which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a North American Grasslands Conservation Council, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>North American Grasslands Conservation Act of 2022</short-title></quote>.</text></section><section id="idD0272B286422452A9587DA0660B3807B"><enum>2.</enum><header>Findings</header><subsection id="idB9C404FD3DFF40498748270792E832FD"><enum/><text>Congress finds that—</text><paragraph id="id18ab097fe4824906b793740de14bb43d"><enum>(1)</enum><text>the maintenance of healthy populations of grassland bird species and working lands that are critical for rural economies and carbon sequestration are dependent on the conservation, restoration, and management of grassland ecosystems, which are composed of tallgrass, mixed grass, and shortgrass prairies, sagebrush shrub-steppe, and savannah grasslands (referred to in this section as <term>grassland ecosystems</term>);</text></paragraph><paragraph id="id9F1005CB26704451BC3BB19016AE3947"><enum>(2)</enum><text>grasslands cover 358,000,000 acres of the United States, 85 percent of which are privately owned and serve as an important habitat for 29 breeding obligate grassland bird species;</text></paragraph><paragraph id="id2254CBE590F84C56AF740F2D38183DE7"><enum>(3)</enum><text>sagebrush occupies 161,000,000 acres of 14 western States;</text></paragraph><paragraph id="id973d821dad7f45deb10a0c96a92a0946"><enum>(4)</enum><text>over the last decade alone, millions of acres of grassland ecosystems in North America have been converted to cropland and residential and commercial development;</text></paragraph><paragraph id="id37AC9CDA63E54B02A574E4A8C72FF173"><enum>(5)</enum><text>grassland ecosystems are threatened by fragmentation, invasive species, wildfire, degradation, and land conversion;</text></paragraph><paragraph id="idcb0c1a21d1904ef293ee0bcdd9cdc3c0"><enum>(6)</enum><text>on average, about 1,200,000 acres of sagebrush burn each year in the United States due to invasive annual grasses that fuel catastrophic wildfires;</text></paragraph><paragraph id="idC1ACA2AC04A14EAC972B3537E786B7E4"><enum>(7)</enum><text>in addition to the wildfires described in paragraph (6), there has been a decrease in the number of working farms and ranches due to—</text><subparagraph id="idEBB6517841D2441C92515A33F927115C"><enum>(A)</enum><text>pressures to convert or sell land; and </text></subparagraph><subparagraph id="id61829E5406624681B16609FAD696F487"><enum>(B)</enum><text>challenges in keeping ranching profitable; and</text></subparagraph></paragraph><paragraph id="idA4683D40DC3B418A83FBF11C8312024F"><enum>(8)</enum><text>effective restoration strategies for land managers of grassland ecosystems require—</text><subparagraph id="idF4BD32425DD54421916B83A150B16324"><enum>(A)</enum><text>access to adequate quantities of high quality, regionally appropriate, and diverse native plant seeds;</text></subparagraph><subparagraph id="idC071CCF365574990934DB5E535E7BE24"><enum>(B)</enum><text>science-based guidance on cultivating native plant species; and</text></subparagraph><subparagraph id="id8D22D98B75154991A3FA47E4D6F2CD09"><enum>(C)</enum><text>as stated in the National Seed Strategy for Rehabilitation and Restoration developed by the Plant Conservation Alliance and chaired by the Director of the Bureau of Land Management, more research on seedling establishment and species interaction in order to increase the use of native plant species.</text></subparagraph></paragraph></subsection></section><section id="id3975358229954AC9B9988CCACBD5F9E1"><enum>3.</enum><header>Purpose</header><subsection id="id63EE45873F1F44F1BDACBB70F4C2ACEA"><enum/><text>The purpose of this Act is to take bold action to conserve and restore grasslands in North America while supporting ranchers, farmers, Indian Tribes, sportsmen and sportswomen, rural communities, and other interests by—</text><paragraph id="id25608b7d567a494787b479d1b9f3be66"><enum>(1)</enum><text>preventing additional conversion and loss of native grasslands and loss of sagebrush biome and sustaining those ecosystems as working lands by creating a flexible, voluntary, and innovative grant program;</text></paragraph><paragraph id="id15e711fd286c4af48247a4bb9ebb6e4d"><enum>(2)</enum><text>improving grassland and rangeland health and management;</text></paragraph><paragraph id="id01E9FEA6BD6E4BE7BD0BC70CEE77D497"><enum>(3)</enum><text>mitigating the impacts of severe drought and wildfire on grasslands;</text></paragraph><paragraph id="id5b5597e5fffe4a5e8ac3681dd3220569"><enum>(4)</enum><text>supporting farmer and rancher stewards and Tribal partners;</text></paragraph><paragraph id="idb5db7cf6163443aeb0aded15a3483d4b"><enum>(5)</enum><text>improving biodiversity and habitat for grassland and sagebrush birds, pollinators, and other wildlife;</text></paragraph><paragraph id="ida66954429fc042128c60b291ab0d90c4"><enum>(6)</enum><text>increasing carbon sequestration;</text></paragraph><paragraph id="idab8255588e574e869dcf59454bec3713"><enum>(7)</enum><text>providing increased recreational and hunter access opportunities, at the discretion of private landowners; and</text></paragraph><paragraph id="id69B1CB4CB44A44FA8752C5C582F43C00"><enum>(8)</enum><text>encouraging stronger public-private partnerships in support of landscape-level grassland conservation.</text></paragraph></subsection></section><section id="idC26E75B5988C43428FAEA9980AEDF99F"><enum>4.</enum><header>Definitions</header><subsection id="id8ED3ADEF61324200845B78A7223CA5CF"><enum/><text>In this Act:</text><paragraph id="idA8A87D452E7C4FD59711E88AD1706188"><enum>(1)</enum><header>Conservation Strategy</header><text>The term <term>Conservation Strategy</term> means the North American Grasslands Conservation Strategy established under section 7(a).