<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4487</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220623">June 23, 2022</action-date><action-desc><sponsor name-id="S311">Ms. Klobuchar</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 39, United States Code, and the Help America Vote Act of 2002 to improve procedures and requirements related to election mail. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Election Mail Act</short-title></quote>.</text></section><section id="H0F0A6F2BDB964C70A7540A7E28FC1A34"><enum>2.</enum><header>Same-day processing of absentee ballots</header><subsection id="HB2AE3E2D307B4EAB8F74F8DEB18AB661"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/34">Chapter 34</external-xref> of title 39, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HE59BED6603D94CA1849068AED130A9A5"><section id="H2C9F4B75BDA748A4866CF4F3D2BBD031"><enum>3407.</enum><header>Same-day processing of ballots</header><subsection id="HD1F6445DF356450FB59B36FD86374047"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Postal Service shall ensure, to the maximum extent practicable, that any ballot carried by the Postal Service is processed by and cleared from any postal facility or post office on the same day that the ballot is received by that facility or post office.</text></subsection><subsection id="H2588C254ED5541828E870B70545D875B"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section—</text><paragraph id="H191E0356E17342FEBE33FB2E4A99BB2B"><enum>(1)</enum><text>the term <term>ballot</term> means any ballot transmitted by a voter by mail in an election for Federal office, but does not include any ballot covered by section 3406; and</text></paragraph><paragraph id="H8CAC63B6B3CB49638BB673F5CF78FCD1"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>election for Federal office</term> means a general, special, primary, or runoff election for the office of President or Vice President, or of Senator or Representative in, or Delegate or Resident Commissioner to, the Congress.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idFDE87270979349419AD7A943FB703630"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id7B89389EF3BE4654B25A455E4DAF3D1D"><enum>(1)</enum><header>Amendment to chapter heading</header><text>The heading for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/34">chapter 34</external-xref> of title 39, United States Code, is amended by striking <quote><header-in-text style="USC" level="chapter">Armed Forces and Free Postage</header-in-text></quote> and inserting <quote><header-in-text style="USC" level="chapter">Armed Forces; Free Postage; Election Mail</header-in-text></quote>.</text></paragraph><paragraph id="id8ADDCEA212D0488E97206FCAAD049420"><enum>(2)</enum><header>Table of chapters</header><text>The table of chapters for part IV of title 39, United States Code, is amended by striking the item relating to chapter 34 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAF9DA81CBD8A4D07A7820085FA4E904E"><toc><multi-column-toc-entry level="chapter" bold="on"><toc-enum>34.</toc-enum><level-header level="chapter">Armed Forces; Free Postage; Election Mail</level-header><target>3401</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H1A982473D90C409FBD617060667415EE"><enum>(3)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/34">chapter 34</external-xref> of title 39, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6199EAC14C564749AD0486E62510F17E"><toc><toc-entry bold="off" level="section">3407. Same-day processing of ballots.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4A3604BFC06346C59D6A275F61EF21EB"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to absentee ballots relating to an election for Federal office occurring on or after the date that is 60 days after the date of the enactment of this Act.</text></subsection></section><section commented="no" id="idD1AE089D1CE64BCEACA3854DBC73A4F3"><enum>3.</enum><header>Intelligent mail barcodes for ballots</header><subsection id="ide1837af4e7274c478bcdd10cffd0c14a"><enum>(a)</enum><header>In general</header><text>Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081</external-xref>) is amended—</text><paragraph id="idA8C0A4938EDE41A6925985A9FF41CB98"><enum>(1)</enum><text>by redesignating section 311 and section 312 as sections 321 and 322, respectively;</text></paragraph><paragraph id="idA0E0EEF5ABA34877B4F1F9A04800BC5F"><enum>(2)</enum><text>by redesignating subtitle B as subtitle C; and </text></paragraph><paragraph id="idCA07ACA1785043E5A6F7CBE70237A450"><enum>(3)</enum><text>by inserting after subtitle A the following new subtitle:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id421b6955ca0c4937975d191298229f6b"><subtitle id="id152b46d47355438b9474413e860fe0cb"><enum>B</enum><header>Requirements relating to mailed ballots</header><section id="id6b9ea3f356bf4779aad5d8b6446f33ba"><enum>311.