which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To promote low-carbon, high-octane fuels, to protect public health, and to improve vehicle efficiency and performance, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6282FDE263524FE29D4B3F053B1316D0"><section section-type="section-one" id="H246866B209424ADDAC5163BCB98742B9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Next Generation Fuels Act of 2022</short-title></quote>.</text></section><section id="H5CB3B08482C2490199DE1820D069C276"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="H74DE36CCE44049689E145D26ABBFFFFD"><enum>(1)</enum><text>continued increases in new automobile efficiency are needed to improve consumer welfare and reduce carbon emissions;</text></paragraph><paragraph id="H03D12FCBE0F9453D9C737F40C35FB47F"><enum>(2)</enum><text>the widespread availability of low-carbon, high-octane fuel will allow continued cost-effective improvements in automobile efficiency by enabling increased engine compression ratios;</text></paragraph><paragraph id="H06FAD50780A0437EA771B20D88370EBB"><enum>(3)</enum><text>high-octane automobiles and low-carbon fuels are readily available to consumers at little incremental cost;</text></paragraph><paragraph id="HFE042B5E6CA7412D82DA9D66C96A41FA"><enum>(4)</enum><text display-inline="yes-display-inline">ethanol is a cost-effective and low-carbon octane enhancer;</text></paragraph><paragraph id="HAD730B1B77544529A94258A45C61E786"><enum>(5)</enum><text display-inline="yes-display-inline">the widespread adoption of climate-smart practices and precision technologies by United States corn producers over the past decade have further reduced the carbon intensity of conventional ethanol;</text></paragraph><paragraph id="H7CE4CA65D0254C6E8090B58F557FB27B"><enum>(6)</enum><text>on average, ethanol has been estimated to have lifecycle greenhouse gas emissions that are 46 percent lower than average gasoline, with some corn ethanol achieving a 61-percent reduction compared to gasoline; and</text></paragraph><paragraph id="H20B976D9D2A546E681CF5B19C26E086A"><enum>(7)</enum><text>ethanol has one of the highest blending octane values available in the marketplace.</text></paragraph></section><section id="H5929032FBC1D40779E8E9E4E3454A38A"><enum>3.</enum><header>High-octane vehicles</header><text display-inline="no-display-inline">Title II of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H7EF2E7788C514EFFACFC6E9E08632CC1"><part id="HAC2D75BCF4314D74B52EA8EAF7D9DCD6"><enum>D</enum><header>High-Octane Vehicles</header><section id="HF2288DEF0BB24853B79FA7F78375EF38"><enum>261.</enum><header>Definitions; applicability</header><subsection id="H03DCA69F58B942EC96E2E9A8104D35EB"><enum>(a)</enum><header>Definitions</header><text>In this part:</text><paragraph id="H74D995707DF34FE58F2A4D5DB7E48CD0"><enum>(1)</enum><header>Automobile</header><text display-inline="yes-display-inline">The term <term>automobile</term> has the meaning given to the term in section 32901(a)(3) of title 49, United States Code.</text></paragraph><paragraph id="H01D890272498400B81A491EEC1D02CF1"><enum>(2)</enum><header>Manufacturer</header><text>The term <term>manufacturer</term> has the meaning given the term in section 216.</text></paragraph><paragraph id="HD861C5E866D64F2AAEBAB3F53286B6BC"><enum>(3)</enum><header>Research octane number</header><text>The term <term>research octane number</term> has the meaning given the term in section 201 of the Petroleum Marketing Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2821">15 U.S.C. 2821</external-xref>). </text></paragraph></subsection><subsection id="H5FD110ED14E44FF89C8052CEA7E134DE"><enum>(b)</enum><header>Applicability</header><text>This part applies with respect to any motor vehicle that is introduced into commerce that—</text><paragraph id="H831E4112C5FA42E1891A2A562B8D1251"><enum>(1)</enum><text>is an automobile;</text></paragraph><paragraph id="H8D7785AF268B409A9819E9131784B83A"><enum>(2)</enum><text>uses gasoline for propulsion or any other operation of the motor vehicle, including the engine thereof; and</text></paragraph><paragraph id="H3A8B3209B1884A05B6A4F590C71101E9"><enum>(3)</enum><text>is a model year 2027 or later motor vehicle.</text></paragraph></subsection></section><section commented="no" id="H8179F739C30A4917A4ED67780FBBB984"><enum>262.</enum><header>High-octane test fuels</header><subsection commented="no" id="H60ED22B27E00410BA84421179E5A3894"><enum>(a)</enum><header>E20 certification fuel</header><text>Except as provided in subsections (b) and (c), manufacturers producing motor vehicles described in section 261(b) shall use a test fuel consisting of gasoline and 19.4 to 20 volume percent ethanol with a minimum 95 research octane number in—</text><paragraph commented="no" id="HB465CFA916D1461EB573B80674940BFF"><enum>(1)</enum><text>emissions testing and certification under section 206(a); and</text></paragraph><paragraph commented="no" id="HACA89D8C80B348D0828B36C1699D4587"><enum>(2)</enum><text>fuel economy testing and calculation procedures under section 32904(c) of title 49, United States Code.</text></paragraph></subsection><subsection commented="no" id="H734244B8F4EC4FEC88FBA85C01E2CED3"><enum>(b)</enum><header>E25 to E30 certification fuel</header><text>As an alternative to the test fuel described in subsection (a), manufacturers producing motor vehicles described in section 261(b) may use a test fuel consisting of gasoline and 24.3 to 30 volume percent ethanol with a minimum 98 research octane number in—</text><paragraph commented="no" id="HDBD0EC9747AF44FFBB88138F552F587D"><enum>(1)</enum><text>emissions testing and certification under section 206(a); and</text></paragraph><paragraph commented="no" id="H3BCAE3EBD506409BAB4AAF95BF50E577"><enum>(2)</enum><text>fuel economy testing and calculation procedures under section 32904(c) of title 49, United States Code.</text></paragraph></subsection><subsection commented="no" id="H1D72DFE1870642B2844D31A5A50432B4"><enum>(c)</enum><header>Model year 2032 and later model years</header><text>Notwithstanding subsections (a) and (b), beginning in model year 2032, manufacturers of motor vehicles described in section 261(b) shall use the gasoline test fuel described in subsection (b) in—</text><paragraph commented="no" id="H000CBE660D8044A6A3B941ED22B29C71"><enum>(1)</enum><text>emissions testing and certification under section 206(a); and</text></paragraph><paragraph commented="no" id="H499D862658234F57A2EE5136F1CD5336"><enum>(2)</enum><text>fuel economy testing and calculation procedures under section 32904(c) of title 49, United States Code.</text></paragraph></subsection><subsection commented="no" id="H7C4DD134B51B4EC1AAF95E6EAE694421"><enum>(d)</enum><header>Formulation</header><text>The test fuels described in subsections (a) and (b) shall be produced by adding neat or denatured fuel ethanol to the gasoline criteria emissions test fuel required for use in model year 2021 and later motor vehicles.</text></subsection><subsection commented="no" id="HB5BD4459E3C0455FBDD2A501E9134F38"><enum>(e)</enum><header>Test fuel equations</header><text display-inline="yes-display-inline">For purposes of—</text><paragraph commented="no" id="H96DC762F938D4160A7424E36EEC6CE6E"><enum>(1)</enum><text>testing and calculation procedures under section 206(a), the emissions of motor vehicles using the test fuels described in subsection (a) or (b) shall be based exclusively on actual measured emissions; and</text></paragraph><paragraph commented="no" id="HD464C748D41E436BA5B79434C3AAC51B"><enum>(2)</enum><text display-inline="yes-display-inline">fuel economy testing and calculation procedures under section 32904(c) of title 49, United States Code, the fuel economy of motor vehicles using the test fuels described in subsection (a) or (b) shall be determined on an energy-equivalent basis, which shall be equal to the product obtained by multiplying—</text><subparagraph commented="no" id="id2F9B8424B47D452D9FC41D0E8D02AD1B"><enum>(A)</enum><text display-inline="yes-display-inline">the measured fuel economy; and</text></subparagraph><subparagraph commented="no" id="id3EEA2B4C989A4DAD8810D790963F6BC1"><enum>(B)</enum><text>the quotient obtained by dividing—</text><clause commented="no" id="id5EB02EE3645E40AAA2B25C6E27EB9A59"><enum>(i)</enum><text>114,086 British thermal units per gallon; by</text></clause><clause commented="no" id="H74769AC389374D23A3D942A456DD9875"><enum>(ii)</enum><text>the volumetric energy density of the test fuel.