Definitions.</toc-entry><toc-entry level="section">614. Office of Regulatory Analysis; establishment; powers.</toc-entry><toc-entry level="section">615. Functions of Office of Regulatory Analysis; Executive branch agency compliance.</toc-entry><toc-entry level="section">616. Regulatory Analysis Advisory Board.</toc-entry></toc><section id="id8A5923BFF9364BD5B5A1DE76A0FD0DA9"><enum>613.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text><paragraph id="iddcf17d650e814b0ba2f4c37a4b4fa260"><enum>(1)</enum><text>the term <term>aggregate costs</term>, with respect to a covered Federal rule, means the sum of—</text><subparagraph id="id8CFA38B8B1294880AAD54201A2DF0BBE"><enum>(A)</enum><text>the direct costs of the covered Federal rule; and</text></subparagraph><subparagraph id="id46F34F19FF454F1684E561B71021154D"><enum>(B)</enum><text>the regulatory costs of the covered Federal rule;</text></subparagraph></paragraph><paragraph id="id4565992F38264E04B826BD659E430344"><enum>(2)</enum><text>the term <term>covered Federal rule</term> means—</text><subparagraph id="id7d8e3d4e55d6461a8324759b51659819"><enum>(A)</enum><text>a rule (as defined in section 551);</text></subparagraph><subparagraph id="id1130fe04312d49d7adcc4501715bc5de"><enum>(B)</enum><text>an information collection requirement given a control number by the Office of Management and Budget; or</text></subparagraph><subparagraph id="id62d76696e67a483f852f11907da8d588"><enum>(C)</enum><text>guidance or a directive that—</text><clause id="id40E68601F9A8402F93F76B5CC2461B14"><enum>(i)</enum><text>is not described in subparagraph (A) or (B);</text></clause><clause id="idC3BC0D4B83BF4E5C9656D6E148E6839F"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id30FDC440F6DF4BEAA6CEC94E96B79958"><enum>(I)</enum><text>is mandatory in its application to regulated entities; or</text></subclause><subclause id="id0337C8113F5E47C8A453AC9614BE91B4" indent="up1"><enum>(II)</enum><text>represents a statement of agency position that regulated entities would reasonably construe as reflecting the enforcement or litigation position of the agency; and</text></subclause></clause><clause id="id45ACE07818664166AFAF94B5E51D1333"><enum>(iii)</enum><text>imposes not less than $25,000,000 in annual costs on regulated entities;</text></clause></subparagraph></paragraph><paragraph id="id39da3eb036db4820826c0b81630c4990"><enum>(3)</enum><text>the term <term>direct costs</term> means—</text><subparagraph id="id52fe237f530f4fd898f5b0efcb59f518"><enum>(A)</enum><text>expenditures made by an Executive branch agency that relate to the promulgation, administration, or enforcement of a covered Federal rule; or</text></subparagraph><subparagraph id="id466eb1b94db143b6a6c2a21bd2fa4f8b"><enum>(B)</enum><text>costs incurred by an Executive branch agency or any other instrumentality of the Federal Government because of a covered Federal rule;</text></subparagraph></paragraph><paragraph id="id2CC3B59A213649B78FC3514AA580059E"><enum>(4)</enum><text>the term <term>Director</term> means the Director of the Office of Regulatory Analysis established under section 614(b);</text></paragraph><paragraph id="id1a0cf47087474d9eb5c53db3e975e6f8"><enum>(5)</enum><text>the term <term>Executive branch agency</term> has the meaning given the term <term>agency</term> in section 551, except that it shall not include an authority of the Government of the United States that is within another agency;</text></paragraph><paragraph id="id7625b837eb6c4ac5a0cbd30c4ba53970"><enum>(6)</enum><text>the term <term>regulated entity</term> means—</text><subparagraph id="id6D52F8C9629144E6A6A7D431D592B386"><enum>(A)</enum><text>a for-profit private sector entity (including an individual who is in business as a sole proprietor);</text></subparagraph><subparagraph id="idDDC94BC64696443BB0D55E69DA08FDD9"><enum>(B)</enum><text>a not-for-profit private sector entity; or</text></subparagraph><subparagraph id="idBC64BC471CFC42D4B626A066EEAD5C2D"><enum>(C)</enum><text>a State or local government; and</text></subparagraph></paragraph><paragraph id="id2198015a0fbd4aa2888029a3ac06ec5c"><enum>(7)</enum><text>the term <term>regulatory costs</term> means all costs incurred by a regulated entity because of covered Federal rules.</text></paragraph></section><section id="id3e55bdc9761846e4a61ede920abe8cc8"><enum>614.</enum><header>Office of Regulatory Analysis; establishment; powers</header><subsection id="id0d33e20592e14d29be97e3cf86ebfb60"><enum>(a)</enum><header>Establishment</header><text>There is established in the executive branch an independent establishment to be known as the <quote>Office of Regulatory Analysis</quote>.