</enum><header>Use of intelligent mail barcodes</header><subsection id="id42f37c74a70f46dda01c146b1e0bd59e"><enum>(a)</enum><header>In general</header><text>Each State and jurisdiction shall provide with each ballot for an election for Federal office that is sent by mail a return envelope that contains an intelligent mail barcode, as prescribed by the United States Postal Service.</text></subsection><subsection id="idf926f9adeb1b4371a888c07f4508d46c"><enum>(b)</enum><header>Exception</header><text>Subsection (a) shall not apply to any ballot for which a State or jurisdiction uses an alternative system that enables voters to track the ballot through the mail.</text></subsection><subsection id="ida8517e6cb9d1487995d01fa4a0f21ac1"><enum>(c)</enum><header>State</header><text>For purposes of this section, the term <term>State</term> includes the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands.</text></subsection><subsection id="id62312A999C3D42029B17CB97F2D4F177"><enum>(d)</enum><header>Effective date</header><text>The requirements of this section shall apply to elections for Federal office occurring on or after January 1, 2023.</text></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idc4df857c717641ab87ec959fc8bb18f5"><enum>(b)</enum><header>Enforcement</header><text>Section 401 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>) is amended by inserting <quote>or the requirements for mailed ballots under subtitle B of title III</quote> before the period at the end.</text></subsection><subsection id="id096C0A39341A42E2BD52911491673183"><enum>(c)</enum><header>Conforming amendment</header><text>Section 321(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21101">52 U.S.C. 21101</external-xref>), as redesignated by subsection (a), is amended by striking <quote>section 312</quote> and inserting <quote>section 322</quote>.</text></subsection><subsection id="id0f24b139d4ab4c59a4f9762d146f30fc"><enum>(d)</enum><header>Clerical amendments</header><text>The table of contents of such Act is amended—</text><paragraph id="idA2B00308C0C54A7EA5663861FF6C08D0"><enum>(1)</enum><text>by striking <quote>Subtitle B—Voluntary</quote> and inserting <quote>Subtitle C—Voluntary</quote>;</text></paragraph><paragraph id="id277E4EDC1701442295C077F748199BC9"><enum>(2)</enum><text>redesignating the items relating to sections 311 and 312 as relating to sections 321 and 322, respectively; and</text></paragraph><paragraph id="id013CA91BFCE9437B82A4E20355B3AEC9"><enum>(3)</enum><text>by inserting after the item relating to section 305 the following:</text><quoted-block style="OLC" id="id326788af-f023-4c2e-b97b-7d97153058b1"><toc><toc-entry level="subtitle" idref="id152b46d47355438b9474413e860fe0cb">Subtitle B—Requirements relating to mailed ballots </toc-entry><toc-entry level="section" idref="id6b9ea3f356bf4779aad5d8b6446f33ba">Sec. 311. Use of intelligent mail barcodes.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HBF07AE28A39D4549873100B9BE26CDC6"><enum>4.</enum><header>Election mail and delivery improvements</header><subsection id="HBE30F16982414CFAB66AF1B7B479C246"><enum>(a)</enum><header>Postmark required for ballots</header><paragraph id="H05CD8FA7CA6649E19D327E0D8ED7C45D"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/34">Chapter 34</external-xref> of title 39, United States Code, as amended by section 2, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H0CE8D32E3D724BF2ABF149089592BADC"><section id="H512B118C9ECA403784BCA6351B420769"><enum>3408.</enum><header>Postmark required for ballots</header><subsection id="HB58555D29E4146DD8F41E560844299B1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any absentee ballot carried by the Postal Service, the Postal Service shall indicate on the ballot envelope, using a postmark or otherwise—</text><paragraph id="HFB2F7AFB5B1C4D68B17C8E9C76EE6130"><enum>(1)</enum><text>the fact that the ballot was carried by the Postal Service; and</text></paragraph><paragraph id="H5A1D5B8BA16249CC947DE8AA9222291D"><enum>(2)</enum><text>the date on which the ballot was mailed. </text></paragraph></subsection><subsection id="H2274760BF0DA4937B9425306866883C4"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section—</text><paragraph id="HD06AFB05FD81458EAA35749BC3CB0024"><enum>(1)</enum><text>the term <term>absentee ballot</term> means any ballot transmitted by a voter by mail in an election for Federal office, but does not include any ballot covered by section 3406; and</text></paragraph><paragraph id="H22CE4020D09A457A88B4D3F5ED94E1A1"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>election for Federal office</term> means a general, special, primary, or runoff election for the office of President or Vice President, or of Senator or Representative in, or Delegate or Resident Commissioner to, the Congress.