Secretary of Energy to administer polygraph examinations to certain foreign nationals with access to nonpublic areas or information of the National Laboratories.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Polygraph examinations for certain foreign nationals with access to nonpublic National Laboratory areas or information</header><subsection id="id003522680B0E4F348C0A501C64CBE115"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idD8F5076B0628429FA93CF1015F3B656F"><enum>(1)</enum><header>Covered foreign national</header><subparagraph id="id4DC8FD8B63504A749C4702F4E909503D"><enum>(A)</enum><header>In general</header><text>The term <term>covered foreign national</term> means a foreign national who—</text><clause id="id00908F56BDFB4C5C86D32726448958A6"><enum>(i)</enum><text>is a citizen or national of, or otherwise owes allegiance to, a country that, as of the date described in subparagraph (B), is designated as a country of particular concern under section 402 of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6442">22 U.S.C. 6442</external-xref>); and</text></clause><clause id="id703A97E842654E788E22148FD622ADA2"><enum>(ii)</enum><text>is not—</text><subclause id="id2B1CC6C3649F41A2AAB61C6C89948ACC"><enum>(I)</enum><text>a national of the United States; or </text></subclause><subclause id="idEAC2CB9A45D84F258168E0A935025904"><enum>(II)</enum><text>lawfully admitted for permanent residence.</text></subclause></clause></subparagraph><subparagraph id="id165AEC40E6AE4DC8BEB3B68B78AF565E"><enum>(B)</enum><header>Date described</header><text>The date referred to in subparagraph (A)(i) is, as applicable—</text><clause id="idD79750EA501F4D79B6840C23BC8052AE"><enum>(i)</enum><text>the date on which the foreign national begins work—</text><subclause id="id28AFDBCE0A5440B894E0B21CAB62B566"><enum>(I)</enum><text>in a position at a National Laboratory; or </text></subclause><subclause id="idB84361F8DA934EE2AA5D03C4AF87AEEA"><enum>(II)</enum><text>in any other position at the Department in which the foreign national will have access to nonpublic areas, data, or information of a National Laboratory; or </text></subclause></clause><clause id="idCEFBF8D17F014E27A3A81B46A7D95F98"><enum>(ii)</enum><text>the date on which the foreign national is initially granted access to nonpublic areas, data, or information of a National Laboratory under a contract or agreement with the Department.</text></clause></subparagraph></paragraph><paragraph id="id44082839FB504F42962FED3790C88BA2"><enum>(2)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Energy.</text></paragraph><paragraph id="id4ED68AD507A44AF39F4C85F2F1914025"><enum>(3)</enum><header>Lawfully admitted for permanent residence</header><text>The term <term>lawfully admitted for permanent residence</term> has the meaning given the term in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>).</text></paragraph><paragraph id="id3DBFA3B086F240A7A5128DD51A3DE9D3"><enum>(4)</enum><header>National of the United States</header><text>The term <term>national of the United States</term> has the meaning given the term in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>).</text></paragraph><paragraph id="id8B6AB12B7A7A4BABB8AAED81C5365225"><enum>(5)</enum><header>National Laboratory</header><text>The term <term>National Laboratory</term> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text></paragraph><paragraph id="id836A7613A81040C8B8950E238921F4F7"><enum>(6)</enum><header>Qualifying polygraph examination</header><text>The term <term>qualifying polygraph examination</term> means a polygraph examination that is carried out in a manner that, as determined by the Secretary, is consistent with Intelligence Community Policy Guidance 704.6 published by the Director of National Intelligence and entitled <quote>Conduct of Polygraph Examinations for Personnel Security Vetting</quote> (or successor guidance).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id448A4BDB8AB14164A293FE5BE242EDFA"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy, acting through the Director of the Office of Intelligence and Counterintelligence.</text></paragraph></subsection><subsection id="idD9FAE104C5B0457ABA2EC9EE053D776C"><enum>(b)</enum><header>Qualifying polygraph examinations</header><paragraph id="idFACA296633D6492289760EE1677BB4B8"><enum>(1)</enum><header>Potential employees of the Department</header><text>Before a covered foreign national is hired by the Department to work in a position at a National Laboratory or in any position in which the covered foreign national will have access to nonpublic areas, data, or information of a National Laboratory, the Secretary shall administer a qualifying polygraph examination to the covered foreign national.