<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4499</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220711">July 11, 2022</action-date><action-desc><sponsor name-id="S396">Mrs. Blackburn</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit any requirement that a member of the National Guard receive a vaccination against COVID–19.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HEB21E0D7037A460D9349A2F6DDAF181D"><section section-type="section-one" id="H95103C9A5C89469BB50932D1A0948426"><enum>1.</enum><header>Prohibitions on requirement that a member of the National Guard receive a vaccination against COVID–19</header><subsection id="HB4F3E8E47F5E42E5A169CB61ADD862FD"><enum>(a)</enum><header>Prohibition on funding</header><text display-inline="yes-display-inline">No Federal funds may be used to require a member of the National Guard to receive a vaccination against COVID–19.</text></subsection><subsection id="H117D3B29F2DE4510BA7B151A64AD3833"><enum>(b)</enum><header>Prohibition on adverse action</header><text display-inline="yes-display-inline">The Secretary of Defense may not take any adverse action against a member of the National Guard because such member refuses to receive a vaccination against COVID–19.</text></subsection><subsection id="HA09444DB77F94C519838F0FCC812D8E8"><enum>(c)</enum><header>Adverse action defined</header><text>In this section, the term <term>adverse action</term> includes the following:</text><paragraph id="H42B8467EFDE74750BA1E9BAC98200FDA"><enum>(1)</enum><text display-inline="yes-display-inline">Retaliation.</text></paragraph><paragraph id="H4451F5B35B984CF9ACAE11385A229F83"><enum>(2)</enum><text>Punishment.</text></paragraph><paragraph id="H1AE896BB29F8407BA9EC14AD27FDDA73"><enum>(3)</enum><text>Disparate treatment.</text></paragraph></subsection></section></legis-body></bill>
