which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To streamline the sharing of information among Federal disaster assistance agencies, to expedite the delivery of life-saving assistance to disaster survivors, to speed the recovery of communities from disasters, to protect the security and privacy of information provided by disaster survivors, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Assistance Simplification Act</short-title></quote>.</text></section><section id="idB618CC2A46E94FEFBB6F25A9BD025D7A"><enum>2.</enum><header>Findings and purpose</header><subsection id="idB76CCF327FA1431DB2AC8255F0A58627"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph id="id2219f2cb4ef1462391f7ad0654d38a04"><enum>(1)</enum><text>The disaster response framework of the United States relies on a unified, integrated, agile, and adaptable whole-of-community effort by Federal, State, and local disaster assistance agencies, and by voluntary organizations, to respond to any natural and man-made disasters that may strike communities.</text></paragraph><paragraph id="idca61dc55c3864a3c9228c4663bf231ff"><enum>(2)</enum><text>Federal disaster assistance agencies must be ready to support States, communities, and volunteer agencies immediately after unpredictable catastrophic disasters that occur without notice.</text></paragraph><paragraph id="id08263b676b754c42965a301422c53f21"><enum>(3)</enum><text>The immediate sharing of information is essential to an efficient and effective delivery of disaster assistance—</text><subparagraph id="id44FA67FE51B34650BE386405A6810484"><enum>(A)</enum><text>when lives and property are at risk; and</text></subparagraph><subparagraph id="idEB25D2040F8A415AAFF8EC7A4ACC9AAF"><enum>(B)</enum><text>as communities seek to recover from disasters as quickly as possible.</text></subparagraph></paragraph><paragraph id="idc64c154130f2438fb36d39890d276b17"><enum>(4)</enum><text>Section 552a of title 5, United States Code (commonly known as the “Privacy Act of 1974”) and subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>) require multiple layers of review, notice, and publication in the Federal Register before Federal disaster assistance agencies can amend or adapt their information sharing practices.</text></paragraph><paragraph id="ided0d55ed0f774c4e936b3e49a8c33a58"><enum>(5)</enum><text>Such extended review processes can have the effect of inhibiting efficiency, innovation, and interoperability among Federal, State, Tribal, territorial, local, private, and volunteer partners in delivering disaster assistance within a whole-of-community disaster assistance effort.</text></paragraph><paragraph id="idb21b088c9f1e427ea7643796f3fe8065"><enum>(6)</enum><text>Legal, regulatory, and policy limitations on the interagency sharing of information submitted by applicants for disaster assistance may require those applicants to submit separate applications to multiple Federal disaster assistance agencies, which increases the burden on those applicants, reduces the efficiency of disaster assistance programs, and places additional costs on taxpayers.</text></paragraph></subsection><subsection id="idDA64A4B6CA07484A9958147D281DF373"><enum>(b)</enum><header>Purpose</header><text>The purposes of this Act are to—</text><paragraph id="id3182D79A548641308A815BC4D741B050"><enum>(1)</enum><text>streamline the sharing of information among Federal disaster assistance agencies;</text></paragraph><paragraph id="id47752EFD5AD642C6AA2C3F9AFD9622E4"><enum>(2)</enum><text>modernize the legal safeguards against the unauthorized disclosure or misuse of information about applicants for disaster assistance; and</text></paragraph><paragraph id="idec875035d9494140ac0a6b981e802d6b"><enum>(3)</enum><text>modernize, streamline, and consolidate the overlapping requirements of section 552a of title 5, United States Code, subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, and the agency policies that implement those authorities to improve the speed, convenience, efficiency, and effectiveness of disaster relief programs. </text></paragraph></subsection></section><section id="idB343169C10754A4E8A66E9C5591ECA24"><enum>3.</enum><header>Establishment of DisasterAssistance.gov electronic information system</header><text display-inline="no-display-inline">The Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id18AF1DD2ED8346AEBE05B06D9C9A89CA"><section id="idE75C27176E1C4DBF860EB1CABF2F8AD4"><enum>707.