</text></clause></subparagraph></paragraph></subsection></section><section id="H1051F490FBC8411EA6CB8810E9675B3E"><enum>263.</enum><header>High-octane vehicles</header><subsection id="H74CD93B76671498B8551292912DFE0F5"><enum>(a)</enum><header>Warranty requirements</header><text>Manufacturers of motor vehicles described in section 261(b) shall warrant to the ultimate purchaser and each subsequent purchaser that each such motor vehicle is designed—</text><paragraph id="H721F51E97D544845A62E89C4EE2C7604"><enum>(1)</enum><text>for model years 2027 through 2031—</text><subparagraph id="HA6C37A3BE51C42A29D8C08905552464D"><enum>(A)</enum><text>to operate with gasoline containing 10 and up to and including 25 percent ethanol by volume; and</text></subparagraph><subparagraph id="HBEA73EC04BC042E19E472BFD253EE361"><enum>(B)</enum><text>to meet the design requirements under subsection (b)(1); and</text></subparagraph></paragraph><paragraph id="H5E3FE35F0222407FA6E1C251DCD751DD"><enum>(2)</enum><text>for model year 2032 and later model years—</text><subparagraph id="HF47CD7FA786F41A9B50607E239618DAA"><enum>(A)</enum><text>to operate with gasoline containing 10 and up to and including 30 percent ethanol by volume; and</text></subparagraph><subparagraph id="H46279B1E9F1C423DB0E49B5BE2FCF5AE"><enum>(B)</enum><text>to meet the design requirements under subsections (b)(1) and (c)(1).</text></subparagraph></paragraph></subsection><subsection id="HCA5E19EE59714D398139956B290A31CB"><enum>(b)</enum><header>Design requirements before model year 2032</header><paragraph id="H9574ABF6B37F4801BE253974813578F4"><enum>(1)</enum><header>Manufacturers</header><text>The manufacturer of a motor vehicle described in section 261(b) shall design each such motor vehicle—</text><subparagraph id="H3505201414034345A5827DB4CFCB260D"><enum>(A)</enum><text>to use gasoline with a 95 research octane number or higher; and</text></subparagraph><subparagraph id="HD9E979B1EFF7436A93C3E1205A4D7FEE"><enum>(B)</enum><text>to incorporate such devices or elements of design (including physical or other barriers, devices, or technological systems) as are determined by the Administrator to be—</text><clause id="HCD56DA963AE64D1E816DE5CBFD58DF80"><enum>(i)</enum><text>necessary to prevent the introduction of gasoline with a research octane number that is lower than 95 into that motor vehicle; and</text></clause><clause id="H74657E535FF44D6291DAD0FE1B3510DE"><enum>(ii)</enum><text>technically and economically feasible.</text></clause></subparagraph></paragraph><paragraph id="HF6F26154FEFA4B86AE3AFFDF4E0C5162"><enum>(2)</enum><header>Fuel retailers</header><text>Any fuel retailer selling gasoline for use in a motor vehicle described in section 261(b) shall incorporate into the dispensing equipment of the fuel retailer such devices or elements of design (including physical or other barriers, devices, or technological systems) as are determined by the Administrator to be—</text><subparagraph id="H74B1F3F766CD489E971D9B2C6B548C15"><enum>(A)</enum><text>necessary to ensure compatibility with the motor vehicle design requirements under paragraph (1); and</text></subparagraph><subparagraph id="HCE5C6C9D708D4F049C401B6A5441313F"><enum>(B)</enum><text>technically and economically feasible.</text></subparagraph></paragraph></subsection><subsection id="HEC8ECD9A14A64D7E8E74DD888540639C"><enum>(c)</enum><header>Design requirements for model year 2032</header><paragraph id="HD75B3634696840C7B68F1AEDE6F20EFD"><enum>(1)</enum><header>Manufacturers</header><text>Subject to paragraph (3)(B), beginning in model year 2032, the manufacturer of a motor vehicle described in section 261(b) shall design each such motor vehicle—</text><subparagraph id="H59226E3A3CD846D1B9DD17216002523C"><enum>(A)</enum><text>to use gasoline with a 98 research octane number or higher; and</text></subparagraph><subparagraph id="HDFFD0E83B76947E69D9FF09F2CFC31D4"><enum>(B)</enum><text>to incorporate such devices or elements of design (including physical or other barriers, devices, or technological systems) as are determined by the Administrator to be—</text><clause id="H6EF0B53C9AF242F4AC4D80F7D4B592D6"><enum>(i)</enum><text>necessary to prevent the introduction of gasoline with a research octane number that is lower than 98 into that motor vehicle; and</text></clause><clause id="H4F46058096294BCDBCD39DA2FE45EC8B"><enum>(ii)</enum><text>technically and economically feasible.</text></clause></subparagraph></paragraph><paragraph id="HA219330B61CF41F89679537F213459BA"><enum>(2)</enum><header>Fuel retailer</header><text display-inline="yes-display-inline">Subject to paragraph (3)(B), any fuel retailer selling gasoline for use in a motor vehicle described in section 261(b) that is model year 2032 or later shall incorporate into the dispensing equipment of the fuel retailer such devices or elements of design (including physical or other barriers, devices, or technological systems) as are determined by the Administrator to be—</text><subparagraph id="HDE7281BC108B46BC8C647A3F3475C695"><enum>(A)</enum><text>necessary to ensure compatibility with the motor vehicle design requirements under paragraph (1); and</text></subparagraph><subparagraph id="H5FAB27F29C5A4F6BB865B948A27E559D"><enum>(B)</enum><text>technically and economically feasible.</text></subparagraph></paragraph><paragraph id="id5C557E3BC9F54B9F974C0136C542B98D"><enum>(3)</enum><header>EPA determination of nationwide availability</header><subparagraph id="idF81C1E877F1243898841EDC8952D807D"><enum>(A)</enum><header>Determination required</header><text>Not later than December 31, 2030, and not later than each December 31 thereafter until the Administrator determines that 98 research octane number gasoline can be made readily available nationwide, the Administrator shall—</text><clause id="idC1CE9177125B413A8F5429FF5A4B92D6"><enum>(i)</enum><text>determine whether 98 research octane number gasoline can be made readily available nationwide; and</text></clause><clause id="id82958DCAE77344E9AC9E7754AEAE59DE"><enum>(ii)</enum><text>publish that determination in the Federal Register. </text></clause></subparagraph><subparagraph id="idBF954B7005A142C08FC94539F894DA3A"><enum>(B)</enum><header>Effect</header><text>The requirements of this subsection shall not take effect until the date on which the Administrator—</text><clause id="id1AED6536D77244CFA403484D94ED10D9"><enum>(i)</enum><text>determines under subparagraph (A)(i) that 98 research octane number gasoline can be made readily available nationwide; and</text></clause><clause id="id66B1CA81C7F149CAA419FFCED96EAAC9"><enum>(ii)</enum><text>publishes that determination under subparagraph (A)(ii).</text></clause></subparagraph><subparagraph id="id838AD935F1254EE09F95E04E79F4E445"><enum>(C)</enum><header>Failure to make determination</header><text>If the Administrator fails to make a determination under subparagraph (A) by the applicable date under that subparagraph, the Administrator shall be deemed to have determined that 98 research octane number gasoline can be made readily available nationwide for purposes of subparagraph (B).