innovation program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Regional Clean Energy Innovation Act of 2022</short-title></quote>.</text></section><section id="H2CF572A3461947E98EA973F229999769" changed="not-changed"><enum>2.</enum><header>Regional Clean Energy Innovation Program</header><subsection changed="not-changed" id="id893887B4A5EE4C199B4B31442CB6F8BE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle C of title IX of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17371">42 U.S.C. 17371 et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block id="H85EB83AD8FCE4B25B569F659474D46D7" changed="not-changed" display-inline="no-display-inline" style="OLC"><section id="H3CC7892311E842E2B404DFCE494D8044" changed="not-changed"><enum>936.</enum><header>Regional Clean Energy Innovation Program</header><subsection id="H692FF05DF2C2403BAC82282A5035F846" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph changed="not-changed" id="id01A26000929147AB8ADA9245D4F1F559"><enum>(1)</enum><header>Covered entity</header><text>The term <quote>covered entity</quote> means any of the following:</text><subparagraph id="H059F788B48AC4CB292A894167D7B5835" changed="not-changed"><enum>(A)</enum><text>An institution of higher education or a consortium of institutions of higher education.</text></subparagraph><subparagraph id="H7AD2A2412A4149F6B9971A1DB8E5ED11" changed="not-changed"><enum>(B)</enum><text>A workforce training provider, including a vocational school and community college.</text></subparagraph><subparagraph id="H5791CD36E180461FBEC58593C9744A45" changed="not-changed"><enum>(C)</enum><text>A private sector entity or group of private sector entities, including a trade or industry association.</text></subparagraph><subparagraph id="HC9C5977FA5BC40EB8D5A5C38D29F2E1A" changed="not-changed"><enum>(D)</enum><text>A nonprofit organization.</text></subparagraph><subparagraph id="H059C65836E3349C7A424F91545CBE59F" changed="not-changed"><enum>(E)</enum><text>A community group.</text></subparagraph><subparagraph id="H9CED9DC2EAF84D69ACF4551A0EEB837B" changed="not-changed"><enum>(F)</enum><text>A labor group.</text></subparagraph><subparagraph id="H874D2D7391C942DDAF24EA47D1589385" changed="not-changed"><enum>(G)</enum><text>A National Laboratory.</text></subparagraph><subparagraph id="HD8E609C9087547CC91943B031FFB2876" changed="not-changed"><enum>(H)</enum><text>A venture development organization.</text></subparagraph><subparagraph id="HD32F5935453941BE8532E05C5D2CE773" display-inline="no-display-inline" changed="not-changed"><enum>(I)</enum><text>A community development financial institution.</text></subparagraph><subparagraph display-inline="no-display-inline" changed="not-changed" id="id8C3734FD9C2549EB8B347A9167E872E1"><enum>(J)</enum><text>A minority depository institution.</text></subparagraph><subparagraph id="H876EBE9D5DD94486872A27EBDBF9D421" changed="not-changed"><enum>(K)</enum><text>A worker cooperative membership association.</text></subparagraph><subparagraph changed="not-changed" id="id7F1606844716474EBFE8F58B67847FC9"><enum>(L)</enum><text>A State or local employee ownership or cooperative development center.</text></subparagraph><subparagraph id="HF95318248D63411CABD022C1333C0890" changed="not-changed"><enum>(M)</enum><text>An organization focused on clean energy technology innovation or entrepreneurship.</text></subparagraph><subparagraph id="HA648E48923374967824CBBA6982CBD12" changed="not-changed"><enum>(N)</enum><text>A business accelerator or incubator.</text></subparagraph><subparagraph id="HB6BFF802271744629EDC6361D7A34A77" changed="not-changed"><enum>(O)</enum><text>An economic development organization.</text></subparagraph><subparagraph id="HCD7E2BA736564839A66B640D70680D34" changed="not-changed"><enum>(P)</enum><text>A manufacturing facility or organization.</text></subparagraph><subparagraph id="H14EBC917C75449A7832ECA63A41AE55F" changed="not-changed"><enum>(Q)</enum><text>A clean energy incubator or clean energy accelerator.</text></subparagraph><subparagraph id="HDB95F4EB77F94F2AA8FAE275665132F0" changed="not-changed" commented="no"><enum>(R)</enum><text>A multi-institutional collaboration of at least 3 institutions.