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HA4D0AA6D585146DC9010344D7D9B556E"><enum>(2)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/34">chapter 34</external-xref> of title 39, United States Code, as amended by section 2(a), is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB066E84CCF584BCB938A7E517D4C443F"><toc><toc-entry bold="off" level="section">3408. Postmark required for ballots. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H619808BCC5D044EE9D4C049DCA35FD8E"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to absentee ballots relating to an election for Federal office occurring on or after the date that is 60 days after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H3F201BD746A84CB9A747C0F8519C105C"><enum>(b)</enum><header>Greater visibility for ballots</header><paragraph id="H465A1F18A0BE419A9A0C39BC6A9957C4"><enum>(1)</enum><header>In general</header><text>Subtitle C of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081 et seq.</external-xref>), as added by section 3, is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAB8FA750BEE14022887FB8A824283BE0"><section id="H9E910B93C3304506BCA73A93DD956FBE"><enum>312.</enum><header>Ballot visibility</header><subsection id="H2D313A9CE3134421A18963E8ED4E5DE8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each State or local election official shall—</text><paragraph id="HA3D398F3CBE04181B99036FC2C915E70"><enum>(1)</enum><text display-inline="yes-display-inline">affix Tag 191, Domestic and International Mail-In Ballots (or any successor tag designated by the United States Postal Service), to any tray or sack of official ballots relating to an election for Federal office that is destined for a domestic or international address;</text></paragraph><paragraph id="H3A71D7EDDED8452DA1083D367F3B8BA1"><enum>(2)</enum><text>use the Official Election Mail logo to designate official ballots relating to an election for Federal office that is destined for a domestic or international address; and</text></paragraph><paragraph id="H207BB19675AF4E95BAB6CE98D27FC7D2" commented="no"><enum>(3)</enum><text>if an intelligent mail barcode (as described in section 311) is utilized for any official ballot relating to an election for Federal office that is destined for a domestic or international address, ensure the specific ballot service type identifier for such mail is visible.</text></paragraph></subsection><subsection id="H6A22FFD894274F78A324605E0F7E55AF"><enum>(b)</enum><header>Effective date</header><text>The requirements of this section shall apply to elections for Federal office occurring on and after the date that is 60 days after the date of the enactment of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HBE9EC1C771E845E7994C66ECEBCAA739"><enum>(2)</enum><header>Issuance of voluntary guidance by election assistance commission</header><text>Section 321(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21101">52 U.S.C. 21101(b)</external-xref>), as redesignated by section 3, is amended—</text><subparagraph id="H73CCEE2262314341915E44E9273AE09B"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (2);</text></subparagraph><subparagraph id="H7F61B2EC736B4C489C54819978E59ACA"><enum>(B)</enum><text>by striking the period at the end of paragraph (3) and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HA9EE73F5EFD845ADAEA24C92DE813C60"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB17685A43E2147D993AA325B9D4ACB5C"><paragraph id="H24BA6103F76345C48532859CC95B924F"><enum>(4)</enum><text display-inline="yes-display-inline">in the case of the recommendations with respect to section 312, the date described in section 312(b).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD440FF53A8F34938B26E4A8E9D6CAEFD"><enum>(3)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents of such Act, as amended by section 3, is amended by inserting after the item relating to section 311 the following new item:</text><quoted-block style="OLC" id="H12C73F1988B24B4793BBE0F4D9437227"><toc><toc-entry level="section" idref="H9E910B93C3304506BCA73A93DD956FBE">Sec. 312. Ballot visibility.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HBA2AF89E5DB44C70BC9AE2A5A68FBA60"><enum>5.</enum><header>Carriage of election mail</header><subsection id="HB9EB4BE8EF0B4242A2CCA1C852DDC6FB"><enum>(a)</enum><header>Treatment of election mail</header><paragraph id="HABABA875ED2F4D07A6A49423C9D9E325"><enum>(1)</enum><header>Treatment as first-class mail; free postage</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/34">Chapter 34</external-xref> of title 39, United States Code, as amended by section 2 and section 3(a), is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="H8319864CCA044F23A0D4C2BBEF5269F9"><section id="H56F47B9642354CA794659190D1EC914C"><enum>3409.