</text></subparagraph></paragraph></subsection><subsection id="H59D3794BBB5947B6A56A56A266BBFB28"><enum>(d)</enum><header>Violations</header><paragraph id="H56B045F48ECD4AAA8BF7B1E8DA1319DB"><enum>(1)</enum><header>Manufacturers</header><subparagraph id="idD6E6F024EEA34066808F9EB8B6E5901F"><enum>(A)</enum><header>In general</header><text>Any manufacturer who violates subsection (b)(1) or (c)(1) shall be subject to a civil penalty of not more than $5,000 for each offense. </text></subparagraph><subparagraph id="idC8EFDDEDE90C4B3DBDCD6E449E1A5FAE"><enum>(B)</enum><header>Separate offenses</header><text>Any violation described in subparagraph (A) shall constitute a separate offense with respect to each motor vehicle. </text></subparagraph></paragraph><paragraph id="H3735E542D7DA42C4B96C8735A220F6B3"><enum>(2)</enum><header>Fuel retailer</header><subparagraph id="idEA3A77BB071D43568D1E3A3661BDF44B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any fuel retailer who violates subsection (b)(2) or (c)(2) shall be subject to a civil penalty of not more than $2,500 for each offense. </text></subparagraph><subparagraph id="idBBEE9136E01F483AB9AA6C64A8B43F86"><enum>(B)</enum><header>Separate offense</header><text>Any violation described in subparagraph (A) with respect to dispensing equipment shall constitute a separate offense with respect to each unit of dispensing equipment in violation of the applicable subsection described in that subparagraph.</text></subparagraph></paragraph></subsection></section><section id="H03E81963837A4FD5AD84197D9673DEBD"><enum>264.</enum><header>Misfueling</header><subsection id="H9F1213897C28456A8748051A3BCB9A69"><enum>(a)</enum><header>Prohibitions against tampering and defeat devices for motor vehicles</header><text>In lieu of applying section 203(a)(3) with respect to the requirements of this part, the following shall apply:</text><paragraph id="H214981D49039401D9CB0F92BD1A23AD5"><enum>(1)</enum><text>No person shall—</text><subparagraph id="HD1E29711EF50434D8CE9A9D841616F12"><enum>(A)</enum><text display-inline="yes-display-inline">remove or render inoperative any device or element of design installed on or in a motor vehicle pursuant to subsection (b)(1) or (c)(1) of section 263 prior to its sale and delivery to the ultimate purchaser; or</text></subparagraph><subparagraph id="H6B056769C8524549A8F0BD791340D7A6"><enum>(B)</enum><text>knowingly remove or render inoperative any such device or element of design after such sale and delivery to the ultimate purchaser.</text></subparagraph></paragraph><paragraph id="H91AED1D9E0984C1AA565AC273B34A0BB"><enum>(2)</enum><text>No person shall manufacture or sell, or offer to sell, or install, any part or component intended for use with, or as part of, any motor vehicle, where—</text><subparagraph id="H5077C2B6F74F4DCD8AA668E59DCC22D7"><enum>(A)</enum><text display-inline="yes-display-inline">a principal effect of the part or component is to bypass, defeat, or render inoperative any device or element of design installed on or in a motor vehicle pursuant to subsection (b)(1) or (c)(1) of section 263; and</text></subparagraph><subparagraph id="HBB190DF8469E4BF9AD89A395A771AFDF"><enum>(B)</enum><text>the person knows or should know that such part or component is being offered for sale or installed for such use or put to such use.</text></subparagraph></paragraph></subsection><subsection id="H0340538846FF452FA8D72C049D6A10FD"><enum>(b)</enum><header>Prohibitions against tampering and defeat devices for dispensing equipment</header><text>No person shall—</text><paragraph id="HED9DB920FF0F42CA8FBB10B9BE1041D4"><enum>(1)</enum><text display-inline="yes-display-inline">remove or render inoperative any device or element of design installed pursuant to subsection (b)(2) or (c)(2) of section 263; or</text></paragraph><paragraph id="H7A707BA8118E4D94980B7E82BD05AF55"><enum>(2)</enum><text>sell, or offer to sell, or incorporate into, any part or component intended for use with, or as part of, any dispensing equipment, where—</text><subparagraph id="HD59E88D537674CB8AD05A75BBB8E6AEB"><enum>(A)</enum><text display-inline="yes-display-inline">a principal effect of the part or component is to bypass, defeat, or render inoperative any device or element of design incorporated into dispensing equipment pursuant to subsection (b)(2) or (c)(2) of section 263; and</text></subparagraph><subparagraph id="H9BCCBF84458241599BD18B3232108BB7"><enum>(B)</enum><text>the person knows or should know that such part or component is being offered for sale or incorporated for such use or put to such use.</text></subparagraph></paragraph></subsection><subsection id="H4C793AA03E21447B9DFF541CFB2F1272"><enum>(c)</enum><header>Violations</header><paragraph id="idAD31715A78B94752B8E109065BFD5168"><enum>(1)</enum><header>In general</header><text>Any person who violates this section shall be subject to a civil penalty of not more than $2,500.</text></paragraph><paragraph id="id98D1FF9C2BB84D388411BCBCFBC5C8CC"><enum>(2)</enum><header>Separate offenses</header><text>Any violation described in paragraph (1) shall constitute a separate offense with respect to—</text><subparagraph id="H42D9B3F8DA6847EE8326B7B27836C40D"><enum>(A)</enum><text>each motor vehicle or unit of dispensing equipment, for purposes of subsections (a)(1) and (b)(1); and</text></subparagraph><subparagraph id="HC7E5E0B714D1410D9AFAB6ECA3EB624E"><enum>(B)</enum><text display-inline="yes-display-inline">each part or component, for purposes of subsections (a)(2) and (b)(2).</text></subparagraph></paragraph></subsection></section><section id="H923D274B3F17491D95B9E1CA0318B55F"><enum>265.</enum><header>Octane standard</header><subsection id="HEE671B1C54254D43A3FDADB21E4C08AB"><enum>(a)</enum><header>Octane standard</header><paragraph id="H50CBDFF7660E4724A05BBB0F1A06DE0E"><enum>(1)</enum><header>Prohibition</header><subparagraph id="H30E697EBFB564EE4A638B30A0EEB99E0"><enum>(A)</enum><header>95 research octane number marketing</header><text>No person shall sell motor vehicle gasoline marketed as 95 research octane number unless that gasoline has a research octane number of 95 or greater.</text></subparagraph><subparagraph id="HDC79988F589D4102A770761D92EFD7F6"><enum>(B)</enum><header>98 research octane number marketing</header><text>No person shall sell motor vehicle gasoline marketed as 98 research octane number unless that gasoline has a research octane number of 98 or greater.</text></subparagraph><subparagraph id="H7677A729EBC7422CB625A351FDFA4C37"><enum>(C)</enum><header>Deemed compliance</header><text display-inline="yes-display-inline">A person, including any distributor, blender, marketer, reseller, carrier, retailer, or wholesaler, shall be deemed to be in full compliance with this paragraph if the person can demonstrate, through evidence deemed acceptable by the Administrator, that the person had reason to believe in good faith that the motor vehicle gasoline complied with subparagraph (A) or (B).</text></subparagraph></paragraph><paragraph id="H16C67B149F7A467DBE8E2D5880C324CD"><enum>(2)</enum><header>Controls</header><subparagraph id="HC9D5824BBE8D47CDB76E3DF5297F462E"><enum>(A)</enum><header>95 research octane number availability</header><text display-inline="yes-display-inline">Effective January 1, 2026, any person that owns, leases, operates, controls, or supervises—</text><clause id="H8F75F4F5E17148279DB965B78B601CD1"><enum>(i)</enum><text>a retail outlet at which 200,000 or more gallons of gasoline were sold during calendar year 2023 or any subsequent calendar year, shall offer for sale motor vehicle gasoline of not less than 95 research octane number at that retail outlet; or</text></clause><clause id="H263E482C10FC4366ACDE3F0E97CAD2FA"><enum>(ii)</enum><text>6 or more retail outlets offering motor vehicle gasoline for sale, shall offer for sale motor vehicle gasoline of not less than 95 research octane number at not fewer than 60 percent of those retail outlets.