which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to require the Secretary of Veterans Affairs to provide the representative of record of a claimant for compensation or benefits administered by the Secretary an opportunity to review a proposed determination regarding that claim.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFCB88B8409A2491DAA493EFEC1A4D11E"><section section-type="section-one" id="HD0A1F260FA5944E48B0F701220C77820"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Claim Transparency Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="HDB831768C21049F1BFEB75EABE545D3B"><enum>2.</enum><header>Opportunity for representative of record to review a proposed determination regarding a claim for compensation or benefits administered by the Secretary of Veterans Affairs</header><subsection id="HA8C1582EDB1C448397B728C87EE87EC2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/59">Chapter 59</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="H7836172788814F7D9B0C6364616B1436"><section id="HE15C941751624642BD0C7830B848E4AE"><enum>5906.</enum><header>Opportunity for representative of record to review a proposed determination regarding a claim for compensation or benefits</header><subsection id="H9976DADAEDBE4E31A09160F3C362110E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For each claim for compensation or benefits under this title in which the claimant has designated a representative of record, the Secretary shall provide that representative of record an opportunity to review the proposed determination of the Secretary before it becomes final.</text></subsection><subsection id="H79EA4D1F3486452C85840ECD0B67586C"><enum>(b)</enum><header>Representative of record</header><text>For purposes of this section, a representative of record of a claimant may be—</text><paragraph id="H49A9D4532CD542ACBB9350085A7E9FC1"><enum>(1)</enum><text>a representative of the claimant recognized under section 5902 of this title; or</text></paragraph><paragraph id="H61D2F75EA2E64488B14269493D702F65"><enum>(2)</enum><text>an agent or attorney of the claimant recognized under section 5904 of this title.</text></paragraph></subsection><subsection id="HE35B6EBE6E20463CA6A028F0B53AB032"><enum>(c)</enum><header>Notice</header><text>The Secretary shall submit notification in writing to a representative of record that a proposed determination is ready for review under subsection (a).</text></subsection><subsection id="H07E05521C9BC4A5AB0DABE9D063CF89A"><enum>(d)</enum><header>Period for review</header><text display-inline="yes-display-inline">Each opportunity to review a proposed determination under subsection (a) for a representative of record of a claimant shall be for a period—</text><paragraph id="H56CA271606494563BF0825D443D983A9"><enum>(1)</enum><text>beginning at the moment the representative receives notification under subsection (b); and</text></paragraph><paragraph id="H44DD3CD6D0354510A47BC7A5A600A64D"><enum>(2)</enum><text>ending on the earlier of—</text><subparagraph id="HA806EE5CE1E848128D77964B86C9DE37"><enum>(A)</enum><text display-inline="yes-display-inline">the moment that the claimant or the representative of record indicates to the Secretary that the claimant does not dispute the proposed determination; or</text></subparagraph><subparagraph id="H6A8250BABAE44873A37E6B85FFB1CEF5"><enum>(B)</enum><text>the moment that is 48 hours after the moment described in paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="HB9528E0981AE477FB4958063522EB18B"><enum>(e)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary may not make a proposed determination, subject to a period of review under this section, final until after the period under subsection (d).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF2E6C0E3FC624688AFC41116BD5DD59F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 59 of such title is amended by inserting after the item relating to section 5905 the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF98FEB98DD17475BA1BEC9D53D66AA4D"><toc><toc-entry bold="off" level="section">5906. Opportunity for representative of record to review a proposed determination regarding a claim for compensation or benefits.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