</text></subsection><subsection id="idcc952117f357475caa47c19424ff0d26"><enum>(b)</enum><header>Director</header><paragraph id="idC3426A314FF04A688C48066E4049FE69"><enum>(1)</enum><header>Establishment of position</header><text>There shall be at the head of the Office of Regulatory Analysis a Director, who shall be appointed by the President, by and with the advice and consent of the Senate.</text></paragraph><paragraph id="id4c7eb728fda4467c8912c1360d5611bd"><enum>(2)</enum><header>Term</header><subparagraph id="id96BEEB0EAF834E9795537D46FDA47F14"><enum>(A)</enum><header>In general</header><text>The term of office of the Director shall—</text><clause id="idB3D30371F2D94D099EE7B6F537A6DE91"><enum>(i)</enum><text>be 4 years; and</text></clause><clause id="id9188891672C54AA782F5FA5424DE1B7D"><enum>(ii)</enum><text>expire on the last day of February following each Presidential election.</text></clause></subparagraph><subparagraph id="id7D8E1FAE88744C73B0015C41FCE7A0D8"><enum>(B)</enum><header>Appointments prior to expiration of term</header><text>Subject to subparagraph (C), an individual appointed as Director to fill a vacancy prior to the expiration of a term shall serve only for the unexpired portion of the term.</text></subparagraph><subparagraph id="idB9934E8560604FF3AA9326E6E19660EC"><enum>(C)</enum><header>Service until appointment of successor</header><text>An individual serving as Director at the expiration of a term may continue to serve until a successor is appointed.</text></subparagraph></paragraph><paragraph id="idbafe909ce71d41778970e19c4496c9b5"><enum>(3)</enum><header>Powers</header><subparagraph id="idAF35D8DF9AD243A69D710C55FD053AE2"><enum>(A)</enum><header>Appointment of Deputy Directors, officers, and employees</header><clause id="id9E699C7111D94A0CAD3CECDF0A3CEF42"><enum>(i)</enum><header>In general</header><text>The Director may appoint Deputy Directors, officers, and employees, including attorneys, in accordance with chapter 51 and subchapter III of chapter 53.</text></clause><clause id="id0E8E07E6D92849AD8C91B9B7F790EBC5"><enum>(ii)</enum><header>Term of Deputy Directors</header><text>A Deputy Director shall serve until the expiration of the term of office of the Director who appointed the Deputy Director (and until a successor to that Director is appointed), unless sooner removed by the Director.</text></clause></subparagraph><subparagraph id="id4168b8bd4c604676b476887efdda5439"><enum>(B)</enum><header>Contracting</header><clause id="id554EEEAC38664F7FA9DCAD053A1317B6"><enum>(i)</enum><header>In general</header><text>The Director may contract for financial and administrative services (including those related to budget and accounting, financial reporting, personnel, and procurement) with the General Services Administration, or such other Federal agency as the Director determines appropriate, for which payment shall be made in advance, or by reimbursement, from funds of the Office of Regulatory Analysis in such amounts as may be agreed upon by the Director and the head of the Federal agency providing the services.</text></clause><clause id="idD33E8AD7840D4B5C9D19186ED0D839BD"><enum>(ii)</enum><header>Subject to appropriations</header><text>Contract authority under clause (i) shall be effective for any fiscal year only to the extent that appropriations are available for that purpose.</text></clause></subparagraph></paragraph></subsection><subsection id="id8ca99800fb384c5d82ebdb5880a0013e"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Office of Regulatory Analysis for each fiscal year such sums as may be necessary to enable the Office of Regulatory Analysis to carry out its duties and functions.</text></subsection></section><section id="idf0acfd2173074691ace2bff76c6da88e"><enum>615.</enum><header>Functions of Office of Regulatory Analysis; Executive branch agency compliance</header><subsection id="id19ada37c61d4468db50b8a203f65f45f"><enum>(a)</enum><header>Annual report required</header><paragraph id="id1BD5CB7A483D4180B9F9C115D5D68B41"><enum>(1)</enum><header>In general</header><text>Not later than January 30 of each year, the Director shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Small Business and Entrepreneurship of the Senate, the Committee on Oversight and Reform of the House of Representatives, and the Committee on Small Business of the House of Representatives a Report on National Regulatory Costs (referred to in this section as the <term>Report</term>) that includes the information specified under paragraph (2).