which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Housing Act to prohibit discrimination based on source of income, veteran status, or military status.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Housing Improvement Act of 2022</short-title></quote>.</text></section><section id="idF677DA90072C4799B7FB3B78ED10B74A"><enum>2.</enum><header>Prohibiting housing discrimination based on source of income, veteran status, or military status</header><subsection id="idCE82A0A0D6EE40E58E99850456ED9B58"><enum>(a)</enum><header>In general</header><text>The Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>) is amended—</text><paragraph id="idec63d76a20084ff2b11fad0b167c40ac"><enum>(1)</enum><text>in section 802 (<external-xref legal-doc="usc" parsable-cite="usc/42/3602">42 U.S.C. 3602</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9717800339F64B45BF41ECF226A9FC88"><subsection id="id4B00EB96032142E7AB98E4C8497AA753"><enum>(p)</enum><text><term>Military status</term> means the status of a person as a member of the uniformed services, as defined in section 101 of title 10, United States Code. </text></subsection><subsection id="id963B00FF88E54403810796825040F92D"><enum>(q)</enum><text><term>Source of income</term> includes—</text><paragraph id="idBC71357FA44C41F8A98F6EF56D9A84D1"><enum>(1)</enum><text>a housing voucher under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) and any form of Federal, State, or local housing assistance provided to a person or family or provided to a housing owner on behalf of a person or family, including—</text><subparagraph id="idDE834484A60B4D63B4311D1778ADA9EC"><enum>(A)</enum><text>rental vouchers;</text></subparagraph><subparagraph id="id61279EE4421847018E6FBC21502FDF16"><enum>(B)</enum><text>rental assistance;</text></subparagraph><subparagraph id="idD8CAEB3AD1AD4877BF9B6C6D55D9723E"><enum>(C)</enum><text>rental subsidies from nongovernmental organizations; and</text></subparagraph><subparagraph id="idF41EA48CCA374A7E9E6A65A945404A5D"><enum>(D)</enum><text>homeownership subsidies;</text></subparagraph></paragraph><paragraph id="id8D183B536E804E5BA81A77F7E64E2811"><enum>(2)</enum><text>income received as a monthly benefit under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>), as a supplemental security income benefit under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>), or as a benefit under the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231">45 U.S.C. 231 et seq.</external-xref>), including any such benefit to which the individual is entitled for which payment is made to a representative payee; </text></paragraph><paragraph id="idA4E7FF4D26834E9EBCDFC0E01BD1E107"><enum>(3)</enum><text>income received by court order, including spousal support and child support;</text></paragraph><paragraph id="idC60775A76B0641D2B319E056432EEE32"><enum>(4)</enum><text>any payment from a trust, guardian, conservator, cosigner, or relative; and</text></paragraph><paragraph id="idC2EDAB1E92F44787AC27E023B71050E3"><enum>(5)</enum><text>any other lawful source of income or funds, including savings accounts and investments.</text></paragraph></subsection><subsection id="idA267DBE594344B96AA9CBAEEA3E57E56"><enum>(r)</enum><text><term>Veteran status</term> means the status of a person as a former member of the Armed Forces.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id88056A0B5C0E4FAFB9DBC4BD1721D5C3"><enum>(2)</enum><text>in section 804 (<external-xref legal-doc="usc" parsable-cite="usc/42/3604">42 U.S.C. 3604</external-xref>)—</text><subparagraph id="id70E60BD553324299AFC073EF41D5810E"><enum>(A)</enum><text>by inserting <quote>source of income, veteran status, military status,</quote> after <quote>familial status,</quote> each place that term appears; and</text></subparagraph><subparagraph id="idE6639ABF25A3407787945F34EB0B8AD7"><enum>(B)</enum><text>in subsection (f), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9F2D4741DAB048A892640E293CBDE00F"><paragraph id="idB9A409EA9EA84B51A80EF236F6F3B1B3" indent="up1"><enum>(10)</enum><text>Nothing in this title shall be construed to prohibit any entity from providing or otherwise making available any services or other assistance to individuals receiving Federal, State or local housing assistance.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id207cef1b52a44113831ed4acf695f63a"><enum>(3)</enum><text>in section 805 (<external-xref legal-doc="usc" parsable-cite="usc/42/3605">42 U.S.C. 3605</external-xref>)—</text><subparagraph id="id745DE32F18144D35AB3199943EAAEC75"><enum>(A)</enum><text>in subsection (a), by inserting <quote>source of income, veteran status, military status,</quote> after <quote>familial status,</quote>; and</text></subparagraph><subparagraph id="idFB549A4C5DB6441088A405D976CB77D0"><enum>(B)</enum><text>in subsection (c), by inserting <quote>source of income, veteran status, military status,</quote> after <quote>handicap,</quote>;</text></subparagraph></paragraph><paragraph id="id14244ec9f42246b6bcb11d153a21c496"><enum>(4)</enum><text>in section 806 (<external-xref legal-doc="usc" parsable-cite="usc/42/3606">42 U.S.C. 3606</external-xref>), by inserting <quote>source of income, veteran status, military status,</quote> after <quote>familial status,</quote>;</text></paragraph><paragraph commented="no" id="id8b9ca1433ac1499aa98cc57a8fda6297"><enum>(5)</enum><text>in section 808(e)(6) (<external-xref legal-doc="usc" parsable-cite="usc/42/3608">42 U.S.C. 3608(e)(6)</external-xref>), by inserting <quote>source of income, veteran status, military status,</quote> after <quote>handicap,</quote>; and</text></paragraph><paragraph commented="no" id="id4CC559E65A4F40A6A8FA2DDA162C999C"><enum>(6)</enum><text>in section 810(f) (<external-xref legal-doc="usc" parsable-cite="usc/42/3610">42 U.S.C. 3610(f)</external-xref>), by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD51D2544D5084B1C91C3855273B47CAB"><paragraph id="id107674824c674775934364da535ed554" indent="up1"><enum>(4)</enum><text>During the period beginning on the date of enactment of the <short-title>Fair Housing Improvement Act of 2022</short-title> and ending on the date that is 40 months after such date of enactment, each agency certified for purposes of this title on the day before such date of enactment shall, for purposes of this subsection, be considered certified under this subsection with respect to those matters for which the agency was certified on that date. If the Secretary determines in an individual case that an agency has not been able to meet the certification requirements within this 40-month period due to exceptional circumstances, such as the infrequency of legislative sessions in that jurisdiction, the Secretary may extend such period by not more than 6 months.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idd1ca9f62d50d463ea0d6eba6c139b593"><enum>(b)</enum><header>Prevention of intimidation in fair housing cases</header><text>Section 901 of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631</external-xref>) is amended by inserting <quote>source of income (as defined in section 802), veteran status (as defined in section 802), military status (as defined in section 802),</quote> before <quote>or national origin</quote> each place that term appears.</text></subsection></section></legis-body></bill>
