which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve certain criminal provisions.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Combating Violent and Dangerous Crime Act</short-title></quote>.</text></section><section id="idc2ada6ef58ea4b77bb7f341c44e960a5"><enum>2.</enum><header>Bank robbery and related crimes</header><text display-inline="no-display-inline">Section 2113 of title 18, United States Code, is amended—</text><paragraph id="ide52b6bca069b47adac53d0de2dda80f8"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id13865710bca34cd2bb36bd73f9f16c61"><enum>(A)</enum><text>by striking <quote>, or attempts to take,</quote>;</text></subparagraph><subparagraph id="idd337765961c84f9180ed5b4a0fccf11a"><enum>(B)</enum><text>by striking <quote>or attempts to obtain</quote>; and</text></subparagraph><subparagraph id="id09955822ba874ca386f8a17e2ac81e4d"><enum>(C)</enum><text>by inserting before <quote>; or</quote> the following: <quote>, or attempts to do so</quote>;</text></subparagraph></paragraph><paragraph id="idf655a05dbaa24dd6b85d0b249a5a23db"><enum>(2)</enum><text>by redesignating subsections (f), (g), and (h) as subsections (g), (h), and (i), respectively; and</text></paragraph><paragraph id="id27942f7c88c948048f368a6734802115"><enum>(3)</enum><text>by inserting after subsection (e) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide537084cda4648edbbfbafee8ce79c03"><subsection id="idfa1d20a18682407da7810c7654bbd3d9"><enum>(f)</enum><text>Whoever conspires to commit any offense under this section shall be subject to the same penalties as those prescribed for the offense the commission of which was the object of the conspiracy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id4D4F15244C1945E0A7330F1B24AA49E5"><enum>3.</enum><header>Homicide offenses</header><subsection id="id1E2D39B721344EC0A5D93F41FE6562BD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/51">Chapter 51</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idE2C8B0C2676749338C0597C661A3BC62"><section id="id4C043DF20EBF4396A94647945B338756"><enum>1123.</enum><header>No maximum time period between act or omission and death of victim</header><text display-inline="no-display-inline">A prosecution may be instituted for any homicide offense under the laws of the United States without regard to the time that elapsed between—</text><paragraph id="id3E2224232121404DBA7886224189EF58"><enum>(1)</enum><text display-inline="yes-display-inline">the act or omission that caused the death of the victim; and</text></paragraph><paragraph id="idA193F7360F90437D9FF022178870E8A4"><enum>(2)</enum><text display-inline="yes-display-inline">the death of the victim.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idBDD13FDA8C7044C6B9C8110954DB05CD"><enum>(b)</enum><header>Table of contents</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/51">chapter 51</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8FAFFB6E52114FEE89B83CC852D0C60B"><toc><toc-entry level="section" bold="off">1123. No maximum time period between act or omission and death of victim.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id6DFF905C9FDA4B4185CCF9B0BFCFD3D1"><enum>4.</enum><header>Protection of officers and employees of the United States</header><subsection id="ida87aa26d2b554ecca5b295d6e6f7d95d"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline"> Congress finds the following:</text><paragraph id="ide1db400cd1f246c0a7f7bca8b4689d31"><enum>(1)</enum><text>Officers and employees of the United States Government dutifully and faithfully serve the United States, often placing themselves at serious risk of death or bodily harm, in order to preserve, protect, and defend the interests of the United States.</text></paragraph><paragraph id="id4b17bb141e3c4a7ba9e8e3770ae57918"><enum>(2)</enum><text>In prohibiting the assaulting, resisting, or impeding of officers and employees of the United States Government, Congress intended to maximize protection for Federal officers and employees and ensure that individuals who kill or assault Federal officers or employees are prosecuted.</text></paragraph><paragraph id="idc3a8287c9fee48e49fa186866ed773cd"><enum>(3)</enum><text>The United States Court of Appeals for the Sixth Circuit analyzed section 111 of title 18, United States Code, correctly when it found, <quote>Categorizing § 111(a)(1) as a general intent crime furthers the congressional objective: <quote>If a person acts in a manner which is assaultive toward a federal official, without specifically intending harm or the apprehension of imminent harm, the official still would be impeded in the performance of his official duties.</quote></quote> United States v. Kimes, 246 F.3d 800, 809 (6th Cir. 2001), quoting United States v. Jennings, 855 F. Supp. 1427, 1440 (M.D. Pa. 1994).</text></paragraph><paragraph id="idc2ea9206405e414489648f14f0e24ac6"><enum>(4)</enum><text>Federal courts, including the United States Courts of Appeals for the Second, Fourth, Sixth, Seventh, Eighth, Ninth, and Eleventh Circuits, have correctly interpreted section 111 of title 18, United States Code, to be a crime of general intent rather than a crime of specific intent.