</text></paragraph><paragraph id="idC56F089A62C94EBCAE136FA5ED3287E5"><enum>(2)</enum><header>Contents</header><text>Each Report shall include–</text><subparagraph id="id98e37b0ba20443118d71b072893e9737"><enum>(A)</enum><text>an estimate, for the fiscal year during which the Report is submitted and for the preceding fiscal year, of—</text><clause id="idF22431574F774FC4829EEDC45B74C076"><enum>(i)</enum><text>the regulatory costs imposed by each Executive branch agency on regulated entities;</text></clause><clause id="id9016ef6ba35d4162933c8faee16a34dd"><enum>(ii)</enum><text>the aggregate costs imposed by each Executive branch agency;</text></clause><clause id="id8e7b54aac81947508ceeaf401c6ca376"><enum>(iii)</enum><text>the aggregate costs imposed by all Executive branch agencies combined;</text></clause><clause id="id70d23c7855f74e7c9e0088ecf50749c8"><enum>(iv)</enum><text>the direct costs incurred by the Federal Government because of covered Federal rules issued by each Executive branch agency;</text></clause><clause id="id648f582ef1d54ee4a45048cf797d8687"><enum>(v)</enum><text>the sum of the costs described in clauses (iii) and (iv);</text></clause><clause id="idf5cc2afa91f542239e0c81347d07f73c"><enum>(vi)</enum><text>the regulatory costs imposed by each Executive branch agency on small businesses, small organizations, and small governmental jurisdictions (as those terms are defined in section 601); and</text></clause><clause id="ideb672e1f9e9446279ca84ce19d3ecf30"><enum>(vii)</enum><text>the sum of the costs described in clause (vi);</text></clause></subparagraph><subparagraph id="id3dfe7573b2b8455d92d1b5b8b1c76d4d"><enum>(B)</enum><text>an analysis of any major changes in estimation methodology used by the Office of Regulatory Analysis since the previous annual report;</text></subparagraph><subparagraph id="id5a27758866dd4b6a90f58e61b5851579"><enum>(C)</enum><text>an analysis of any major estimate changes caused by improved or inadequate data since the previous annual report;</text></subparagraph><subparagraph id="idf1bbde12216c44789dc139303715bc90"><enum>(D)</enum><text>recommendations, both general and specific, regarding—</text><clause id="id37eec1a8bf374b5ab9d8b9c68c2855df"><enum>(i)</enum><text>how regulations may be streamlined, simplified, and modernized;</text></clause><clause id="ida324aa25375043439dee7a5be189ebff"><enum>(ii)</enum><text>regulations that should be repealed; and</text></clause><clause id="id120a0c9456404fcbad5ffe6c3d103ae8"><enum>(iii)</enum><text>how the Federal Government may reduce the costs of regulations without diminishing the effectiveness of regulations; and</text></clause></subparagraph><subparagraph id="ideef0cae3c6174297af76c18dd08f3b63"><enum>(E)</enum><text>any other information that the Director determines may be of assistance to Congress in determining the National Regulatory Budget required under section 617.</text></subparagraph></paragraph></subsection><subsection id="id01d3d598360141b28ef5c174e41547b3"><enum>(b)</enum><header>Regulatory analysis of new rules</header><paragraph id="idE6317C98939740DFBFAC3C571ABCABF1"><enum>(1)</enum><header>Requirement</header><text>The Director shall publish in the Federal Register and on the website of the Office of Regulatory Analysis a regulatory analysis of each proposed covered Federal rule issued by an Executive branch agency, and each proposed withdrawal or modification of a covered Federal rule by an Executive branch agency, that—</text><subparagraph id="id091ad85543a84c4e8f2b31981b8af9e0"><enum>(A)</enum><text>imposes costs on a regulated entity; or</text></subparagraph><subparagraph id="iddc23d566915e41e88018eeafb8d30202"><enum>(B)</enum><text>reduces costs imposed on a regulated entity.</text></subparagraph></paragraph><paragraph id="id60B9DDFE47AF47B6A8C7D9470DCAF196"><enum>(2)</enum><header>Contents</header><text>Each regulatory analysis published under paragraph (1) shall include—</text><subparagraph id="idE49E35905B9D4BEB8D23948A70A3A64F"><enum>(A)</enum><text>an estimate of the change in regulatory cost of each proposed covered Federal rule (or proposed withdrawal or modification of a covered Federal rule); and</text></subparagraph><subparagraph id="id6633BFD36536438EA0B621F9114C8D91"><enum>(B)</enum><text>any other information or recommendation that the Director may choose to provide.</text></subparagraph></paragraph><paragraph id="ida503f4b2d73842cd84501292ad74fb2a"><enum>(3)</enum><header>Timing of regulatory analysis</header><subparagraph id="idBB484E57858A4F58A603B20985549DF5"><enum>(A)</enum><header>Initial regulatory analysis</header><text>Not later than 60 days after the date on which the Director receives a copy of a proposed covered Federal rule from the head of an Executive branch agency under paragraph (4), the Director shall publish an initial regulatory analysis.