which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Water Resources Reform and Development Act of 2014 to improve provisions relating to the development of hydropower at Corps of Engineers facilities, and for other purposes. </official-title></form><legis-body><section id="id65CEC85034E74A93879FFA931DDF8315" section-type="section-one"><enum>1.</enum><header>Expediting hydropower at Corps of Engineers facilities</header><text display-inline="no-display-inline">Section 1008 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/2321b">33 U.S.C. 2321b</external-xref>) is amended—</text><paragraph id="id1fb0f12b158548baa73535a8c8027699"><enum>(1)</enum><text>in subsection (b)(1), by inserting <quote>and to meet the requirements of subsection (b)</quote> after <quote>projects</quote>;</text></paragraph><paragraph id="id57ef2ca750c14e3599a1ef826a35e676"><enum>(2)</enum><text>by redesignating subsections (b) and (c) as subsections (c) and (d), respectively; </text></paragraph><paragraph id="idbad3224d74f2409bae0c228bbbfcfb5b"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb6074ed53ba44ab3ad267cbcfbb8b6b4"><subsection id="idbcc3e3d3295341cfa6d20a8f1e4b748f"><enum>(b)</enum><header>Implementation of policy</header><text>The Secretary shall—</text><paragraph id="id896c095a0a2c46aca056fd207937d8ad"><enum>(1)</enum><text>ensure that the policy described in section (a) is implemented nationwide in an efficient, consistent, and coordinated manner; and</text></paragraph><paragraph id="id42af29efb4b04f3aaf153fd63d33d1e4"><enum>(2)</enum><text>assess opportunities—</text><subparagraph id="idc720f4e7fc1b40d784d9aeac4404a2b8"><enum>(A)</enum><text>to increase the development of hydroelectric power at existing hydroelectric water resources development projects of the Corps of Engineers; and</text></subparagraph><subparagraph id="id6533fbfed66545f2b32b3dd39e574fec"><enum>(B)</enum><text>to develop new hydroelectric power at nonpowered water resources development projects of the Corps of Engineers.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id5b941c1f94bd409cb4e16158b038a520"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id94DCD35BE50F4AED8335673C5CB91F64"><subsection id="id00cd588da1a74018aa61da00f583e940"><enum>(e)</enum><header>Program manager for non-Federal hydroelectric power development</header><paragraph id="idfd9690f9c6dc4ab49c2f08d40779af41"><enum>(1)</enum><header>Designation</header><text>The Chief of Engineers shall designate an employee of the Corps of Engineers as a Program Manager for Non-Federal Hydroelectric Power Development (referred to in this subsection as the <quote>Program Manager</quote>).</text></paragraph><paragraph id="id0e9093e165ec44ab89f8c3cb3cfff722"><enum>(2)</enum><header>Requirements</header><text>The Program Manager shall—</text><subparagraph id="id34d68babd22545b59554e25a181b80e9"><enum>(A)</enum><text>not be otherwise involved in the review of any Corps of Engineers permit to develop hydroelectric power at Corps of Engineers civil works projects; and</text></subparagraph><subparagraph id="id8924742d22d241c58996cd3276c96bfd"><enum>(B)</enum><text>be located at the headquarters office of the Corps of Engineers.</text></subparagraph></paragraph><paragraph id="ida4b474e1ac29429ea2c71bc29c0c46b7"><enum>(3)</enum><header>Responsibilities</header><text>With respect to the development of non-Federal hydroelectric power at Corps of Engineers civil works projects, the Program Manager shall—</text><subparagraph id="id7866255e586e434d8329540601225e9f"><enum>(A)</enum><text>ensure timely and consistent review of permits across Corps of Engineers districts and levels;</text></subparagraph><subparagraph id="id8a4a2dca0e6546c4bac5b3e2d648da94"><enum>(B)</enum><text>answer questions within the Corps of Engineers, or facilitate communication between developers and the Corps of Engineers, concerning Corps of Engineers permits;</text></subparagraph><subparagraph id="id2d1afc7f62384e66ae35840c87af373e"><enum>(C)</enum><text>answer questions from developers regarding the permitting process of the Corps of Engineers;</text></subparagraph><subparagraph id="id9de192960cad48c19408b76a4312a30a"><enum>(D)</enum><text>coordinate with the Federal Energy Regulatory Commission on licensing matters;</text></subparagraph><subparagraph id="id0fd780848f2d48368a62a36386f4ed7b"><enum>(E)</enum><text>facilitate timely action on all aspects of Federal permitting required for hydropower development; and</text></subparagraph><subparagraph id="id6ec79aa43c484a88bdd62969f7eff855"><enum>(F)</enum><text>ensure that new hydropower productions are designed and operated with environmentally sustainable technologies and management plans.</text></subparagraph></paragraph><paragraph id="idb1c9e85e1e174758beb9116d1040d978"><enum>(4)</enum><header>Reporting</header><text>Not later than 90 days after the date of enactment of this subsection, the Chief of Engineers shall submit to Congress a report on the implementation of this subsection and subsection (b).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