</text></paragraph><paragraph id="id23E4ECE3904A4518860C1680E1778DAB"><enum>(2)</enum><header>Council</header><text>The term <term>Council</term> means the North American Grasslands Conservation Council established by section 5(a).</text></paragraph><paragraph id="id4D7A34A3CEAB406E9F450F2BE328E12A"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the United States Fish and Wildlife Service.</text></paragraph><paragraph id="id366ff5ade9974ce9aba7a468994c4962"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id0C9FDAFF90A14894BE96DAE699B362F4"><enum>(A)</enum><text>a grazing land coalition; </text></subparagraph><subparagraph id="id80A296E979524FE38294E8DEA34C79F4"><enum>(B)</enum><text>an agricultural or livestock producer group; </text></subparagraph><subparagraph id="idC32D8B159E244FE5942D5094E546E763"><enum>(C)</enum><text>an Indian Tribe; </text></subparagraph><subparagraph id="id222B059B12DC4C59A0810EB5574FE9A3"><enum>(D)</enum><text>a land trust; </text></subparagraph><subparagraph id="id2874B9680A324C0DAE7B139EA5D8D341"><enum>(E)</enum><text>a State or local government;</text></subparagraph><subparagraph id="id06A2A213001D4E6987B4834243A6C930"><enum>(F)</enum><text>a Federal land management agency;</text></subparagraph><subparagraph id="idAC63196416954259966DC40B62CEE5AC"><enum>(G)</enum><text>a nongovernmental organization;</text></subparagraph><subparagraph id="id641BE8E093614F65A0914EE22A78284B"><enum>(H)</enum><text>a community-based organization; and</text></subparagraph><subparagraph id="idF1A00FDBDCBA48FD8A9CDA4533C77830"><enum>(I)</enum><text>a group of individuals that are private landowners.</text></subparagraph></paragraph><paragraph id="id3501A05BBA7241FB958C60DE25A9E7BA"><enum>(5)</enum><header>Grasslands</header><text>The term <term>grasslands</term> means tallgrass, mixed grass, shortgrass, native prairie, sagebrush shrub-steppe, savanna grasslands, glades, wet meadows, coastal grasslands, and other related grassland ecosystems.</text></paragraph><paragraph id="id9e9e816b0c5f428b99be115dc454633f"><enum>(6)</enum><header>Grasslands conservation project</header><text>The term <term>grasslands conservation project</term> means any conservation, restoration, protection, or enhancement activity that is carried out with a grant awarded under the program.</text></paragraph><paragraph id="idF6A196BC3D1D476DAC45AF32560975A9" commented="no"><enum>(7)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id1DD85C1645434718B90C6BCE513B93BA"><enum>(8)</enum><header>Program</header><text>The term <term>program</term> means the grant program established under section 8(a).</text></paragraph><paragraph id="id640073e1850445909b28ec813fa2f825"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="idF57542AD882B48209679D6CFC55EC28C" commented="no"><enum>(10)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></subsection></section><section id="idCE7DF8FEAEB044BE83B3576AD2507ACD"><enum>5.</enum><header>North American Grasslands Conservation Council</header><subsection id="id853160CF11A54D52A757D59411BD5AEF"><enum>(a)</enum><header>Establishment</header><text>There is established the North American Grasslands Conservation Council.</text></subsection><subsection id="id59EDAFEC518444058251FAB140E7CF7D"><enum>(b)</enum><header>Membership</header><paragraph id="id1025B8B83DFC4E53B80732D14FCFA7F4"><enum>(1)</enum><header>In general</header><text>The Council shall be composed of 10 members, of whom—</text><subparagraph id="id1A3C2CD1EB9A488A80F57BFD15275DBD"><enum>(A)</enum><text>1 shall be the Director, who shall be the responsible Federal official for ensuring Council compliance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subparagraph><subparagraph id="id481e1ae1ea8341eea7d4743fda837457"><enum>(B)</enum><text>1 shall be a representative of the National Fish and Wildlife Foundation;</text></subparagraph><subparagraph id="idaf489b727779496fb8ad4dcae00d3506"><enum>(C)</enum><text>2 shall be appointed by the Secretary, who shall each be a Director of a State fish and wildlife agency;</text></subparagraph><subparagraph id="id1d20f73161c445d491494167e6fa0c02"><enum>(D)</enum><text>2 shall be appointed by the Secretary, who shall be representatives of Indian Tribes;</text></subparagraph><subparagraph id="idf868665fcebe48828832b86fb17cbe73"><enum>(E)</enum><text>2 shall be appointed by the Secretary, who shall each represent a different landowning, farming, ranching, or grazing group organization that is actively participating in carrying out grassland conservation projects; and</text></subparagraph><subparagraph id="idDDFF62AE0F2543158FB0B2E1AA09C19F"><enum>(F)</enum><text>2 shall be appointed by the Secretary, who shall be members of conservation organizations.</text></subparagraph></paragraph><paragraph id="id5508cd73f74b4d1495434a1d16bcd210"><enum>(2)</enum><header>Period of appointment; vacancies</header><subparagraph id="id76dfa69755794d09a353d9a1381123d7"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a member of the Council shall serve for a term of 3 years.</text></subparagraph><subparagraph id="id2CC0E2ED507D47E891CFDC80E3FA3FE5"><enum>(B)</enum><header>Exceptions</header><clause id="id80D2C1CC506A47F89F821C9E13D2954F"><enum>(i)</enum><header>Directors of State fish and wildlife agencies</header><text>Of the members first appointed under paragraph (1)(C)—</text><subclause id="id732550647D2A45D88B4E6DFCB0ACDA11"><enum>(I)</enum><text>1 shall be appointed for a term of 2 years; and</text></subclause><subclause id="id7E03D95CB3F340CC8F259619C29B09B8"><enum>(II)</enum><text>1 shall be appointed for a term of 3 years.