which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Energy to stipulate, as a condition on the sale at auction of any crude oil from the Strategic Petroleum Reserve, that the crude oil not be exported to certain countries, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Emergency Crude Oil for Foreign Adversaries Act</short-title></quote>.</text></section><section id="id9F079DE3EADE41B6BDA922ACFE3C172A"><enum>2.</enum><header>Condition on auction of crude oil from the Strategic Petroleum Reserve</header><subsection id="id3679E48463D14A28ACE594468CD94021"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idBDECAA479312466D893694A49EC8C094"><enum>(1)</enum><header>Bidder</header><text>The term <term>bidder</term> means an individual or entity bidding or intending to bid at an auction of crude oil from the Strategic Petroleum Reserve.</text></paragraph><paragraph id="idC5167B6750B0413A90A73F7EC81CE4A5"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="idD7AFFBB3AE754F70A69EEBE9064C4CAD"><enum>(3)</enum><header>Strategic Petroleum Reserve</header><text>The term <term>Strategic Petroleum Reserve</term> means the Strategic Petroleum Reserve established under part B of title I of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6231">42 U.S.C. 6231 et seq.</external-xref>).</text></paragraph></subsection><subsection id="id6D5E317D57604A8FB0F65F8EE2CBC804"><enum>(b)</enum><header>Prohibition on export of SPR crude oil to certain countries</header><paragraph id="id4E8CAFD22F384426869934D4B649E080"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, including section 161 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6241">42 U.S.C. 6241</external-xref>), and subject to paragraph (2), with respect to the drawdown and sale at auction of any crude oil from the Strategic Petroleum Reserve after the date of enactment of this Act, the Secretary shall require, as a condition of any such sale, that the crude oil not be exported to—</text><subparagraph id="id3CCA7173F8854804A4B19D9B2A9FAC3F"><enum>(A)</enum><text>the People’s Republic of China;</text></subparagraph><subparagraph id="id74CBDD5DBF0D42C4A74E5F9E42698D0A"><enum>(B)</enum><text>the Russian Federation;</text></subparagraph><subparagraph id="id60F611732BCA45EC8F2533105A046878"><enum>(C)</enum><text>the Democratic People’s Republic of Korea; or</text></subparagraph><subparagraph id="idB40ED85E95D74FB3A5F33E6B0720D3D1"><enum>(D)</enum><text>the Islamic Republic of Iran.</text></subparagraph></paragraph><paragraph id="id5F5C4A362B234CAC9FB306053D2B6EC6"><enum>(2)</enum><header>Waiver</header><subparagraph id="id81BD0EB8656944F38DAA91BCCD97D014"><enum>(A)</enum><header>In general</header><text>On application by a bidder, the Secretary may waive, prior to the date of the applicable auction, the condition described in paragraph (1) with respect to the sale of crude oil to that bidder at that auction.</text></subparagraph><subparagraph id="id663B88F4C80F4B3BBADE2078A892EAEE"><enum>(B)</enum><header>Requirement</header><text>The Secretary may issue a waiver under subparagraph (A) only if the Secretary determines that the waiver is in the interest of the national security of the United States.</text></subparagraph><subparagraph id="id8898AD3EB417404E924F0CEFFA792528"><enum>(C)</enum><header>Applications</header><clause id="id381CBF0B7DC449D1BC79A39A137988AA"><enum>(i)</enum><header>In general</header><text>A bidder desiring a waiver under subparagraph (A) shall submit to the Secretary an application—</text><subclause id="idA1C327A9205D4DAAAB47FF02DA2E06D5"><enum>(I)</enum><text>not later than the date that is 30 days before the date of the applicable auction; and</text></subclause><subclause id="idD1CB58BCABC44FD28010792246FDA8C5"><enum>(II)</enum><text>in such form and containing such information as the Secretary may require.</text></subclause></clause><clause id="id1CF9566D52074CC296E189EF557B6063"><enum>(ii)</enum><header>Deadline for decision</header><text>The Secretary shall determine whether to approve or deny an application submitted under clause (i) by the date that is 30 days after the date on which the application is submitted.</text></clause></subparagraph></paragraph></subsection><subsection id="id663F2854045A4823A0872D8FE83E7901"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committees on Energy and Commerce and Natural Resources of the House of Representatives a report describing—</text><paragraph id="idEF88CFEA5B3D43F8BBFB9790EB596FE9"><enum>(1)</enum><text>the route to destination and place of refinement of all crude oil sold at auction from the Strategic Petroleum Reserve since November 23, 2021; and</text></paragraph><paragraph id="id647DBF0102D34279AA87C51FCD978D2C"><enum>(2)</enum><text>the ownership of the refinement facilities at which crude oil described in paragraph (1) was refined.</text></paragraph></subsection></section></legis-body></bill>