</text></paragraph><paragraph id="idad218ef36f9d44d795a14ce1f3f96f8c"><enum>(5)</enum><text>Other Federal courts, including the United States Courts of Appeals for the First, Fifth, and Tenth Circuits, have issued decisions with language arguably suggesting that section 111 of title 18, United States Code, is a crime of specific intent rather than a crime of general intent, creating the appearance of a split among the United States courts of appeals.</text></paragraph><paragraph id="idd319db2b673a495495b1c7a77e153fd4"><enum>(6)</enum><text>In light of the appearance of a split among the United States courts of appeals described in paragraph (5), it has become necessary for Congress to clarify its original intent that section 111 of title 18, United States Code, is a crime of general intent.</text></paragraph></subsection><subsection id="idcebde86ccdb64001817157b377706132"><enum>(b)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 111 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idABEF4F978F0F437B80A7C8B61E436D99"><subsection id="id8e374ab82b3e45a9bc0711ca1032af42"><enum>(d)</enum><header>Knowledge of defendant</header><text>In a prosecution for an offense under subsection (a), the Government need not prove that the defendant—</text><paragraph id="idC74F5A050B3344D592C1200EE2E01F80"><enum>(1)</enum><text>knew that the victim of the offense was a person designated in section 1114 or performed official duties during service as a person so designated; or</text></paragraph><paragraph id="id9ADACCBBFA514F4685FE6EE57F6487D8"><enum>(2)</enum><text>acted with any intent greater than knowledge.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id1D12BDFD294B453A88E9592BB7DBF1A0"><enum>5.</enum><header>Motor vehicles</header><text display-inline="no-display-inline">Section 2119 of title 18, United States Code, is amended—</text><paragraph id="id0CA14357171840649E228366A528D086"><enum>(1)</enum><text>in the matter preceding paragraph (1)—</text><subparagraph id="id90E38A535A554FF182D8312582A43D6D"><enum>(A)</enum><text>by striking <quote>, with the intent to cause death or serious bodily harm</quote>; </text></subparagraph><subparagraph id="id9DB4BBB0901B4A1CBFC5E7A186FF631A"><enum>(B)</enum><text>by inserting a comma after <quote>force and violence</quote>; and</text></subparagraph><subparagraph id="id4B5015B00AF343998AC4BE178E980BC6"><enum>(C)</enum><text>by inserting <quote>or conspires</quote> after <quote>attempts</quote>; </text></subparagraph></paragraph><paragraph id="id0314AF26F7A04B05AC82E81525F1BCB4"><enum>(2)</enum><text>in paragraph (1), by striking <quote>15 years</quote> and inserting <quote>20 years</quote>; </text></paragraph><paragraph id="id82D6C574816B4D10B844685EBC098EB6"><enum>(3)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively;</text></paragraph><paragraph id="id78C16EA0903F471992100C4F472E1145"><enum>(4)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id48EBE2B19A394484A082E6F85E4E0BEE"><paragraph id="id6d9456bcdf8f4eaa81e8e01a2fe9e41c"><enum>(2)</enum><text>if a dangerous weapon or device is used in committing, or in attempting to commit, the offense, be fined under this title or imprisoned not more than 25 years, or both,</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id94E4024428124BA6999D5370CD84159E"><enum>(5)</enum><text>in paragraph (3), as so redesignated, by striking <quote>25 years</quote> and inserting <quote>40 years</quote>.</text></paragraph></section><section id="id1DD98D005AFC48B1A013680686233110"><enum>6.</enum><header>Penalties for firearms offenses</header><text display-inline="no-display-inline">Section 924(c)(3)(B) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBCCB3A2B789E4000978D6D6393FF2895"><subparagraph id="id4c2971c59e914f4290f599ec5abf2109" indent="up1"><enum>(B)</enum><text>is a conspiracy, or an attempt, to commit an offense that has as an element the use, attempted use, or threatened use of physical force against the person or property of another.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id7a51d5d8-5d84-49f3-8396-c029ffa7c571" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Offenses involving candy-flavored controlled substances manufactured or distributed for minors</header><subsection commented="no" display-inline="no-display-inline" id="id12476C06E6CC459AB98FB79B63DEF80B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Part D of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841 et seq.</external-xref>) is amended by inserting after section 418 the following:</text><quoted-block display-inline="no-display-inline" id="idC80CF813DA8E4D2C92EA4567510AC9E4" style="traditional"><section id="id854FCD0FC2B4451E8273C546964553E6"><enum>418a.<?LEXA-Enum 418a.?