</text></subparagraph><subparagraph id="H4D2FF443B1D44276ABDB79AA90F2D179" changed="not-changed"><enum>(S)</enum><text>Any other entity that the Secretary determines to be relevant.</text></subparagraph></paragraph><paragraph changed="not-changed" id="idBE7B44BF8BA043DE9191F23629CA75D9"><enum>(2)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text><subparagraph changed="not-changed" id="id029F60C6A4FA4222BEAF5F58B4053C07"><enum>(A)</enum><text>a partnership of not less than 2 covered entities; and</text></subparagraph><subparagraph changed="not-changed" id="idA43CBDB547AA433DAAC96FE00D015A39"><enum>(B)</enum><text>a regional clean energy innovation partnership in existence as of the date of enactment of the <short-title>Regional Clean Energy Innovation Act of 2022</short-title>.</text></subparagraph></paragraph><paragraph id="H095121A3108344DD983B26327D7525AE" changed="not-changed"><enum>(3)</enum><header>Program</header><text>The term <quote>program</quote> means the Regional Clean Energy Innovation Program established under subsection (b).</text></paragraph><paragraph id="H6E8F95978F17403FBD9DA2BA55881E5C" changed="not-changed"><enum>(4)</enum><header>Regional clean energy innovation partnership</header><text>The term <quote>regional clean energy innovation partnership</quote> means a partnership—</text><subparagraph id="id986C9C2DA25745F1AC6192D0D7B12995"><enum>(A)</enum><text>among—</text><clause id="idE15204D8DA3744CE8A5EF0D8A20A5D61"><enum>(i)</enum><text>a government entity, including a unit of State, local, or Tribal government; and </text></clause><clause id="idA809565A298F408B8134BDCEA1F9E108"><enum>(ii)</enum><text>not less than 2 covered entities; and</text></clause></subparagraph><subparagraph id="idAAB54DA5CC7042869BB055D647DD4FF7" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>that carries out or coordinates activities or programs that further the purposes of the program described in subsection (c), including the activities described in subsection (f). </text></subparagraph></paragraph></subsection><subsection id="H1D2495D3E6E84F09A70EA75B5E73C68D" changed="not-changed"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a research, development, demonstration, and commercial application program, to be known as the <quote>Regional Clean Energy Innovation Program</quote>, to enhance the economic, environmental, and energy security of the United States and accelerate the pace of innovation of diverse clean energy technologies through the formation of new, or support of existing, regional clean energy innovation partnerships that—</text><paragraph id="HAD92C2227ED0442AA75926831D264F3E" changed="not-changed"><enum>(1)</enum><text>account for the diverse domestic energy resources available in the United States;</text></paragraph><paragraph id="H88D85A3DA1AC48468F1E44F5E425D55B" changed="not-changed"><enum>(2)</enum><text>are responsive to the needs of industry, workforce, policy landscape, and clean energy innovation capabilities of the region served by a regional clean energy innovation partnership;</text></paragraph><paragraph id="H5D3082FE08C741E9AB3779A63B2228E2" changed="not-changed"><enum>(3)</enum><text>enhance and accelerate clean energy innovation; </text></paragraph><paragraph id="H14D7EAA6520D4156AD700F4065EA590C" changed="not-changed"><enum>(4)</enum><text>are located in diverse geographic regions of the United States, including United States territories; and</text></paragraph><paragraph id="H9811CAF6017C4EEA8AE3DDA74329C417" changed="not-changed"><enum>(5)</enum><text>maximize the opportunities for cooperation between institutions of higher education, industry, State and local governments, and nonprofit research institutions with shared areas of energy expertise.