which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve services for trafficking victims by establishing, in Homeland Security Investigations, the Investigators Maintain Purposeful Awareness to Combat Trafficking Trauma Program and the Victim Assistance Program.</official-title></form><legis-body><section id="id163a459e596749ada1913c6531132e24" section-type="section-one"><enum>1.</enum><header>Investigators Maintain Purposeful Awareness to Combat Trafficking Trauma Program</header><subsection id="id775db39c06f743cea28babca4ed2fbb6"><enum>(a)</enum><header>Establishment</header><text>There is established, in Homeland Security Investigations of U.S. Immigration and Customs Enforcement, the Investigators Maintain Purposeful Awareness to Combat Trafficking Trauma Program (referred to in this Act as the <quote>IMPACTT Program</quote>).</text></subsection><subsection id="id8e0875555def47eabce129f6b200bb7c"><enum>(b)</enum><header>Functions</header><text>The IMPACTT Program shall—</text><paragraph id="id68a6d7fb0f1a4fa18b6518784f5afc29"><enum>(1)</enum><text>provide outreach and training to Homeland Security Investigations employees and partners who have been exposed to various forms of trauma in working with victims of human trafficking, including—</text><subparagraph id="id27974d6e272f4e7cabaed62a156332f2"><enum>(A)</enum><text>self-awareness training for the relevant employees on recognizing the signs of burnout, compassion fatigue, critical incident stress, traumatic stress, posttraumatic stress, secondary traumatic stress, and vicarious trauma;</text></subparagraph><subparagraph id="idf28ac7d91a874fa7bca7aa6475de184e"><enum>(B)</enum><text>training material that provides mechanisms for self-care and resilience, and notify of resources available through the U.S. Immigration and Customs Enforcement Employee Assistance Program and other relevant accredited programs, as available; and</text></subparagraph><subparagraph id="id8e87cf1400c9454d96bc1c4be4bda607"><enum>(C)</enum><text>provide additional training to first line supervisors of relevant employees on recognizing the signs referred to in subparagraph (A) and the appropriate responses to employees exhibiting such signs;</text></subparagraph></paragraph><paragraph id="id5b85f63e2fc645c1b379b76362efce66"><enum>(2)</enum><text>include training modules that are carried out by—</text><subparagraph id="id711AEAE35F5F4749B15F46912EAEE50B"><enum>(A)</enum><text>licensed and accredited clinicians who have been trained on the exposure of various forms of trauma and other stressors experienced in working with victims; and </text></subparagraph><subparagraph id="id235493B1FC804CEEB84B9070D7817E01"><enum>(B)</enum><text>additional subject matter experts, as available; and</text></subparagraph></paragraph><paragraph id="idce1f22ec712a49bf8132396d6a43339f"><enum>(3)</enum><text>be overseen and coordinated by the Homeland Security Investigations Countering Human Trafficking Center to ensure that—</text><subparagraph id="idF618FC701CAA4B67976E8481F3244C70"><enum>(A)</enum><text>appropriate program materials are distributed;</text></subparagraph><subparagraph id="idEFB22CA395154D88B24F117D97082BC4"><enum>(B)</enum><text>training is offered to all relevant employees; and </text></subparagraph><subparagraph id="id21EA1358966C418BABFC5BF569B87981"><enum>(C)</enum><text>any needed travel and equipment is provided.</text></subparagraph></paragraph></subsection><subsection id="id8601e17514d346e78a448d2d92766b46"><enum>(c)</enum><header>Authorization of appropriations</header><text>In addition to amounts otherwise authorized to be appropriated, there is authorized to be appropriated $800,000 for each fiscal year to the Secretary of Homeland Security to carry out this subsection.</text></subsection></section><section id="idecfa57b045454ce786b4c4131c58fe83"><enum>2.</enum><header>Homeland Security Investigations Victim Assistance Program</header><subsection id="id573F71D458EA4D548D47EFE1D2CC878F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle D of title IV of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/251">6 U.S.C. 251 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id369815A559A34BDA9CB6F44F111B78A4"><section id="id5243dd6ed5a840808cf02b0e76713a39"><enum>447.