</text></subclause></clause><clause id="id509077C81C194B3BB6411340410209A1"><enum>(ii)</enum><header>Other members</header><text>Of the members first appointed under subparagraphs (D), (E), and (F) of paragraph (1)—</text><subclause id="id7C81FA61006E4755873F1660F1A3DAEC"><enum>(I)</enum><text>2 shall be appointed for a term of 1 year;</text></subclause><subclause id="id3CF942E9BC05430D9334AA8FB343EC0A"><enum>(II)</enum><text>2 shall be appointed for a term of 2 years; and</text></subclause><subclause id="idE3626A6C4821420BB1CA15893E2E5E33"><enum>(III)</enum><text>2 shall be appointed for a term of 3 years.</text></subclause></clause></subparagraph><subparagraph id="idf83b90dfb7324613b9a0e1ead8913c5e"><enum>(C)</enum><header>Vacancies</header><clause id="idE1E5C27581C24EA2A4F70CA916AAF6BE"><enum>(i)</enum><header>In general</header><text>With respect to a member appointed to the Council under subparagraph (C) or (E) of paragraph (1), a vacancy in the Council shall be filled in accordance with that subparagraph for the remainder of the applicable term of that member.</text></clause><clause id="id01A62155B20642B9994352BED3D35034" commented="no"><enum>(ii)</enum><header>Alternate members</header><text>Until a vacancy referred to in clause (i) is filled, or in the event of an anticipated absence of a member described in that clause from any meeting of the Council, the Secretary shall appoint an alternate member to the Council who shall—</text><subclause id="id6DB2575907604F2E9C292766E8FA5998" commented="no"><enum>(I)</enum><text>be knowledgeable and experienced in matters relating to grassland conservation and restoration; and</text></subclause><subclause id="id6DA19D25DB184B33894CAA5BAA87E092" commented="no"><enum>(II)</enum><text>perform the duties of a member appointed to the Council under subparagraph (C) or (E) of paragraph (1).</text></subclause></clause></subparagraph></paragraph><paragraph id="idFCCD854713D44724975B3457940ADC2E"><enum>(3)</enum><header>Ex officio members</header><text>The Secretary may include as ex officio, nonvoting members of the Council—</text><subparagraph id="idC502BDD81B244559BE79BB146D0D8235"><enum>(A)</enum><text>the Under Secretary for Farm Production and Conservation of the Department of Agriculture; </text></subparagraph><subparagraph id="idB59C8BED2BEC43D7A21BCF418EBC7056" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the Director of the Bureau of Land Management; and</text></subparagraph><subparagraph id="id79EE4D55C1C84CB9AF8CC0F1BA59C471"><enum>(C)</enum><text>representatives of—</text><clause id="id7950377226b24c7086e5742c59cbef9e"><enum>(i)</enum><text>other appropriate Federal, provincial, territorial, or Tribal government agencies; and</text></clause><clause id="idabdfb4d04b1f41b2948850f819f30eeb" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>nonprofit charitable organizations and Native American interests, including Tribal organizations, that are participating in grasslands conservation projects.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id924C0993CBD44432B7E5D0222055D850"><enum>(4)</enum><header>Chairperson</header><subparagraph commented="no" display-inline="no-display-inline" id="id252CD6BFFA8248BCB1E43C0DA2D1EF02"><enum>(A)</enum><header>In general</header><text>The Council shall select a Chairperson from among the members of the Council. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id70039A0629014C29B87D956C79808CFA"><enum>(B)</enum><header>Term</header><text>A Chairperson shall serve for a 3-year term, except that the first selected Chairperson may serve a term of less than 3 years.</text></subparagraph></paragraph></subsection><subsection id="idADCFE44DDEC14B198B4DFA4576C499CA" commented="no"><enum>(c)</enum><header>Meetings</header><paragraph commented="no" id="idE4F3BEA3D4A345F78863B1D541E56AAD"><enum>(1)</enum><header>In general</header><text>The Council shall meet at the call of the Chairperson.</text></paragraph><paragraph commented="no" id="id71217E7A694848D38F7F406FA303B34F"><enum>(2)</enum><header>Frequency</header><text>The Council shall meet not less frequently than once per year.</text></paragraph><paragraph commented="no" id="id6E74736AC08A43B28E10BA28A192EAF1"><enum>(3)</enum><header>Format</header><text>A meeting of the Council may be conducted in person or virtually.</text></paragraph><paragraph commented="no" id="id7605C708BC4E478BADA84CCA3214BA9B"><enum>(4)</enum><header>Availability</header><text>Meetings of the Council shall be open to the public, and the Council shall give public notice of the time and place of such meetings.</text></paragraph></subsection><subsection commented="no" id="id0716FF41C3934410A92B28FC35E7E551"><enum>(d)</enum><header>Duties</header><text>The Council shall—</text><paragraph commented="no" id="id4A3C1B456B8D405FAAC807F65C1FC911"><enum>(1)</enum><text>provide input to the Director in the development of the Conservation Strategy;</text></paragraph><paragraph commented="no" id="idFD1CB985AB774DCA9670A4BB7A1C3442"><enum>(2)</enum><text>establish publicly available project evaluation criteria for applications submitted under the program; and</text></paragraph><paragraph commented="no" id="id03FCB41782C24D2FA869BF43618AA1AB"><enum>(3)</enum><text>provide funding recommendations to the Director with respect to those applications.</text></paragraph></subsection><subsection id="id205AF0D1BF9A4BDEA43D3941A9D7643A"><enum>(e)</enum><header>Compensation</header><text>A member of the Council shall receive no compensation as a result of serving on the Council.</text></subsection><subsection id="idEBB7470FEF3447168407A22E293A1835"><enum>(f)</enum><header>FACA applicability</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Council.</text></subsection></section><section commented="no" id="id66ECA54E94494676AB631A49A9B62DDD"><enum>6.