which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To repeal the Defense of Marriage Act and ensure respect for State regulation of marriage, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Respect for Marriage Act</short-title></quote>.</text></section><section id="idf54a1cfaa11f476c8a9035ff86e5c61d"><enum>2.</enum><header>Full faith and credit given to marriage equality</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/115">Chapter 115</external-xref> of title 28, United States Code, is amended by striking section 1738C and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id5f59897d77324d789de94bdca75e6f71"><section id="id66ef73739d984dbc95ac24babd5a1d80"><enum>1738C.</enum><header>Certain acts, records, and proceedings and the effect thereof</header><subsection id="idFA98DC0A19C44C2E9DA4980E09801C03"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>State</term> has the meaning given the term in section 7 of title 1.</text></subsection><subsection id="id10dcb70c28b24ba59c0bb9e57358ade9"><enum>(b)</enum><header>Prohibition</header><text>No person acting under color of law of a State may deny—</text><paragraph id="idf4bedf085a5c42c7b4200b3f843805e6"><enum>(1)</enum><text>full faith and credit to any public act, record, or judicial proceeding of any other State pertaining to a marriage between 2 individuals, on the basis of the sex, gender, race, ethnicity, or national origin of those individuals; or</text></paragraph><paragraph id="id0e1e0552b5a44ba095efd300d91bd040"><enum>(2)</enum><text>a right or claim arising from such a marriage on the basis that such marriage would not be recognized under the law of such other State on the basis of the sex, gender, race, ethnicity, or national origin of those individuals.</text></paragraph></subsection><subsection id="id3156c24cb7ff45bd9675123b8a4c434f"><enum>(c)</enum><header>Enforcement by attorney general</header><text>The Attorney General may bring a civil action in the appropriate district court of the United States against any person who violates subsection (b) for declaratory and injunctive relief.</text></subsection><subsection id="id119044d613b6488993226a5d0dbb9de1"><enum>(d)</enum><header>Private right of action</header><text>Any person who is harmed by a violation of subsection (b) may bring a civil action in the appropriate district court of the United States against the person who violated such subsection for declaratory and injunctive relief.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id314077c3dff54d0a9382c635427e3078"><enum>3.</enum><header>Marriage recognition</header><text display-inline="no-display-inline">Section 7 of title 1, United States Code, is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="id74E87C06386C4F74B14343F508A82816"><section id="idcc5720e6a11d46f1848867e1dbba46e2"><enum>7.</enum><header>Marriage</header><subsection id="id60F4BA7DFBB44AEDAD018343B66CD235"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>State</term> means a State, the District of Columbia, the Commonwealth of Puerto Rico, any other territory or possession of the United States, or an Indian Tribe. </text></subsection><subsection id="idd2ed6f6ffc264d0da43e547db3b825e1"><enum>(b)</enum><header>Marriage</header><text>For the purposes of any Federal law in which marital status is a factor, an individual shall be considered married if—</text><paragraph id="id7D38F6ED1C884EB699E3E1FD2FBAF0F9"><enum>(1)</enum><text>the marriage of the individual is valid in the State where the marriage was entered into; or</text></paragraph><paragraph id="id4D60C854F30A4743B61A2916E0843749"><enum>(2)</enum><text>in the case of a marriage entered into outside any State, the marriage—</text><subparagraph id="id4E2CEED302384286A1808E17C66C8E30"><enum>(A)</enum><text>is valid in the place where entered into; and</text></subparagraph><subparagraph id="id25BAA45D64F24706924E3F8EFDB25781"><enum>(B)</enum><text>could have been entered into in a State.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id6804576e082f476b8cb0b9f8e7265ed1"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person, entity, government, or circumstance, is held to be unconstitutional, the remainder of this Act, any amendment made thereby, or the application of such provision or amendment to all other persons, entities, governments, or circumstances, shall not be affected thereby.</text></section></legis-body></bill>