</text></subparagraph><subparagraph id="id0212CBD78EFE47138AB27A41951F8DEC"><enum>(B)</enum><header>Revised regulatory analysis</header><text>The Director may publish a revised regulatory analysis at any time.</text></subparagraph></paragraph><paragraph id="idf8e12ba4227049a8933566170bc0a7a8"><enum>(4)</enum><header>Notice to Director of proposed covered Federal rule</header><text>The head of an Executive branch agency shall provide a copy of each proposed covered Federal rule to the Director in a manner prescribed by the Director.</text></paragraph></subsection><subsection id="id122b92f475644e229bd023fd86d6ce00"><enum>(c)</enum><header>Effective dates</header><paragraph id="idE79FBADFE8A84F77A8C8C07FBCD1534C"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a covered Federal rule may not take effect earlier than 75 days after the date on which the head of the Executive branch agency proposing the covered Federal rule submits a copy of the proposed covered Federal rule to the Director in the manner prescribed by the Director under subsection (b)(4).</text></paragraph><paragraph id="id397395E1212B401ABE3DC3BFB74D514F"><enum>(2)</enum><header>Exception</header><text>If the head of the Executive branch agency proposing a covered Federal rule determines that the public health or safety or national security requires that the covered Federal rule be promulgated earlier than the date specified under paragraph (1), the head of the Executive branch agency may promulgate the covered Federal rule without regard to paragraph (1).</text></paragraph></subsection></section><section id="idfe2b73fc229d466991e213783054db77"><enum>616.</enum><header>Public disclosure of estimate methodology and data; privacy</header><subsection id="idb07dfad5e5604240850f21e1dcf3aea0"><enum>(a)</enum><header>Privacy</header><text>The Director shall comply with all relevant privacy laws, including—</text><paragraph id="idC3A86032CF724AA6948D81B2B01425D6"><enum>(1)</enum><text>the Confidential Information Protection and Statistical Efficiency Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/44/3501">44 U.S.C. 3501</external-xref> note);</text></paragraph><paragraph id="id8EB35BFDEEDE4822AB08E6B101DDBD0C"><enum>(2)</enum><text>section 9 of title 13; and</text></paragraph><paragraph id="id06F01227A05A41C798069CC6C6D81AD6"><enum>(3)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></subsection><subsection id="ida0db35cb387d495b9206b05856cd4aa2"><enum>(b)</enum><header>Disclosure</header><paragraph id="id178BC23DC4B74DDCB8CD7BA114638C36"><enum>(1)</enum><header>In general</header><text>To the maximum extent permitted by law, the Director shall disclose, by publication in the Federal Register and on the website of the Office of Regulatory Analysis, the methodology and data used to generate the estimates in the Report on National Regulatory Costs required under section 615.</text></paragraph><paragraph id="id37F2BD1F45454E5286FECD6B9A09D875"><enum>(2)</enum><header>Goal of disclosure</header><text>In disclosing the methodology and data under paragraph (1), the Director shall seek to provide sufficient information so that outside researchers may replicate the results contained in the Report on National Regulatory Costs.</text></paragraph></subsection></section><section id="idf012615b3a584739b259671ff3f8cd82"><enum>617.</enum><header>National Regulatory Budget; timeline</header><subsection id="id2b5fcdead499439a994dcebcdfc59611"><enum>(a)</enum><header>Definition</header><text>In this section—</text><paragraph id="id9C2A4E674E0B444B9033EEDEC3E1AFE0"><enum>(1)</enum><text>the term <term>annual overall regulatory cost cap</term> means the maximum amount of regulatory costs that all Executive branch agencies combined may impose in a fiscal year;</text></paragraph><paragraph id="idAE58C20247EE42E29BDCCB79736BE299"><enum>(2)</enum><text>the term <term>annual agency regulatory cost cap</term> means the maximum amount of regulatory costs that an Executive branch agency may impose in a fiscal year; and</text></paragraph><paragraph id="id449A2A4654274C7CB353A82EAECE2BC4"><enum>(3)</enum><text>the term <term>National Regulatory Budget</term> means an Act of Congress that establishes, for a fiscal year—</text><subparagraph id="id7850E54BB1974FE48CADBBACD9CD97D9"><enum>(A)</enum><text>the annual overall regulatory cost cap; and</text></subparagraph><subparagraph id="id61FA8A5BA61E4F5E8A516227E1ADEF16"><enum>(B)</enum><text>an annual agency regulatory cost cap for each Executive branch agency.