</text></clause></subparagraph><subparagraph id="HA1B5EC9252FB4B618413188FAAB98F06"><enum>(B)</enum><header>98 research octane number availability</header><text display-inline="yes-display-inline">Effective January 1, 2031, any person that owns, leases, operates, controls, or supervises—</text><clause id="H16EF6DBF1B5346EEA645FD3EB4715A53"><enum>(i)</enum><text>a retail outlet at which 200,000 or more gallons of gasoline were sold during calendar year 2029 or any subsequent calendar year, shall offer for sale motor vehicle gasoline of not less than 98 research octane number at that retail outlet; or</text></clause><clause id="H94E1F1950E7C40E6B30B973C3914D717"><enum>(ii)</enum><text>6 or more retail outlets offering motor vehicle fuel for sale, shall offer for sale motor vehicle gasoline of not less than 98 research octane number at no fewer than 60 percent of those retail outlets.</text></clause></subparagraph></paragraph></subsection><subsection id="H6A12CAE8F4094AB48455CCCED654CAC4"><enum>(b)</enum><header>Violations</header><text display-inline="yes-display-inline">Any person that violates—</text><paragraph id="H66815271F75244649FFAAC298791147E"><enum>(1)</enum><text display-inline="yes-display-inline">subsection (a)(1), (a)(2)(A)(i), or (a)(2)(B)(i) shall be subject to a civil penalty of not more than $25,000 for each day on which the violation continues; and</text></paragraph><paragraph id="H4EC4AEF803114825827DF60FB35E4B28"><enum>(2)</enum><text display-inline="yes-display-inline">subsection (a)(2)(A)(ii) or (a)(2)(B)(ii) shall be subject to a civil penalty of not more than $2,500 per day for each retail outlet owned, leased, operated, controlled, or supervised by that person.</text></paragraph></subsection></section><section id="H082F1A0F1A274B1CA909DCECDF037198"><enum>266.</enum><header>Regulations</header><text display-inline="no-display-inline">The Administrator shall—</text><paragraph id="HC8D5AF6D9753416DB9C76E28CFFEBF24"><enum>(1)</enum><text>not later than 1 year after the date of enactment of the <short-title>Next Generation Fuels Act of 2022</short-title>, propose regulations to carry out this part; and</text></paragraph><paragraph id="H89C0054A70A2495F98D0FAD570A2284D"><enum>(2)</enum><text>not later than 2 years after that date of enactment, finalize regulations to carry out this part.</text></paragraph></section><section id="H79EF7EA856A746338E889ED38FA18A48"><enum>267.</enum><header>Liability limitation and preemption</header><subsection id="HC204819C58924FEAB45A52C70CFE0105"><enum>(a)</enum><header>Limitation of liability</header><text>A manufacturer of a motor vehicle, or a gasoline retailer, that is in compliance with the requirements of this part and the requirements of sections 203(e) and 206 of the Petroleum Marketing Practices Act, shall not be liable under any provision of this Act or any other Federal, State, or local law, including common law, for damages—</text><paragraph id="HB817011C0BAA4D67A1380C6A6EB05390"><enum>(1)</enum><text>to or caused by a motor vehicle described in section 261(b); and</text></paragraph><paragraph id="HA0FA717CA7CD4E4A87006919CDA0D8D7"><enum>(2)</enum><text>that would not have occurred but for the introduction of gasoline with a research octane number required by this part.</text></paragraph></subsection><subsection id="H2831923ECB924F7B91C31811E533A550"><enum>(b)</enum><header>Preemption</header><text>No State or any political subdivision of a State may adopt, continue in effect, or enforce, any provision of law or regulation—</text><paragraph id="H9799ACAE0C63426D9561130CD9F8F93B"><enum>(1)</enum><text>requiring motor vehicles to operate using gasoline with a certain octane content, or the corresponding design of equipment for dispensing such gasoline into such motor vehicles, unless the provision of that law or regulation is the same as the corresponding provision under this part; or</text></paragraph><paragraph id="H8EC5DDD63C8949759CBB12205797E51D"><enum>(2)</enum><text>limiting the concentration of ethanol in motor vehicle gasoline.</text></paragraph></subsection></section><section id="HA9EA200C31C642AD9322FA1A79F589F6"><enum>268.</enum><header>Civil actions; administrative assessment of certain penalties</header><text display-inline="no-display-inline">The provisions of subsections (b) and (c) of section 205 shall apply with respect to a violation of section 263 or 264 to the same extent and in the same manner as such provisions apply with respect to a violation of section 203(a)(3).</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HD2B50400499D4709B41AAD23B8B174E8"><enum>4.</enum><header>Octane disclosure</header><subsection id="HAFA48F916AB24365B483AB2921F00186"><enum>(a)</enum><header>High-Efficiency fuels</header><text display-inline="yes-display-inline">Title II of the Petroleum Marketing Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2821">15 U.S.C. 2821 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD8DBD2AAAE87428F8EFF905F6F95EC89"><section id="HC59B1A19A00F4D36B651F47465204ADE"><enum>206.</enum><header>High-efficiency fuel and vehicle marketing requirements</header><subsection id="H038DD1DD86E2459F92B71C19B6A5BB30"><enum>(a)</enum><header>Rule</header><text>The Federal Trade Commission shall, by rule, and in consultation with persons to be regulated under this section, consumer advocates, and other stakeholders, as appropriate—</text><paragraph id="H8D0CBDD934C641C0BE4F8A07DBD4309E"><enum>(1)</enum><text>prescribe or revise requirements under this title relating to the certification, display, and representation of the automotive fuel rating of an automotive fuel as necessary to carry out—</text><subparagraph id="H77EA13E81B40456880510330BD97B05F"><enum>(A)</enum><text>the requirement under subsection (b); and</text></subparagraph><subparagraph id="H2DB46B33218E40969322D0118A3366E7"><enum>(B)</enum><text>any determination made under subsection (c);</text></subparagraph></paragraph><paragraph id="H1E6B1BA64D9B49E5B52728A496C1A5FE"><enum>(2)</enum><text>make the determination required under subsection (c); and</text></paragraph><paragraph id="HB08DF770F605402B86495B18D4E41D5B"><enum>(3)</enum><text>prescribe requirements under subsection (d).</text></paragraph></subsection><subsection id="HDA4C89D77E22444B8B30AFC6FF58D3F1"><enum>(b)</enum><header>Requirement</header><text>The Federal Trade Commission shall require that, for purposes of this title, beginning on the date that is 180 days after the date on which the Federal Trade Commission issues a final rule under subsection (a), the automotive fuel rating of an automotive fuel with a research octane number of 95 or higher be determined only by the research octane number of such automotive fuel.