</enum><header>Establishment of DisasterAssistance.gov electronic information system</header><subsection id="id403f5e07912341c7ac14092e2384a8b5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id5DBBA82A8F814C85B6AA3377756C8AD2"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></paragraph><paragraph id="id38a345e0d50946b68fae90705ee59104"><enum>(2)</enum><header>Applicant</header><text>The term <term>applicant</term> means—</text><subparagraph id="idc55e3731e92247a4b7bcb0529d1a0dfd"><enum>(A)</enum><text>an individual or organization who applies for disaster assistance from a disaster assistance program; and</text></subparagraph><subparagraph id="idf51e498755c647b6b1ca7e7242371b4a"><enum>(B)</enum><text>an individual or organization on behalf of which an individual described in subparagraph (A) applies for disaster assistance from a disaster assistance program.</text></subparagraph></paragraph><paragraph id="id3C4244876458477C836CA3881D065398"><enum>(3)</enum><header>DisasterAssistance.gov</header><text>The term <term>DisasterAssistance.gov</term> means the electronic information system established under subsection (b)(1).</text></paragraph><paragraph id="idaaba274592ea4a6481fbd43dbb5ed08f"><enum>(4)</enum><header>Disaster assistance agency</header><text>The term <term>disaster assistance agency</term> means—</text><subparagraph id="id81ebab6c1c6e4e84962df5fb50d438a3"><enum>(A)</enum><text>the Federal Emergency Management Agency;</text></subparagraph><subparagraph id="idaf5f33df172f4ebb891ef755fc8215f0"><enum>(B)</enum><text>the Department of Housing and Urban Development;</text></subparagraph><subparagraph id="idf8f0f1816d1b4f98862f42317626191e"><enum>(C)</enum><text>the Small Business Administration;</text></subparagraph><subparagraph id="id3C2AD0E01C384278A46E35422548A93C"><enum>(D)</enum><text>the Department of Agriculture; and</text></subparagraph><subparagraph id="idae2757d997904720abd989ef349a2a9f"><enum>(E)</enum><text>any Federal agency that provides disaster assistance to individuals that the Administrator certifies as a disaster assistance agency in accordance with subsection (f) to carry out the purposes of a disaster assistance program.</text></subparagraph></paragraph><paragraph id="idcc68c313ffba4ab78d013a14b57afd2a"><enum>(5)</enum><header>Disaster assistance information</header><text>The term <term>disaster assistance information</term> includes any personal, biographical, demographic, geographical, financial, or application decision information that a disaster assistance agency is authorized to collect, maintain, share, or use to—</text><subparagraph id="idECBDDC1E1AED4483A38073FE1D1831A8"><enum>(A)</enum><text>process an application for disaster assistance from a disaster assistance program; or</text></subparagraph><subparagraph id="id4DCAEAA972ED4AD08AC009E2160505AD"><enum>(B)</enum><text>otherwise carry out the purpose of a disaster assistance program.</text></subparagraph></paragraph><paragraph id="id3ced8afeaab1496694c1bb82c58923b0"><enum>(6)</enum><header>Disaster assistance program</header><text>The term <term>disaster assistance program</term> means—</text><subparagraph id="id4CF7BC4A37694406A1D9128A057DC4FC"><enum>(A)</enum><text>a program that provides disaster assistance to individuals and households under title IV or V in accordance with sections 408 and 502; or</text></subparagraph><subparagraph id="id1bfee0f2a72e4f11acc89844c211219a"><enum>(B)</enum><text>any other assistance program authorized by a Federal statute under which a disaster assistance agency awards or distributes disaster assistance to an individual, household, or organization that arises from a major disaster or emergency declared under section 401 or 501, respectively, including—</text><clause id="ide0b962fcdc7741d88542d6df50dd1d12"><enum>(i)</enum><text>disaster assistance;</text></clause><clause id="idCA9F070D1AED4315B828D08C4C5F7B87"><enum>(ii)</enum><text>long-term disaster recovery assistance;</text></clause><clause id="idAC3707196EF447B6893C7EC694A482E5"><enum>(iii)</enum><text>the post-disaster restoration of infrastructure and housing;</text></clause><clause id="idAF2655AE0C414EAEA9A39B0354625382"><enum>(iv)</enum><text>post-disaster economic revitalization;</text></clause><clause id="id9E877CCDCF8A4397A85EB715C8602195"><enum>(v)</enum><text>pre-disaster mitigation under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>);</text></clause><clause id="id6a784cd13f344b1280255f10f9edbb7b"><enum>(vi)</enum><text>a loan authorized under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>); and</text></clause><clause id="idB64C9B19C1DF426B9D7EDF74108A6D85"><enum>(vii)</enum><text>food benefit allotments under section 412 of this Act and Section 5(h) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(h)</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="idFDD78B095BF04581A16AB8DCF2A1731A"><enum>(7)</enum><header>Record</header><text>The term <term>record</term> has the meaning given the term in section 552a of title 5, United States Code.