GAO report.</toc-entry></toc></subsection><subsection id="id5220C06C0D02481DBC5D134206A481A4"><enum>(c)</enum><header>Purpose</header><text>The purpose of this Act is to ensure access to advertising services from radio and television stations for cannabis-related legitimate businesses and service providers.</text></subsection></section><section id="ida6c454950b5149a8a057597de59b376e"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id20bd164c9edf458aa82915df374afd6b"><enum>(1)</enum><header>Cannabis</header><text>The term <term>cannabis</term> has the meaning given the term <term>marihuana</term> in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph><paragraph id="idb9f2160fc0064aeead6f93efde90eeeb"><enum>(2)</enum><header>Cannabis product</header><text>The term <term>cannabis product</term> means any article that contains cannabis, including an article that is a concentrate, an edible, a tincture, a cannabis-infused product, or a topical.</text></paragraph><paragraph id="id0383d3925a3546679ebe1a21e92d4822"><enum>(3)</enum><header>Cannabis-related legitimate business</header><text>The term <term>cannabis-related legitimate business</term> means a manufacturer, a producer, or any person or company that—</text><subparagraph id="idd3bea721d78046888db1351dbcb792f8"><enum>(A)</enum><text>engages in any activity described in subparagraph (B) pursuant to a law established by a State or political subdivision of a State, as determined by the State or political subdivision; and</text></subparagraph><subparagraph id="id2bedac8acc11413c9f2bf1edb7408936"><enum>(B)</enum><text>participates in any business or organized activity that involves handling cannabis or cannabis products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing cannabis or cannabis products.</text></subparagraph></paragraph><paragraph id="idc0e763d6e5564df393c0c06ace220445"><enum>(4)</enum><header>CBD</header><text>The term <term>CBD</term> means cannabidiol.</text></paragraph><paragraph id="idd9029face8414d76904ca98648a26951" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Hemp</header><text>The term <term>hemp</term> has the meaning given the term in section 297A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639o">7 U.S.C. 1639o</external-xref>).</text></paragraph><paragraph id="ide640a3d308bc49d793dc71af3c709d7a" commented="no"><enum>(6)</enum><header>Indian country</header><text>The term <term>Indian country</term> has the meaning given that term in section 1151 of title 18, United States Code.</text></paragraph><paragraph id="idd73c250b0a0545c4843e029734ed77e9" commented="no"><enum>(7)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>).</text></paragraph><paragraph id="id99c20c199f0d490f9f76709ef9442fc0"><enum>(8)</enum><header>Manufacturer</header><text>The term <term>manufacturer</term> means a person who manufactures, compounds, converts, processes, prepares, or packages cannabis or cannabis products.</text></paragraph><paragraph id="id5497ace3736345a783dec6421815c4e4"><enum>(9)</enum><header>Producer</header><text>The term <term>producer</term> means a person who plants, cultivates, harvests, or in any way facilitates the natural growth of cannabis.</text></paragraph><paragraph id="ida0fb58664d37431e8ad5ab587e1cb8a8"><enum>(10)</enum><header>Service provider</header><text>The term <term>service provider</term>—</text><subparagraph id="id6de30f2401694d46aea125ce393810e9"><enum>(A)</enum><text>means a business, organization, or other person that—</text><clause id="id99588bebbfa84cc89b8bc20b679698c3"><enum>(i)</enum><text>sells goods or services to a cannabis-related legitimate business; or</text></clause><clause id="iddf20ce759b66479db65bc9a07e90a9ba"><enum>(ii)</enum><text>provides any business services, including the sale of advertising, the sale or lease of real or any other property, legal or other licensed services, or any other ancillary service, relating to cannabis; and</text></clause></subparagraph><subparagraph id="idc9d75060d51a48e3b0d2988321938c10"><enum>(B)</enum><text>does not include a business, organization, or other person that participates in any business or organized activity that involves handling cannabis or cannabis products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing cannabis or cannabis products.</text></subparagraph></paragraph><paragraph id="ida10e097fd8c14a3ead6098a73eedcd81"><enum>(11)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the United States.</text></paragraph></section><section id="id6c167ec3aec34d40a8c75718b3de8845"><enum>3.