eb0a1735cd89e3ed2c0"><enum>(i)</enum><text>with respect to electricity—</text><subclause id="id1AEC381B6F084248BA1B5FED90C8D050"><enum>(I)</enum><text>the transmission and distribution of electricity;</text></subclause><subclause id="id241BA4839F77458AA20770E4E54420B2"><enum>(II)</enum><text>the establishment of microgrids; and </text></subclause><subclause id="id5D723E7A78394D709CFC004640DE0268"><enum>(III)</enum><text>smart grid technologies;</text></subclause></clause><clause id="id5645d97ecda24bc68ac32befe994e608"><enum>(ii)</enum><text>pipelines for the transmission of oil, natural gas, hydrogen, biomass, and other energy feedstocks; and</text></clause><clause id="id132ef51648be45798677d34cc0158880"><enum>(iii)</enum><text>vehicle charging and alternative fueling infrastructure.</text></clause></subparagraph><subparagraph id="id575e0c2e4b4747ef97ca0f8c0170cf84"><enum>(E)</enum><text>The energy efficiency industry, including work relating to conservation, weatherization, electrification, energy auditing, retrofitting, programming and automation, construction, plumbing, and inspection.</text></subparagraph><subparagraph id="idef2d8773d12642f7ac92a11a03cdbf6a"><enum>(F)</enum><text>The manufacturing industry, including—</text><clause id="id83ecfc68327f4b76912446a51b660975"><enum>(i)</enum><text>the manufacture of—</text><subclause id="id8DF6625C751E452791FAEDD4139AC352"><enum>(I)</enum><text>wind, solar, and geothermal energy equipment;</text></subclause><subclause id="idC9BF7B50EDD741A3A9CAB538248DED75"><enum>(II)</enum><text>hydropower, wave power, and biofuel combustion equipment;</text></subclause><subclause id="id08F101D4855C438FB30B6912AC9F721B"><enum>(III)</enum><text>nuclear components; and </text></subclause><subclause id="id852EFECBA88F410EBD818579CA29927F"><enum>(IV)</enum><text>other alternative energy equipment;</text></subclause></clause><clause id="id2720a02c49cb4e83961a71d6a92ddf68"><enum>(ii)</enum><text>the manufacture of alternative fuel vehicles, engines, drive trains, and fuel cells;</text></clause><clause id="idfd89b781c0da47bc892178b787c37a49"><enum>(iii)</enum><text>the manufacture of electric batteries, cryogenic hydrogen equipment, and other forms of chemical and physical energy storage;</text></clause><clause id="ida58364e00a064174a6cb1bed0c0b3966"><enum>(iv)</enum><text>the manufacture of heat pumps, induction heaters, and other advanced technologies used for—</text><subclause id="id91A983731E194460B21ED7E739C26C9E"><enum>(I)</enum><text>space and water heating and cooling; or</text></subclause><subclause id="idF3EF0A44583247F3AF02298B284C2DDA"><enum>(II)</enum><text>drying applications; and</text></subclause></clause><clause id="id3228be0ea9f7473a92ea954256e5942a"><enum>(v)</enum><text>advanced manufacturing that supports the energy sector, such as operations and design relating to—</text><subclause id="idE96D70A523064B6781F5B581C6971296"><enum>(I)</enum><text>additive manufacturing;</text></subclause><subclause id="id27A28EC4786145E8B314E0B34A5DB54D"><enum>(II)</enum><text>3-dimensional printing;</text></subclause><subclause id="id831919D7591742A4B055C3B1461326D6"><enum>(III)</enum><text>advanced composites and advanced aluminum and other alloys; </text></subclause><subclause id="idEF1B3ED43D4F468398A8730585B8D2A7"><enum>(IV)</enum><text>industrial energy efficiency management systems (including power electronics); and </text></subclause><subclause id="id09EDD25D5E2E4304B833E403E7A93A25"><enum>(V)</enum><text>other innovative technologies.</text></subclause></clause></subparagraph></paragraph><paragraph id="idEA68CB77373E4B3ABFE0B3FF7BE9EF4E" commented="no"><enum>(5)</enum><header>Complementarity with existing resources</header><text>In carrying out paragraph (1)(B)—</text><subparagraph id="id4767E1768F9C4C4DBE651D08F8B1F9FB" commented="no"><enum>(A)</enum><text>the Secretary shall draw from or complement any existing resources of the Department of Labor, as the Secretary determines to be appropriate; and</text></subparagraph><subparagraph id="idEECF88C4648C4E87A27FF470C671517E" commented="no"><enum>(B)</enum><text>if the Secretary and the Secretary of Labor agree, the Secretary and the Secretary of Labor may—</text><clause id="idEFCBAE7AFE2A47E2B40B1CDFECB316BB" commented="no"><enum>(i)</enum><text>integrate the development and maintenance of the guidelines described in that paragraph with any existing resources of the Department of Labor; or </text></clause><clause id="idAD700CD03F3C410C913248688AD2BBB1" commented="no"><enum>(ii)</enum><text>modify those existing resources to ensure complementarity between those resources and the development and maintenance of those guidelines.