</text></subparagraph></paragraph></subsection><subsection id="idf7c27323180c46d2bb9334d2c3421cca"><enum>(b)</enum><header>Committee deadlines</header><paragraph id="id0A5ADE7B8F0040F08F59F337D1213416"><enum>(1)</enum><header>Referral</header><text>Not later than March 31 of each year—</text><subparagraph id="id2726FECEBB9842D88B7A586AED7379DE"><enum>(A)</enum><text>the Committee on Small Business and Entrepreneurship of the Senate shall refer to the Committee on Homeland Security and Governmental Affairs of the Senate a bill that sets forth a National Regulatory Budget for the fiscal year beginning on October 1 of that year; and</text></subparagraph><subparagraph id="id3dfa25d8a26d4c7eb8bd04bfd639fee6"><enum>(B)</enum><text>the Committee on Small Business of the House of Representatives shall refer to the Committee on Oversight and Reform of the House of Representatives a bill that sets forth a National Regulatory Budget for the fiscal year beginning on October 1 of that year.</text></subparagraph></paragraph><paragraph id="ide9764509431d4955864531c222ccd2b2"><enum>(2)</enum><header>Reporting</header><text>Not later than May 31 of each year—</text><subparagraph id="idBF38FFF250014865A16499FD499C7CF5"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate shall report a bill establishing a National Regulatory Budget for the fiscal year beginning on October 1 of that year; and</text></subparagraph><subparagraph id="ide78013fd1f4544678a73f357a6c6872e"><enum>(B)</enum><text>the Committee on Oversight and Reform of the House of Representatives shall report a bill establishing a National Regulatory Budget for the fiscal year beginning on October 1 of that year.</text></subparagraph></paragraph></subsection><subsection id="id9a6b41f7770e4632aeaa243e8ceeb569"><enum>(c)</enum><header>Passage</header><text>Not later than July 31 of each year, the House of Representatives and the Senate shall each pass a bill establishing a National Regulatory Budget for the fiscal year beginning on October 1 of that year.</text></subsection><subsection id="ide6dcbd0cfb8843bdbc81bfbdf5c3055b"><enum>(d)</enum><header>Presentment</header><text>Not later than September 15 of each year, Congress shall pass and present to the President a National Regulatory Budget for the fiscal year beginning on October 1 of that year.</text></subsection><subsection id="idca9fe72c4c394f0d91265a0a784f0ccd"><enum>(e)</enum><header>Default budget</header><paragraph id="id9B3654F5D4274B0B8C1C47599E839B03"><enum>(1)</enum><header>In general</header><text>If a National Regulatory Budget is not enacted with respect to a fiscal year, the most recently enacted National Regulatory Budget shall apply to that fiscal year.</text></paragraph><paragraph id="idE0537C7983D04E5A808254D93F182861"><enum>(2)</enum><header>Default initial budget</header><subparagraph id="id499D8EC81D474CC3934D7C1F77E0518D"><enum>(A)</enum><header>Calculation</header><text>If a National Regulatory Budget is not enacted with respect to a fiscal year, and no National Regulatory Budget has previously been enacted—</text><clause id="id1328C2A9E8DD44F7ACDE4270B8CF4611"><enum>(i)</enum><text>the annual agency regulatory cost cap for an Executive branch agency for the fiscal year shall be equal to the amount of regulatory costs imposed by that Executive branch agency on regulated entities during the preceding fiscal year, as estimated by the Director in the annual report submitted to Congress under section 615(a); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1A9761F2C7C74E6895230E02D91560BD"><enum>(ii)</enum><text display-inline="yes-display-inline">the annual overall regulatory cost cap for the fiscal year shall be equal to the sum of the amounts described in clause (i).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3BE9D90E87BD4B95A9E04BF72BB5C9CE"><enum>(B)</enum><header>Effect</header><text display-inline="yes-display-inline">For purposes of section 619, an annual agency regulatory cost cap described in subparagraph (A) that applies to a fiscal year shall have the same effect as if the annual agency regulatory cost cap were part of a National Regulatory Budget applicable to that fiscal year.</text></subparagraph></paragraph></subsection><subsection id="id315c5ddc774143209bdef7a77269a588"><enum>(f)</enum><header>Initial budget</header><text>The first National Regulatory Budget shall be with respect to fiscal year 2024.</text></subsection></section><section id="id6949c0048e7b42baaef7f15afa1e472f"><enum>618.</enum><header>Executive branch agency cooperation mandatory; information sharing</header><subsection id="idefb2bd4ce9e340509c1d470e7f608407"><enum>(a)</enum><header>Executive branch agency cooperation mandatory</header><text>Not later than 45 days after the date on which the Director requests any information from an Executive branch agency, the Executive branch agency shall provide the Director with the information.