</text></paragraph></subsection><subsection id="H6A7C723413B44FBDA19FF116ACEE78A9" changed="not-changed"><enum>(c)</enum><header>Purposes</header><text>The purposes of the program are—</text><paragraph id="HE19704E3EC27479C83B5FC6708B70CE7" changed="not-changed"><enum>(1)</enum><text>to improve the competitiveness of the United States in clean energy technology research, development, demonstration, and commercial application; and</text></paragraph><paragraph id="H3AA99678B314459087AC24D746015427" changed="not-changed"><enum>(2)</enum><text>to support the development of clean energy tools and technologies best suited for use in diverse regions of the United States, including in rural, tribal, and low-income communities. </text></paragraph></subsection><subsection id="H930164E352E34A988DA1BC294F803624" changed="not-changed"><enum>(d)</enum><header>Grants</header><paragraph id="H4AF14D6241BA4042838AC2D3CCED88C0" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Under the program, the Secretary shall competitively award grants to—</text><subparagraph changed="not-changed" id="id98973F9E34A747199B702D402D9D9708"><enum>(A)</enum><text>eligible entities described in subsection (a)(2)(A) to establish new regional clean energy innovation partnerships; and</text></subparagraph><subparagraph changed="not-changed" id="id33C08BBC795F4AF6958FFB02F33AA389" commented="no"><enum>(B)</enum><text>eligible entities described in subsection (a)(2)(B) to support ongoing activities of those eligible entities, in accordance with the requirements of the program.</text></subparagraph></paragraph><paragraph id="H9D51C553CB354EAB81CF0EB12B48A7EE"><enum>(2)</enum><header>Grant amount</header><text>The amount of a grant awarded to an eligible entity under the program in a calendar year—</text><subparagraph id="id4D468D095B6642C1934823D147B25EE0"><enum>(A)</enum><text>shall not exceed $10,000,000; and</text></subparagraph><subparagraph id="id7904B70E90554C64882104184F7F00A4"><enum>(B)</enum><text>shall be, subject to a waiver by the Secretary, less than the amount of a grant awarded to the eligible entity under the program the previous calendar year, if applicable.</text></subparagraph></paragraph><paragraph id="HDFD1EAF2AD7F43C0A005A33A1083B42E" changed="not-changed"><enum>(3)</enum><header>Administrative costs</header><text>The Secretary may allow an eligible entity awarded a grant under the program to allocate a portion of the grant funds for administrative or indirect costs. </text></paragraph><paragraph id="HBCB2D43F9223491C8615B2C3A358ABD1" changed="not-changed"><enum>(4)</enum><header>Non-federal cost share</header><text>In the case of a grant awarded under the program that has a term of 3 or more years, the Secretary shall require, as a condition of receipt of the grant funds, that the non-Federal share of the cost of activities carried out using the grant funds shall be not less than 50 percent of the cost of the activities during the third, fourth, and fifth year of the grant, as applicable.</text></paragraph><paragraph id="H60243E46D2A94F53B818C1E37F420A32" changed="not-changed"><enum>(5)</enum><header>Duration</header><subparagraph changed="not-changed" id="id6A89B4D16D22477684FD0D6EC4FD3380"><enum>(A)</enum><header>In general</header><text>The term of a grant awarded under the program shall not exceed 5 years.</text></subparagraph><subparagraph id="H50E6955D722E4FC593D00C7AA053D496" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Renewal</header><text>A grant awarded to an eligible entity under the program may be renewed for a period of not more than 5 years, subject to a rigorous merit review based on the progress of the regional clean energy innovation partnership in achieving the purposes of the program described in subsection (c) and the metrics developed under subsection (h)(2). </text></subparagraph></paragraph><paragraph id="HFCC7D4BAB0654A2E887A032B31A4CFC8" changed="not-changed"><enum>(6)</enum><header>Termination</header><text>The Secretary may terminate grant funding under the program to an eligible entity during the performance period if the Secretary determines that the applicable regional clean energy innovation partnership is underperforming. </text></paragraph></subsection><subsection id="HCA5960D334124B9EA1F4229D1677949C" changed="not-changed"><enum>(e)</enum><header>Applications</header><paragraph