</text></clause></subparagraph></paragraph><paragraph id="id17ABF170097D447BAD6C4EAB6619DB1F" commented="no"><enum>(6)</enum><header>Complete integration with existing resources</header><subparagraph id="id251664816998406E9CCA6325EBA7E622" commented="no"><enum>(A)</enum><header>In general</header><text>The publication and maintenance of the guidelines described in paragraph (1)(B) may be carried out entirely through the modification of 1 or more existing resources of the Department of Labor if—</text><clause id="id52FFABEDAC624AE38BADDE8D7EF30116" commented="no"><enum>(i)</enum><text>the Secretary, in consultation with the Secretary of Labor, determines that the modification of 1 or more existing resources of the Department of Labor, rather than the establishment of a new resource, would be an efficient and effective means of publishing and maintaining those guidelines; and</text></clause><clause id="idCDFB0FBCEBB3457D82A6810C0EED5E29" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>the Secretary of Labor agrees to modify (or allows the Secretary to modify) the applicable resources in a manner that carries out clause (i) to the satisfaction of the Secretary.</text></clause></subparagraph><subparagraph id="id30537F410B004165BC27C26BCC255A24" commented="no"><enum>(B)</enum><header>Subsequent establishment of new resource</header><text>If the Secretary, in consultation with the Secretary of Labor, determines at any time that it would be more appropriate to establish a new resource to carry out paragraph (1)(B), the Secretary may do so. </text></subparagraph></paragraph></subsection></section><section commented="no" id="HE1C4D04E7391440AB35EAC5A3774052D"><enum>4.</enum><header>Energy workforce grant program</header><subsection commented="no" id="H2FFB3EECF67547118DFB2803412667B9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="id202D0B62B65F4A9583BC0E48AD25B28F"><enum>(1)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means a business or joint labor-management partnership that—</text><subparagraph commented="no" id="id2F4FC56CA2714BA4896AD4F154EEEA2C"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idD9FA107346A04EEFAB43DE38751A28E3"><enum>(i)</enum><text>is directly involved with energy efficiency, renewable energy technology, electrification, grid modernization, grid storage, or reduction in greenhouse gas emissions, as determined by the Secretary; or</text></clause><clause commented="no" id="id4345B66EF27B4604851884AFF0868CA6" indent="up1"><enum>(ii)</enum><text>works on behalf of a business or joint labor-management partnership that is directly involved with energy efficiency, renewable energy technology, electrification, grid modernization, energy storage, or reduction in greenhouse gas emissions, as determined by the Secretary; and</text></clause></subparagraph><subparagraph commented="no" id="id8AEC818D8BDF4CF2B47F302246648343"><enum>(B)</enum><text>manufactures products or provides services related to—</text><clause commented="no" display-inline="no-display-inline" id="H12396CEC0AB54509BA3F52D9E5BF4035"><enum>(i)</enum><text>renewable energy generation, including solar, wind, geothermal, hydropower, and other renewable energy generation technologies;</text></clause><clause commented="no" id="H11A9A47D8B5D497E93BEFEEAEE200ED7"><enum>(ii)</enum><text>energy efficiency, including energy efficient lighting, advanced building materials and techniques, insulation and air sealing, and other high efficiency products and services, and auditing and inspection in energy