</text></subsection><subsection id="idd63c7bdb093e498faed7c11786bf4156"><enum>(b)</enum><header>Memoranda of understanding regarding confidentiality</header><paragraph id="id7490E77E0E4A4D17ADE1DE81CDE14D25"><enum>(1)</enum><header>In general</header><text>An Executive branch agency may require the Director to enter into a memorandum of understanding regarding the confidentiality of information provided by the Executive branch agency to the Director under subsection (a) as a condition precedent to providing any requested information.</text></paragraph><paragraph id="idD7BF2F53BFF0424C9C3D33D31998EF36"><enum>(2)</enum><header>Degree of confidentiality or data protection</header><text>An Executive branch agency may not require a greater degree of confidentiality or data protection from the Director in a memorandum of understanding entered into under paragraph (1) than the Executive branch agency itself must adhere to.</text></paragraph><paragraph id="id49C248870FFA40779C94F10B010D35E7"><enum>(3)</enum><header>Scope</header><text>A memorandum of understanding entered into by the Director and an Executive branch agency under paragraph (1) shall—</text><subparagraph id="id0E893AD22D6C4987A6208AC3C6016B5A"><enum>(A)</enum><text>be general in scope; and</text></subparagraph><subparagraph id="id18E511715AE94008BDE06121D8B54E3B"><enum>(B)</enum><text>govern all pending and future requests made to the Executive branch agency by the Director.</text></subparagraph></paragraph></subsection><subsection id="id48460c0d9c3d4c3e8c885325f7f48237"><enum>(c)</enum><header>Sanctions for non-Cooperation</header><paragraph id="id92917DCB262D49D6BF4E169302F9598E"><enum>(1)</enum><header>In general</header><text>The appropriations of an Executive branch agency for a fiscal year shall be reduced by one-half of 1 percent if, during that fiscal year, the Director finds that—</text><subparagraph id="id8429b52381f54e00adc41f71fa8fec37"><enum>(A)</enum><text>the Executive branch agency has failed to timely provide information that the Director requested under subsection (a);</text></subparagraph><subparagraph id="id005ac58a04e6483092781d681d36b83f"><enum>(B)</enum><text>the Director has provided notice of the failure described in subparagraph (A) to the Executive branch agency;</text></subparagraph><subparagraph id="idA18D17846F8F430D988479B09E4B2597"><enum>(C)</enum><text>the Executive branch agency has failed to cure the failure described in subparagraph (A) within 30 days of being notified under subparagraph (B); and</text></subparagraph><subparagraph id="id8701428f9d16489eb596d76e053d9608"><enum>(D)</enum><text>the information that the Director requested under subsection (a)—</text><clause id="id507D7B3C1C0A4555BE161F026FAF78D9"><enum>(i)</enum><text>is in the possession of the Executive branch agency; or</text></clause><clause id="idF43B03018F5440A8A06CFD8B4E80E179"><enum>(ii)</enum><text>may reasonably be developed by the Executive branch agency.</text></clause></subparagraph></paragraph><paragraph id="id8410C7303FE543FB84A399251A399FF0"><enum>(2)</enum><header>Sequestration</header><text>The Office of Management and Budget, in consultation with the Office of Federal Financial Management and Financial Management Service, shall enforce a reduction in appropriations under paragraph (1) by sequestering the appropriate amount of funds and returning the funds to the Treasury.</text></paragraph><paragraph id="idbbae8ce3eb7b46cda37a9a062aef0c63"><enum>(3)</enum><header>Appeals</header><subparagraph id="id798E689839C141CFB578EAA4E0727E1D"><enum>(A)</enum><header>In general</header><text>The Director of the Office of Management and Budget may reduce the amount of, or except as provided in subparagraph (B), waive, a sanction imposed under paragraph (1) if the Director of the Office of Management and Budget finds that—</text><clause id="id4A37AA3EC9124E91830101A759BC9630"><enum>(i)</enum><text>the sanction is unwarranted;</text></clause><clause id="idBFB0D4C6955D4E4EA8BB7B70AEE8CF8F"><enum>(ii)</enum><text>the sanction is disproportionate to the gravity of the failure;</text></clause><clause id="idD8057C9BAEA54778945E03D2BA2A6B40"><enum>(iii)</enum><text>the failure has been cured; or</text></clause><clause id="id8B2521563DFB4BF4BF52E58004357CDE"><enum>(iv)</enum><text>providing the requested information would adversely affect national security.