changed="not-changed" id="idD8148385386446289672DAD4CBD60E20"><enum>(1)</enum><header>In general</header><text>An eligible entity shall submit to the Secretary an application to receive a grant under the program at such time, in such manner, and containing such information as the Secretary may require, including—</text><subparagraph id="H42CF922612594379BB15A0F8C0E0A58F" changed="not-changed"><enum>(A)</enum><text>a list of members of the proposed or existing regional clean energy innovation partnership, the roles of those members, and any other relevant stakeholders;</text></subparagraph><subparagraph id="HE77C278AF5874A228476116C3A6094BB" changed="not-changed"><enum>(B)</enum><text>a description of—</text><clause changed="not-changed" id="id7841FE5B2C9E477DBF44981439F4F68E"><enum>(i)</enum><text>the geographical region served, or to be served, by the regional clean energy innovation partnership;</text></clause><clause id="id16DD8140622743708178C4C4BF041DA6"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idE6F99B7918A04B699C78FB9CA3069443"><enum>(I)</enum><text>the activities that the proposed or existing regional clean energy innovation partnership intends to undertake; and </text></subclause><subclause id="id0902914DB75A478BB0F5FEB7086D9CB4" indent="up1" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>the manner in which those activities will achieve the purposes of the program described in subsection (c) and the proposed outcomes described in clause (iii); and </text></subclause></clause><clause changed="not-changed" id="idF05A6659328B4CA7AB562547B7F965A7"><enum>(iii)</enum><text>the proposed outcomes of the regional clean energy innovation partnership;</text></clause></subparagraph><subparagraph id="H13013A3085AD4AFAAACA2C47F137FB63" changed="not-changed"><enum>(C)</enum><text>an assessment of—</text><clause changed="not-changed" id="idD12DC2775AC3457A93EF5DFB4E0EC774"><enum>(i)</enum><text>the relevant clean energy innovation assets needed in the geographical region identified under subparagraph (B)(i) to achieve the proposed outcomes described in subparagraph (B)(iii), such as education and training programs, research facilities, infrastructure or site development, access to capital, manufacturing capabilities, or other assets; and</text></clause><clause changed="not-changed" id="id69A5C80FA32D481788D6C4AF92165BC2"><enum>(ii)</enum><text>the clean energy resource potential of that geographical region;</text></clause></subparagraph><subparagraph id="HFE74D3A4F30B4C719FC37C7816FD2EF1" changed="not-changed"><enum>(D)</enum><text>a plan for attracting additional funds, including identification of non-Federal funding sources, to deliver the proposed outcomes described in subparagraph (B)(iii);</text></subparagraph><subparagraph id="H2CA291C5FE4C46D7B4C6C5DCBC84D5EB" display-inline="no-display-inline" changed="not-changed"><enum>(E)</enum><text display-inline="yes-display-inline">a plan for partnering and collaborating with community development financial institutions, minority depository institutions, labor and community groups, worker cooperative membership associations, local and State employee ownership and cooperative development centers, and other local institutions—</text><clause display-inline="no-display-inline" changed="not-changed" id="idBFBF4D6C21384326B623BE4D1910979C"><enum>(i)</enum><text display-inline="yes-display-inline">to promote employee, community, and public ownership in the clean energy sector; and </text></clause><clause display-inline="no-display-inline" changed="not-changed" id="id3069E7D13FE94ECF8A30739B3BEA8D4F"><enum>(ii)</enum><text display-inline="yes-display-inline">to advance models of local economic development that build and retain wealth in the region;</text></clause></subparagraph><subparagraph id="H0CB55AF0121D49808FB793CF5C315D1A" changed="not-changed"><enum>(F)</enum><text>a plan for sustaining the activities of the regional clean energy innovation partnership after funds received under the program have been expended; and</text></subparagraph><subparagraph id="H0FC77B27FB3642ACAF9C89F21BA4204E" changed="not-changed"><enum>(G)</enum><text>a