efficiency;</text></clause><clause commented="no" id="id7AA3578352BB4BC18F8CB889FFB59EE6"><enum>(iii)</enum><text>electrification, including—</text><subclause commented="no" id="id96D32EC4002F47B2A725DD4DCAD00EF8"><enum>(I)</enum><text>installation of—</text><item commented="no" id="id7D7DBD92B67F4C658575BB9A83A49AFE"><enum>(aa)</enum><text>electric heat pump water heaters; </text></item><item commented="no" id="idDE32A2A132A649FF8DEB5D80F7476926"><enum>(bb)</enum><text>electric heat pumps for heating and cooling;</text></item><item commented="no" id="id12D5E803034C44C68E62BDF93DB80BC5"><enum>(cc)</enum><text>electric heat pump clothes dryers; </text></item><item commented="no" id="idA7C0625AAB464C1CA898CAF866A7F2E3"><enum>(dd)</enum><text>electric stoves, cooktops, ranges, or ovens; and </text></item><item commented="no" id="idE516E5CF8B234C7F96FCEA3170514C03"><enum>(ee)</enum><text>electric load or service centers; and</text></item></subclause><subclause commented="no" id="id95AEBAABB2434DAB82466E7B3E5AECDF"><enum>(II)</enum><text>retrofitting production lines of air conditioners to manufacture heat pumps;</text></subclause></clause><clause commented="no" id="H34F6E20901744F618CDDEEBDB4AA4C45"><enum>(iv)</enum><text>grid modernization, including smart grid, microgrid and other distributed energy solutions, demand response management, and home energy management technology;</text></clause><clause commented="no" id="idD1A70400642E452C83BEA77DE47D986D"><enum>(v)</enum><text>energy storage, including batteries, pumped hydro, and other market-viable means of chemical and physical energy storage;</text></clause><clause commented="no" id="idE417893B6623446597A1411056504A08"><enum>(vi)</enum><text>technologies that improve the conversion, use, and storage of carbon dioxide produced from fossil fuels, including carbon capture and storage and direct air capture;</text></clause><clause id="ide9ae5642140d4dd9a0d4369f5815aec1"><enum>(vii)</enum><text>nuclear energy, including nuclear technology research, development, demonstration, and commercial application;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC0BF8A02541649C0AAE01CCBFBC03189"><enum>(viii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idAC9B182541FC4C95A4A60ECE60E492BE"><enum>(I)</enum><text display-inline="yes-display-inline">vehicles and equipment that use fuel cell or hybrid fuel cell energy; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id714CF2FE59C3420592E6612EECE014A8" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">associated fueling equipment; or</text></subclause></clause><clause display-inline="no-display-inline" commented="no" id="id4806AF74B6EE4A2DA98CE45F01028A31"><enum>(ix)</enum><text>electric vehicles and associated charging infrastructure.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id65628EC647C64FFBBFE56F4939662AEB"><enum>(2)</enum><header>Joint labor-management partnership</header><subparagraph commented="no" display-inline="no-display-inline" id="id4AD3E03705774570B1BF6FBFF9B3F85C"><enum>(A)</enum><header>In general</header><text>The term <term>joint labor-management partnership</term> means a registered nonprofit organization that—</text><clause commented="no" display-inline="no-display-inline" id="id6299811A1A3446DAAA0DCE717C2DA126"><enum>(i)</enum><text>is made up of—</text><subclause commented="no" display-inline="no-display-inline" id="idE6F20BD71C354770989269CD406862AA"><enum>(I)</enum><text>representatives from nonprofit organizations, employers, industry, and labor organizations; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idB5E2CEE274BF4CB78B068C4023B3A1DA"><enum>(II)</enum><text>an intermediary or a sustained convener; and</text></subclause></clause><clause display-inline="no-display-inline" commented="no" id="idCBDF7390A31A4E809A850EE534B6251B"><enum>(ii)</enum><text>sets goals, encourages agreements, fosters open dialogue, solves problems, creates incentives for outstanding individual or team performance, and encourages flexibility and innovation.