</text></paragraph></subsection><subsection id="id9b0a087dba3d49cbb4189c9ce0860038"><enum>(b)</enum><header>Establishment of consolidated application system</header><paragraph id="idDAFD35AD2D6946CFA3FB11285EEF6330"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Disaster Assistance Simplification Act</short-title>, the Administrator shall establish a web-based, interagency electronic information system to be known as DisasterAssistance.gov to—</text><subparagraph id="idd7d9cc53affc47dd909619ab6d90685d"><enum>(A)</enum><text>facilitate a consolidated application for any form of disaster assistance provided by a disaster assistance agency;</text></subparagraph><subparagraph id="ida1cc30d1e47541a48525a2e38752d960"><enum>(B)</enum><text>carry out the purposes of disaster assistance programs swiftly, efficiently, equitably, and in accordance with applicable laws and the privacy and data protections provided under this section; and</text></subparagraph><subparagraph id="idfa28800725a746ccad9ca57445dea955"><enum>(C)</enum><text>detect, prevent, and investigate waste, fraud, abuse, or discrimination in the administration of disaster assistance programs.</text></subparagraph></paragraph><paragraph id="id5bd36db2c6de40548dcb1d9dba0adc3c"><enum>(2)</enum><header>Capabilities of the consolidated application system</header><text>DisasterAssistance.gov shall—</text><subparagraph id="ida9f43bb4ce464f81860af9a8f8167a7e"><enum>(A)</enum><text>allow for applicants to receive status updates on applications for disaster assistance programs through DisasterAssistance.gov;</text></subparagraph><subparagraph id="id2eda9d6986fd4d048f4a1c6d7bf9dfdd"><enum>(B)</enum><text>allow for applicants to update disaster assistance information throughout the recovery journeys of those applicants;</text></subparagraph><subparagraph id="idcca0790964334b2ab41d0725c561277f"><enum>(C)</enum><text>allow for the distribution of additional recovery resource information to disaster survivors that may be available in a disaster stricken jurisdiction;</text></subparagraph><subparagraph id="idfcde930ecdcf4c1d80b7b43ca7fe6cb1"><enum>(D)</enum><text>provide disaster survivors with information and documentation on the applications of those disaster survivors for a disaster assistance program; and</text></subparagraph><subparagraph id="idc3ce683354214129a4218fd7b6aed7a0"><enum>(E)</enum><text>contain other capabilities determined necessary by the heads of disaster assistance agencies. </text></subparagraph></paragraph></subsection><subsection id="idaf9f1069e47b4c0ca09cb1353114689d"><enum>(c)</enum><header>Authorities of Administrator</header><text>The Administrator may—</text><paragraph id="id2dd10a9baa4a4c09aeb0de449301dcbc"><enum>(1)</enum><text>collect, maintain, share, and use disaster assistance information using DisasterAssistance.gov or received from any disaster assistance agency with any other disaster assistance agency; and</text></paragraph><paragraph id="idbd156bb227e84727b7e5057694d8c309"><enum>(2)</enum><text>subject to subsection (d), authorize the collection, sharing, and use of disaster assistance information collected on or after the date of enactment of the <short-title>Disaster Assistance Simplification Act</short-title> by publishing a notice on DisasterAssistance.gov that—</text><subparagraph id="id17C1C94D4BEF4DD284A0B41CE59D04F7"><enum>(A)</enum><text>includes a detailed description of—</text><clause id="idc5d6faf7d930432981e0cbf0d8d76d41"><enum>(i)</enum><text>the specific disaster assistance information authorized to be collected, maintained, and shared;</text></clause><clause id="idd5cda5ba3fdd4ced8cbbde4136645350"><enum>(ii)</enum><text>why the collection, maintenance, or sharing of the disaster assistance information is—</text><subclause id="id41B60C9CCC164D449892C737A1BBB131"><enum>(I)</enum><text>necessary to carry out the purpose of a disaster assistance