proposed budget, including financial contributions from non-Federal sources. </text></subparagraph></paragraph><paragraph id="HF81A7405ECFE4414B1A30269F6802BD5" changed="not-changed"><enum>(2)</enum><header>Selection considerations</header><text>In awarding grants under the program, the Secretary shall, to the maximum extent practicable—</text><subparagraph id="H8F5571F3C7E047FD9FFAD6D4E0BB46A3" changed="not-changed"><enum>(A)</enum><text>give special consideration to applications from eligible entities located in rural, tribal, and low-income communities; and</text></subparagraph><subparagraph id="H493B4F39CB6640B9B1B4CEFC67946EF7" changed="not-changed"><enum>(B)</enum><text>ensure geographic diversity among the eligible entities awarded grants.</text></subparagraph></paragraph></subsection><subsection id="H01032AABF22A4B93A146435D6ADCC567" changed="not-changed"><enum>(f)</enum><header>Permissible activities</header><text>Activities that may be carried out by a regional clean energy innovation partnership established or supported using a grant awarded under the program shall include—</text><paragraph id="H0CDCFD17CA904FB3BD5032FED15EE497" changed="not-changed"><enum>(1)</enum><text>facilitating the commercial application of clean energy products, processes, and services, including through research, development, demonstration, or technology transfer;</text></paragraph><paragraph id="H69AE98FE25024DDD80040DE0B44B75E9" changed="not-changed"><enum>(2)</enum><text>improving strategic and cost-effective coordination among the partners of the regional clean energy innovation partnership;</text></paragraph><paragraph id="H05D3E71C7ACB4C79BEC8ECD9B6C6AA4C" changed="not-changed"><enum>(3)</enum><text>improving stakeholder involvement in developing the goals and activities of the regional clean energy innovation partnership;</text></paragraph><paragraph id="HE1A9BBA53FE44B21AFFDA25231E96BD0" changed="not-changed"><enum>(4)</enum><text>assessing different incentive mechanisms for clean energy development and commercial application in the region served by the regional clean energy innovation partnership;</text></paragraph><paragraph id="H5E95D516E0924AB5B79FA1AECB41DC00" changed="not-changed"><enum>(5)</enum><text>hosting events and conferences; </text></paragraph><paragraph id="H70DFADC3E74A40D19AB737A1A79223AA" changed="not-changed"><enum>(6)</enum><text>establishing and updating roadmaps to measure progress on relevant goals, including goals relevant to metrics developed under subsection (h)(2); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE748232940BC412E82F370927396DC88"><enum>(7)</enum><text>any other activity determined appropriate by the Secretary to achieve the purposes of the program described in subsection (c). </text></paragraph></subsection><subsection id="H6F6C22B193694F4EA689FF4DA7B605DD" changed="not-changed"><enum>(g)</enum><header>Planning awards</header><text>The Secretary may competitively award grants to a covered entity or a government entity, including a State, local, or tribal government, or unit of such government, in an amount not greater than $2,000,000, for a term of not more than 2 years, to conduct planning for the purpose of establishing a regional clean energy innovation partnership. </text></subsection><subsection changed="not-changed" id="id1672974DF5864E9E8C76CCE8810BEA3C"><enum>(h)</enum><header>Administration</header><paragraph id="H30A04B15BDE34BB3BA93D17BB993655D" changed="not-changed"><enum>(1)</enum><header>Best practices</header><text>As part of the program, the Secretary shall support the gathering, analysis, and dissemination of information on best practices for developing and operating successful regional clean energy innovation partnerships.