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1716118E67AB4367A79F2448E67E8F5D"><enum>(B)</enum><header>Inclusion</header><text>The term <term>joint labor-management partnership</term> includes a qualified youth or conservation corps that—</text><clause commented="no" display-inline="no-display-inline" id="id4238B3077A2F4B569CDA7E4AA058305C"><enum>(i)</enum><text>provides training to individuals to work for an eligible entity that is a business; or </text></clause><clause commented="no" display-inline="no-display-inline" id="idCD1C683A1DEF48C6B3A889A5ECC4C75E"><enum>(ii)</enum><text>works on behalf of an eligible entity that is a business.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="id75B6E733F1A34E45B83318848BA0ACF3"><enum>(b)</enum><header>Establishment</header><paragraph id="H8D6A4B68EC074DEA8F8474C68D9BE2D7"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a program to provide grants to eligible entities to pay the wages of a new or existing employee during the time period in which the employee receives training to work—</text><subparagraph id="idFB1C12716F3540C8B5A7C59AE12C60B5"><enum>(A)</enum><text>in the energy efficiency sector, the renewable energy sector, the electrification sector, or the grid modernization sector; or </text></subparagraph><subparagraph id="id892D3D52CC664EA5B39F6EEBE0F49840"><enum>(B)</enum><text>on matters pertaining to the reduction of greenhouse gas emissions.</text></subparagraph></paragraph><paragraph commented="no" id="H7F814D01750C48F08B2EA8067FD846F3"><enum>(2)</enum><header>Guidelines</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary, in consultation with the Secretary of Labor, stakeholders, contractors, and organizations that work to advance existing residential energy efficiency, shall establish guidelines for the program under paragraph (1) to determine the criteria for—</text><subparagraph id="idfce14ac2f5a042b4a677f8832e345ae3"><enum>(A)</enum><text>the wages or stipends that shall be paid using the grant funds, subject to subsection (c)(4)(A); and</text></subparagraph><subparagraph commented="no" id="id9237015F21C743FCBD3F49AACA5D30DC"><enum>(B)</enum><text>training received by an employee that qualifies under the program.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H8598A952FACF4630BF6ED0B9F3C67621"><enum>(c)</enum><header>Grants</header><paragraph id="id5BF1468927AB4BEDA9A6465263C9152A"><enum>(1)</enum><header>In general</header><text>An eligible entity desiring a grant under subsection (b)(1) shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph commented="no" id="H72E998828EC146E2BADACCCBE4855899"><enum>(2)</enum><header>Priority for targeted communities</header><text>In providing grants under subsection (b)(1), the Secretary shall give priority to an eligible entity that—</text><subparagraph commented="no" id="HE4C32384975D4615B77FD5FA0DEC4D14"><enum>(A)</enum><text>recruits employees—</text><clause commented="no" id="H0B6F6981EAA94714BBCA5E35818C22C5"><enum>(i)</enum><text>from the 1 or more communities that are served by the eligible entity; and</text></clause><clause commented="no" id="H102BC2FEABA54C1C8A598FEBCDCC4ACE"><enum>(ii)</enum><text display-inline="yes-display-inline">that are minorities, women, veterans, individuals who are or were foster children, or individuals who are transitioning from fossil energy sector jobs; and</text></clause></subparagraph><subparagraph commented="no" id="H83DDE37C87974B14ADFB3014B468542C"><enum>(B)</enum><text>provides trainees with the opportunity to obtain real-world experience.</text></subparagraph></paragraph><paragraph commented="no" id="H7FC0120A51B34976980456BF03BE1542"><enum>(3)</enum><header>Use of grants</header><text>Subject to paragraph (4)(B), an eligible entity may use a grant received under subsection (b)(1)—</text><subparagraph commented="no" id="H5058248AE98048EBA6401E2C92B42D85"><enum>(A)</enum><text>in the case of an eligible entity with 20 or fewer employees, to pay not more than—</text><clause commented="no" id="H0E4535C4D0DB4A029192E259F7856FC8"><enum>(i)</enum><text>45 percent of the wages of an employee for the duration of the training, if the training is provided by the eligible