</enum><header>Regional grasslands conservation councils</header><subsection commented="no" id="id5DCF209C3BEC40D79F4E8CA126589A51"><enum>(a)</enum><header>In general</header><text>There are established Regional Grasslands Conservation Councils for each region established by the Director, in consultation with relevant Federal agencies.</text></subsection><subsection commented="no" id="idCF587AD5FA6B40979B9E34B2583BE0CE"><enum>(b)</enum><header>Membership</header><text>Each Regional Grasslands Conservation Council shall be composed of not more than 10 members, which shall include—</text><paragraph commented="no" id="id41C16C0993D048EB8C2062329381BBD8"><enum>(1)</enum><text>representatives of nongovernmental organizations representing the conservation community;</text></paragraph><paragraph commented="no" id="id18710D47D4EF4F30B73B7F99C74DECA1"><enum>(2)</enum><text>representatives from Tribal governments and organizations;</text></paragraph><paragraph commented="no" id="id4B84BEBF93FB4A9EACC04B0A26E08A97"><enum>(3)</enum><text>representatives of rancher and farming interests;</text></paragraph><paragraph commented="no" id="idD3CC237024444227B79FBCD287410083"><enum>(4)</enum><text>representatives from State fish and wildlife agencies; and</text></paragraph><paragraph commented="no" id="idF91B8FDC6FC94F68A0F8708E0673BDCA"><enum>(5)</enum><text>any other representatives, as determined necessary by the Secretary in coordination with the Council.</text></paragraph></subsection><subsection commented="no" id="id3077903E96BE48C0BFE93EAB6F96BEDE"><enum>(c)</enum><header>Recommendations</header><text>A Regional Grasslands Conservation Council shall provide recommendations to the Council on—</text><paragraph commented="no" id="id6952AD55C24444DC8443CEA554F9ADE2"><enum>(1)</enum><text>the selection of grasslands conservation projects; and</text></paragraph><paragraph commented="no" id="id426362E9FF924C45936E92ECDB510B81"><enum>(2)</enum><text>best practices of established regional grassland conservation plans.</text></paragraph></subsection><subsection commented="no" id="id2D63B41661D442B8A91E06F6E8D232CF"><enum>(d)</enum><header>FACA applicability</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to a Regional Grasslands Conservation Council.</text></subsection></section><section id="id90E43EDFC5D14659AB844302DE44C064"><enum>7.</enum><header>North American Grasslands Conservation Strategy</header><subsection id="id9AFDB3C10F65465AB7E1A8A3A825D96D"><enum>(a)</enum><header>In general</header><text>After not less than half of the members of the Council are appointed under section 5(b)(1), the Director shall, in consultation with the Council—</text><paragraph id="id6EDC183EEB06468BA5E7EDC2BF61B48F"><enum>(1)</enum><text>develop a coordinated strategy, to be known as the <quote>North American Grasslands Conservation Strategy</quote>, for the protection, restoration, and management of grassland ecosystems across the United States; and</text></paragraph><paragraph id="id81CB99B6C4414583A01A23DD95208871"><enum>(2)</enum><text>support implementation, monitoring, and communication efforts relating to the Conservation Strategy.</text></paragraph></subsection><subsection id="idF8132F1B2AA144B5BFA7D8E73E0BA7DF"><enum>(b)</enum><header>Existing conservation plans</header><text>The Conservation Strategy shall draw from existing local, State, and regional conservation plans and frameworks, conservation plans of Indian Tribes, and State wildlife action plans, with an emphasis on supporting existing science-based frameworks from the Natural Resources Conservation Service, including the Working Land for Wildlife framework.</text></subsection><subsection id="id8A79B7DF658B442A99EC56F05279249C"><enum>(c)</enum><header>Inclusion</header><text>The Conservation Strategy shall—</text><paragraph id="id94689A5E19BB4A449E6D31CD840049DE"><enum>(1)</enum><text>identify key areas with—</text><subparagraph id="id565C393B06094B20B81C3FB156B7C762"><enum>(A)</enum><text>grasslands at high risk of conversion to cropland, residential and commercial development, shrub or woody encroachment, or invasion of annual grasses or other undesired vegetation;</text></subparagraph><subparagraph id="id556499079DD247BC86B1EFE14A62D501"><enum>(B)</enum><text>the highest potential of conserving native grasslands, restoring grasslands, and reducing fragmentation;</text></subparagraph><subparagraph id="id9C2C19B0CBE44BF0BF1D6A346F71EB05"><enum>(C)</enum><text>ecologically significant grassland remnants;</text></subparagraph><subparagraph id="id86C2751DAC8549A6943557DB980D9228"><enum>(D)</enum><text>populations of grassland bird species of greatest conservation need, as identified in—</text><clause id="id8739D92E32C5414A97EE9193998D0CEA"><enum>(i)</enum><text>State wildlife action plans; </text></clause><clause id="idEC6999BD712C4EB49B9B07271DB645C9"><enum>(ii)</enum><text>Tribal conservation plans; or</text></clause><clause id="id2DE7150748AF49AE8D295E16FD0A1F4D"><enum>(iii)</enum><text>the report of the United States Fish and Wildlife Service entitled <quote>Birds of Conservation Concern 2021 Migratory Bird Program</quote> and dated April 2021 (or a successor document); and</text></clause></subparagraph><subparagraph id="id5845AFDA5A824EA794288060092095E7"><enum>(E)</enum><text>grassland habitats important to the recovery of species listed as threatened species or endangered species under section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>);</text></subparagraph></paragraph><paragraph id="idccef7134556a4f6baabd3d86254f9b62"><enum>(2)</enum><text>identify specific goals for increasing grassland acreage and enhancing existing grasslands primarily through incentivizing the voluntary restoration of grasslands