which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require U.S. Customs and Border Protection to expand the use of non-intrusive inspection systems at land ports of entry.</official-title></form><legis-body><section id="id4af919fef8604d6098d65d0971c5e868" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Non-Intrusive Inspection Expansion Act</short-title></quote>.</text></section><section id="id7d1886dcefa44d05802b2640ff608ff9"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="idabafd7363afa47b3b73ce24aa44940c1"><enum>(1)</enum><text>non-intrusive inspections systems are an important tool to increase U.S. Customs and Border Protection’s ability to detect and interdict illicit and unclaimed goods while securely and efficiently facilitating the flow of trade and travel entering the United States at land ports of entry;</text></paragraph><paragraph id="id68dc17ba7fb846738e34763f0bd503dc"><enum>(2)</enum><text>it is in the interest of United States trade and border security to develop the capacity to increase to 100 percent the rate of scanning of passenger and commercial vehicles entering the United States at land ports of entry;</text></paragraph><paragraph id="id7607d3f23e9c4f66af772df3d5a14d42"><enum>(3)</enum><text>U.S. Customs and Border Protection should actively implement plans to increase the rate of scanning of passenger and commercial vehicles entering the United States at land ports of entry towards 100 percent, consistent with the Securing America's Ports Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/299">Public Law 116–299</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/211">6 U.S.C. 211</external-xref> note); and</text></paragraph><paragraph id="idb13bb122b9b44611a2a049c506265ecc"><enum>(4)</enum><text>U.S. Customs and Border Protection should use past and future congressional appropriations for non-intrusive inspection systems to incrementally increase the rate of scanning of passenger and commercial vehicles entering the United States at land ports of entry and to ensure adequate staffing and other resources so as to support the full use of such systems and adjudication of scans. </text></paragraph></section><section section-type="subsequent-section" id="id7AD109B26F324E07A13A1F38289381B3"><enum>3.</enum><header>Use of non-intrusive inspection systems at land ports of entry</header><subsection id="id792A56A2EC5147D5A73FD757A7D40019"><enum>(a)</enum><header>Fiscal year 2024</header><text display-inline="yes-display-inline">Using non-intrusive inspection systems acquired through previous appropriations Acts, beginning not later than September 30, 2024, U.S. Customs and Border Protection shall use non-intrusive inspection systems at land ports of entry to scan not fewer than— </text><paragraph id="ida0099a40b0744c67b5dec4b771dd7e4a"><enum>(1)</enum><text>40 percent, cumulatively, of passenger vehicles entering the United States through land ports of entry; and</text></paragraph><paragraph id="idd1428bc97314425eb6e54652b44867fd"><enum>(2)</enum><text>90 percent, cumulatively, of commercial vehicles entering the United States through land ports of entry.</text></paragraph></subsection><subsection id="id7EF545B09455441682070658C39CC77A"><enum>(b)</enum><header>Subsequent fiscal years</header><text>Following fiscal year 2024, U.S. Customs and Border Protection shall use non-intrusive inspection systems at land ports of entry to reach the next projected benchmark for incremental scanning of passenger and commercial vehicles entering the United States at such ports of entry. </text></subsection></section><section id="id3fdf9b0a643f428fabaaf5fbd8764b90"><enum>4.</enum><header>Briefing</header><text display-inline="no-display-inline">Not later than May 30, 2024, U.S. Customs and Border Protection shall brief the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> regarding the progress made during the first half of fiscal year 2024 in achieving the scanning benchmarks referred to in that section. </text></section><section id="id0475ae8e395b4b559b13c3c223ac6989"><enum>5.</enum><header>Report</header><text display-inline="no-display-inline">If the requirements described in section 3(a) are not met in fiscal year 2024, not later than 120 days after the end of that fiscal year, the Commissioner of U.S. Customs and Border Protection shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that—</text><paragraph id="id9376374BD5764A68A3BD4738A0BE6CA5"><enum>(1)</enum><text display-inline="yes-display-inline">analyzes the causes for not meeting such requirements and identifies any resource gaps and challenges; and</text></paragraph><paragraph id="idB0912871FE6B40BE8EDA3C2C541D4014"><enum>(2)</enum><text display-inline="yes-display-inline">details the steps that will be taken to ensure compliance with such requirements in the subsequent fiscal year.</text></paragraph></section></legis-body></bill>