entity; and</text></clause><clause commented="no" id="H85226DC0FA114CAB9FCFC055B75EB7F5"><enum>(ii)</enum><text>90 percent of the wages of an employee for the duration of the training, if the training is provided by an entity other than the eligible entity;</text></clause></subparagraph><subparagraph commented="no" id="HF9A52B46510140DEAA526DD1B9ED7E96"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of an eligible entity with 21 to 99 employees, to pay not more than—</text><clause commented="no" id="H746EC93C20824D2A9B81D110A10430D7"><enum>(i)</enum><text display-inline="yes-display-inline">37.5 percent of the wages of an employee for the duration of the training, if the training is provided by the eligible entity; and</text></clause><clause commented="no" id="HD71BAB5041A8408EB693124347A85C51"><enum>(ii)</enum><text display-inline="yes-display-inline">75 percent of the wages of an employee for the duration of the training, if the training is provided by an entity other than the eligible entity; and</text></clause></subparagraph><subparagraph commented="no" id="HD36878F737B14F7ABBAEA699CF238D99"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of an eligible entity with not less than 100 employees, to pay not more than—</text><clause commented="no" id="HF320EDC0D0604E6EBF02C62116D74492"><enum>(i)</enum><text>25 percent of the wages of an employee for the duration of the training, if the training is provided by the eligible entity; and</text></clause><clause commented="no" id="H914102B9C84748BC98609315F7052A4B"><enum>(ii)</enum><text>50 percent of the wages of an employee for the duration of the training, if the training is provided by an entity other than the eligible entity.</text></clause></subparagraph></paragraph><paragraph commented="no" id="idC7AB7B37049E4DE0AB57EFC88E41E230"><enum>(4)</enum><header>Conditions</header><subparagraph commented="no" id="id3690A5E8B205419DAA8DB9C5DD325078"><enum>(A)</enum><header>Schedule of wages</header><clause commented="no" id="id6471482330404A9ABF03D3EBB6181EB8"><enum>(i)</enum><header>In general</header><text>An eligible entity receiving a grant under subsection (b)(1) shall provide a clearly defined schedule of wages to be paid to each employee any portion of the wages of whom will be paid using grant funds.</text></clause><clause commented="no" id="id90F4F12D2E04444485A747AC685A370F"><enum>(ii)</enum><header>Requirement</header><text>A schedule of wages under clause (i) shall—</text><subclause commented="no" id="idADCC1A1C9A8D454C93FA0393E5D6D53E"><enum>(I)</enum><text>be consistent with skill gains that result from participation in or completion of the training described in subsection (b)(1);</text></subclause><subclause commented="no" id="idA2C2A2EDF1CA4F33AFE63CF23E80BD2F"><enum>(II)</enum><text>ensure that the entry wage of each employee described in that clause is not less than the greater of—</text><item commented="no" id="id42E98F3A9DF845419AC63D56909754AA"><enum>(aa)</enum><text>the minimum wage required under section 6(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)</external-xref>); and</text></item><item commented="no" id="id03954DD03999478C99FC953D3D0B84EC"><enum>(bb)</enum><text>the applicable wage required by—</text><subitem commented="no" id="id7D04190216644F8CBE4D55FAF630B3C5"><enum>(AA)</enum><text>other applicable Federal or State law; or </text></subitem><subitem commented="no" id="id78FC82F889CD4444A62766BD25B7267C"><enum>(BB)</enum><text>a collective bargaining agreement; and</text></subitem></item></subclause><subclause commented="no" id="idCF9E5A7887CB4086AD82D70E0789870B"><enum>(III)</enum><text>ensure that the wages of existing employees of the eligible entity described in that clause progressively increase as a result of completion of the training.</text></subclause></clause></subparagraph><subparagraph commented="no" id="id5547BC1F796343EEA708DAA9BC3BF7A4"><enum>(B)</enum><header>Duration of training</header><clause commented="no" id="idF7E37E53488549AB86D5AFA7359ABD78"><enum>(i)</enum><header>In general</header><text>For purposes of paragraph (3), the duration of the training referred to in each of subparagraphs (A) through (C) of that paragraph may not exceed a period of 180 days beginning on the date on which the employee begins the training.