which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Community Reinvestment Act of 1977 to provide financial institutions with credit for providing community business development referrals or resources, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Community Business Development Act</short-title></quote>.</text></section><section id="id7E19CAB678EC42C3986B8C7D022423E2"><enum>2.</enum><header>CRA credit for providing community business development referrals or resources</header><text display-inline="no-display-inline">Section 804 of the Community Reinvestment Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/12/2903">12 U.S.C. 2903</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8A6EE468BF2B44D0A30E8C81AED359B0"><subsection id="idC0BCD6DD87F24B37A1083409662A6D08"><enum>(e)</enum><header>Referrals to community business development organizations</header><paragraph id="id861338EC00594EC9B878E02948BE10E2"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>community business development organization</term>—</text><subparagraph id="idE95E4E0B5C314BFEB74795464C374B36"><enum>(A)</enum><text>means an organization that provides low- and moderate-income borrowers with business development resources, including—</text><clause id="id584cec0d32564661b1b996e5f18c881c"><enum>(i)</enum><text>credit improvement programs;</text></clause><clause id="id1731883DCF5440A491D8E0003582CAC7"><enum>(ii)</enum><text>business counseling and mentoring;</text></clause><clause id="idEC8865806221401FB892DF5DA22E4B5E"><enum>(iii)</enum><text>financial literacy programs; and </text></clause><clause id="idE87D3B59AFBD42E687F4A4DEDCB2C77C"><enum>(iv)</enum><text>business development courses; and</text></clause></subparagraph><subparagraph id="id5ED0426CB4904DA7AF66C9681D1C7B75"><enum>(B)</enum><text>includes—</text><clause id="id690797D0523647EF9FFF5EEB6BAD6735"><enum>(i)</enum><text>a district office of the Small Business Administration;</text></clause><clause id="id315EB6A4235A42F18F839DDD40C56F63"><enum>(ii)</enum><text>a small business development center described in section 21 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>);</text></clause><clause id="idD7901EF6614A42ABBEE955927E6F29AE"><enum>(iii)</enum><text>a women's business center described in section 29 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/649">15 U.S.C. 649</external-xref>); </text></clause><clause id="id72c031c2a4f143af9e81f6ace759fe7a"><enum>(iv)</enum><text>an entrepreneurial center that offers business development resources, including—</text><subclause id="id7f51456d475b497c823efb5ffa598d9a"><enum>(I)</enum><text>workshops, training, educational programs, and other business development services; and</text></subclause><subclause id="id0159bb0b64d34f379120db0ecc2f3075"><enum>(II)</enum><text>mentorship and business counseling services;</text></subclause></clause><clause id="id028D936DABAB4F829A2A789FCE708480"><enum>(v)</enum><text>the Service Corps of Retired Executives authorized under section 8(b)(1)(B) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(b)(1)(B)</external-xref>); and</text></clause><clause id="idDE8C5C37C9D746A88AE9C427E052577E"><enum>(vi)</enum><text>a Veteran Business Outreach Center described in section 32 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657b">15 U.S.C. 657b</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="id99873AD9E0CF41979490AD842AE784C0"><enum>(2)</enum><header>Requirement</header><text>In assessing and taking into account, under subsection (a), the record of a financial institution, the appropriate Federal financial supervisory agency may consider, as a factor, efforts of the financial institution to—</text><subparagraph id="idD407D7C8893B4B5DAB21ACE6EEFC53E4"><enum>(A)</enum><text>refer low- and moderate-income borrowers to whom they have denied business loans to community business development organizations; or</text></subparagraph><subparagraph id="id406CEE630D8C4971A7B8444972B8E923"><enum>(B)</enum><text>directly provide low- and moderate-income borrowers with business development resources.</text></subparagraph></paragraph><paragraph id="idA18CE69E096D4CA18EBBB8B63565A2D0"><enum>(3)</enum><header>Guidance</header><subparagraph id="id51E97395D67D40EFBA84A9B9D96905BD"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this subsection, the appropriate Federal financial supervisory agencies shall issue guidance to carry out this subsection.</text></subparagraph><subparagraph id="idE03EE435C96F4176A1C9B7B51B1D2B2F"><enum>(B)</enum><header>Consideration of small financial institutions</header><text>In issuing the guidance required under subparagraph (A), the appropriate Federal financial supervisory agencies shall consider ways for small financial institutions to receive credit for referrals and resources provided under paragraph (2).</text></subparagraph><subparagraph id="id1E7D59B85C6C4C26B7AF0CA9C835C816"><enum>(C)</enum><header>Additional guidance</header><text>The Secretary of the Treasury shall issue guidance for financial institutions on the process of referring a borrower to a community business development organization in a manner that responds to community needs.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