</text></paragraph><paragraph id="H2D7872D1F4C04F369B8F67827FED49A6" changed="not-changed"><enum>(2)</enum><header>Metrics</header><text>The Secretary shall collaborate with program evaluation experts to develop and make publicly available metrics by which to measure the progress of a regional clean energy innovation partnership in achieving the purposes of the program described in subsection (c), including, as a result of activities carried out under the regional clean energy innovation partnership—</text><subparagraph id="HF0AC10B3F622428F8E66236D02F7BF75" changed="not-changed"><enum>(A)</enum><text>the number and quality of—</text><clause id="H669F4E11E2C84DE88DC851D001816689" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">new clean energy companies created in the region, including clean energy companies created or preserved through employee ownership and cooperative development;</text></clause><clause id="H5E16E638E2AB469D948F97269321A642" changed="not-changed"><enum>(ii)</enum><text>new or expanded workforce development or training programs in the region; and</text></clause><clause id="H5D3944F1BF824C768D7F53F9DA31B9D3" changed="not-changed"><enum>(iii)</enum><text>support services provided to clean energy technology developers in the region;</text></clause></subparagraph><subparagraph id="HBD54C9A61E734F23BF6BC65161780AF6" changed="not-changed"><enum>(B)</enum><text>changes in clean energy employment in the region;</text></subparagraph><subparagraph id="H86BC6F0A9BE54117925DB0B103CD5869" changed="not-changed"><enum>(C)</enum><text>the amount of capital investment in clean energy companies in the region; and</text></subparagraph><subparagraph id="iddfd98a2239174a3a8dd471fa1fbdc80f"><enum>(D)</enum><text>the completion of new or updated clean energy resource assessments in the region. </text></subparagraph></paragraph><paragraph id="HF6435C7C79864BA0B8A197AFEA0D137C" changed="not-changed"><enum>(3)</enum><header>Coordination</header><text>In carrying out the program, the Secretary shall coordinate with, and avoid unnecessary duplication of—</text><subparagraph id="H62197814053245E8AD1D909241D7E4DF" changed="not-changed"><enum>(A)</enum><text>activities under other research entities of the Department, including the National Laboratories, the Office of Science, the Advanced Research Projects Agency—Energy, the Office of Technology Transitions, Energy Innovation Hubs, and Energy Frontier Research Centers; and</text></subparagraph><subparagraph id="HF0C2CF0FB2364BB882172C12179512FC" changed="not-changed"><enum>(B)</enum><text>relevant programs at other Federal agencies, including—</text><clause id="H5B05E1953C224935A74721702575D678"><enum>(i)</enum><text>programs under the Office of Innovation and Entrepreneurship of the Economic Development Administration;</text></clause><clause id="id7CD5EFCA8CB846ABA8B5DC713420943D" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>the regional innovation program established under section 27 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3722">15 U.S.C. 3722</external-xref>);</text></clause><clause (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k</external-xref>);</text></clause><clause id="HF76D243508684357B01D2FE9DBCC5DE7"><enum>(iv)</enum><text>the Manufacturing USA Program established under section 34 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s</external-xref>);</text></clause><clause id="HC4A7A13D544A47A780DDA176E3073B08"><enum>(v)</enum><text>the Defense Manufacturing Community Support Program established under section 846 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="usc" parsable-cite="usc/10/2501">10 U.S.C. 2501</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>); </text></clause><clause id="H4B2C34F305C140D49EA98700143884DC" changed="not-changed"><enum>(vi)</enum><text>the Office of Economic Adjustment of the Department of Defense;</text></clause><clause id="H3D92749DDFBD49D0991F775493EB907B" changed="not-changed"><enum>(vii)</enum><text display-inline="yes-display-inline">programs under the rural development mission area of the Department of Agriculture; and</text></clause><clause id="idb720660be8084c77bb2d160d1f0a85e6"><enum>(viii)</enum><text>programs under the energy and mineral resources mission area of the Department of the Interior. </text></clause></subparagraph></paragraph><paragraph id="HA663AF8278A8471C8AE786CC65C75132" changed="not-changed"><enum>(4)</enum><header>Conflicts of interest</header><text>In carrying out the program, the Secretary shall maintain conflict of interest procedures consistent with the conflict of interest procedures of the Department.