</text></paragraph><paragraph id="id1363509CB35245ADB29E187B68FF5ABF"><enum>(2)</enum><header>Existing employees of the Department</header><subparagraph id="id566BF530F10446E7B8655663D57D7D91"><enum>(A)</enum><header>In general</header><text>Before an employee of the Department who is a covered foreign national may be transferred to a position at a National Laboratory or to any other position at the Department in which the employee will have access to nonpublic areas, data, or information of a National Laboratory, the Secretary shall administer a qualifying polygraph examination to the employee.</text></subparagraph><subparagraph id="id967CADB9A1804CCDA32653CB8094B2D0"><enum>(B)</enum><header>Certain existing employees with access to nonpublic information</header><clause id="id2684A2B12B314A33ABC08CAEBFFF2D12"><enum>(i)</enum><header>Existing employees who are covered foreign nationals</header><text>Each employee of the Department who, as of the date of enactment of this Act, is a covered foreign national who works in a position at a National Laboratory or in any other position at the Department in which the employee has access to nonpublic areas, data, or information of a National Laboratory shall be required to submit to a qualifying polygraph examination by a date determined by the Secretary, but not later than 1 year after the date of enactment of this Act, to remain in that position.</text></clause><clause id="id251402895B4B423EA2164E45ECBC18E9"><enum>(ii)</enum><header>Existing employees who become covered foreign nationals</header><text>An employee of the Department who works in a position at a National Laboratory or in any other position at the Department in which the employee has access to nonpublic areas, data, or information of a National Laboratory shall be required to submit to a qualifying polygraph examination—</text><subclause id="id7D01F93C4C20472D914905A76D88DC2E"><enum>(I)</enum><text>as soon as practicable after becoming a covered foreign national; and</text></subclause><subclause id="id8DE5DB2EEED04E30AE581BFCC4FC6831"><enum>(II)</enum><text>before being transferred, promoted, or otherwise hired into another position at the Department in which the employee will have access to nonpublic areas, data, or information of a National Laboratory if the employee is a covered foreign national as of the date of the transfer, promotion, or hiring.</text></subclause></clause></subparagraph></paragraph><paragraph id="id29F38B6BC16B44618179C4E5DB9F2ADC"><enum>(3)</enum><header>Contractors and other individuals with access to nonpublic information</header><text>Before a covered foreign national is initially granted access to nonpublic areas, data, or information of a National Laboratory under a contract or agreement with the Department, the Secretary shall administer a qualifying polygraph examination to the covered foreign national.</text></paragraph></subsection><subsection id="id67AF1C5D6D794331914D4475DDAD4C23"><enum>(c)</enum><header>Specific Issue Polygraph examinations</header><text>The Secretary may require a covered foreign national to submit to a Specific Issue Polygraph examination (within the meaning of Intelligence Community Policy Guidance 704.6 published by the Director of National Intelligence and entitled <quote>Conduct of Polygraph Examinations for Personnel Security Vetting</quote> (or successor guidance)) at any time during which the covered foreign national is employed by the Department.</text></subsection><subsection id="idF082D5EF927942ED87A0555BB93566B5"><enum>(d)</enum><header>Reexamination</header><text>The Secretary shall require each employee of the Department who is a covered foreign national to be reexamined with an appropriate polygraph examination—</text><paragraph id="id38B13944D03247EDB6830E8FEF86666C"><enum>(1)</enum><text>not less frequently than once every 5 years while employed by the Department; and</text></paragraph><paragraph id="id853822CC18804AEB82C1E44C7D6DD4CE"><enum>(2)</enum><text>in a manner consistent with other members of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)) that require reexamination every 5 years.