</text></subsection><subsection id="HED16497E515D41DE95CA6BA46F2AE8A6"><enum>(c)</enum><header>Labeling</header><paragraph id="H9E169864F305489E9F79A7C62C4C5CDC"><enum>(1)</enum><header>In general</header><text>The Federal Trade Commission shall prescribe requirements—</text><subparagraph id="H87D01AA038D247E7A8CEFABA8768FAA7"><enum>(A)</enum><text>as the Federal Trade Commission determines necessary with respect to a display at the point of sale to ultimate purchasers of automotive fuel and a display on a motor vehicle to—</text><clause id="HB84786C017DC4059A8FAE278AB6376F5"><enum>(i)</enum><text>inform such ultimate purchaser of such automotive fuel and any purchaser or user of such motor vehicle that—</text><subclause id="H463DB802A0E14A1CB1821FF2BAC86008"><enum>(I)</enum><text>a model year 2027 or later motor vehicle is only warrantied to use automotive fuel with a research octane number of 95 or higher; and</text></subclause><subclause id="H881803D4565C47F68227C5FC37229587"><enum>(II)</enum><text>a model year 2032 or later motor vehicle is only warrantied to use automotive fuel with a research octane number of 98 or higher;</text></subclause></clause><clause id="H0803440DB1BB46E5A2ED0A4B82EAF7D9"><enum>(ii)</enum><text>provide a warning to such ultimate purchaser of such automotive fuel and any such purchaser or user of such motor vehicle, that the use of automotive fuel with a research octane number that—</text><subclause id="H6A879FD477C340708CCF3DD517C24FEB"><enum>(I)</enum><text>is lower than 95 in a model year 2027 or later motor vehicle will result in reduced fuel economy, increased exhaust emissions, and possibly engine damage; and</text></subclause><subclause id="HCA23686F0D1C42E2AD256AF8F331F6D9"><enum>(II)</enum><text>is lower than 98 in a model year 2032 or later motor vehicle will result in reduced fuel economy, increased exhaust emissions, and possibly engine damage; and</text></subclause></clause><clause id="H4D74D5739790440E8C805FC5C786EC9A"><enum>(iii)</enum><text>inform such ultimate purchaser of such automotive fuel and any purchaser or user of such motor vehicle that—</text><subclause id="HCA493178FC624A749F749383BC5E0DFF"><enum>(I)</enum><text>a model year 2027 or later motor vehicle is warrantied to use gasoline containing up to and including 25 percent ethanol by volume; and</text></subclause><subclause id="H9CB132DC059D46A6913B0BB444EABB63"><enum>(II)</enum><text display-inline="yes-display-inline">a model year 2032 or later motor vehicle is warrantied to use gasoline containing up to and including 30 percent ethanol by volume; and</text></subclause></clause></subparagraph><subparagraph id="H885DCEF24EEF4BB18A251FF097A738DF"><enum>(B)</enum><text>that are applicable to—</text><clause id="H7CF7C1FFC46B48B786C507ACC5A146A5"><enum>(i)</enum><text>a manufacturer of a new motor vehicle (or an entity making a representation in connection with the sale of such motor vehicle) with respect to a display on such motor vehicle; and</text></clause><clause id="H25BF3E12FA67408599D9B2961764AE97"><enum>(ii)</enum><text>an automotive fuel retailer, with respect to a display at the point of sale to an ultimate purchaser of automotive fuel.</text></clause></subparagraph></paragraph><paragraph id="H0A0DD8B405B34E3F902BC9922EB15D59"><enum>(2)</enum><header>Considerations</header><text>In prescribing requirements under paragraph (1), the Federal Trade Commission shall ensure that such requirements are designed to be—</text><subparagraph id="H8BF64BFFA9D844FABE89F8F2D7219D7F"><enum>(A)</enum><text>understandable to—</text><clause id="HCD8F74CFC62644B6B8378BC6AE78F8F1"><enum>(i)</enum><text>the ultimate purchaser of automotive fuel; and</text></clause><clause id="HA006F3966C0E436B983A46E949069247"><enum>(ii)</enum><text>any purchaser or user of a model year 2027 or later motor vehicle; and</text></clause></subparagraph><subparagraph id="HC3D2A04257FE47998DBAA799537AEE3C"><enum>(B)</enum><text>cost effective for automotive fuel retailers.</text></subparagraph></paragraph></subsection><subsection id="H86133C5E0F074A67B8ECE55272298576"><enum>(d)</enum><header>Deadlines</header><text>The Federal Trade Commission shall—</text><paragraph id="H3C56BA89229F4A1E91158567A769AEA6"><enum>(1)</enum><text>not later than January 1, 2025, issue a proposed rule under subsection (a); and</text></paragraph><paragraph id="HA96F362AA18C4923AC33B844EEBC6D75"><enum>(2)</enum><text>not later than July 1, 2026, issue a final rule under subsection (a).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA5F3F1350D224A189436F9083D4922A5"><enum>(b)</enum><header>Enforcement</header><text>Section 203(e) of the Petroleum Marketing Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2823">15 U.S.C. 2823(e)</external-xref>) is amended—</text><paragraph id="HE2596C77B61B42E7BAF370BC7CB659A4"><enum>(1)</enum><text>by striking <quote>or a rule prescribed</quote> and inserting <quote>a rule prescribed</quote>; and</text></paragraph><paragraph id="H513F1E4C3DA54CFEB5C1CFFEDCD025FD"><enum>(2)</enum><text>by striking <quote>of such section.</quote> and inserting <quote>of section 202, or a rule prescribed under section 206.</quote>.</text></paragraph></subsection><subsection id="H72AC2F14470C49B0936E92DD78F7F20C"><enum>(c)</enum><header>Table of contents amendment</header><text>The table of contents for the Petroleum Marketing Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2801">15 U.S.C. 2801 et seq.</external-xref>) is amended by inserting after the item relating to section 205 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H012AEE70161B47A5931BD082A05950E6"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 206. High-efficiency fuel and vehicle marketing requirements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HF9AC8C838BD34DCABA9E37702A93164F"><enum>5.</enum><header>Advertisement of price of high-octane automotive fuel</header><subsection id="HDB06A81D0EC945F5AC3EA045EEF2FE4C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person to sell or offer for sale, at retail, automotive fuel with a research octane number (as such terms are defined in section 201 of the Petroleum Marketing Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2821">15 U.S.C. 2821</external-xref>)) of 95 or greater unless such person displays, in a manner specified in the rules promulgated under subsection (b), the total price per gallon of such fuel on any sign on which such person displays the price of the most-sold grade of automotive fuel of such person.</text></subsection><subsection id="HC336E24B81DA4A579340400B2F7FA97B"><enum>(b)</enum><header>Rulemaking</header><paragraph id="H94AE49769A5B4E13815390934E15DAEF"><enum>(1)</enum><header>In general</header><text>Not later than 24 months after the date of enactment of this Act, the Federal Trade Commission shall promulgate, in accordance with section 553 of title 5, United States Code, any rules necessary for the implementation and enforcement of this section.</text></paragraph><paragraph id="H937DAD0EEDEF460A8C814C8A3F14758D"><enum>(2)</enum><header>Contents</header><text>Such rules—</text><subparagraph id="HB08E0DF2FC0A4C9D997CE746AE072538"><enum>(A)</enum><text>shall define <quote>retail</quote> and <quote>most-sold</quote> for the purposes of this section;</text></subparagraph><subparagraph id="HF066D8DCB9DE4A13AFA1B1469D9E425E"><enum>(B)</enum><text>shall specify the manner in which the price of automotive fuel with a research octane number of 95 or greater must be displayed in order to comply with subsection (a); and</text></subparagraph><subparagraph id="HCE9A2822E6454F97BEAD5CFA4A97268E"><enum>(C)</enum><text>shall be consistent with the requirements for declaring unfair acts or practices in section 5(n) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(n)</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H34ED2E62A4CA4FF9BD8587AF2EA0CA44" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Enforcement</header><text>A violation of subsection (a) shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>). The Federal Trade Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made part of this section.</text></subsection></section><section id="H45378C7562DE463EBF321E1CC65860C1"><enum>6.