and the management of native prairie or sagebrush shrublands through conservation practices such as—</text><subparagraph id="id9AB3109EA99C418B9EB79379E2B14EF1"><enum>(A)</enum><text>advanced grazing management or other prescribed grazing management that meets the objectives of the Conservation Strategy; </text></subparagraph><subparagraph id="id2E149D0F3C014593960C902F8B2028E8"><enum>(B)</enum><text>prescribed fires;</text></subparagraph><subparagraph id="id91447BD35F90498F910102131E92E545"><enum>(C)</enum><text>invasive species management; </text></subparagraph><subparagraph id="idC32579EB1EBD47599DB5D3753D46D449"><enum>(D)</enum><text>removal of encroaching woody vegetation; and</text></subparagraph><subparagraph id="id578E7C4C5BC14CFFB3897C75323611F4"><enum>(E)</enum><text>restoration of marginal cropland and pastureland to native grasslands in areas that were historically grasslands; and</text></subparagraph></paragraph><paragraph id="id276998e47aba42a5b1fd107f2408b0b3"><enum>(3)</enum><text>develop—</text><subparagraph id="id44E2E1B1B0C24D2599DDE70E229BB1B1"><enum>(A)</enum><text>baseline inventories and population estimates of key indicator birds, pollinators, and other wildlife species at risk;</text></subparagraph><subparagraph id="idE6A0B4D1B8D3465EA862A95913807353"><enum>(B)</enum><text>goals for increasing population size and resiliency of those species, including through ensuring grassland habitat connectivity; and</text></subparagraph><subparagraph id="idF9E9432F110148EBB7BE01FE8A4CE268"><enum>(C)</enum><text>a tool for tracking county-level aggregated conversion of native grasslands to cropland, residential and commercial development, and other uses that shall be—</text><clause id="idC7EF6360DFB5423FA7CDD14711798FFB"><enum>(i)</enum><text>made publicly available; and</text></clause><clause id="id8FEB710AEBAA4BF1A33E5D8B66969BBC"><enum>(ii)</enum><text>updated on an annual basis.</text></clause></subparagraph></paragraph></subsection><subsection id="idC69A232767CA450E9088912E45F4FDDA"><enum>(d)</enum><header>Availability</header><text>Not later than 120 days before the date on which the program is established, the Conservation Strategy shall be finalized and made publicly available on the website of the United States Fish and Wildlife Service to help target investments in grasslands conservation projects.</text></subsection></section><section id="id48753922F7064676B315A07D9DC60B2E"><enum>8.</enum><header>Grassland conservation grant program</header><subsection id="id9AD348C20E154AF28BB36C70E0953677"><enum>(a)</enum><header>Establishment</header><text>Not later than 2 years after the date of enactment of this Act, the Director, in consultation with the Secretary of Agriculture and other heads of relevant Federal agencies, shall establish a competitive grant program to award grants to eligible entities for eligible projects to support voluntary grasslands conservation projects, including projects—</text><paragraph id="id905aebdd6884407b89992b4c6e91601b"><enum>(1)</enum><text>to conserve intact grasslands at risk of conversion to cropland and residential and commercial development;</text></paragraph><paragraph id="idCCDC123926DB4854847533792A2A12CB"><enum>(2)</enum><text>to restore degraded grasslands and improve grassland health;</text></paragraph><paragraph id="id2597c01f80e74f979ef2afca00e88370"><enum>(3)</enum><text>to increase carbon sequestration and ecological function in soils and improve resilience of grasslands;</text></paragraph><paragraph id="id02ce99d98e0f4580a6cb2df3063c36b2"><enum>(4)</enum><text>to support habitat and habitat connectivity for native grassland and sagebrush birds, pollinators, plants, watersheds, and other wildlife, including big game species; and</text></paragraph><paragraph id="idA7D242976C5F430FB26DA9237F348EBD"><enum>(5)</enum><text>to restore and enhance watersheds.</text></paragraph></subsection><subsection id="id5D158AF0E47945A4A6AEB7CEC73F3450"><enum>(b)</enum><header>Applications</header><text>An eligible entity desiring a grant under the program shall submit to the Director an application at such time, in such manner, and containing such information as the Director may require. </text></subsection><subsection id="idB5D60434AFEE482F9CC7F9124F0F67F8"><enum>(c)</enum><header>Priority</header><text>In awarding grants under the program, the Director shall prioritize grants to eligible entities that advance the goals of the Conservation Strategy.</text></subsection><subsection id="idFEC1B517A4FE436A89FFF175CC1FEA7B"><enum>(d)</enum><header>Considerations</header><text>In awarding grants under the program, the Director shall consider recommendations made by the Council.</text></subsection><subsection id="id5FA8C5B4208540E6B5BAF028B94B7D79"><enum>(e)</enum><header>Use of funds</header><paragraph id="id05DA2D82B7B5440F972106463271F4E3"><enum>(1)</enum><header>In general</header><text>An eligible entity may use a grant awarded under the program for grasslands conservation projects, including—</text><subparagraph id="idC21D2029280841329EB8B444C549EDC8"><enum>(A)</enum><text>voluntary conservation easements;</text></subparagraph><subparagraph id="id814DB0786D7147669D92EC3AE37690B5"><enum>(B)</enum><text>restoration and management activities, including—</text><clause id="idB951F6E55D7F414C890CD5C09AE3D6DF"><enum>(i)</enum><text>voluntary incentives to producers for prescribed burns;</text></clause><clause id="id3B176926E8D04923BDC2FEE124EDCFB5"><enum>(ii)</enum><text>removal of pinyon juniper or any other encroaching woody species; </text></clause><clause id="id2E3E05710C8547A78BC10F5696F26639"><enum>(iii)</enum><text>management of invasive species;</text></clause><clause id="idFB696DA9839B48DDBFBC8A9255A6CB55"><enum>(iv)</enum><text>maintenance