which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the National Academies of Sciences, Engineering, and Medicine to study and report on a Federal research agenda to advance the understanding of perfluoroalkyl and polyfluoroalkyl substances, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal PFAS Research Evaluation Act </short-title></quote>.</text></section><section id="id30ffa59793214af58402d4dc7083ffae"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id41c7d99be49e45e498766ef3a48dc961"><enum>(1)</enum><text>perfluoroalkyl and polyfluoroalkyl substances are a group of manmade chemicals that have been used in a wide range of products since the 1940s, including firefighting foam, carpeting, packaging, and cookware;</text></paragraph><paragraph id="idED8D3FD2F4814A25B89EFCFF6B90D7C4"><enum>(2)</enum><text>there are more than 5,000 types of registered perfluoroalkyl and polyfluoroalkyl substances;</text></paragraph><paragraph id="id8B8D48C435874C70AE7A9F293E1F79DC"><enum>(3)</enum><text>perfluoroalkyl and polyfluoroalkyl substances are not currently regulated at the Federal level;</text></paragraph><paragraph id="idbbfee74d7a524895ae9ad949d05b055e"><enum>(4)</enum><text>perfluoroalkyl and polyfluoroalkyl substances—</text><subparagraph id="idC45AF9CB60F346B5AB82D9FE98131DCD"><enum>(A)</enum><text>have been detected in air, water, soil, food, biosolids, and more, where they persist for a long time;</text></subparagraph><subparagraph id="id3EB29534ADBB49638D7270CB9C0446F7"><enum>(B)</enum><text>can accumulate and remain in the human body and in wildlife and other biota for a long time; and </text></subparagraph><subparagraph id="idB643D6C8673E418E9F2F5F417B0FD74B"><enum>(C)</enum><text>can lead to serious health effects, including cancer, low infant birthweight, liver and kidney issues, reproductive and developmental problems, and more;</text></subparagraph></paragraph><paragraph id="id5c00fba674464a86bf80d1156100edac"><enum>(5)</enum><text>there remains much unknown about—</text><subparagraph id="id5D75F448888247BA9A833713897B629A"><enum>(A)</enum><text>the toxicity, human and environmental health effects, exposure pathways, and effective removal, treatment, and destruction methods of perfluoroalkyl and polyfluoroalkyl substances; and</text></subparagraph><subparagraph id="id4C635314FF39461FBACD7300FB1FCB78"><enum>(B)</enum><text>safe alternatives to perfluoroalkyl and polyfluoroalkyl substances;</text></subparagraph></paragraph><paragraph id="id68AB331EDED846D4B4E2DE37EDDBA1C0"><enum>(6)</enum><text>Federal research efforts have been fragmented at various Federal agencies and have struggled to effectively address the full scope of challenges presented by perfluoroalkyl and polyfluoroalkyl substances; </text></paragraph><paragraph id="id904ef5583cff4567aa437a7770ad7e11"><enum>(7)</enum><text>regulatory action and cleanup with respect to perfluoroalkyl and polyfluoroalkyl substances depend on—</text><subparagraph id="idCA9525279B654F4586F93B4967053B53"><enum>(A)</enum><text>scientific analysis of toxicity data of perfluoroalkyl and polyfluoroalkyl substances;</text></subparagraph><subparagraph id="idB63CE977735142658B1273D363724A8F"><enum>(B)</enum><text>decisionmaking on how best to deal with the thousands of perfluoroalkyl and polyfluoroalkyl substances; and</text></subparagraph><subparagraph id="id9A9471314D884C1A94BDF1595C86F5A3"><enum>(C)</enum><text>understanding the significance of the many exposure pathways for perfluoroalkyl and polyfluoroalkyl substances that exist; and</text></subparagraph></paragraph><paragraph id="id6F0BC35A47764FF5AAC211385F4EF6A1"><enum>(8)</enum><text>a consensus study by the National Academies would help inform decisions by the Federal Government, State governments, industry, and other stakeholders on how to best address perfluoroalkyl and polyfluoroalkyl substances.</text></paragraph></section><section id="id0849f87d2b114ea7a72c3757500600b7"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idFED3F6D014954B9CB6E259C28CA599EA"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="idBF6654F6E4FE442BA226D9AC8D02998D"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Science Foundation.