</enum><header>E40 retail infrastructure standard</header><text display-inline="no-display-inline">Section 9003 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6991b">42 U.S.C. 6991b</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H5479D9DB907D4FBFA1200645231A4A66" display-inline="no-display-inline" style="OLC"><subsection id="HB31D1626AA004B12B7DFAEECE0CC0B7F"><enum>(k)</enum><header>E40-Compatible retail infrastructure systems</header><paragraph id="H3CA779455A83480393591FA5FB790760"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H7595DF1A452540D89644F2B75B61B12E"><enum>(A)</enum><header>Automotive fuel</header><text>The term <term>automotive fuel</term> has the meaning given the term in section 201 of the Petroleum Marketing Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2821">15 U.S.C. 2821</external-xref>).</text></subparagraph><subparagraph commented="no" id="H61382C89ACCF4E24AFC2B8630C28DF5B"><enum>(B)</enum><header>Compatible</header><text display-inline="yes-display-inline">The term <term>compatible</term> means, to the extent feasible, certified by a nationally recognized testing laboratory recognized by the Occupational Safety and Health Administration in accordance with section 1910.7 of title 29, Code of Federal Regulations (or any successor regulations) to maintain system performance throughout the operational life of the dispenser system.</text></subparagraph><subparagraph id="HCD32475A62C54272A5E83A276B272CE6" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Dispenser system</header><text display-inline="yes-display-inline">The term <term>dispenser system</term> has the meaning given the term in section 280.12 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this subsection).</text></subparagraph></paragraph><paragraph id="H573AB8614D424B0E8E35A99607C6BA5F"><enum>(2)</enum><header>Performance standards</header><text display-inline="yes-display-inline">The Administrator shall, not later than January 1, 2024, issue or revise, as necessary, performance standards for underground storage tank systems and dispenser systems that are brought into use on or after January 1, 2024, to require that those systems be compatible with automotive fuel consisting of gasoline and at least 40 percent ethanol by volume.</text></paragraph><paragraph id="H389A9F9EA6AA4363AEE7034965EC86E6"><enum>(3)</enum><header>Compatibility</header><text>An owner or operator may demonstrate the compatibility of an underground storage tank system with automotive fuel containing any concentration of ethanol through the use of a secondary containment system that is able—</text><subparagraph id="HFA85519D3FA340308B0A2B25CDA3AA6C"><enum>(A)</enum><text>to contain regulated substances leaked from the primary containment system until the regulated substances are detected and removed; and</text></subparagraph><subparagraph id="H8C8A26B5A9194409BE9C6A0E48813E5B"><enum>(B)</enum><text>to prevent the release of regulated substances to the environment at any time during the operational life of the underground storage tank system.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H82F813178D094055B86E7ABF6BF8BD13"><enum>7.</enum><header>Registration testing, Reid vapor pressure, and substantially similar waivers</header><subsection id="HF964E3DAB14F407484C16FCB877C53EF"><enum>(a)</enum><header>Registration testing waiver</header><text>Section 211(e) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H521C1A75AF9C4C69B4E3CFDAF1069843"><paragraph id="H1204C719408841B69F1BE5F0DBB05027" indent="up1"><enum>(4)</enum><text>Fuels consisting of gasoline and no more than 30 percent ethanol by volume that meet the requirements of subsection (f)(3) shall be deemed—</text><subparagraph id="idA6CFC6DB967C4115B2CE06615A08DFAD"><enum>(A)</enum><text>to have satisfied any testing regulations promulgated under this subsection; and</text></subparagraph><subparagraph id="id9119887C275149B9BCAB1E4F92FDDAA9"><enum>(B)</enum><text>to be immediately eligible for registration under subsection (b) without further testing.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1B78472C9664457CB5DBEB8AFC243837"><enum>(b)</enum><header>Reid vapor pressure waiver</header><text>Section 211(h) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(h)</external-xref>) is amended—</text><paragraph id="HBE2507A4840F493D99A235293569D975"><enum>(1)</enum><text>in paragraph (4)—</text><subparagraph id="H54A752AA588845DDB8A563481EC90B12"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>or more</quote> after <quote>10 percent</quote>; and</text></subparagraph></paragraph><paragraph id="H2FF8E5AFB4124E9DAEA7D9731CCC8ACD"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H136327E13D0C44F093017449EC379F57"><subsection id="H3C1DB6014AC94A95BCF947FD9C5611DD"><enum>(w)</enum><header>Clean octane standard</header><paragraph id="H744E6DA9555B4905811C2BDF776BE203"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HA99C9319687A4F0AA515787884E45694"><enum>(A)</enum><header>Baseline lifecycle greenhouse gas emissions</header><text>The term <term>baseline lifecycle greenhouse gas emissions</term> means the average lifecycle greenhouse gas emissions, as determined by the Administrator, in consultation with the Director of the Argonne National Laboratory, for unblended gasoline sold or distributed as transportation fuel in 2022.</text></subparagraph><subparagraph id="H52B8BF87054D4B669177FAC77F666C89"><enum>(B)</enum><header>Lifecycle greenhouse gas emissions</header><text display-inline="yes-display-inline">The term <term>lifecycle greenhouse gas emissions</term> means the aggregate quantity of greenhouse gas emissions as determined by the Secretary of Energy using the version of the Argonne National Laboratory Greenhouse gases, Regulated Emissions, and Energy use in Transportation (GREET) model in effect as of the date of enactment of the <short-title>Next Generation Fuels Act of 2022</short-title>.</text></subparagraph><subparagraph id="id8FD3F951024145EB9B726966F55F19A6"><enum>(C)</enum><header>Research octane number</header><text>The term <term>research octane number</term> has the meaning given the term in section 201 of the Petroleum Marketing Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2821">15 U.S.C. 2821</external-xref>).</text></subparagraph></paragraph><paragraph id="HD9BAB9D62A2B4AF18E5A63E17C51F182"><enum>(2)</enum><header>Aromatics</header><subparagraph id="HE280A1662E2D4BA5BB6406340C9E4096"><enum>(A)</enum><header>Annual average limitation</header><text>Effective beginning on January 1, 2026, it shall be unlawful for refiners or importers to sell motor vehicle gasoline that contains, on an average annual basis, an aromatic hydrocarbon concentration in excess of 17.5 percent by volume.</text></subparagraph><subparagraph id="H398EFF653E8D4D26805CBFFDC34B7303"><enum>(B)</enum><header>2026 cap</header><text display-inline="yes-display-inline">Effective beginning on January 1, 2026, it shall be unlawful for refiners or importers to sell motor vehicle gasoline that contains an aromatic hydrocarbon concentration in excess of 30 percent by volume.</text></subparagraph><subparagraph id="HEFE7A5F4B13948DBA48A08D0B0F261C8"><enum>(C)</enum><header>2031 cap</header><text display-inline="yes-display-inline">Effective beginning on January 1, 2031, it shall be unlawful for refiners or importers to sell motor vehicle gasoline that contains an aromatic hydrocarbon content in excess of 25 percent by volume.</text></subparagraph><subparagraph id="H83FE49D2B5474DC6B97D05049A104581"><enum>(D)</enum><header>Oxygenate adjustment for gasoline blendstock</header><clause id="id9A8D9CF1B19B43248DB76AEF4776B894"><enum>(i)</enum><header>In general</header><text>For purposes of compliance with this paragraph, the aromatics volume of motor vehicle gasoline produced as blendstock for oxygenate blending may be adjusted based on the specified type and amount of oxygenate required to be added downstream. </text></clause><clause id="idDA94A6DD21E14E2FAD685AA7375F5482"><enum>(ii)</enum><header>Requirements</header><text>Any adjustment under clause (i) shall be made through—</text><subclause id="H5A31FBEE64C642AD92EA3725F92966F0"><enum>(I)</enum><text>the preparation of a hand blend containing oxygenate; or</text></subclause><subclause id="HF41512680B5247BB942267497CB35F49"><enum>(II)</enum><text>any other method deemed acceptable to the Administrator.