<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4619</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220726">July 26, 2022</action-date><action-desc><sponsor name-id="S307">Mr. Brown</sponsor> (for himself, <cosponsor name-id="S306">Mr. Menendez</cosponsor>, <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, <cosponsor name-id="S394">Ms. Smith</cosponsor>, <cosponsor name-id="S366">Ms. Warren</cosponsor>, <cosponsor name-id="S415">Mr. Warnock</cosponsor>, <cosponsor name-id="S313">Mr. Sanders</cosponsor>, <cosponsor name-id="S331">Mrs. Gillibrand</cosponsor>, <cosponsor name-id="S413">Mr. Padilla</cosponsor>, <cosponsor name-id="S386">Ms. Duckworth</cosponsor>, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, <cosponsor name-id="S316">Mr. Whitehouse</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S354">Ms. Baldwin</cosponsor>, <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, and <cosponsor name-id="S409">Mr. Luján</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that all persons shall be entitled to the full and equal enjoyment of the goods, services, facilities, privileges, and accommodations of financial institutions. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id24A9A1A9BEF44A3A800AD357433BC876"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Access to Financial Services Act of 2022</short-title></quote>.</text></section><section section-type="subsequent-section" id="id66FF3790E6AF41FD8364F6980128CAEE"><enum>2.</enum><header>Financial institutions</header><subsection id="id456E5C54B08C4EF08E4A79835BDA1BA5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">All persons shall be entitled to the full and equal enjoyment of the goods, services, facilities, privileges, and accommodations of any financial institution, as defined in section 803 of the Payment, Clearing, and Settlement Supervision Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5462">12 U.S.C. 5462</external-xref>), without discrimination on the ground of race, color, religion, national origin, and sex (including sexual orientation and gender identity).</text></subsection><subsection id="id2E8C5054CB854D38A35FEB5D5658AF3C"><enum>(b)</enum><header>Private right of action</header><paragraph id="id0E1ACE92C167475EBC6C0DF350199F14"><enum>(1)</enum><header>In general</header><text>Whenever any person has engaged or there are reasonable grounds to believe that any person is about to engage in any act or practice prohibited by subsection (a), a civil action for preventive relief, including an application for a permanent or temporary injunction, restraining order, or other order, may be instituted by the person aggrieved.</text></paragraph><paragraph id="id241F8AEBF4744F4197ACE9002E58CDBB"><enum>(2)</enum><header>Costs</header><text>In any action commenced pursuant to this section, the court, in its discretion, may allow the prevailing party, other than the United States, a reasonable attorney's fee as part of the costs, and the United States shall be liable for costs the same as a private person.</text></paragraph><paragraph id="id4282FE2EE16A49FF80CAE5BD9C2E38F4"><enum>(3)</enum><header>Jurisdiction</header><text>The district courts of the United States shall have jurisdiction of proceedings instituted pursuant to this section and shall exercise the same without regard to whether the aggrieved party shall have exhausted any administrative or other remedies that may be provided by law.</text></paragraph><paragraph id="id8BBA894E658648F58E2E5696AD738F83"><enum>(4)</enum><header>Exclusive means</header><text>The remedies provided in this subsection shall be the exclusive means of enforcing the rights based on this section, but nothing in this section shall preclude any individual or any State or local agency from asserting any right based on any other Federal or State law not inconsistent with this section, including any statute or ordinance requiring nondiscrimination in goods, services, facilities, privileges, and accommodations of any financial institution, or from pursuing any remedy, civil or criminal, which may be available for the vindication or enforcement of such right.</text></paragraph></subsection></section></legis-body></bill>
