which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide requirements relating to data caps on broadband internet access service, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Uncap America Act</short-title></quote>.</text></section><section id="idD9FD249E5C6247079A7C31AD6B924F57"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id5CADBE1FF5824139BE3C9086D68541F9"><enum>(1)</enum><header>Broadband internet access service</header><text>The term <term>broadband internet access service</term> has the meaning given the term in section 8.1(b) of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph id="id11E3B874775E4C388A81DEA83120BD29"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="idD3C75B6321C84FAABD3DC34751DC32FF"><enum>(3)</enum><header>Data cap</header><text>The term <term>data cap</term> means a limit on the amount of bits or other units of information a customer of a broadband internet access service provider may download or upload during a period of time specified by the broadband internet service access provider—</text><subparagraph id="id85E2EB1D7AB04C999F68AF61AF93C0E1"><enum>(A)</enum><text>before the customer—</text><clause id="id6FFC2995DF4048088363D92427D6F696"><enum>(i)</enum><text>is charged a fee for additional usage; </text></clause><clause id="id459A869E3F594BF3BD5DF358318F0825"><enum>(ii)</enum><text>is subject to an increasing cost per bit or other unit of information; </text></clause><clause id="id330ABA8820104227A7B72CEA69DD6515"><enum>(iii)</enum><text>is charged for an incremental block of usage; or </text></clause><clause id="idD9C739526D4E4AD2A8AADF36F4293B8E"><enum>(iv)</enum><text>experiences a reduction of access speed; or </text></clause></subparagraph><subparagraph id="id2C59447238C241F3BAE7AC8FDEBAEED7"><enum>(B)</enum><text>that the customer is otherwise discouraged or prevented from exceeding.</text></subparagraph></paragraph></section><section id="idF10FF2085F3F407A9E3573F95B05589B"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id92668677AD7E42738461720F676525B6"><enum>(1)</enum><text>Access to resilient, affordable, and secure internet service is essential for individuals to participate in society, including by providing individuals access to work, education, and health care and allowing individuals to communicate with friends and family.</text></paragraph><paragraph id="id48C6DEF6E8F2459BA758D531BDBF6D50"><enum>(2)</enum><text>Congress has a well-established role in supporting infrastructure for broadband internet access service and ensuring that such infrastructure best serves the public interest.</text></paragraph><paragraph id="id7AE1EB670BF84112989B5F01A1661DFD"><enum>(3)</enum><text>It is in the public interest to ensure that telecommunications networks in the United States are utilized to their fullest capacity in order to encourage innovation, reduce barriers to employment, and increase access to education and health care.</text></paragraph><paragraph id="id6790F665D74E4030962A96B37E6B62DD"><enum>(4)</enum><text>Sustained strong performance of broadband internet access service networks in the United States during historically high demand throughout the COVID–19 pandemic is evidence that many such networks can accommodate significantly increased usage rates without the imposition of data caps.</text></paragraph><paragraph id="idAB549DE5DFBD45A8B12EC2671F93CEE3"><enum>(5)</enum><text>While certain broadband internet access service networks may require practices to effectively manage congestion, those practices should be tailored to improve equitable access among consumers.</text></paragraph><paragraph id="id1F013157DCA64399AD724533192BE8C1"><enum>(6)</enum><text>Unnecessary data caps limit participation in the digital economy and are contrary to the public interest.</text></paragraph></section><section id="id81B39FE0B4454C239089A5E77F68F48F"><enum>4.</enum><header>Network management practices</header><subsection id="idAA5DD6E90A944E6A83F690D949B74D3A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A broadband internet access service provider shall not impose a data cap except when tailored primarily for the purposes of reasonable network management or managing network congestion.</text></subsection><subsection id="id7253CC4586A44C80B6FB30F6603DAC35"><enum>(b)</enum><header>Regulations</header><paragraph id="id4E2302A4EE414C9C88D8305DC0A67493"><enum>(1)</enum><header>In general</header><text>The Commission may prescribe such regulations as may be necessary in the public interest to carry out this section.</text></paragraph><paragraph id="idE72FE83C37AD46B3B345E41A2F0E6F53"><enum>(2)</enum><header>Tailored data caps</header><text>Not later than 270 days after the date of enactment of this Act, the Commission shall promulgate regulations to define the conditions under which a data cap is to be considered tailored to the purpose of reasonable network management or managing network congestion for purposes of subsection (a).</text></paragraph></subsection><subsection id="id89AB770EC6AB4D559D997BAA13A3E62E"><enum>(c)</enum><header>Enforcement</header><paragraph id="id7c59817b40824428881af76f01bfebcc"><enum>(1)</enum><header>In general</header><text>The Commission shall implement and enforce this section as if this section were a part of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>). </text></paragraph><paragraph id="idD7799EEC3FDE466887777F4DEA982A34"><enum>(2)</enum><header>Violations</header><text>Any violation of this section or any regulation promulgated under this section shall be considered to be a violation of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) or a regulation promulgated under that Act, respectively. </text></paragraph></subsection></section></legis-body></bill>