</text></paragraph><paragraph id="id9e2fe94aca944581bb1884d21fe428be"><enum>(3)</enum><header>National academies</header><text>The term <term>National Academies</term> means the National Academies of Sciences, Engineering, and Medicine.</text></paragraph></section><section id="idb318bb31a998411daaa822f40f92f988"><enum>4.</enum><header>National academies reports</header><subsection id="iddfe03508f8fe42deb606777796ba198a"><enum>(a)</enum><header>Research assessments of PFAS exposure and toxicity</header><paragraph id="id4c4c82c104f440cf8a9239669b2cd2b4"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Director, in consultation with the Administrator, the Secretary of Defense, the Director of the National Institutes of Health, and the heads of other Federal agencies with expertise relevant to understanding exposure to and toxicity of perfluoroalkyl and polyfluoroalkyl substances, shall enter into an agreement with the National Academies—</text><subparagraph id="idEC1549E96A7C45F9AC6C6A150C591CED"><enum>(A)</enum><text>to conduct a 2-phase study in accordance with this subsection to identify research and development needed to advance human exposure estimations and toxicity and hazard estimations of individual perfluoroalkyl and polyfluoroalkyl substances or perfluoroalkyl and polyfluoroalkyl substances collectively; and</text></subparagraph><subparagraph id="id63EBDA9F52EC4C1F92BE2B62E78F05B7"><enum>(B)</enum><text>to submit reports describing the results of the studies in accordance with this subsection.</text></subparagraph></paragraph><paragraph id="id0ff7d6e254a94457be45f6492d7b6496"><enum>(2)</enum><header>Phase I study and report on human exposure estimation</header><subparagraph id="iddb4d8b1d05fa42e18d7538fcd3775e69"><enum>(A)</enum><header>In general</header><text>The phase I study under paragraph (1) shall, at a minimum—</text><clause id="idcc53b7511e4b4645b2cbda33dc5f1cd5"><enum>(i)</enum><text>consider lifecycle information on the manufacture, use, and disposal of products containing perfluoroalkyl and polyfluoroalkyl substances to identify potential human exposure sources and pathways;</text></clause><clause id="id666432053c804c14a96733b873fcfacc"><enum>(ii)</enum><text>evaluate—</text><subclause id="id22740D270C754F17864C68FDA99A7B98"><enum>(I)</enum><text>the fate and transport of perfluoroalkyl and polyfluoroalkyl substances; and</text></subclause><subclause id="id22F3DD019A4240A297B80B82CC5A370D"><enum>(II)</enum><text>the breakdown products of perfluoroalkyl and polyfluoroalkyl substances, as related to human exposure;</text></subclause></clause><clause id="id5b50b7105a904b5d95c5c638139957d5"><enum>(iii)</enum><text>if feasible, estimate human exposure to individual perfluoroalkyl and polyfluoroalkyl substances or perfluoroalkyl and polyfluoroalkyl substances collectively to determine relative source contributions for various exposure pathways (such as air, water, soil, or food);</text></clause><clause id="id252e818692324aefad2c6054a8881eee"><enum>(iv)</enum><text>determine which perfluoroalkyl and polyfluoroalkyl substances are most likely to contribute to human exposure; and</text></clause><clause id="idd67a512427ad4b4d8b59c11b0a30d788"><enum>(v)</enum><text>identify research that is needed to advance exposure estimations to individual perfluoroalkyl and polyfluoroalkyl substances or perfluoroalkyl and polyfluoroalkyl substances collectively.