></enum><header>Manufacturing or distributing candy-flavored controlled substances for minors</header><subsection commented="no" display-inline="yes-display-inline" id="idB20110652CEE4CD6826ED10587A62A15"><enum>(a)</enum><text>Except as provided in subsection (c) and in section 418, 419, or 420, a person shall be subject to the penalty described in subsection (b) if the person violates section 401(a)(1)—</text><paragraph id="id3EACE3171E924CA191CC3119A60867FA"><enum>(1)</enum><text display-inline="yes-display-inline">by manufacturing, creating, distributing, dispensing, or possessing with intent to distribute a controlled substance listed in schedule I or II that is—</text><subparagraph id="id7F366F78DC7F42AF8E262D9588933843"><enum>(A)</enum><text display-inline="yes-display-inline">combined with a candy or beverage product;</text></subparagraph><subparagraph id="id26DD1E3A99074C56A8A86120F0761787"><enum>(B)</enum><text display-inline="yes-display-inline">marketed or packaged to appear similar to a candy or beverage product; or</text></subparagraph><subparagraph id="id9E45D416C5CA459BB6FBA03D473F83FA"><enum>(C)</enum><text display-inline="yes-display-inline">modified by flavoring or coloring to appear similar to a candy or beverage product; and</text></subparagraph></paragraph><paragraph id="id9D1DC3F922BD4ED29C260AE8AA544EC5"><enum>(2)</enum><text display-inline="yes-display-inline">knowing, or having reasonable cause to believe, that the controlled substance will be distributed, dispensed, or sold to a person under 18 years of age.</text></paragraph></subsection><subsection id="idA2DE1AE1EC2248FCB032DDCB8227BA27"><enum>(b)</enum><text display-inline="yes-display-inline">The penalty described in this subsection is—</text><paragraph id="idC93652B144BE4057A0165322182EF127"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of a first offense involving the same controlled substance and schedule, an additional term of imprisonment of not more than 10 years; and</text></paragraph><paragraph id="id72E6C29BF0594FCFAF1EF0D0FD27E4DC"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a second or subsequent offense involving the same controlled substance and schedule, an additional term of imprisonment of not more than 20 years.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id907693c1-a710-4a2b-9469-50351c2d7f78"><enum>(c)</enum><text display-inline="yes-display-inline">Subsection (a) shall not apply to any controlled substance that—</text><paragraph commented="no" display-inline="no-display-inline" id="id8a18c18e-314e-42f0-b2b2-2cf463864704"><enum>(1)</enum><text display-inline="yes-display-inline">has been approved by the Secretary under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>), if the contents, marketing, and packaging of the controlled substance have not been altered from the form approved by the Secretary; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38c39bd0-74ce-4ce8-94f9-0f7b20882720"><enum>(2)</enum><text display-inline="yes-display-inline">has been altered at the direction of a practitioner who is acting for a legitimate medical purpose in the usual course of professional practice.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id1BAC574AE09D4D9FA3655BFFF0C87CE6"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents for the Comprehensive Drug Abuse Prevention and Control Act of 1970 (<external-xref legal-doc="public-law" parsable-cite="pl/91/513">Public Law 91–513</external-xref>; 84 Stat. 1236) is amended by inserting after the item relating to section 418 the following:</text><quoted-block display-inline="no-display-inline" id="id0DB4D6134C0E445DA08C2FD4A38813C4" style="OLC"><toc><toc-entry level="section">Sec. 418a. Manufacturing or distributing candy-flavored controlled substances for minors.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id11CC67331A824A219B666D39228604BC"><enum>(c)</enum><header display-inline="yes-display-inline">Sentencing Guidelines</header><text display-inline="yes-display-inline">Pursuant to its authority under section 994 of title 28, United States Code, and in accordance with this section, the United States Sentencing Commission shall amend and review the Federal sentencing guidelines and policy statements to ensure that the guidelines provide for a penalty enhancement of not less than 2 offense levels for a violation of section 401(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(a)</external-xref>) if the defendant—</text><paragraph id="id22BB5CFC64074AF1ABC38C86123F43C3"><enum>(1)</enum><text display-inline="yes-display-inline">manufactures, creates, distributes, dispenses, or possesses with intent to distribute a controlled substance listed in schedule I or II that is—</text><subparagraph id="id45F2F540E37F4208B78E308C5E3FD171"><enum>(A)</enum><text display-inline="yes-display-inline">combined with a candy or beverage product;</text></subparagraph><subparagraph id="idB9A64394AB97428CB6A43F210CB9D7CB"><enum>(B)</enum><text display-inline="yes-display-inline">marketed or packaged to appear similar to a candy or beverage product; or</text></subparagraph><subparagraph id="idF8E1BEC8E8394AAD897D0FAF124F665F"><enum>(C)</enum><text display-inline="yes-display-inline">modified by flavoring or coloring to appear similar to a candy or beverage product; and</text></subparagraph></paragraph><paragraph id="id5F46FEF65CD240F09C6DDF0461659BEA" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">knows, or has reasonable cause to believe, that the controlled substance will be distributed, dispensed, or sold to a person under 18 years of age.