</text></paragraph></subsection><subsection id="id49D31445900A4BDBA610B7DFC2C71D11"><enum>(e)</enum><header>Refusal of examination; termination of employment</header><paragraph id="id461EA4834286484E807814DE7F20F2FB" commented="no"><enum>(1)</enum><header>In general</header><text>If a covered foreign national refuses to submit to a polygraph examination under this section—</text><subparagraph commented="no" id="id13FBAFB304FC4AA5BE2A2253717AC2EF"><enum>(A)</enum><text>the covered foreign national shall not be granted access to any nonpublic areas, data, or information of a National Laboratory, and any existing grant of access to such areas, data, or information shall be immediately revoked; and</text></subparagraph><subparagraph commented="no" id="idD0E694767D5748378B5ECC277879C0EA"><enum>(B)</enum><text>if the covered foreign national is an employee of the Department, the employment of the covered foreign national at the Department shall be terminated.</text></subparagraph></paragraph><paragraph commented="no" id="idAC2A291295394D8DBE146F004CCB843A"><enum>(2)</enum><header>Certain employees of the Department</header><subparagraph id="id85871DAEF7EC499E83951E123797626C" commented="no"><enum>(A)</enum><header>Employees under consideration for transfer to certain positions</header><text>Paragraph (1)(B) shall apply to an employee of the Department described in subsection (b)(2)(A) who does not have access to nonpublic areas, data, or information of the Department but is under consideration for a transfer to a position described in that paragraph such that, if the employee refuses to submit to a polygraph examination under this section—</text><clause commented="no" id="idF2862428FA334508B77C11684C356904"><enum>(i)</enum><text>the employee shall be ineligible for the transfer; and</text></clause><clause commented="no" id="id1A9C4B75E8294537965CAC7FC0AADE3A"><enum>(ii)</enum><text>the employment of the employee at the Department shall be terminated.</text></clause></subparagraph><subparagraph id="id3F7EC58C7B3145DAB8602DAB872D6005"><enum>(B)</enum><header>Employees with access to nonpublic areas or information</header><text>Paragraph (1)(B) shall apply to any employee of the Department who is a covered foreign national and works in a position at a National Laboratory or in any other position at the Department in which the employee has access to nonpublic areas, data, or information of a National Laboratory such that, if the employee refuses to submit to a polygraph examination under this section, the employment of the employee at the Department, including at any National Laboratory, shall be terminated.</text></subparagraph></paragraph><paragraph id="idE5A10172A7D8404F8091C01EC7FE4239"><enum>(3)</enum><header>Potential employees of the Department</header><text>A covered foreign national who is under consideration for employment in a position described in subsection (b)(1) and refuses to submit to a polygraph examination under this section—</text><subparagraph id="idEA2E97D0B0B04BA1A02B4A39B29A5CE1"><enum>(A)</enum><text>shall be removed from consideration for employment in that position; and</text></subparagraph><subparagraph id="idA6AD63A246474E8686869F79D1D1CA94" commented="no"><enum>(B)</enum><text>in accordance with paragraph (4), shall not be eligible for employment at the Department, including at any National Laboratory.</text></subparagraph></paragraph><paragraph id="id4211A6BEA0074E4C8A29B291C2DC1C04" commented="no"><enum>(4)</enum><header>Subsequent employment at the Department</header><subparagraph commented="no" id="id25C53CA39B5D4F3982F212A2F1A1CA0B"><enum>(A)</enum><header>In general</header><text>A covered foreign national shall not be eligible for employment at the Department, including at any National Laboratory, if the covered foreign national previously refused to submit to a polygraph examination under this section.</text></subparagraph><subparagraph commented="no" id="id620A32DAB42F4853977054EC66753A20"><enum>(B)</enum><header>Change in status</header><text>A foreign national who is lawfully admitted for permanent residence shall not be eligible for employment at the Department, including at any National Laboratory, if the foreign national previously refused to submit to a polygraph examination under this section at a time when the foreign national was a covered foreign national.</text></subparagraph></paragraph></subsection><subsection id="id93FEDF640A174040930AF80E33C2A612" commented="no"><enum>(f)</enum><header>Savings provision</header><text>Nothing in this section authorizes the Secretary to require an individual who is not a covered foreign national to submit to a polygraph examination.</text></subsection></section></legis-body></bill>
