which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide health care and benefits to veterans who were exposed to toxic substances while serving as members of the Armed Forces at Karshi Khanabad Air Base, Uzbekistan, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>K2 Veterans Care Act of 2021</short-title></quote>.</text></section><section id="id8EA4624DBBB24C9AB66E9E865A3B4F34"><enum>2.</enum><header>Presumptions of service connection for certain diseases associated with exposure to certain toxic substances by members of Armed Forces serving at Karshi Khanabad Air Base, Uzbekistan</header><subsection id="id19F1CD904F154DB08F4EE87D31F65CF3"><enum>(a)</enum><header>In general</header><text>For purposes of section 1110 of title 38, United States Code, and subject to section 1113 of such title, a disease specified in subsection (b) becoming manifest in a veteran who served on active duty in the Armed Forces at Karshi Khanabad Air Base, Uzbekistan, at any time during the period beginning on January 1, 2001, and ending on December 31, 2005, shall be considered to have been incurred in or aggravated by such service, notwithstanding that there is no record of evidence of such disease during the period of such service.</text></subsection><subsection id="id62AF52C97E0E4684A4D4E972A0E1FAD6"><enum>(b)</enum><header>Diseases specified</header><text>The diseases specified in this subsection are the illnesses and diseases that the National Academies of Sciences, Engineering, and Medicine determine have a positive association, including a sufficient, limited, or suggestive association, with exposure to any of the following substances:</text><paragraph id="id4943A54E463C4C9AB204DC302167F6DF"><enum>(1)</enum><text>Jet fuel.</text></paragraph><paragraph id="idB3DA2948106D40139648FFEBF2A9DC16"><enum>(2)</enum><text>Volatile organic compounds.</text></paragraph><paragraph id="id8F0170807EE543239C4047BF6F68F215"><enum>(3)</enum><text>High levels of particulate matter and dust resulting from open burn pits, as defined in section 201(c) of the Dignified Burial and Other Veterans' Benefits Improvement Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/260">Public Law 112–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/527">38 U.S.C. 527</external-xref> note). </text></paragraph><paragraph id="id5C2CE6B83F014AA68856F4324C065907"><enum>(4)</enum><text>Depleted uranium.</text></paragraph><paragraph id="id0582FAC3912F4500A1125A899D5857B0"><enum>(5)</enum><text>Asbestos.</text></paragraph><paragraph id="id411569F542FA4635ACF83A94842EC99B"><enum>(6)</enum><text>Lead-based paint.</text></paragraph></subsection></section><section display-inline="no-display-inline" id="H2820E8CC8ADD49F6B97185F361EF6658" changed="not-changed"><enum>3.</enum><header>Health care for veterans exposed to toxic substances while serving as members of the Armed Forces at Karshi Khanabad Air Base, Uzbekistan</header><text display-inline="no-display-inline">Section 1710(e) of title 38, United States Code, is amended—</text><paragraph display-inline="no-display-inline" changed="not-changed" id="id1CB456C83BCC4E27891ADABF8232E83E"><enum>(1)</enum><text>in paragraph (1), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF1139F9B9B254F98AAE903F679052C3F"><subparagraph id="id548854B7E0E042B483A9874CA3F3BB34" indent="up2"><enum>(G)</enum><text>A veteran who served on active duty in the Armed Forces at Karshi Khanabad Air Base, Uzbekistan, during the period beginning on January 1, 2001, and ending on December 31, 2005, is eligible for hospital care, medical services, and nursing home care under subsection (a)(2)(F) for any illness or disease for which the National Academies of Sciences, Engineering, and Medicine determine has a positive association, including a sufficient, limited, or suggestive association, with exposure to any of the following substances, notwithstanding that there is insufficient medical evidence to conclude that such illness or disease is attributable to such service: </text><clause id="idbe7f27aecaf14375ab58451928d1f214"><enum>(i)</enum><text>Jet fuel.</text></clause><clause id="id05e03fe745e84a73a437c3728de5171e"><enum>(ii)</enum><text>Volatile organic compounds.</text></clause><clause id="idd62a8ee9c962491fb844d6e27cadb1e1"><enum>(iii)</enum><text>High levels of particulate matter and dust resulting from open burn pits, as defined in section 201(c) of the Dignified Burial and Other Veterans' Benefits Improvement Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/260">Public Law 112–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/527">38 U.S.C. 527</external-xref> note). </text></clause><clause id="id31ce83114784417ea8f356ded4090b66"><enum>(iv)</enum><text>Depleted uranium.</text></clause><clause id="idbb39df8140014b93b7440a45641db6c1"><enum>(v)</enum><text>Asbestos.</text></clause><clause id="idf256d0f04f7f4d92af6e6059bc95a181"><enum>(vi)</enum><text>Lead-based paint.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph display-inline="no-display-inline" changed="not-changed" id="id8A012CD68C844AD1A894622ABB54AAD8"><enum>(2)</enum><text>in paragraph (2)(B), by striking <quote>or (F)</quote> and inserting <quote>(F), or (G)</quote>.</text></paragraph></section></legis-body></bill>