</text></clause><clause commented="no" id="idA99871B58BDB49AFBD2042169F458792"><enum>(ii)</enum><header>Different types of training</header><text>The 180-day period described in clause (i) shall apply to each type of training received by an employee, such that a new 180-day period shall apply to training leading to a substantially different certification, as determined by the Secretary, than a prior training.</text></clause></subparagraph><subparagraph commented="no" id="idB19227140D264F5CB377D7862ECA1487"><enum>(C)</enum><header>Union neutrality</header><text>An eligible entity receiving a grant under subsection (b)(1) to pay any portion of the wages of 1 or more employees of the eligible entity shall remain neutral—</text><clause commented="no" id="id8C0D252A797B4D168BA001EDA2AA4989"><enum>(i)</enum><text>in any labor organization organizing effort; and</text></clause><clause commented="no" id="idECE5EEECBF5140E19DA04FC20C5851E8"><enum>(ii)</enum><text>with respect to the exercise of employees and labor organizations of the right to organize and bargain and engage in other protected concerted activity under the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF9109E54DEA64FFE877C8EB1D0F5BFCC"><enum>(5)</enum><header>Grant amount</header><text>An eligible entity may not receive more than $100,000 per fiscal year under subsection (b)(1).</text></paragraph></subsection><subsection commented="no" id="H05D564DF417244A0B3C59C47DB5D41EB"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $100,000,000 for each of fiscal years 2023 through 2027.</text></subsection></section><section commented="no" id="idF5A0D03C958D419C8C1755C07D43E691"><enum>5.</enum><header>Clean energy education grant program</header><subsection commented="no" id="idABD2B8B048C64EAA84091786D38A5B78"><enum>(a)</enum><header>Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph id="idb951e8c0c2644379a1f9153bb1d3a641"><enum>(1)</enum><text>a junior or community college (as defined in section 312(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058(f)</external-xref>));</text></paragraph><paragraph id="id7a2f768ccb604a72b18bc42c1e164e37"><enum>(2)</enum><text>a postsecondary vocational institution (as defined in section 102(c) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(c)</external-xref>));</text></paragraph><paragraph id="ide91f6981f23144bba2dc1efa28cfba18"><enum>(3)</enum><text>a secondary school (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>));</text></paragraph><paragraph id="id1fcb1a3dd01547dcb1d67ce9168287d8"><enum>(4)</enum><text>a Bureau-funded school (as defined in section 1141 of the Education Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/2021">25 U.S.C. 2021</external-xref>)); and</text></paragraph><paragraph id="id153ecfd0fae84853b4085fdd5421674d" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>an area career and technical education school (as defined in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>)). </text></paragraph></subsection><subsection commented="no" id="id9D44D12A48CE43E3BA006F9FBEF51BF0"><enum>(b)</enum><header>Grants</header><text>The Secretary shall provide grants to eligible entities to establish clean energy education programs that, at a minimum, include 1 or more of the following:</text><paragraph commented="no" id="idAEC9D1DF367B4B1A8E8A163DFD39C86C"><enum>(1)</enum><text>A curriculum that prepares individuals for an occupation in the manufacturing of products or the provision of services described in section 4(a)(1)(B).</text></paragraph><paragraph commented="no" id="idCE58D33CB7CE4B68BFE19377A3716322"><enum>(2)</enum><text>Scholarships or stipends for students enrolled in the clean energy education program.