which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To address the importation and proliferation of firearm modification devices.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Illegal Weapons Trafficking Act of 2022</short-title></quote>.</text></section><section id="id9E6A2D20ECF04161921BA5B5DD0552DE"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="id46305458BA074833B0814E53A44A8AC9"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>firearm modification device</term> means any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a weapon into a machinegun; and</text></paragraph><paragraph id="id8E93BC7B3B65432AA22CB1132EC82427"><enum>(2)</enum><text>the term <term>machinegun</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/5845">section 5845</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></section><section id="idC70BF8B16BD54F56A011DC9FAC85EE9B"><enum>3.</enum><header>Prevention and interception strategy</header><subsection id="id9067014FDC2E40C2875DF9899603F0FB"><enum>(a)</enum><header>Strategy</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Attorney General, the Secretary of Homeland Security, and the Secretary of the Treasury shall develop and implement a strategy to prevent or intercept the importation or trafficking of firearm modification devices, including by—</text><paragraph id="id0ae1b4cec9284500bc26e7eef3cfc943"><enum>(1)</enum><text>improving the capacity of Federal law enforcement agencies to detect, intercept, and seize firearm modification devices;</text></paragraph><paragraph id="id48a97c3093a34398a7c6f0aef99a88b1"><enum>(2)</enum><text>increasing the coordination between State and local law enforcement agencies and Federal law enforcement agencies, including the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Federal Bureau of Investigation, Homeland Security Investigations, and U.S. Customs and Border Protection, when firearm modification devices are seized at ports of entry;</text></paragraph><paragraph id="id045bf25d195d46bdbe30b51bd6924448"><enum>(3)</enum><text>ensuring that the Bureau of Alcohol, Tobacco, Firearms and Explosives collaborates with State and local law enforcement agencies to identify and trace firearm modification devices used in crimes, including identifying the source of the device, whether from a foreign country or the United States;</text></paragraph><paragraph id="id47fc0ad925824e44bc2bdf0a3f7b3f25"><enum>(4)</enum><text>investigating and collecting data regarding the origins of firearm modification devices that are seized at ports of entry or recovered by law enforcement agencies in the United States in order to identify patterns and detect vulnerabilities; and</text></paragraph><paragraph id="ida24001791d294338a3bd43fce6f691c0"><enum>(5)</enum><text>improving the capacity of Federal law enforcement agencies, including the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Federal Bureau of Investigation, and Homeland Security Investigations, to detect, intercept, and seize domestically produced firearm modification devices, including firearm modification devices produced using 3D printing technology.</text></paragraph></subsection><subsection id="idE6E9DBB06AAD4A1DA7E434E331A8FF09"><enum>(b)</enum><header>Reports</header><paragraph id="idDFA0BF22B2AD421FB05A4353512D423B"><enum>(1)</enum><header>Initial report</header><text>Not later than 120 days after the date of enactment of this Act, the Attorney General, the Secretary of Homeland Security, and the Secretary of the Treasury shall submit a report on the strategy developed and implemented under subsection (a), which shall include relevant statistical information, to—</text><subparagraph id="idF341E1598CBA4C2E93A3C634DD967F1F"><enum>(A)</enum><text>the Committee on the Judiciary of the Senate;</text></subparagraph><subparagraph id="idC35C565C8BDC46E1AD47C1D9EE21CAF5"><enum>(B)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph><subparagraph id="id40BEE3469F7B471B83B0FFBFF69FBB5E"><enum>(C)</enum><text>the Committee on the Judiciary of the House of Representatives; and</text></subparagraph><subparagraph id="id363D488D1DFD4F5BA40CBE50DF10BC8D"><enum>(D)</enum><text>the Committee on Homeland Security of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id0F787844AB69465DAEFD35C0423B3533"><enum>(2)</enum><header>Periodic updates</header><text>Not less frequently than once every 2 years, the Attorney General, the Secretary of Homeland Security, and the Secretary of the Treasury shall submit to the congressional committees described in paragraph (1) an update to the report submitted under that paragraph that describes progress made on the implementation of the strategy developed under subsection (a).</text></paragraph></subsection></section><section id="id9608615818D0474187D8C26105833175"><enum>4.</enum><header>Forfeiture of proceeds from machinegun violations</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5872">Section 5872</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="idC46004E746C540099D0D6DE673B3A9A1"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>, and any proceeds derived from the illegal trafficking of a machinegun,</quote> after <quote>provisions of this chapter</quote>; and</text></paragraph><paragraph id="id4C81CC06781043468950FA9F5EBF0806"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4F724D4DE97E4836A95C6896162FB532"><subsection id="idA2A4F18190EA40AA915C2C3B2512EF83"><enum>(c)</enum><header>Illegal trafficking of a machinegun</header><text>For purposes of subsection (a), the term <term>illegal trafficking of a machinegun</term> means the making, manufacture, importation, exportation, or transfer of a machinegun in violation of the provisions of this chapter or any regulations prescribed under this chapter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id54D6E39C334844F1A103609C08C508FE"><enum>5.</enum><header>Gun trafficking report</header><text display-inline="no-display-inline">The Attorney General shall include information about firearm modification devices in the annual firearms trafficking report announced by the President on April 7, 2021, including—</text><paragraph id="id3249971F80AF46ABBC3D6CF700EBFA20"><enum>(1)</enum><text>the number of crimes in which firearm modification devices are used; and</text></paragraph><paragraph id="id23B4FC8150044221AF6E621AC13EA954"><enum>(2)</enum><text>whether the firearm modification devices recovered from crimes described in paragraph (1) are manufactured in the United States or a foreign country.</text></paragraph></section></legis-body></bill>