</enum><header>Safety for advertising</header><subsection id="idc6b209f11a0740eeb5305ff92dedd1af"><enum>(a)</enum><header>In general</header><text>The Federal Communications Commission may not—</text><paragraph id="idcc81a9c151f0411d96f69db981589947"><enum>(1)</enum><text>with respect to an authorization relating to a radio or television broadcast station, deny, fail to renew for a full term or condition the authorization, decline to approve an application for authority to assign the authorization or transfer direct or indirect control of the licensee, require an early renewal application, or otherwise impair the authorization, because the station broadcast or otherwise transmitted advertising of a cannabis-related legitimate business or service provider, if the activities of the cannabis-related legitimate business or service provider were, at the time of the broadcast or other transmission of advertising, authorized in the State, political subdivision of a State, or Indian country in which the community of license of the station is located;</text></paragraph><paragraph id="idf5726e9bfdde4ebaaa949843e83d7b65"><enum>(2)</enum><text>commence any proceeding against, issue a notice of apparent liability or inquiry to, or impose a forfeiture penalty on a radio or television broadcast station under title V of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/501">47 U.S.C. 501 et seq.</external-xref>) because the station broadcast or otherwise transmitted advertising of a cannabis-related legitimate business or service provider, if the activities of the cannabis-related legitimate business or service provider were, at the time of the broadcast or other transmission of advertising, authorized in the State, political subdivision of a State, or Indian country in which the community of license of the station is located; or</text></paragraph><paragraph id="idd01f0815d00b4635bfa03caa2bab070a"><enum>(3)</enum><text>deny or designate for hearing any application for an authorization relating to a radio or television broadcast station solely because—</text><subparagraph id="id1f71b8458d344dae9598a75fb95dcb06"><enum>(A)</enum><text>the applicant—</text><clause id="id1bbfc61edde34783aaa6512da097d46b"><enum>(i)</enum><text>is or has been a cannabis-related legitimate business or service provider; or</text></clause><clause id="id85ca10e3897f4cf1a67405a19a6c29c7"><enum>(ii)</enum><text>is an owner, officer, operator, or employee of a cannabis-related legitimate business or service provider; or</text></clause></subparagraph><subparagraph id="id75b863868d6c43ceb2a63fbe1a81f0e3"><enum>(B)</enum><text>an owner, officer, director, or employee of the applicant, any parent entity of the applicant, or the applicant has provided or is providing services, including advertising services, equipment, or other support, for the operation of a cannabis-related legitimate business or service provider.</text></subparagraph></paragraph></subsection><subsection id="id5eed5ec38b634b7dac46789c880f7fb3"><enum>(b)</enum><header>Labeling requirement</header><text>Subsection (a) shall only apply with respect to the advertising of products sold by a cannabis-related legitimate business if—</text><paragraph id="id7E09028503744411A256C1AF3FCF37E4"><enum>(1)</enum><text>the advertisement—</text><subparagraph id="idDAEA176B3B0B4555BE9C368C48F005C2"><enum>(A)</enum><text>contains a disclosure that states, <quote>This product has not been evaluated by the Food and Drug Administration. There may be health risks associated with consumption of this product.</quote>; or</text></subparagraph><subparagraph id="id0D8686196E5C4A268E1FA7CE0C7CB370"><enum>(B)</enum><text>complies with any applicable labeling requirements or other requirements adopted by the Surgeon General or the Food and Drug Administration for advertising of cannabis or cannabis products; and</text></subparagraph></paragraph><paragraph id="id39F360A7555D4B34A4CF28C9BCC31A20"><enum>(2)</enum><text>the advertiser has reliable evidence that not less than 70 percent of the audience for the advertisement is reasonably expected to be not less than 21 years of age, with the burden of proof regarding the expected audience composition lying with the advertiser.</text></paragraph></subsection></section><section id="id6122b7f7c9f14eaab36a64b49e5691ba"><enum>4.