and monitoring of new or ongoing grasslands conservation projects;</text></clause><clause id="idB9C0426AED4642DC9519974DCAA5D052"><enum>(v)</enum><text>advanced grazing management activities;</text></clause><clause id="idECAAA77F38104BE1A41429BD0BE40530"><enum>(vi)</enum><text>drought monitoring and preparedness activities; and</text></clause><clause id="idDECAE50D9E0D4717BF7A9F4136F00FD9"><enum>(vii)</enum><text>such other restoration and management activities as determined appropriate by the Director;</text></clause></subparagraph><subparagraph id="id0BD4568EFEE745C3A7380139F1187225"><enum>(C)</enum><text>ecosystem education, outreach, and conservation stewardship assistance, which may include—</text><clause id="idD0FC36D5887B4F49A752FCB9F0CAD0EE"><enum>(i)</enum><text>field days; </text></clause><clause id="id4C8409A42EAA41CD8B9B366A13EEAA18"><enum>(ii)</enum><text>grazing management training programs; </text></clause><clause id="id3625273FF5B5447092228A5A94B66B20"><enum>(iii)</enum><text>conservation planning; and</text></clause><clause id="idF6E52C26AFB647F69439AD87705E9041"><enum>(iv)</enum><text>education and outreach relating to—</text><subclause id="id958B336C923E45DBBF40E19DDCBC1BF1"><enum>(I)</enum><text>grazing management; </text></subclause><subclause id="id0A681FD40A134ECCADA7FA6CE074E631"><enum>(II)</enum><text>control of invasive species; </text></subclause><subclause id="id22E9930BE248457C927E3A67AF478FC2"><enum>(III)</enum><text>prescribed fires;</text></subclause><subclause id="id86545EE420E943E4A1A56F6160664D67"><enum>(IV)</enum><text>native seed crop systems research, in accordance with the research carried out by the Secretary of Agriculture under section 9;</text></subclause><subclause id="id1AB810CC722847C5A2AF639165798135"><enum>(V)</enum><text>land access, generational land transfers, and ensuring ranchland viability;</text></subclause><subclause id="id376552FCCD244ED19FAA483D26FA7318"><enum>(VI)</enum><text>best management practices relating to grassland biomes; and</text></subclause><subclause id="id9055C7D4F9A34D699B973C0DA63E7B1F"><enum>(VII)</enum><text>participation in carbon and ecosystem markets;</text></subclause></clause></subparagraph><subparagraph id="idDB4210D5717543C5AC3604D3572F0695"><enum>(D)</enum><text>payments for ecosystem or conservation services; and</text></subparagraph><subparagraph id="id8B2B8B621D6F4B60AAA256C408BECF2A"><enum>(E)</enum><text>such other activities that benefit grasslands and associated wildlife.</text></subparagraph></paragraph><paragraph id="id8DC86BB1A61F4E80B7AC950F36B7BCFD"><enum>(2)</enum><header>Restoration activities</header><text>For purposes of paragraph (1)(B), any restoration activity shall prioritize a diverse mix of appropriately sourced native grasses and forbs, with such exceptions as the Director determines to be appropriate for ecologically appropriate noninvasive and non-native species.</text></paragraph></subsection><subsection id="id07E17033EE274ACABF52224332568BE7" commented="no"><enum>(f)</enum><header>Grasslands conservation projects in Mexico and Canada</header><text>The Secretary shall grant or otherwise provide up to 10 percent of the amounts made available under section 12(a)(1) to Federal agencies, eligible entities, and other individuals and entities, including foreign land management agencies, for the purpose of assisting those entities and individuals in carrying out grasslands conservation projects in Mexico and Canada that—</text><paragraph commented="no" id="idD66219433A49416093D9CFD3949E8479"><enum>(1)</enum><text>have been approved by the Council; and</text></paragraph><paragraph commented="no" id="id983F2882B29C4F3795644CA67F706057"><enum>(2)</enum><text>meet the goals of the Conservation Strategy.</text></paragraph></subsection><subsection id="id3D8F9FA1411340139CEDBE7745896519" commented="no"><enum>(g)</enum><header>Tribal set-Aside</header><text>For each fiscal year, of the amounts made available to carry out the program, the Director shall set aside not less than 10 percent to provide grants to Indian Tribes and Tribal organizations.</text></subsection><subsection id="id807D324DD0E044EEB7BF4DEC06D0DB98" commented="no"><enum>(h)</enum><header>Cost-Sharing requirement</header><paragraph commented="no" id="id29AAEFD8813440ED89F139982EC65B48"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the non-Federal share of the cost of carrying out an eligible project using funds from a grant awarded under the program shall be not less than 25 percent, including in-kind contributions.</text></paragraph><paragraph commented="no" id="id3ECABFA7C7FB4EF690394667A31A57DA"><enum>(2)</enum><header>Waivers</header><subparagraph commented="no" id="id2B5AD692680947088ECB83B18C1E3CC4"><enum>(A)</enum><header>Indian Tribes</header><text>The Secretary shall waive the cost-share requirement under paragraph (1) for grants awarded to Indian Tribes and Tribal organizations.</text></subparagraph><subparagraph commented="no" id="id3FA05879EDF74280A9FB1AE375697989"><enum>(B)</enum><header>Other eligible entities</header><text>The Council shall establish waiver criteria under which the Secretary may waive the cost-share requirement under paragraph (1), in whole or in part, for grants awarded to such other eligible entities.</text></subparagraph></paragraph></subsection><subsection commented="no" id="idB6FAE282165148319C12D7898AF7F342"><enum>(i)</enum><header>Administrative costs</header><text>An eligible entity awarded a grant under this section may use the grant funds for administrative costs relating to that grant.</text></subsection></section><section id="idc4d675bbe2ac464091671b967f50dda1"><enum>9.