</text></paragraph></subsection></section><section id="id02ac2a3be3e641d981a6f64d6f478e9b"><enum>8.</enum><header>Kidnapping</header><text display-inline="no-display-inline">Section 1201 of title 18, United States Code, is amended—</text><paragraph id="id24ac9f015e074e458be3ded2e1c7c390"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2f3cfe06cc31480bb776db5d0acf9af9"><subsection id="id0a054e3eee3e4ccb9012a444a13a1520"><enum>(a)</enum><header>Kidnapping</header><paragraph id="idd0815d38597d4c068bef49474caa9bc8"><enum>(1)</enum><header>Offense</header><text>Except as provided in paragraph (2), it shall be unlawful for any person, in any circumstance described in paragraph (3), to—</text><subparagraph id="idd5d545298dd6471fb213e0121379d312"><enum>(A)</enum><text>unlawfully—</text><clause id="id1D544C540CD84830BBA609287C48A3B6"><enum>(i)</enum><text>seize, confine, kidnap, abduct, or carry away an individual by—</text><subclause id="id2e25c90edcd146a79ce4c3731285e7f2"><enum>(I)</enum><text>force and violence; or</text></subclause><subclause id="id0f981a54b7824701b2d7fbfbdda45cb1"><enum>(II)</enum><text>intimidation; or</text></subclause></clause><clause id="id91c054b54a9f4893a37603c558484ee6"><enum>(ii)</enum><text>inveigle or decoy an individual; and</text></clause></subparagraph><subparagraph id="id92f136ffab2d40e6b529e8b9d3b5629d"><enum>(B)</enum><text>hold the individual described in subparagraph (A) for ransom, reward, or otherwise.</text></subparagraph></paragraph><paragraph id="id25bfe1ee942948c3abd99a31dab41f6a"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to an act done against a minor by the parent thereof.</text></paragraph><paragraph id="id319beef85f2f481a91093b523f1b33c7"><enum>(3)</enum><header>Circumstances</header><text>A circumstance described in this paragraph is that—</text><subparagraph id="id31460ac688944f13bace5762df64c634"><enum>(A)</enum><text>the individual is willfully transported in interstate or foreign commerce, regardless of whether the individual was alive when transported across a State boundary, or the offender travels in interstate or foreign commerce or uses the mail or any means, facility, or instrumentality of interstate or foreign commerce in committing or in furtherance of the commission of the offense;</text></subparagraph><subparagraph id="ida480aae7126c40bba290b6c259e35e9d"><enum>(B)</enum><text>any such act against the individual is done within the special maritime and territorial jurisdiction of the United States;</text></subparagraph><subparagraph id="idce8c85c97c12454f995a9118761164e9"><enum>(C)</enum><text>any such act against the individual is done within the special aircraft jurisdiction of the United States as defined in section 46501 of title 49;</text></subparagraph><subparagraph id="idc1648396fff348439b7f39fc02dacc1f"><enum>(D)</enum><text>the individual is a foreign official, an internationally protected person, or an official guest as those terms are defined in section 1116(b) of this title; or</text></subparagraph><subparagraph id="id3a14e8b801334b09b860784242d58f75"><enum>(E)</enum><text>the individual is among those officers and employees described in section 1114 of this title and any such act against the individual is done while the individual is engaged in, or on account of, the performance of official duties.</text></subparagraph></paragraph><paragraph id="ide80f62acf2624d7ab5f798821a195473"><enum>(4)</enum><header>Penalty</header><text>Any person who commits a violation under this subsection shall be punished by imprisonment for any term of years or for life and, if the death of any individual results, shall be punished by death or life imprisonment.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="ida648ab95d93b4b8b83df127301fbcb47"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id2cdd0e7d8c5f4c32bb22fdac4d452af2"><enum>(A)</enum><text>by striking <quote>subsection (a)(1), above,</quote> and inserting <quote>subsection (a)(3)(A)</quote>;</text></subparagraph><subparagraph id="ida76c785eb80e4ec6ba36f6390e7e07f3"><enum>(B)</enum><text>by striking <quote>he</quote> and inserting <quote>the victim</quote>; and</text></subparagraph><subparagraph id="id994a0e52ca9747df95ef6118c98df065"><enum>(C)</enum><text>by striking <quote>under this section</quote> and inserting <quote>under this subsection</quote>; and</text></subparagraph></paragraph><paragraph id="idfc1aa6c03b744114b2a96642d482a1cd" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>in subsection (f), by striking <quote>subsection (a)(4)</quote> each place it appears and inserting <quote>subsection (a) with respect to a circumstance described in paragraph (3)(D) of that subsection</quote>. </text></paragraph></section></legis-body></bill>