</enum><header>Homeland Security Investigations Victim Assistance Program</header><subsection id="idf773e014e1c84a75a6d3da13de2762c9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id319ea7e183a04725823b8ba242e691ff"><enum>(1)</enum><header>Forensic interview specialist</header><text>The term <term>forensic interview specialist</term> is an interview professional who has specialized experience and training in conducting trauma-informed forensic interviews with victims of crime.</text></paragraph><paragraph id="ide44d2641615b4885b3feeb7bdcdeff8b"><enum>(2)</enum><header>Victim assistance specialist</header><text>The term <term>victim assistance specialist</term> is a victim assistance professional who—</text><subparagraph id="id6DE0E55EC62144649BFEA5BA93A5FF0D"><enum>(A)</enum><text>has experience working with victims of crime in a service capacity; and</text></subparagraph><subparagraph id="idD94E35C759BE44A7912453276F2A11CA"><enum>(B)</enum><text>has been trained on the exposure of various forms of trauma and other stressors experienced in working with victims.</text></subparagraph></paragraph></subsection><subsection id="idDF05D53BF100491EB92ACAFDE3AC587C"><enum>(b)</enum><header>In general</header><text>There is established, in Homeland Security Investigations of U.S. Immigration and Customs Enforcement, the Victim Assistance Program.</text></subsection><subsection id="idfc0e5e53fad24a3bb10d0e40107611db"><enum>(c)</enum><header>Functions</header><text>The Victim Assistance Program shall—</text><paragraph id="id33d9cc432f4244d4969818f5b085716e"><enum>(1)</enum><text>provide oversight, guidance, training, travel, equipment, and coordination to victim assistance personnel throughout the United States;</text></paragraph><paragraph id="ida115ec738d0e4b1c88a3e271fef71875"><enum>(2)</enum><text>recruit not fewer than—</text><subparagraph id="id19205196B96C4564BA5B1000FD0C90F3"><enum>(A)</enum><text>1 forensic interview specialist and 1 victim assistance specialist for each Homeland Security Investigations Special Agent in Charge office;</text></subparagraph><subparagraph id="id43408EB0449D4295BAFFA22CBBC571FB"><enum>(B)</enum><text>1 victim assistance specialist for—</text><clause id="id23BDD032A93A4513926D0779ED359B0B"><enum>(i)</enum><text>every Homeland Security Investigations office participating in a human trafficking task force;</text></clause><clause id="id1FE7FB316D4B471EB91A1C493B3222C1"><enum>(ii)</enum><text>every Homeland Security Investigations regional attaché office; and </text></clause><clause id="idB421BE2ABC62468893D13A916C2AA98D"><enum>(iii)</enum><text>every Homeland Security Investigations office participating in a child sexual exploitation task force;</text></clause></subparagraph></paragraph><paragraph id="id4d6e18a8c86a43dcb59e155a2f60e8f2"><enum>(3)</enum><text>provide training regarding victims’ rights, victim-related policies, roles of forensic interviewers and victim assistance specialists, and an approach that is—</text><subparagraph id="idFD6E6F8F6CF44D0BBA32F1207610A63F"><enum>(A)</enum><text>victim-centered; </text></subparagraph><subparagraph id="idB014EA435CF745B5BADF0D6D42A758D5"><enum>(B)</enum><text>trauma-informed; and</text></subparagraph><subparagraph id="id081ED083FAE548ED9DE213A74624BDD2"><enum>(C)</enum><text>linguistically appropriate; and</text></subparagraph></paragraph><paragraph id="id71723a265a864f8aa541096ff8f8b4ac"><enum>(4)</enum><text>provide sufficient funding for emergency expenditures to purchase items needed to assist identified victims, including food, clothing, hygiene products, transportation, and temporary shelter that is not otherwise provided by a nongovernmental organization.