</enum><header>Native seed crop systems research</header><text display-inline="no-display-inline">The Secretary and the Secretary of Agriculture shall jointly coordinate and implement the National Seed Strategy for Rehabilitation and Restoration developed by the Plant Conservation Alliance and chaired by the Director of the Bureau of Land Management, with an emphasis on— </text><paragraph id="idBA345A1BF61E4DFAB544F5C2CD4F4870"><enum>(1)</enum><text display-inline="yes-display-inline">research relating to native seed crop systems, including—</text><subparagraph id="id12A47588E0F3423183656D61EE5727A9"><enum>(A)</enum><text display-inline="yes-display-inline">agronomic research to improve the understanding of native plants as seed crops for native rangeland revegetation, with an emphasis on enhancing natural plant establishment in the environment;</text></subparagraph><subparagraph id="id8f6df94d321c4c0797bb78cba387ef13"><enum>(B)</enum><text>research on plant seed physiology to improve seed quality, storage, and seeding success in the landscape; </text></subparagraph><subparagraph id="id8daad38fb58c4b8882abee8daef507ee"><enum>(C)</enum><text>the development and technology transfer of best management practices and technologies for seed production, seed collection, seed storage, and reseeding success in the environment;</text></subparagraph><subparagraph id="id4f6d07e8fbcf49f5bd4200fe1a6d39d6"><enum>(D)</enum><text>research on soil chemistry and biome composition and how soil chemistry and biome composition impact native seed establishment; and</text></subparagraph><subparagraph id="id5c46cc0f16c34b9e88becfff972dc8c9"><enum>(E)</enum><text>identification of scenarios and preferred species for the incorporation of non-native seed, with the goal of the overall successful restoration of functional groups of species;</text></subparagraph></paragraph><paragraph id="id1e0506d871304234b545523adea68088"><enum>(2)</enum><text>extension of research described in paragraph (1) to seed producers and land managers responsible for restoration efforts; and</text></paragraph><paragraph id="idC76195176D254FA5A4B584B8F5AE2B02" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>production, storage, distribution, and planting of native seed crops in grassland areas for restoration.</text></paragraph></section><section id="idE598E23E85E742758FA13BC2782A7974"><enum>10.</enum><header>Regenerative grazing data collection</header><subsection id="id95AA5B8D0D07462E889778EC4846239E"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id6A94C47981C24330852AD4A1F7473628" commented="no"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text><subparagraph id="idff22747f606d43dba63b7f27e8d5476f" commented="no"><enum>(A)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)); and</text></subparagraph><subparagraph id="id3b9e6fa65593408498defd9158d265ec" commented="no"><enum>(B)</enum><text>land of the National Forest System (as defined in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>)).</text></subparagraph></paragraph><paragraph id="id6021E24CC31744B19DCE26BBC2EBF7A8"><enum>(2)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the pilot program established under subsection (b)(1).</text></paragraph><paragraph id="id4E55A7DE87C0418AAC41CE8B81B9AF2E"><enum>(3)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means the Secretary of Agriculture (acting through the Chief of the Forest Service) and the Secretary (acting through the Director of the Bureau of Land Management), acting jointly.</text></paragraph></subsection><subsection id="id3AA7F8194B3545759A6FFB5F5FA9E08B"><enum>(b)</enum><header>Pilot program for use of regenerative grazing on Federal land To mitigate the effects of climate change</header><paragraph id="id0A5B185E6BC64573AED1E3131089E3BA"><enum>(1)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Secretaries shall establish a pilot program to study the effectiveness of using grazing on Federal land to mitigate the effects of climate change.</text></paragraph><paragraph id="id656DE8E5B6264C198742E357B6495F08"><enum>(2)</enum><header>Requirements</header><text>In carrying out the pilot program, the Secretaries shall—</text><subparagraph id="id19ce4c5202484e02b0008de830eca1e5"><enum>(A)</enum><text>identify—</text><clause id="idDF06B676C66E4D5CA551F72F66CB7D57"><enum>(i)</enum><text>a standard set of practices to study, such as carbon beneficial practices, that support conservation and grazing goals, including—</text><subclause id="id1D17DDAF3C0D4C2E9A230A01448FE989"><enum>(I)</enum><text>ecologically appropriate silvopasture;</text></subclause><subclause id="id073168BB3EAA498D82357DD93FC83E28"><enum>(II)</enum><text>practices that provide wildlife habitat benefits;</text></subclause><subclause id="idee11a51e4f664d059626c37fa7a4a111" commented="no"><enum>(III)</enum><text>practices that consider flexibility in season of use;</text></subclause><subclause id="idF1073CCCFEAD4EE49CB5D4E3EE28602F"><enum>(IV)</enum><text>forage and biomass management;</text></subclause><subclause id="id7FF3E9E866D9414FA2E59358FAA99CE7"><enum>(V)</enum><text>planned grazing; and </text></subclause><subclause id="id2BF5A3075C3A4C13A53CC396753C52CA"><enum>(VI)</enum><text>range monitoring; and</text></subclause></clause><clause id="idc49303472f4f4422af894b2c48b9c2d2"><enum>(ii)</enum><text>sufficient grazing allotments on a diverse mixture of ecosystems to identify whether, and the extent to which, grazing is an effective tool to mitigate effects of climate change, including the ability—</text><subclause id="idb6e6dcfc5785408ab4fb80d82151641b"><enum>(I)</enum><text>to improve soil health;</text></subclause><subclause id="id84a9af66116042cc9fa71ccd0f479b9b"><enum>(II)</enum><text>to increase carbon sequestration;</text></subclause><subclause