</enum><header>Protections for ancillary businesses</header><text display-inline="no-display-inline">For the purposes of sections 1956 and 1957 of title 18, United States Code, section 421 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/862">21 U.S.C. 862</external-xref>), and any other provision of Federal law, the proceeds from a transaction involving activities of a cannabis-related legitimate business or service provider shall not be considered proceeds from an unlawful activity or require the denial of Federal benefits solely because—</text><paragraph id="idb4c14540b1e84bb1bdd69bc46c6b3c89"><enum>(1)</enum><text>the transaction involves proceeds from a cannabis-related legitimate business or service provider; or</text></paragraph><paragraph id="id3226473411c44cceb866c0002ab7e615"><enum>(2)</enum><text>the transaction involves proceeds from—</text><subparagraph id="iddc999fde56a44c93a57c58cbc0a92f40"><enum>(A)</enum><text>cannabis-related activities described in section 2(3)(B) conducted by a cannabis-related legitimate business; or</text></subparagraph><subparagraph id="id52171b611b9a41f18cf616557e5fd6df"><enum>(B)</enum><text>activities described in section 2(10)(A) conducted by a service provider.</text></subparagraph></paragraph></section><section id="id235c01c89d204839a049b57696d1deef"><enum>5.</enum><header>Protections under Federal law</header><text display-inline="no-display-inline">With respect to providing advertising service to a cannabis-related legitimate business (where the cannabis-related legitimate business operates within a State, a political subdivision of a State, or Indian country in which the cultivation, production, manufacture, sale, transportation, display, dispensing, distribution, or purchase of cannabis is allowed pursuant to a law or regulation of the State, the political subdivision, or the Indian Tribe with jurisdiction over the Indian country, respectively) or a service provider (wherever located), a radio or television station licensed to a community within a State, a political subdivision of a State, or Indian country in which the activities of the cannabis-related legitimate business promoted in the advertising service are allowed, a depository institution, insurer, or other entity that provides a financial or other service to such a radio or television station providing advertising service to a cannabis-related legitimate business or service provider, and the officers, directors, and employees of such radio or television station, depository institution, insurer, or other entity may not be held liable pursuant to any Federal law or regulation, including subsection (b) or (c) of section 403 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/843">21 U.S.C. 843</external-xref>)—</text><paragraph id="idcb48a71c01074aa6a9cf16c42ad297bd"><enum>(1)</enum><text>solely for providing such advertising service or related financial or other service; or</text></paragraph><paragraph id="id9a2ae8d04cbc4ccabb9d24f7f0969f1e"><enum>(2)</enum><text>for further investing any income derived from such advertising service or related financial or other service.</text></paragraph></section><section id="idd6984165717049598e2b42514b3bfb58"><enum>6.</enum><header>Application of this Act with respect to hemp-related legitimate businesses and hemp-related service providers</header><subsection id="id8694bbefd5214849a5d6a6e0b29ff583"><enum>(a)</enum><header>In general</header><text>This Act shall apply with respect to a hemp-related legitimate business or hemp-related service provider in the same manner as the Act applies with respect to a cannabis-related legitimate business or service provider.</text></subsection><subsection id="idef3c88818f0044ff8f35b84f74dd6376"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id29b585d32cc84911832108979a56bc6b"><enum>(1)</enum><header>Hemp-related legitimate business</header><text>The term <term>hemp-related legitimate business</term> means a manufacturer, producer, or any person that—</text><subparagraph id="idea08921987c0447ea3283516eeb502ce"><enum>(A)</enum><text>engages in any activity described in subparagraph (B) in conformity with—</text><clause id="id2BC8D143E2584B3D82C1C9705D060F99"><enum>(i)</enum><text>subtitle G of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639o">7 U.S.C. 1639o et seq.</external-xref>) and the regulations issued to implement that subtitle by the Department of Agriculture, where applicable; and</text></clause><clause id="id036B4F1F678F4C7CBF4DE15D980EB252"><enum>(ii)</enum><text>the applicable law of a State, political subdivision of a State, or Indian Tribe; and</text></clause></subparagraph><subparagraph id="id881974cb6c5d43da9a92a56661f9c34b"><enum>(B)</enum><text>participates in any business or organized activity that involves handling hemp, hemp-derived CBD products, and other hemp-derived cannabinoid products, including cultivating, producing, extracting, manufacturing, selling, transporting, displaying, dispensing, or purchasing hemp, hemp-derived CBD products, and other hemp-derived cannabinoid products.