which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to clarify the meaning of the term <quote>frivolous application</quote> with respect to asylum claims, and for other purposes.</official-title></form><legis-body><section id="id7c26cbf6f9a2425482861fed871a201f" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Asylum Integrity Act</short-title></quote>.</text></section><section id="id3df975fda8914a4299fa9537ef7b3927"><enum>2.</enum><header>Clarification with respect to frivolous asylum applications</header><text display-inline="no-display-inline">Section 208(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(d)</external-xref>) is amended—</text><paragraph id="id14D9DA1B47974FB0910DF4340C162701"><enum>(1)</enum><text>in paragraph (4), in the matter preceding subparagraph (A), by inserting <quote>the Secretary of Homeland Security or</quote> before <quote>the Attorney General</quote>; and</text></paragraph><paragraph id="idDA08B5BA473D45EE973501AD50443B60"><enum>(2)</enum><text>by amending paragraph (6)—</text><subparagraph id="id9204AF17402C45C3BAC3985EEED0F528"><enum>(A)</enum><text>by striking <quote>If the Attorney General determines that an alien has knowingly</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4AAD14C4EB6C4DE5B727F4567D90C5EE"><subparagraph id="id963E0F4FE8AE4A3898E80BFB632140C8"><enum>(A)</enum><header>In general</header><text>If the Secretary of Homeland Security or the Attorney General determines that an alien has</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id74C7CF1613F9417FB8A8775F0803CEA4"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3FC89CEDA19F40B4B9EA1F5A9E71208A"><subparagraph id="id079529c3f70346e3971f550b93f8cb40"><enum>(B)</enum><header>Determination</header><clause id="id6E7A698B0B3F48EA8C0A06499633140F"><enum>(i)</enum><header>In general</header><text>For purposes of this paragraph, a frivolous application is an application for asylum that the Secretary of Homeland Security or the Attorney General determines—</text><subclause id="idB77B91F1D24844F5A976164DEB124F7D"><enum>(I)</enum><text>has been made knowingly by the applicant; and</text></subclause><subclause id="id76DC56A8320F4DC4B494D2ACCBECA394"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id93B50C8F6B8E42FE8765F86AED15B1A4"><enum>(aa)</enum><text>includes a fabricated material element; </text></item><item indent="up1" id="id158312BD276B483FA6530F631A3AFC89"><enum>(bb)</enum><text>is premised on false or fabricated evidence; </text></item><item indent="up1" id="id8BF94C43D7324005B5BC707CF17B119C"><enum>(cc)</enum><text>was filed without regard to the merits of the claim; or </text></item><item indent="up1" id="id1A73991E3C4C44B6BEAE84DB1AE7FAEF"><enum>(dd)</enum><text>is clearly foreclosed by applicable law.</text></item></subclause></clause><clause id="id4C31342432D642C1AD222F6607BEF0F8"><enum>(ii)</enum><header>Effect of finding</header><text>For purposes of this section, a finding that an alien has filed a frivolous asylum application shall not preclude the alien from seeking withholding of removal under section 241(b)(3) of protection pursuant to the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, done at New York December 10, 1984.</text></clause><clause id="id9041BF6285DE4363A2C1D93EE86B67A8"><enum>(iii)</enum><header>Findings by asylum officers</header><text>In adjudicating an affirmative asylum application, if an asylum officer determines that the application is described in subclauses (I) and (II) of clause (i), the asylum officer may—</text><subclause id="id85F168A7AD23454AB421024BEA49FE6C"><enum>(I)</enum><text>make a finding that the application is a frivolous application; and</text></subclause><subclause id="idAC069DFEBCA845F9BCD9CC152FA24609"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id16D7DAC7BDD34B9386E46677C7607E45"><enum>(aa)</enum><text>in the case of an applicant who is not in lawful status, refer the application to an immigration judge; or</text></item><item id="id4D8154B01F0F49B29573440840536687" indent="up1"><enum>(bb)</enum><text>in the case of an applicant who is in lawful status, deny the application.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