</text></clause></subparagraph><subparagraph id="id1d31bc5e7fab4a908e6b295b50120565"><enum>(B)</enum><header>Report</header><text>Not later than 1 year after the date on which the agreement described in paragraph (1) is finalized, the National Academies shall—</text><clause id="idA9F41A1A7FD3487A9D9672F6CCD050D4"><enum>(i)</enum><text>submit to Congress a report containing the findings and recommendations of the study described in subparagraph (A); and </text></clause><clause id="idCDCA7F3D601F4E23A3E498637EAC8D9F"><enum>(ii)</enum><text>make the report under clause (i) available on a publicly accessible website. </text></clause></subparagraph></paragraph><paragraph id="id6ffc3a0abcd84bf594187ddc844e6213"><enum>(3)</enum><header>Phase II study and report on PFAS toxicity and hazard estimation</header><subparagraph id="id452564fd61ca4aebb2bbffcf816d8757"><enum>(A)</enum><header>In general</header><text>The phase II study under paragraph (1) shall, at a minimum—</text><clause id="idd703e0b917644e5e8c5fe4aa943d0e91"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idE687306561424EF88CC230E4883BED9D"><enum>(I)</enum><text>review animal and human toxicity information on the perfluoroalkyl and polyfluoroalkyl substances most likely to contribute to human exposure, as identified in the phase I report under paragraph (2)(B)(i); and</text></subclause><subclause id="id0D87DA9CD15948B7A494B9C8AD6B26C9" indent="up1"><enum>(II)</enum><text>develop an approach for conducting a human health hazard assessment of the identified perfluoroalkyl and polyfluoroalkyl substances;</text></subclause></clause><clause id="id21aff449a2bc4913b43758e73141e412"><enum>(ii)</enum><text>give consideration as to whether chemical category-based approaches for assessing hazards would be appropriate for evaluating perfluoroalkyl and polyfluoroalkyl substances as a group; and</text></clause><clause id="idf091107ab28045ac8a2ee21368579c96"><enum>(iii)</enum><text>identify research that is needed to advance toxicity and hazard assessments of individual perfluoroalkyl and polyfluoroalkyl substances or perfluoroalkyl and polyfluoroalkyl substances collectively.</text></clause></subparagraph><subparagraph id="id17a72ce844a54f8b80cc34ac8005f91e"><enum>(B)</enum><header>Report</header><text>Not later than 1 year after the date on which the phase I report is submitted to Congress under paragraph (2)(B)(i), the National Academies shall—</text><clause id="idE33B9FD454CC46D9AD64E464392045A4"><enum>(i)</enum><text>submit to Congress a report containing the findings and recommendations of the study described in subparagraph (A); and </text></clause><clause id="idB1416AAD306D42709774CD62053F3658"><enum>(ii)</enum><text>make the report under clause (i) available on a publicly accessible website.</text></clause></subparagraph></paragraph></subsection><subsection id="ideba131e9f75d479e98c54ce7db98ecc1"><enum>(b)</enum><header>Research assessments of management and treatment alternatives for PFAS contamination in the environment and development of safe alternatives</header><paragraph id="ida2b903fe8e8f49ae914a85f2b9387636"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Director and the Administrator, in consultation with the Secretary of Defense and the heads of other Federal agencies with expertise relevant to the development of alternatives to perfluoroalkyl and polyfluoroalkyl substances and the management and treatment of perfluoroalkyl and polyfluoroalkyl substances, shall jointly enter into an agreement with the National Academies—</text><subparagraph id="idF6C2E53168AA45EE855EE9495C2271A2"><enum>(A)</enum><text>to conduct a 2-phase study in accordance with this subsection to better understand—</text><clause id="id00CC9B0565CF4D55BCB5DA988267EC14"><enum>(i)</enum><text>the research and development needed to advance the understanding of the extent and implications of environmental contamination by perfluoroalkyl and polyfluoroalkyl substances; </text></clause><clause id="idF495713A501B4163A9BB3D862565C7DE"><enum>(ii)</enum><text>the best methods to manage and treat that contamination; and</text></clause><clause id="id63C34A3F86D24E31BC48BFA4FBBD99D4"><enum>(iii)</enum><text>the development of safe alternatives to perfluoroalkyl and polyfluoroalkyl substances; and</text></clause></subparagraph><subparagraph id="idD9FEBB3A0D594C6EAE1D342A5E880030"><enum>(B)</enum><text>to submit reports describing the results of the studies in accordance with this subsection.