</enum><header>Domestic election mail; restriction of operational changes prior to elections</header><subsection id="HAB7515FB18774FA6AF4EE0C267610FDB"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idacf39fed9b9d415c8785ccfd3776b20e"><enum>(1)</enum><header>Election for federal office</header><text>The term <term>election for Federal office</term> means a general, special, primary, or runoff election for the office of President or Vice President, or of Senator or Representative in, or Delegate or Resident Commissioner to, the Congress. </text></paragraph><paragraph id="idBE59AE1CE2F742C5A9045B5D940954C9"><enum>(2)</enum><header>Election mail</header><text>The term <term>election mail</term> means— </text><subparagraph id="H2A2AB482B2B8478F9EA4D1FAFE6FC77B"><enum>(A)</enum><text>a blank or completed voter registration application form, voter registration card, or similar materials, relating to an election for Federal office;</text></subparagraph><subparagraph id="HCDFC27796DB648ABBA884B760CD6DD15"><enum>(B)</enum><text>a blank or completed absentee and other mail-in ballot application form, and a blank or completed absentee or other mail-in ballot, relating to an election for Federal office, and</text></subparagraph><subparagraph id="HA8BA3DC371A34882BA04C944820E3B04"><enum>(C)</enum><text>other materials relating to an election for Federal office that are mailed by a State or local election official to an individual who is registered to vote.</text></subparagraph></paragraph></subsection><subsection id="H8D54B58C876046329819895EE6D2B07D"><enum>(b)</enum><header>Carriage of election mail</header><text display-inline="yes-display-inline">Election mail (other than balloting materials covered under section 3406 (relating to the Uniformed and Overseas Absentee Voting Act)), individually or in bulk, shall be carried in accordance with the service standards established for first-class mail under section 3691.</text></subsection><subsection id="H0E2FB34D8F164E2BA0A49908680E87DF"><enum>(c)</enum><header>No postage required for completed ballots</header><text display-inline="yes-display-inline">Completed absentee or other mail-in ballots (other than balloting materials covered under section 3406 (relating to the Uniformed and Overseas Absentee Voting Act)) shall be carried free of postage.</text></subsection><subsection id="H886B3FF6CEB9488B91699EB19F7CD53D"><enum>(d)</enum><header>Restriction of operational changes</header><text>During the 120-day period which ends on the date of an election for Federal office, the Postal Service may not carry out any new operational change that would restrict the prompt and reliable delivery of election mail. This subsection applies to operational changes which include—</text><paragraph id="HFD4A157E410045138B25937E9F583953"><enum>(1)</enum><text>removing or eliminating any mail collection box without immediately replacing it; and </text></paragraph><paragraph id="HE531AF39266843ED8A04EB8C2B6B42E9"><enum>(2)</enum><text>removing, decommissioning, or any other form of stopping the operation of mail sorting machines, other than for routine maintenance.</text></paragraph></subsection><subsection id="HF34E3BE6BA644D7E8465832B868548F3"><enum>(e)</enum><header>Election mail coordinator</header><text>The Postal Service shall appoint an Election Mail Coordinator at each area office and district office to facilitate relevant information sharing with State, territorial, local, and Tribal election officials in regards to the mailing of election mail.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H4A9FFD90FAC547988416098F732868E6"><enum>(2)</enum><header>Reimbursement of Postal Service for revenue forgone</header><text>Section 2401(c) of title 39, United States Code, is amended by striking <quote>sections 3217 and 3403 through 3406</quote> and inserting <quote>sections 3217, 3403 through 3406, and 3409</quote>.</text></paragraph></subsection><subsection id="HB8384676AB174BE8BAB61537B0ED4008"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/34">chapter 34</external-xref> of title 39, United States Code, as amended by section 2 and section 3(a), is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H296C1D8BC4BD4BC1AF245F6456381B12"><toc><toc-entry bold="off" level="section">3409. Domestic election mail; restriction of operational changes prior to elections.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H13F83128574E4662B572010D796B6FD3"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect upon the expiration of the 180-day period which begins on the date of the enactment of this section.