</text></paragraph></subsection><subsection id="H9D5BC924D50546B19AD8166D7776459C"><enum>(i)</enum><header>Reports and plan</header><paragraph commented="no" id="HC8F36560003E495EA72AA5CA0AED8439"><enum>(1)</enum><header>Annual Report</header><text display-inline="yes-display-inline">As part of the annual budget of the Department submitted to Congress for a fiscal year, the Secretary shall annually submit to Congress a report that describes the activities carried out by each regional clean energy innovation partnership established or supported using grants awarded under the program during the fiscal year covered by the report.</text></paragraph><paragraph id="H7E4EEC25F8CD423198F7E44EDEF1C486" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Strategic Plan</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Regional Clean Energy Innovation Act of 2022</short-title>, and not less frequently than once every 5 years thereafter, the Secretary shall submit to Congress a 5-year strategic plan describing how the Secretary shall utilize regional clean energy innovation partnerships to deploy clean energy technologies.</text></paragraph><paragraph id="H7341FF0744464A94B1FC8537BC9B7E43" changed="not-changed"><enum>(3)</enum><header>Evaluation by Comptroller General</header><text>Not later than 3 years after the date of enactment of the <short-title>Regional Clean Energy Innovation Act of 2022</short-title>, and every 3 years thereafter, the Comptroller General of the United States shall submit to the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Energy and Natural Resources of the Senate an evaluation of the operation of the program during the most recent 3-year period, including—</text><subparagraph id="HA039D43545B543F09670442CB2BB9E59" changed="not-changed"><enum>(A)</enum><text>an assessment of the progress made in achieving the purposes described in subsection (c) based on the metrics developed under subsection (h)(2);</text></subparagraph><subparagraph id="H2ECF3349A6D54B7DBF6F1C6AA356315A" changed="not-changed"><enum>(B)</enum><text>the short-term and long-term metrics used to determine the success of the program under subsection (h)(2), and any recommended changes to those metrics;</text></subparagraph><subparagraph id="H7E7EA2762CF147DDA744965934DA2B5D" changed="not-changed"><enum>(C)</enum><text>the regional clean energy innovation partnerships established or supported by grants received under the program; and</text></subparagraph><subparagraph id="H2C5E84890F794BAEBCF95D5D3FD0F68D" changed="not-changed"><enum>(D)</enum><text>any recommendations for improvement to the program.</text></subparagraph></paragraph></subsection><subsection id="H96520FFE6F834094BAAF29291F15C10E" changed="not-changed"><enum>(j)</enum><header>Security</header><text>In carrying out this section, the Secretary shall ensure that proper security controls are in place to protect sensitive information, as appropriate.</text></subsection><subsection changed="not-changed" id="idF37540DCB4454A94B4A13064DE07DBCC"><enum>(k)</enum><header>Funding</header><paragraph id="H751A05A93F5C477EA3FB8D7607DDFF12" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $50,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><paragraph id="H51AA9E74A28C4BC69B769C87E17CAD2B" changed="not-changed"><enum>(2)</enum><header>Additional funding</header><text>The Secretary may accept funds from other Federal agencies to support funding and activities under the program.</text></paragraph><paragraph id="HEE62696C9E6E44999502211D1E8AC9F2" changed="not-changed"><enum>(3)</enum><header>No funds for construction</header><text display-inline="yes-display-inline">None of the funds made available to carry out the program may be used for construction.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection changed="not-changed" id="idA2861524D0C444759CF65BFFAE7D964E"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/140">Public Law 110–140</external-xref>;