</text></subparagraph></paragraph><paragraph id="id0fef984a12394670adda363772c878eb"><enum>(2)</enum><header>Hemp-related service provider</header><text>The term <term>hemp-related service provider</term>—</text><subparagraph id="id60cf02b809cf4dbd85317f462b443058"><enum>(A)</enum><text>means a business, organization, or other person that—</text><clause id="id0f9a7eb65e774f9da421407d1b32399e"><enum>(i)</enum><text>sells goods or services to a hemp-related legitimate business; or</text></clause><clause id="id8ad8f5ffd4724756a20b4a0e8cb65b00"><enum>(ii)</enum><text>provides any business services, including the sale of advertising, the sale or lease of real or any other property, legal or other licensed services, or any other ancillary service, relating to hemp, hemp-derived CBD products, or other hemp-derived cannabinoid products; and</text></clause></subparagraph><subparagraph id="id0dee664f8e454153911b947ff2321484"><enum>(B)</enum><text>does not include a business, organization, or other person that participates in any business or organized activity that involves handling hemp, hemp-derived CBD products, or other hemp-derived cannabinoid products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing hemp, hemp-derived CBD products, and other hemp-derived cannabinoid products.</text></subparagraph></paragraph></subsection></section><section id="id884a3fc75a5f4f2498dbc3b8d475922d"><enum>7.</enum><header>GAO report</header><subsection id="id1BE0D10E3D8A45B09833822517DD1F6D"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id1ce5a0111d4f480a98ae4c624a46bbf7"><enum>(1)</enum><text>the term <term>small business concern</term> has the meaning given the term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>); and</text></paragraph><paragraph id="id53dff05338744effbc084a5a655239df"><enum>(2)</enum><text>the term <term>socially and economically disadvantaged individual</term> has the meaning given the term in section 8(d) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)</external-xref>) and relevant subcontracting regulations prescribed under such section 8(d), except that women are presumed to be socially and economically disadvantaged.</text></paragraph></subsection><subsection id="id96FEDF37D64949FE88FCE6F8E8093D56"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall—</text><paragraph id="id0FC75265C23F4ABBAB8795812355CF9E"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a study of cannabis-related legitimate businesses that—</text><subparagraph id="id403BC050CD304D58941FBF87032EF737"><enum>(A)</enum><text display-inline="yes-display-inline">are small business concerns; or</text></subparagraph><subparagraph id="idF69D0231624643E288447232721FBBAF"><enum>(B)</enum><text display-inline="yes-display-inline">are owned by a socially and economically disadvantaged individual; and</text></subparagraph></paragraph><paragraph id="id8E57B90D3AEC4321B126E1004BF01FAE"><enum>(2)</enum><text display-inline="yes-display-inline">submit a report on the results of the study conducted under paragraph (1) to Congress.</text></paragraph></subsection><subsection id="idB6A5F49DE7574E4F9E3D1C71807CE7A4"><enum>(c)</enum><header>Contents</header><text display-inline="yes-display-inline">The report submitted under subsection (b) shall include— </text><paragraph id="idd8e79b412e974166ae85d8f37078aa7d"><enum>(1)</enum><text>an evaluation of whether cannabis-related legitimate businesses that are small business concerns or are owned by a socially and economically disadvantaged individual face systemic barriers to access service providers compared to other cannabis-related legitimate businesses; and</text></paragraph><paragraph id="id8ed05059e6554eb48ce03bf8b312f7ec"><enum>(2)</enum><text>recommendations to Congress to facilitate the access of cannabis-related legitimate businesses to service providers, particularly cannabis-related legitimate businesses that—</text><subparagraph id="id8625B10EB78347E5AAF19626B0DFB6F3"><enum>(A)</enum><text display-inline="yes-display-inline">are small business concerns; or</text></subparagraph><subparagraph id="id0A8F234B005D406E85D9FFE472AC098F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">are owned by a socially and economically disadvantaged individual.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