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H65BBD069E4874BB9A0193EC265B752BE"><enum>(E)</enum><header>Regulations</header><clause commented="no" id="HC05A019183304BE2AE40790581BB00CC"><enum>(i)</enum><header>In general</header><text>The Administrator shall promulgate regulations to implement this paragraph.</text></clause><clause commented="no" id="HCA408D07E35F49D6AD0937D2D40EA243"><enum>(ii)</enum><header>Contents</header><text>Regulations promulgated under clause (i) shall allow for the generation of tradeable credits to meet the requirement of subparagraph (A), but any credits shall expire after not more than 5 years.</text></clause><clause commented="no" id="HCD4F7E92FAEC4439B924C9D1B8C7751E"><enum>(iii)</enum><header>Initial regulations</header><text display-inline="yes-display-inline">Not later than January 1, 2026, the Administrator shall promulgate final regulations under clause (i).</text></clause></subparagraph></paragraph><paragraph id="HD3A0537A01C64B78AAD4F2B3B63BAF29"><enum>(3)</enum><header>Low-carbon octane</header><subparagraph id="H94466CD202FE4AFAA3020A781992009E"><enum>(A)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Effective beginning on January 1, 2026, no refiner or importer shall introduce into commerce motor vehicle gasoline with a research octane number of 95 or higher except through the use of a fuel additive that has average lifecycle greenhouse gas emissions that (as determined by the Secretary of Energy using the version of the Argonne National Laboratory Greenhouse gases, Regulated Emissions, and Energy use in Transportation (GREET) model in effect as of the date of enactment of the <short-title>Next Generation Fuels Act of 2022</short-title>) are at least 40 percent less than baseline lifecycle greenhouse gas emissions.</text></subparagraph><subparagraph id="H7C9F6264FE694A558A8EC68D34C73B23"><enum>(B)</enum><header>Regulations</header><clause id="HEA551AB0473F4E13B2E378EDD29080BD"><enum>(i)</enum><header>In general</header><text>The Administrator shall promulgate regulations to implement this paragraph.</text></clause><clause id="H457CE5A8D8AD4DDC9460369DCC865D4F"><enum>(ii)</enum><header>Contents</header><text>Regulations promulgated under clause (i) shall—</text><subclause id="HC1C7FC07BA6C4137AB132EC1113ADEC8"><enum>(I)</enum><text>determine the baseline lifecycle greenhouse gas emissions for purposes of this paragraph;</text></subclause><subclause id="H8DCCF2CBE0C542C6A3EFF90F2B2BC3A6"><enum>(II)</enum><text>determine the average lifecycle greenhouse gas emissions of sources of octane value for purposes of this paragraph; and</text></subclause><subclause id="H0ADF15A4872841A2BF008EB7D2394ECD"><enum>(III)</enum><text>ensure that the requirements of this paragraph are met.</text></subclause></clause><clause id="H001A22AEEFCB4134AF429822642250B4"><enum>(iii)</enum><header>Initial regulations</header><text display-inline="yes-display-inline">Not later than January 1, 2025, the Administrator shall promulgate final regulations under clause (i).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H7B764D6684094310BA26BB4E34BE3E46"><enum>9.</enum><header>New fuel effects study</header><subsection id="HBBE1609079D04F2E938FD2C22F2CE76B"><enum>(a)</enum><header>Fuel effects study</header><paragraph id="idD3124671D0D443CBA3445E6B613054BD"><enum>(1)</enum><header>Study required</header><text>Subject to subsection (b), the Administrator of the Environmental Protection Agency (referred to in this section as the <quote>Administrator</quote>) shall carry out a study of the emissions effects of ethanol-blended fuels in light-duty vehicles and light-duty trucks, for the purpose of updating the Motor Vehicle Emission Simulator modeling system. </text></paragraph><paragraph id="idE58C258B4D174D6298CCD605FFEA4DD9"><enum>(2)</enum><header>Requirements</header><text>In designing and conducting the study under paragraph (1), the Administrator shall—</text><subparagraph id="HBA90572B788841C69EAD8B334C55823C"><enum>(A)</enum><text>select test fuels that—</text><clause id="H300FA0F2641A4DAAB04FFF93031B461B"><enum>(i)</enum><text>reflect a range of ethanol concentrations between 0 and at least 25 percent by volume; and</text></clause><clause id="HB21E611532FE46FF9B9258C6FD032709"><enum>(ii)</enum><text>are representative of fuels that are widely available on the date of enactment of this Act or reasonably could be available regionally or nationally, taking into account fuel refinery operations and economics, including the cost of reformate;</text></clause></subparagraph><subparagraph id="H7C037BA9F25D4D9B84958D9DDE9445AB"><enum>(B)</enum><text>select test vehicles that are representative of vehicles of recent model years as of the date of enactment of this Act that include relevant technologies that are, or reasonably may come to be, in widespread use;</text></subparagraph><subparagraph id="H6C2BEFF9731F4E47B19BDB090A2051DC"><enum>(C)</enum><text>measure emission products of combustion including, at a minimum—</text><clause id="H3CC4F65A6A9340C8B998E79642361DC5"><enum>(i)</enum><text>particulate matter of 2.5 micrometers in diameter or less;</text></clause><clause id="H940C9C90E206433B8748AF80C1FE0925"><enum>(ii)</enum><text>ultrafine particulate matter of 0.1 micrometers in diameter or less;</text></clause><clause id="H4E6506CCA6E645CB97F7DF0379F6B09F"><enum>(iii)</enum><text>nitrogen oxides;</text></clause><clause id="H721186FD065B46368DB843ED6F48D99D"><enum>(iv)</enum><text>total hydrocarbons;</text></clause><clause id="H95278E67C9444DD6AD7B7420C5CE2162"><enum>(v)</enum><text>nonmethane organic gas;</text></clause><clause id="H350521A8175D4271B0219115A8A13DAB"><enum>(vi)</enum><text>carbon monoxide;</text></clause><clause id="H156FF5E7A8A54AE6AB1C4AC717F1003F"><enum>(vii)</enum><text>benzene;</text></clause><clause id="H1EE314BE6B014A4CBAFFB1F536166EF8"><enum>(viii)</enum><text>toluene;</text></clause><clause id="HA2834FE4393148F3807E9BBC39BBF1FF"><enum>(ix)</enum><text>ethylbenzene;</text></clause><clause id="H0DB946F0ACD04274BE4220E15F77CC5A"><enum>(x)</enum><text>xylene;</text></clause><clause id="H8A8F84C7FA624C01BD4ED5CDE240BE37"><enum>(xi)</enum><text>1,3-butadiene;</text></clause><clause id="HF81B2714EB4B4A8E9A1FA8A9B99A7701"><enum>(xii)</enum><text>ethanol; and</text></clause><clause id="H4D325D87B4594B27A733A8E29A403217"><enum>(xiii)</enum><text>polycyclic aromatic hydrocarbons, including at a minimum benzo(a)pyrene;</text></clause></subparagraph><subparagraph id="H7BF13C219D0346D590000FA73C21BF5B"><enum>(D)</enum><text>measure the tendency of measured emissions to form secondary organic aerosols and any other relevant secondary air pollution; and</text></subparagraph><subparagraph id="HD50F71E5EC1F4FFDB15CDD366391C732"><enum>(E)</enum><text>consult with the Secretary of Energy, the Secretary of Agriculture, and the Secretary of Transportation (or their delegates).</text></subparagraph></paragraph></subsection><subsection id="H10B1D7508DE745E6A39E38FA0A0FB552"><enum>(b)</enum><header>Certification by Secretary of Energy</header><text>The Administrator shall—</text><paragraph id="H672BC0E1C8EA44E98B210359DDC305C5"><enum>(1)</enum><text>provide the proposed design of the study under subsection (a) to the Secretary of Energy for review; and</text></paragraph><paragraph id="H18602F8A874C449A868E77FC7893A286"><enum>(2)</enum><text>not commence the study under subsection (a) until the Secretary of Energy certifies in writing that the design of the study complies with the requirements of subsection (a).