</text></paragraph></subsection><subsection id="id0d857f9ad1cf40489dec50f9e1c85d71"><enum>(c)</enum><header>Applications</header><text>An eligible entity desiring a grant under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including, at a minimum—</text><paragraph id="idd1dd152a642d4060974d9a0e57bc8127"><enum>(1)</enum><text>a description of—</text><subparagraph id="idC83D28B3183E416A85D72688AC59ADC7"><enum>(A)</enum><text>the training the eligible entity would provide using grant funds (including, in cases in which grant funds will be used to provide scholarships or stipends, the training that the eligible entity will provide to the recipient of the scholarship or stipend); </text></subparagraph><subparagraph id="idCE4E7A49692840FE9DE38424E5CF77CD"><enum>(B)</enum><text>how that training fulfills the workforce needs of employers that manufacture products or provide services described in section 4(a)(1)(B);</text></subparagraph><subparagraph id="id28EE8A6F738440B49192196DB43E3493"><enum>(C)</enum><text>how that training aligns with or contributes to the development of—</text><clause id="idCF0D0CCBB26E40FC87FD9EB6C6EB7987"><enum>(i)</enum><text>the guidance provided by the resources of the online resource center established under subsection (d) of section 3; and</text></clause><clause id="id9BB19A0D933F4AB78F6858BCA3157C30"><enum>(ii)</enum><text>the guidelines developed under subsection (f) of that section; and</text></clause></subparagraph><subparagraph id="idE82C71BEC9E64A20992C049945190918"><enum>(D)</enum><text>how the workforce needs that would be fulfilled by that training relate to an industry or occupation in the region in which the training is conducted;</text></subparagraph></paragraph><paragraph id="id256fdd19f09f41a2a2c95157465d1224"><enum>(2)</enum><text>a description of the criteria for selecting recipients of scholarships or stipends for students enrolled in the clean energy education program;</text></paragraph><paragraph id="id6b7c1633335340a393d50eece042d025"><enum>(3)</enum><text>evidence of the experience of the eligible entity in conducting training programs in the clean energy technology sector;</text></paragraph><paragraph id="id48bfb2d682104bc5971d7dc7316076b6"><enum>(4)</enum><text>information about—</text><subparagraph id="idAAFD219CCD364CA89C2500E4BD5F43F9"><enum>(A)</enum><text>the eligible entity; and </text></subparagraph><subparagraph id="id71C3D96F83DD4833BD12FAF2BB20FD8E"><enum>(B)</enum><text>any relevant partnerships that the eligible entity has with the Federal Government, other worker training entities, employers or employer-sponsored organizations, State or local agencies, labor or joint labor-management organizations, institutions of higher education, community-based organizations, or faith-based organizations;</text></subparagraph></paragraph><paragraph id="id0fdd1c52d99c4549b64c3470af6a1e64"><enum>(5)</enum><text>information about how the eligible entity will collect additional wage and employment data of graduates of the clean energy education program to evaluate the quality of the training and other programming provided by the program; and</text></paragraph><paragraph id="ida1ec9c1654bf4a68b6ea07ef9b00486f"><enum>(6)</enum><text>any other information that the Secretary determines to be appropriate in order to determine whether an eligible entity will provide training and other programming of sufficient quality.</text></paragraph></subsection><subsection id="id4c02fbe5d09b40e5b4793509f1ee706a"><enum>(d)</enum><header>Requirements</header><paragraph id="idD07CB25927104053B35C5AD4010A9EE8"><enum>(1)</enum><header>In general</header><text>In providing grants under this section, the Secretary shall—</text><subparagraph id="id722c76c6c9054484be2d73a81f1f6708"><enum>(A)</enum><text>specify a percentage of funding, at the discretion of the Secretary, to be used for innovative programs, as defined by the Secretary in accordance with paragraph (2); and</text></subparagraph><subparagraph id="idf50bf331c35f448dafb6e62721c217df"><enum>(B)</enum><text>specify a percentage of funding, at the discretion of the Secretary, to be used to provide scholarships and stipends that adequately cover wraparound services for recipients of the scholarships and stipends, including—</text><clause id="idabeafaa4593e412c883fcba7428973a5"><enum>(i)</enum><text>necessary transportation costs with respect to attending the applicable curriculum; and</text></clause><clause id="id304acca27d6d4fea8cd0178b49038f74"><enum>(ii)</enum><text>child care costs relating to attending the applicable curriculum.