</text></clause></subparagraph><subparagraph id="id50956822B4F34EB2A2EDB24B99214DCF"><enum>(B)</enum><header>No waiver for historically non-compliant agencies</header><text>The Director of the Office of Management and Budget may not waive a sanction imposed on an Executive branch agency under paragraph (1) if the Executive branch agency has a history of non-compliance with requests for information by the Director of the Office of Regulatory Analysis under subsection (a).</text></subparagraph></paragraph></subsection><subsection id="idb29a9e9b711b428b830091881e5382cf"><enum>(d)</enum><header>National security</header><text>The Director may not require an Executive branch agency to provide information under subsection (a) that would adversely affect national security.</text></subsection></section><section id="id10e0a49ac86b4cc8a415e42628119628"><enum>619.</enum><header>Enforcement</header><subsection id="id8d19df9d2bb34a4a92a7f7f577aa95db"><enum>(a)</enum><header>Exceeding annual agency regulatory cost cap</header><text>An Executive branch agency that exceeds the annual agency regulatory cost cap imposed by the National Regulatory Budget for a fiscal year may not promulgate a new covered Federal rule that increases regulatory costs until the Executive branch agency no longer exceeds the annual agency regulatory cost cap imposed by the applicable National Regulatory Budget.</text></subsection><subsection id="ide88a88d33b9f45dcaa92808ed9c4463e"><enum>(b)</enum><header>Determination of Director</header><paragraph id="id9DC42F9CFA4D437295681ABF06D66B4D"><enum>(1)</enum><header>In general</header><text>An Executive branch agency may not promulgate a covered Federal rule unless the Director determines, in conducting the regulatory analysis of the covered Federal rule under section 615(b)(3)(A) that, after the Executive branch agency promulgates the covered Federal rule, the Executive branch agency will not exceed the annual agency regulatory cost cap for that Executive branch agency.</text></paragraph><paragraph commented="no" id="id861C09F2BAEC46F9A1877A38033C0B12"><enum>(2)</enum><header>Timing</header><text>The Director shall make a determination under paragraph (1) with respect to a proposed covered Federal rule not later than 60 days after the Director receives a copy of the proposed covered Federal rule under section 615(b)(4).</text></paragraph></subsection><subsection commented="no" id="id2f553cfbcbd042fc94f73d390d22f2be"><enum>(c)</enum><header>Effect of violation of this section</header><paragraph commented="no" id="id8854AAC2237D4A7A9BC5E98128A31B18"><enum>(1)</enum><header>No force or effect</header><text>A covered Federal rule that is promulgated in violation of this section shall have no force or effect.</text></paragraph><paragraph commented="no" id="idC6C1DC8315EC487D8E86F3B16A475EBB"><enum>(2)</enum><header>Judicial Enforcement</header><text>Any party may bring an action in a district court of the United States to declare that a covered Federal rule has no force or effect because the covered Federal rule was promulgated in violation of this section.</text></paragraph></subsection></section><section id="idf701087ce6ee4cb5bd8324d5ff2f9b9a"><enum>620.</enum><header>Regulatory Analysis Advisory Board</header><subsection id="id9DD2607FACCC4A5D9CE806D8CBFCBB96"><enum>(a)</enum><header>Establishment of Board</header><text display-inline="yes-display-inline">In accordance with the Federal Advisory Committee Act (5 U.S.C. App.), the Director shall—</text><paragraph id="idAA0B016FAAFD486B96134F37BD673955"><enum>(1)</enum><text display-inline="yes-display-inline">establish a Regulatory Analysis Advisory Board; and</text></paragraph><paragraph id="idE5B404CAFC3742CB9A17BB6A77C774A5"><enum>(2)</enum><text display-inline="yes-display-inline">appoint not fewer than 9 and not more than 15 individuals as members of the Regulatory Analysis Advisory Board.</text></paragraph></subsection><subsection id="idC68FEAA47F2A4D668F53F2CC3DC1F239"><enum>(b)</enum><header>Qualifications</header><text display-inline="yes-display-inline">The Director shall appoint individuals with technical and practical expertise in economics, law, accounting, science, management, and other areas that will aid the Director in preparing the annual Report on National Regulatory Costs required under section 615.