program; and</text></subclause><subclause id="id6B9BC5634C1943D09907055A44A5F6F7"><enum>(II)</enum><text>consistent with fair information practice principles; and</text></subclause></clause><clause id="id2a6252c9cefb495ca282e04008cb84cb"><enum>(iii)</enum><text>the disaster assistance agencies that will be granted access to the disaster assistance information to carry out the purpose of any disaster assistance program; and</text></clause></subparagraph><subparagraph id="idB530B7DFA4FE4EFF9896A54DDCBAC001"><enum>(B)</enum><text>the submission of an application through DisasterAssistance.gov constitutes prior written consent to disclose disaster assistance information to disaster assistance agencies for the purpose of section 552a(b) of title 5, United States Code.</text></subparagraph></paragraph></subsection><subsection id="idb88b3305c307424084925cd3ee36c796"><enum>(d)</enum><header>Collection and sharing of records and information</header><paragraph id="id789acd4f27bf48a3af404b74a1037b30"><enum>(1)</enum><header>Effect of publication of notice on DisasterAssistance.gov</header><text>The publication of a notice by the Administrator on DisasterAssistance.gov of a revision to the DisasterAssistance.gov system of records on DisasterAssistance.gov prior to any new collection, or uses, of records, to carry out the purposes of a disaster assistance program with respect to a major disaster or emergency declared by the President under section 401 or 501, respectively, of this Act shall be deemed to satisfy the notice and publication requirements of section 552a(e)(4) of title 5, United States Code, for a period of not more than 90 days following such declaration, unless such revision has been published in the Federal Register earlier than 90 days after the date of such declaration.</text></paragraph><paragraph id="id2E92A1686A784706A23FBA3CB1D4D247"><enum>(2)</enum><header>Paperwork Reduction Act waiver</header><subparagraph id="id321A72F8FA7E4D5E8457CD22F0B9C609"><enum>(A)</enum><header>In general</header><text>Upon the declaration of a major disaster or emergency pursuant to section 401 or 501, respectively, of this Act, the President, without delegation, may direct the Secretary of Homeland Security to waive the requirements of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States (commonly known as the <quote>Paperwork Reduction Act</quote>) with respect to voluntary collection of information to carry out the purposes of a disaster assistance program.</text></subparagraph><subparagraph id="id82CA20945C7640B4BB596E3D2606B807"><enum>(B)</enum><header>Duration</header><text>A waiver described in subparagraph (A) shall be in effect for the duration of the major disaster or emergency, as applicable. </text></subparagraph><subparagraph id="idF0049987DA454598AA0064B49D09BA10"><enum>(C)</enum><header>Transparency</header><text>If the Secretary of Homeland Security waives the requirements described in subparagraph (A), the Secretary shall—</text><clause id="id76623D94E0F74631BDC9653AFB328957"><enum>(i)</enum><text>promptly post on the internet website of the Department of Homeland Security—</text><subclause id="idB9E88C40065C49FEA3BC249866B920B5"><enum>(I)</enum><text>a brief justification for the waiver; and</text></subclause><subclause id="id7B4CC0D482104FCEB5E5ECC33AB9C7B6"><enum>(II)</enum><text>the agencies and offices to which the waiver shall apply; and</text></subclause></clause><clause id="id31150E725DBF4B799F8A1EA5F824DF2F"><enum>(ii)</enum><text>update the information posted under clause (i), as applicable.</text></clause></subparagraph><subparagraph id="idA0268DE2BB99411384C7A2C9C19E9C31"><enum>(D)</enum><header>Effectiveness of waiver</header><text>Any waiver under subparagraph (A) shall take effect on the date on which the Secretary of Homeland Security posts information on the internet website as provided for under subparagraph (C).