</text></clause></subparagraph></paragraph><paragraph id="idF4FDCD50228F4E9AAD42372D9E6C01F3"><enum>(2)</enum><header>Innovative programs</header><text>In carrying out paragraph (1)(A), the Secretary may define innovative programs as those programs with the potential to scale quickly, such as—</text><subparagraph id="id26B33D3EB5454E9C8EFF424FE81DBB5C"><enum>(A)</enum><text>train-the-trainer programs; </text></subparagraph><subparagraph id="id67D9C79E934942A2B7707B9D073D6EB1"><enum>(B)</enum><text>online or hybrid education programs; and </text></subparagraph><subparagraph id="id066F0B4F09C54D44BE9CF4CAD061E4F7"><enum>(C)</enum><text>programs that use broadly distributed institutions, such as community colleges.</text></subparagraph></paragraph></subsection><subsection id="id95c4e49bac584a94b57701377d6f7a8a"><enum>(e)</enum><header>Priority</header><text>In providing grants under this section, the Secretary shall give priority to eligible entities that, in carrying out clean energy education programs under this section, give priority to underrepresented groups.</text></subsection><subsection id="id76d1c848c1b141dbb0c0fb6584fd2e51"><enum>(f)</enum><header>Conditions</header><paragraph id="idB6E4E0F2E709403AACAB1CF67E449B91"><enum>(1)</enum><header>Grant period</header><text>The period of a grant provided under this section shall not exceed 3 years.</text></paragraph><paragraph id="id7A478539116E4404929472017BD8BC89"><enum>(2)</enum><header>Grant amount</header><text>The amount of a grant provided under this section shall not exceed $150,000.</text></paragraph><paragraph id="id38bb67005a5d4c2ca65f70b819358ec4"><enum>(3)</enum><header>Scholarships and stipends</header><subparagraph id="idD4CBA41882DA40BDAF51F1D53D7FFE8B"><enum>(A)</enum><header>Postsecondary institutions</header><text>Scholarships and stipends administered by an eligible entity described in paragraph (1) or (2) of subsection (a) or, in the case of an eligible entity described in paragraph (5) of that subsection, an entity described in subparagraph (C) or (D) of section 3(3) of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302(3)</external-xref>)—</text><clause id="id44A814E8105C4A3091676EBEC6132EBB"><enum>(i)</enum><text>may not exceed $12,000 per year per individual recipient; and</text></clause><clause id="id7865F2539BB44E97A5AC8281A60AB3E6"><enum>(ii)</enum><text>may be provided for a period of not more than 2 years per recipient.</text></clause></subparagraph><subparagraph id="ida041011b8d0143819fddeeca3fc11c3b"><enum>(B)</enum><header>Secondary schools</header><clause id="idB45BAD55C8914047A0DDFA1448A81613"><enum>(i)</enum><header>Definition of secondary school</header><text>In this subparagraph, the term <term>secondary school</term> means—</text><subclause id="idCC033828D96C401DBFFECD4DFBFC96B6"><enum>(I)</enum><text>an eligible entity described in paragraph (3) or (4) of subsection (a); and</text></subclause><subclause id="id2ACF6BDDCB7045F5A794E4794A40DB3C" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>in the case of an eligible entity described in paragraph (5) of that subsection, an entity described in subparagraph (A) or (B) of section 3(3) of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302(3)</external-xref>). </text></subclause></clause><clause id="id346D850565AB44FD98B8B58639D47FF8"><enum>(ii)</enum><header>Prohibition</header><text>A grant provided under this section may not be used to provide scholarships for, or stipends relating to, attendance at or enrollment in a secondary school or any clean energy education program carried out by a secondary school.</text></clause></subparagraph></paragraph></subsection><subsection id="id4a6dc20efc0b46e0a8e289748b16c541"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $30,000,000 for each of fiscal years 2023 through 2027.</text></subsection></section></legis-body></bill>