</text></paragraph></subsection></section><section id="H51761B7E93E8419091850E0CDEBBB140"><enum>10.</enum><header>Dual-fueled automobile default utilization factor</header><subsection id="HE699FAD5FE304492AEDC99005D1ACFAA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 32905 of title 49, United States Code, is amended by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H17C80B9FC7E242578283C384DAEF4D82"><subsection id="H8C0CDBFB04AD4D48A1091ACA2E9EE527"><enum>(b)</enum><header>Dual-Fueled automobiles</header><paragraph id="id1882C090C6DE4B63964887D0DDE1DBDB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (d) or section 32904(a)(2)—</text><subparagraph id="HE62868209CF944FE88D9B840D9F8FEB1"><enum>(A)</enum><text>for any model of dual-fueled automobile manufactured by a manufacturer in model years 1993 through 2019, the Administrator of the Environmental Protection Agency shall measure the fuel economy for that model by dividing 1.0 by the sum of—</text><clause id="H686F6F19FB2A4B28843B6CE08BF34A85"><enum>(i)</enum><text display-inline="yes-display-inline">0.5 divided by the fuel economy measured under section 32904(c) when operating the model on gasoline or diesel fuel; and</text></clause><clause id="HFAA22053B8B84950B18A09F8F1581D70"><enum>(ii)</enum><text display-inline="yes-display-inline">0.5 divided by the fuel economy—</text><subclause id="H5C83A99B88174EF2934F971B6DDECCEB"><enum>(I)</enum><text display-inline="yes-display-inline">measured under subsection (a) when operating the model on alternative fuel; or </text></subclause><subclause id="HBB07C54BEEE64C05B65EF0172947148F"><enum>(II)</enum><text>measured based on the fuel content of B20 when operating the model on B20, which is deemed to contain 0.15 gallon of fuel; and</text></subclause></clause></subparagraph><subparagraph id="HBF3D521ECE6142408CF42748D9371E2A"><enum>(B)</enum><text>subject to paragraph (2), for any model of dual-fueled automobile manufactured by a manufacturer in model year 2023 or later, the Administrator of the Environmental Protection Agency shall measure the fuel economy for that model by dividing 1.0 by the sum of—</text><clause id="HB8CC3C7BD4804637B468EFF53C21BE22"><enum>(i)</enum><text>0.79 divided by the fuel economy measured under section 32904(c) when operating the model on gasoline or diesel fuel; and</text></clause><clause id="H7F081E0B57664E7C8FEFEC07FF6F5247"><enum>(ii)</enum><text>0.21 divided by the fuel economy measured under subsection (a) when operating the model on alternative fuel.</text></clause></subparagraph></paragraph><paragraph id="id4EE21B4213A64690B24920DA01FDDC66"><enum>(2)</enum><header>Higher utilization factor for new models</header><text>A manufacturer may demonstrate that a higher utilization factor applies to any model of dual-fueled automobile manufactured by the manufacturer in model year 2023 or later.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF7E1907E67CF4A3EB1145F0E51FDEB01"><enum>(b)</enum><header>Testing procedures</header><text>Section 206 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7525">42 U.S.C. 7525</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id55803FC5CBDF44FFBA3FCC88AE71620A"><subsection id="id72A688DEEF024E64BEE68BC3D7A9C2C1"><enum>(i)</enum><header>Requirement To update test procedures</header><text>Not later than July 1, 2023, the Administrator shall amend the test procedures promulgated under this section to be in accordance with section 32905(b)(1)(B) of title 49, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HBBCE70C087E942E784B1C067A8B09508"><enum>11.</enum><header>Transfers of credits for exceeding average fuel economy standards</header><text display-inline="no-display-inline"> Section 32903(g) of title 49, United States Code, is amended by striking paragraph (3) and inserting the following:</text><quoted-block id="HB31CEA636FE241A38AE091BB2B21347A" display-inline="no-display-inline" style="OLC"><paragraph id="H35EA5331A52A4A73AD37391B6EF8923C"><enum>(3)</enum><header>Maximum increase</header><text>The maximum increase in any compliance category attributable to transferred credits is—</text><subparagraph id="H183948F891FA477DAC4EE437E0D9A580"><enum>(A)</enum><text>for model year 2021, 4.0 miles per gallon; and</text></subparagraph><subparagraph id="H8D089BC0EEDC44D1936A1588289B7221" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>for model year 2022 and subsequent model years, 6.0 miles per gallon.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8EEE437C3E7849FBBFB57E3C42B690B6"><enum>12.</enum><header>Extension and expansion of alternative fuel vehicle refueling property credit</header><subsection id="HF924DA6DF7EC4EFB81E0D3C7525C3AB5"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/30C">Section 30C</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H414D83069F4D403D8409C660119EDE34"><enum>(1)</enum><text>by amending subsection (c) to read as follows:</text><quoted-block style="OLC" id="HFE2FE50578C24282BED5E65FA8404BB1"><subsection id="H460533C0DF5445E0A0F9FF067DDFB7CA"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph id="H5B0F10D7D36D437F9035FD42B5D39217"><enum>(1)</enum><header>Qualified alternative fuel vehicle refueling property</header><text>The term <term>qualified alternative fuel vehicle refueling property</term> means any property (not including a building and its structural components) if—</text><subparagraph id="H5869DF5017E1440A8DF15904DA72037F"><enum>(A)</enum><text>such property is of a character subject to the allowance for depreciation,</text></subparagraph><subparagraph id="H08986B494113435E91E7320B3C1A3DB4"><enum>(B)</enum><text>the original use of such property begins with the taxpayer, and is not used as the principal residence (within the meaning of section 121) of the taxpayer, and</text></subparagraph><subparagraph id="H48BBFA50B7F0407AB192600ED1D5A112"><enum>(C)</enum><text>such property is used—</text><clause id="H2EBF49980F4D4F50A896D94CBA52B7B0"><enum>(i)</enum><text>for the storage or dispensing of a qualifying fuel into the fuel tank of a motor vehicle propelled by such fuel, but only if the storage or dispensing of the fuel is at the point where such fuel is delivered into the fuel tank of the motor vehicle, or</text></clause><clause id="HAD1DBBFA567349BEBC7255794C1FDCF4"><enum>(ii)</enum><text>for the recharging of motor vehicles propelled by electricity, but only if such property is located at the point where the motor vehicles are recharged.</text></clause></subparagraph></paragraph><paragraph id="H7B9BB596C2C14A0D96A15C82E09FFE5B"><enum>(2)</enum><header>Qualifying fuel</header><text>The term <term>qualifying fuel</term> means—</text><subparagraph id="H4EFAE0F284E54D64B6DE0106E69F3132"><enum>(A)</enum><text display-inline="yes-display-inline">any fuel at least 50 percent of the volume of which consists of natural gas, compressed natural gas, liquified natural gas, liquefied petroleum gas, or hydrogen, or</text></subparagraph><subparagraph id="H4A658A17E91D4B2484377BEC37B15996"><enum>(B)</enum><text>any fuel mixture at least 20 percent of the volume of which consists of ethanol or biodiesel, without regard to any denaturant or kerosene used in such mixture.</text></subparagraph></paragraph></subsection><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph><paragraph id="HB3A0EE224DA94AD586C66424E21C8EF1"><enum>(2)</enum><text>in subsection (g), by striking <quote>December 31, 2021</quote> and inserting <quote>December 31, 2027</quote>.</text></paragraph></subsection><subsection id="HC9492E7B2ED643E4A66F6E20CEB18549"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to taxable years beginning after December 31, 2021.</text></subsection></section></legis-body></bill>