</text></subparagraph></paragraph><paragraph id="id2fed6df3942a4b13a44993b6b93cd062"><enum>(2)</enum><header>Phase I study and report on treatment and remediation</header><subparagraph id="idE7DF1D04FFCA4920BB244F470BA21787"><enum>(A)</enum><header>In general</header><text>The phase I study under paragraph (1) shall, at a minimum—</text><clause id="idee6e0670a0f942559c3c7675247fd392"><enum>(i)</enum><text>assess the best available strategies for treatment, site remediation, and safe disposal of perfluoroalkyl and polyfluoroalkyl substances; and</text></clause><clause id="id1bc3a56cda644b238dd0aeb5dd017ec9"><enum>(ii)</enum><text>describe research gaps relating to the issues described in clause (i), including socioeconomic considerations and ways that the Federal Government can address the research needs.</text></clause></subparagraph><subparagraph id="id2d462de95a8c4ad3bd736e291f10a747"><enum>(B)</enum><header>Report</header><text>Not later than 18 months after the date on which the agreement described in paragraph (1) is finalized, the National Academies shall—</text><clause id="id9AD4BA6E4B4243B48A00644868B7D0F7"><enum>(i)</enum><text>submit to Congress a report containing the findings and recommendations of the study described in subparagraph (A); and</text></clause><clause id="id7CEA50E2B69E4F37A26DDCCC1314BAFE"><enum>(ii)</enum><text>make the report under clause (i) available on a publicly accessible website.</text></clause></subparagraph></paragraph><paragraph id="ide88951f26a554bcaa57b48392a1cd0d5" commented="no"><enum>(3)</enum><header>Phase II study and report on assessment of safe alternatives for PFAS</header><subparagraph id="ida7d4a985ea454753a12ae2b49652c66a"><enum>(A)</enum><header>In general</header><text>The phase II study under paragraph (1) shall, at a minimum—</text><clause id="idB0879A55E0264188A3FC1DE1D0CCA060"><enum>(i)</enum><text>examine the state of knowledge for alternatives to perfluoroalkyl and polyfluoroalkyl substances in applications currently, as of the date of the study, using perfluoroalkyl and polyfluoroalkyl substances that contribute to significant human health or ecological exposures and potential risk; and</text></clause><clause id="idD136BDC6A9A245979DA049871C313179"><enum>(ii)</enum><text>identify research needs to address the highest priorities for development of alternatives to perfluoroalkyl and polyfluoroalkyl substances. </text></clause></subparagraph><subparagraph id="id98e8f1418e2f454ba647c31cc605419d"><enum>(B)</enum><header>Report</header><text>Not later than 3 years after the date on which the agreement described in paragraph (1) is finalized, the National Academies shall—</text><clause id="id319EC13348A84C19A61883CA387E58FF"><enum>(i)</enum><text>submit to Congress a report containing the findings and recommendations of the study described in subparagraph (A); and</text></clause><clause id="id5E2010E345EA487486A6CE7653DD69BD"><enum>(ii)</enum><text>make the report under clause (i) available on a publicly accessible website. </text></clause></subparagraph></paragraph></subsection></section><section id="ideacf4557fca142a6ac906d08cfead2a9"><enum>5.</enum><header>Implementation plan</header><subsection id="idCAB2ACCF3E0341E2B21F7A2963545B7C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which all reports from the National Academies under section 4 have been submitted to Congress, the Director of the Office of Science and Technology Policy, in coordination with the heads of all relevant Federal agencies, shall submit to Congress an implementation plan for increased collaboration and coordination of Federal research, development, and demonstration activities with respect to perfluoroalkyl and polyfluoroalkyl substances.</text></subsection><subsection id="idFD464250A51D482E94716DE548BBC44F"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">In preparing the implementation plan under subsection (a), the Director of the Office of Science and Technology Policy shall take into consideration the recommendations included in the reports submitted to Congress under section 4.</text></subsection></section></legis-body></bill>