id="idd1fa308df5f8450fb41380571cd2ab46"><enum>(III)</enum><text>to reduce wildfire risk; and</text></subclause><subclause id="id8586a71dd28a40c09c9b3dea30af781d"><enum>(IV)</enum><text>to improve watershed resilience and biodiversity; and</text></subclause></clause></subparagraph><subparagraph id="id0198d71dc4ed47bd81ed1c07b7d61727"><enum>(B)</enum><text>in developing, implementing, and monitoring the pilot program, consult with—</text><clause id="id14e2412935de441680f997e327535a47"><enum>(i)</enum><text>the Chief of the Forest Service;</text></clause><clause id="id30ccfec20a9840f4ab9403004c1d6449"><enum>(ii)</enum><text>the Director of the Bureau of Land Management; </text></clause><clause id="id6b6898e6262b4f60abaeac33aca671b3"><enum>(iii)</enum><text>the Administrator of the Agricultural Research Service;</text></clause><clause id="id30301f36bb0141689b65c9f0289a04e8"><enum>(iv)</enum><text>the Chief of the Natural Resources Conservation Service;</text></clause><clause id="id392ea2df01194e54b56acdb676ed14fd"><enum>(v)</enum><text>the Director of the United States Geological Survey; </text></clause><clause id="id32a8fc80189b44a6a1d5a57907e3bf08"><enum>(vi)</enum><text>ranchers and representatives of the ranching industry; </text></clause><clause id="id75bd3809463a49048c1cecad55b46601" commented="no"><enum>(vii)</enum><text>representatives from grazing districts, associations, boards, or councils;</text></clause><clause id="id8f6ac8726767422aa759bf1505a37272"><enum>(viii)</enum><text>environmental and conservation nongovernmental organizations;</text></clause><clause id="ideb3259e1ff674919850bde05c96cc58c"><enum>(ix)</enum><text>institutions of higher education; and</text></clause><clause id="ide515a171f693484598ffc0e7d348247c"><enum>(x)</enum><text>any other Federal or State agency, academic institution, or organization that the Secretaries determine to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="id3042B1E6D7D84EAF882201A93C4DDA1F" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Funds made available to carry out the pilot program may be used for—</text><subparagraph commented="no" display-inline="no-display-inline" id="idE243306ABA8E43F79956351A7292BD95"><enum>(A)</enum><text display-inline="yes-display-inline">the conduct of research activities; </text></subparagraph><subparagraph id="idaa74665d149d481593865b0477c1f57a"><enum>(B)</enum><text>the provision of technical assistance to permittees; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id49E322E30C8049249050BDB8F5DB0FC6"><enum>(C)</enum><text display-inline="yes-display-inline">the construction of infrastructure necessary for implementing and analyzing regenerative grazing. </text></subparagraph></paragraph><paragraph id="idd02750575cdc49fabe069b9362bc22fc"><enum>(4)</enum><header>Report to Congress</header><text>Not later than 180 days after the date on which the Secretaries determine that a sufficient quantity of data has been collected under the pilot program, the Secretaries shall submit to the Committee on Energy and Natural Resources and the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Natural Resources and the Committee on Agriculture of the House of Representatives, and make publicly available on the websites of the Department of Agriculture and the Department of the Interior, a report on the findings and data derived from the pilot program, including whether and the extent to which the use of regenerative grazing improved the ability to mitigate the impacts of climate change. </text></paragraph></subsection></section><section id="id00CE565A5E2C4865AFE03A0237463ECD"><enum>11.</enum><header>Report to Congress</header><text display-inline="no-display-inline">The Director shall submit to Congress, and make publicly available, an annual report on the implementation of this Act, which shall include an annual assessment of the status of grasslands conservation projects, including an accounting of expenditures by Federal, State, and other entities.</text></section><section id="id984468767A764CB2B2F4CE0D061A69B2"><enum>12.</enum><header>Authorization of appropriations</header><subsection id="id005DEF1037524E658B48A33EA78C502A"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated—</text><paragraph id="id638490B6FA584E5EB8308270E803C9FA"><enum>(1)</enum><text>to the Director to carry out the program, $290,000,000 for each of fiscal years 2022 through 2026, to remain available until expended;</text></paragraph><paragraph id="idCECF9C7DC7A94A3E967161084BE8C5E6" commented="no"><enum>(2)</enum><text>to carry out section 5, $1,000,000 for each of fiscal years 2022 through 2026, to remain available until expended;</text></paragraph><paragraph id="id635222451D2D4013B294C08A43DA7DEE"><enum>(3)</enum><text>to the Secretary of Agriculture to carry out section 9, $1,000,000 for each of fiscal years 2022 through 2025, to remain available until expended; and</text></paragraph><paragraph id="id9BB31059FB3B46CE9DA7D2DC5B2B63AA"><enum>(4)</enum><text>to carry out section 10, $10,000,000 for each of fiscal years 2022 through 2024, to remain available until expended.</text></paragraph></subsection><subsection id="idCC0DFF0498A04BBF9B51E2EBA5FAA8CE" commented="no"><enum>(b)</enum><header>Administrative costs for the Council and program</header><text>Of the amounts made available under subsection (a)(2), not more than 10 percent may be used for administrative costs relating to the Council and the program.</text></subsection><subsection commented="no" id="id4C1E115585764561B6FAB2D3E6818459"><enum>(c)</enum><header>Limitation</header><text>None of the funds made available under this section may be used for species or habitat mitigation under any Federal law.</text></subsection></section></legis-body></bill>