</text></subsection></section><section id="id9e2440f5a47b4caf9939c3b5503b0a80"><enum>6.</enum><header>United States Postal Service consultation</header><subsection id="idDB0CE051656C4EEAAD30DAC643494286"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Postmaster General shall consult with Indian Tribes, on an annual basis, regarding issues relating to the United States Postal Service that present barriers to voting for eligible voters living on Indian lands. </text></subsection><subsection id="id11E909E411914B828BFA8F2D97E14740"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section—</text><paragraph id="H86F8A69BBC664709A6F07F1DF8449032"><enum>(1)</enum><header>Indian lands</header><text>The term <term>Indian lands</term> means—</text><subparagraph commented="no" id="HDC5A62CC00B04843A6A9C48929BC63A2"><enum>(A)</enum><text>any Indian country, as such term is defined in section 1151 of title 18, United States Code, of an Indian Tribe;</text></subparagraph><subparagraph commented="no" id="H2B2E58ADA2F14DE7BB7DFB63A783B349"><enum>(B)</enum><text>any land in Alaska that is owned, pursuant to the Alaska Native Claims Settlement Act, by an Indian Tribe that is a Native village (as such term is defined in section 3 of such Act), or by a Village Corporation that is associated with the Indian Tribe (as such term is defined in section 3 of such Act);</text></subparagraph><subparagraph commented="no" id="HED267941D4E54D2EAA70AF42F0FCF238"><enum>(C)</enum><text>any land on which the seat of government of the Indian Tribe is located; and</text></subparagraph><subparagraph commented="no" id="HB7297560C9A44E19BC113ED97FE09D46"><enum>(D)</enum><text>any land that is part or all of a tribal designated statistical area associated with the Indian Tribe, or is part or all of an Alaska Native village statistical area associated with the Tribe, as defined by the Bureau of the Census for the purposes of the most recent decennial census.</text></subparagraph></paragraph><paragraph id="H1FA1F025C2FE4C3BBD45579C322A3B82"><enum>(2)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> means the recognized governing body of any Indian or Alaska Native Tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>). </text></paragraph></subsection></section><section id="id2110C1485CD14FA593D201AE71387F02"><enum>7.</enum><header>Uniform deadline for acceptance of mailed ballots</header><subsection id="id5BB5250F709D47DDB39BA0B2254B57FE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle C of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081 et seq.</external-xref>), as added by section 3 and amended by section 4, is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3C15D89B807546BB87245F24481A5637"><section id="id34268fcb7aff451285593fa2956a37e6"><enum>313.</enum><header>Uniform deadline for acceptance of mailed ballots</header><subsection id="ide4d8ed9b8f0e46f488a3a188f2eb7958"><enum>(a)</enum><header>In general</header><text>A State or local election official may not refuse to accept or process a ballot submitted by an individual by mail with respect to an election for Federal office in the State on the grounds that the individual did not meet a deadline for returning the ballot to the appropriate State or local election official if—</text><paragraph id="ida7a92bc4c9e3410ca9dfba5fc196d62a"><enum>(1)</enum><text>the ballot is postmarked or otherwise indicated by the United States Postal Service to have been mailed on or before the date of the election; and</text></paragraph><paragraph id="idc4f1a5c816694d85b02e3757e8a7b6a8"><enum>(2)</enum><text>the ballot is received by the appropriate election official prior to the expiration of the 7-day period which begins on the date of the election.</text></paragraph></subsection><subsection id="ide058fb3ebcef467d815280e8e96c3d42"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to prohibit a State from having a law that allows for counting of ballots in an election for Federal office that are received through the mail after the date that is 7 days after the date of the election.</text></subsection><subsection id="id9445289bdfbe457097ae6a72296a1b9f"><enum>(c)</enum><header>Effective date</header><text>This section shall apply with respect to the regularly scheduled general election for Federal office held in November 2022 and each succeeding election for Federal office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id44CE63D78DB6420390E49F533B0269B6"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of such Act, as amended by sections 3 and 4, is amended by inserting after the item relating to section 312 the following new item:</text><quoted-block style="OLC" id="idd436abc9-a9c8-4346-844f-85b294765b6a"><toc><toc-entry level="section" idref="id34268fcb7aff451285593fa2956a37e6">Sec. 313.