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idd86816030c8140b28bca06041f046f44"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="H1EB4490B40E94285B4D13C597C12286D"><enum>(1)</enum><header>Table of chapters</header><text>The table of chapters for part I of title 5, United States Code, is amended by inserting after the item relating to chapter 6 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H41252A720D1F4679919AE064AD71ED48"><toc><multi-column-toc-entry bold="off" level="section"><toc-enum>6A. </toc-enum><level-header level="section">National Regulatory Budget and Office of Regulatory Analysis</level-header><target>613</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id771DCE12D52C4554A9CB4DC0AAB8C54E"><enum>(2)</enum><header>Internal Revenue Code of 1986</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6103">Section 6103(j)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block style="tax" display-inline="no-display-inline" id="id0C5F89919CF746E5B4E54C4FE07BC845"><paragraph id="id891dc4525ca246c8b14dfa60b0a66017"><enum>(7)</enum><header>Office of Regulatory Analysis</header><text>Upon written request by the Director of the Office of Regulatory Analysis established under section 614 of title 5, United States Code, the Secretary shall furnish to officers and employees of the Office of Regulatory Analysis return information for the purpose of, but only to the extent necessary for, an analysis of regulatory costs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id3b5e89d225b64abf8d7e4eaf96437ada"><enum>3.</enum><header>Report on duplicative personnel; report on regulatory analysis</header><subsection id="idFBAA4EBA04074DE98C8845C1C6A965BD"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>Director</term> means the Director of the Office of Regulatory Analysis established under section 614(b) of title 5, United States Code, as added by section 2.</text></subsection><subsection id="id16a2990ae77f486ebbc0fd25e7fbbe38"><enum>(b)</enum><header>Report on duplicative personnel</header><text>Not later than December 31, 2022, the Director shall submit to Congress a report determining positions in the Federal Government that are—</text><paragraph id="id89D6DD97F880428DB58FB74D0331C2A6"><enum>(1)</enum><text>duplicative of the work performed by the Office of Regulatory Analysis established under section 614 of title 5, United States Code, as added by section 2; or</text></paragraph><paragraph id="idA1D6117E5B114DAFA6EB242B7B806329"><enum>(2)</enum><text>otherwise rendered cost ineffective by the work of the Office of Regulatory Analysis.</text></paragraph></subsection><subsection id="id8b6759a28ff84918a637d3a92bf485c6"><enum>(c)</enum><header>Report on regulatory analysis</header><paragraph id="id059528F3E4AE49F98887A2614F655038"><enum>(1)</enum><header>Report required</header><text>Not later than June 30, 2023, the Director shall submit to Congress a report analyzing the practice of Federal regulatory analysis with respect to, and the effectiveness of—</text><subparagraph id="idbeed6e230f8f42179bdf02c9adc406bf"><enum>(A)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code (commonly known as the <quote>Regulatory Flexibility Act</quote>);</text></subparagraph><subparagraph id="id40954bc9329348d2b5edb8ee256b8423"><enum>(B)</enum><text>the Small Business Regulatory Enforcement Fairness Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note);</text></subparagraph><subparagraph id="idb4ef26aaf5324367af57c75c266ce975"><enum>(C)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>);</text></subparagraph><subparagraph id="id4ee7e61659bd49b0b8f47a6f1d86ac29"><enum>(D)</enum><text>each Executive order that mandates economic analysis of Federal regulations; and</text></subparagraph><subparagraph id="id01de1334f5c24c068da9157d0eca04f2"><enum>(E)</enum><text>Office of Management and Budget circulars, directives, and memoranda that mandate economic analysis of Federal regulations.</text></subparagraph></paragraph><paragraph id="id08C09F9A803D490D8661F4137953D057"><enum>(2)</enum><header>Recommendations</header><text>The report under paragraph (1) shall include recommendations about how Federal regulatory analysis may be improved.</text></paragraph></subsection></section><section id="idb9def98adef84c5c9ff34b3852a1f8f1"><enum>4.</enum><header>Administrative procedure</header><subsection commented="no" id="idd8798135d9ed4a0c8a62794816ddfbb8"><enum>(a)</enum><header>Definition of <quote>rule</quote></header><text>Section 551(4) of title 5, United States Code, is amended by inserting after <quote>requirements of an agency</quote> the following: <quote>, whether or not the agency statement amends the Code of Federal Regulations and including, without limitation, a statement described by the agency as a regulation, rule, directive, or guidance,</quote>.</text></subsection><subsection id="id7a693c27b6a3495f8f8a9e7e60ba2177"><enum>(b)</enum><header>Notice of proposed rulemaking</header><text>Section 553(b) of title 5, United States Code, is amended, following the flush text, in subparagraph (A) by striking <quote>interpretative rules, general statements of policy, or</quote>.</text></subsection></section></legis-body></bill>