</text></paragraph></subsection><subsection id="id707e2bdbc32c40c0b6ea3c10ebf68eb0"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $25,000,000 for each fiscal year to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id81b214b1840247df8786374b0d791e26"><enum>(b)</enum><header>Technical and conforming amendments</header><text>The Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>) is amended—</text><paragraph id="id8053fa7ff6af45d194d1bd2b161e276c"><enum>(1)</enum><text>in section 1(b) (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref> note)—</text><subparagraph id="idC17DBD4418494B17B98639CFE5954BB1"><enum>(A)</enum><text>by striking the item relating to section 442 and inserting the following:</text><quoted-block style="OLC" id="id42773fc7-885b-4543-94ed-5109d275b9f8"><toc><toc-entry level="section">Sec. 442. U.S. Immigration and Customs Enforcement.</toc-entry></toc><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><continuation-text continuation-text-level="paragraph">and</continuation-text><subparagraph id="idB6E45DC29FAD4A2F9561B75949C0B4F7"><enum>(B)</enum><text>by inserting after the item relating to section 446 the following: </text><quoted-block style="OLC" id="id96038db9-8e83-4609-9f34-7e708557285a"><toc><toc-entry level="section" idref="id5243dd6ed5a840808cf02b0e76713a39">Sec. 447. Homeland Security Investigations Victim Assistance Program.</toc-entry></toc><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id599664EB2DD444F1A644A2C92508E02F"><enum>(2)</enum><text>in section 442—</text><subparagraph id="idf0de0d376ed44d1d9e5370f6a600868e"><enum>(A)</enum><text>by amending the section heading to read as follows: <quote><header-in-text style="OLC" level="section">U.S. Immigration and Customs Enforcement</header-in-text></quote>;</text></subparagraph><subparagraph id="id7b5c29ad113f49f7b1370336d27aeff1"><enum>(B)</enum><text>striking <quote>bureau</quote> each place such term appears (except in subsection (a)(1)) and inserting <quote>agency</quote>;</text></subparagraph><subparagraph id="idbc0edb001ce84e538b7542f7b2e9ec4f"><enum>(C)</enum><text>striking <quote>the Bureau of Border Security</quote> each place such term appears and inserting <quote>U.S. Immigration and Customs Enforcement</quote>;</text></subparagraph><subparagraph id="id1c46549a0da84875832f2ff2b45a50b6"><enum>(D)</enum><text>in subsection (a)—</text><clause id="ida5bc1bcbd33446eba3de67b0f1878502"><enum>(i)</enum><text>in the subsection heading, striking <quote><header-in-text style="OLC" level="subsection">of Bureau</header-in-text></quote>;</text></clause><clause id="id5417042f4cbe4f678dad0b490e59f6e8"><enum>(ii)</enum><text>in paragraph (3)(C), striking <quote>affecting the Bureau of</quote> and inserting <quote>affecting U.S.</quote>; and</text></clause><clause id="ida3fbb3b74f9e46698350116811fad06a"><enum>(iii)</enum><text>in paragraph (4), striking <quote>the Bureau.</quote> and inserting <quote>the agency.</quote>; and</text></clause></subparagraph><subparagraph id="id0b4cecfd4e194f26952d361d0687e860"><enum>(E)</enum><text>in subsection (b)(2)—</text><clause id="id2f65e96b82854d0a95b253d90cc8de79"><enum>(i)</enum><text>in the matter preceding subparagraph (A), striking <quote>Bureau of Border Security</quote> and inserting <quote>U.S. Immigration and Customs Enforcement</quote>; and</text></clause><clause id="id66aa9e0c4ec64e96987b1ca74339037a"><enum>(ii)</enum><text>in subparagraph (B), striking <quote>the Bureau of</quote> before <quote>Citizenship and Immigration Services</quote> and inserting <quote>U.S.</quote>; and</text></clause></subparagraph></paragraph><paragraph id="id487c351bd673407fa1526a65f2a0c0cb"><enum>(3)</enum><text>in section 443(2), by striking <quote>such bureau</quote> and inserting <quote>such agency</quote>.</text></paragraph></subsection></section><section id="id268f3a28d4d8432089c670b87c195059"><enum>3.</enum><header>Annual report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security shall submit a report to Congress that identifies, with respect to the reporting period—</text><paragraph id="idBC41C6BD12DB45D3A8F3AC30F3D83B3C"><enum>(1)</enum><text>the number of trainings that were provided through the IMPACTT Program and the number of personnel who received such training; and</text></paragraph><paragraph id="id37CD0591BD884D008DE6F83518F7539E"><enum>(2) </enum><text>the number of potential human trafficking victims who were assisted by the Homeland Security Investigations Victim Assistance Program.</text></paragraph></section></legis-body></bill>