</text></subparagraph></paragraph></subsection><subsection id="id66807995ed6343f78f14a8939b2d2b10"><enum>(e)</enum><header>Data security</header><text>The Administrator shall facilitate the collection of disaster assistance information into DisasterAssistance.gov only after—</text><paragraph id="idcc2a322a15904e2aba7e0a1a2ce5e4fd"><enum>(1)</enum><text>the Administrator certifies that DisasterAssistance.gov substantially complies with the data security standards and best practices of the National Institute of Standards and Technology;</text></paragraph><paragraph id="ida9969dfdc59a480d88026e5370758360"><enum>(2)</enum><text>the Secretary of Homeland Security publishes a privacy impact assessment for DisasterAssistance.gov that is similar to the privacy assessment conducted under section 222(a)(4) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/142">6 U.S.C. 142(a)(4)</external-xref>); and</text></paragraph><paragraph id="ide029280731f74a5e93782bd23f98b81b"><enum>(3)</enum><text>the Administrator publishes standard rules of behavior for disaster assistance agencies and personnel granted access to disaster assistance information to protect such information from improper disclosure.</text></paragraph></subsection><subsection id="id7772f5b1e39049f4ad4c2b921661bb73"><enum>(f)</enum><header>Certification of disaster assistance agencies</header><paragraph id="idB304346279C24619AC0DC5ED1C14A4F6"><enum>(1)</enum><header>In general</header><text>The Administrator may certify a Federal agency as a disaster assistance agency after posting an agreement between the Administrator and the Federal agency on DisasterAssistance.gov that contains the detailed terms of the agreement.</text></paragraph><paragraph id="id7A97EAC52F0144BB843EDA10701BA51E"><enum>(2)</enum><header>Contents of agreement</header><text>An agreement between the Administrator and a Federal agency described in paragraph (1) shall state that the Federal agency will—</text><subparagraph id="id6805c4f7c2e14442913e896a97ff1004"><enum>(A)</enum><text>collect, share, maintain, and use disaster assistance information—</text><clause id="id8EAAA585C75643C9AB9D62E7C4304B5B"><enum>(i)</enum><text>in accordance with this section; and</text></clause><clause id="idC66CE07191B249E39AB9C8CB29755927"><enum>(ii)</enum><text>in substantial compliance with the data security standards and best practices of the National Institute of Standards and Technology;</text></clause></subparagraph><subparagraph id="id91f92aeb5ba94e31b8303403e1d64fc6"><enum>(B)</enum><text>train any personnel granted access to disaster assistance information on the rules of behavior established by the Administrator under subsection (e)(3);</text></subparagraph><subparagraph id="id23c453e2c10b40ee8412b29b95ab000d"><enum>(C)</enum><text>in the event of any unauthorized disclosure of disaster assistance information—</text><clause id="idb6a0fe0f4cbc491f8a50e3f673990c77"><enum>(i)</enum><text>not later than 24 hours after discovering the unauthorized disclosure, notify the Administrator of the disclosure;</text></clause><clause id="id8686dbcb010a46c3aa357982bbaaf140"><enum>(ii)</enum><text>cooperate fully with the Administrator in the investigation and remediation of the disclosure; and</text></clause><clause id="idaeb9d00b7a9441de901d7a2c317d35eb"><enum>(iii)</enum><text>cooperate fully in the prosecution of a person responsible for the disclosure; and</text></clause></subparagraph><subparagraph id="id1e7f8cd98fa64fcb971739a3d84d3c1a"><enum>(D)</enum><text>assume the responsibility for any compensation, civil liability, or other remediation measure awarded by a judgment of a court or agreed as a compromise of any potential claim by or on behalf of an applicant, including by obtaining credit monitoring and remediation services, for an improper disclosure of disaster assistance information that is—</text><clause id="id408c467fff12439a8377822ec7e09fe0"><enum>(i)</enum><text>caused, directly or indirectly, by the acts or omissions of an officer, employee, or contractor of the disaster assistance agency; or</text></clause><clause id="idf79a75fb1c8a40ad87facc7b736ac61d"><enum>(ii)</enum><text>from any electronic system of records that created or maintained by the disaster assistance agency pursuant to section 552a(e) of title 5, United States Code.</text></clause></subparagraph></paragraph></subsection><subsection id="id8e9a93237065452388c4624244ed8589"><enum>(g)</enum><header>Rules of construction</header><paragraph id="id6848478805764B269DC223CA23123663"><enum>(1)</enum><header>Inapplicability of matching program provisions</header><text>The sharing of disaster assistance information subject to the requirements of section 552a of title 5, United States Code among disaster assistance agencies or with State, local, or Tribal governments carrying out disaster assistance programs shall not—</text><subparagraph id="idFFFF46D5764E43E7AFC9F9EE224E5490"><enum>(A)</enum><text>be construed as a matching program for the purpose of section 552a(a)(8) of title 5, United States Code;
