which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Labor Standards Act of 1938 to provide increased labor law protections for agricultural workers, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE8A90257E42D4CB9B0474F0770236A9B"><section section-type="section-one" id="HA36137C6EE724EC4BBA71EDDDE573DB0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness for Farm Workers Act</short-title></quote>.</text></section><section id="H9074542209D54FEEA589A6AF51D9B2AB"><enum>2.</enum><header>Redressing discrimination against agricultural workers under the Fair Labor Standards Act of 1938</header><subsection id="H129235D80DEF4BAEB06100BB3AE6FAAA"><enum>(a)</enum><header>Ending discrimination with respect to overtime hours requirements</header><text>Section 7 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/207">29 U.S.C. 207</external-xref>) is amended—</text><paragraph id="HDEE9A43B6B57494BBB56CBA4358610C9"><enum>(1)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block style="OLC" id="HA686D09D8E2E48A4B671C618A5B7A992"><paragraph id="HA5C546CAB8F14C27B18321F47C9396E0"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HAB3C80080C5B438B90B7E3E6AD57B64E"><enum>(A)</enum><text>Except as provided in subparagraph (C), beginning on January 1, 2023, no employer shall employ any employee employed in agriculture (who in any workweek is engaged in commerce or in the production of goods for commerce, or is employed in an enterprise engaged in commerce or in the production of goods for commerce) for a workweek that is longer than the hours specified under subparagraph (B), unless such employee receives compensation for employment in excess of the hours specified in such subparagraph at a rate not less than one and one-half times the regular rate at which the employee is employed.</text></subparagraph><subparagraph id="H1F93E0D4416141C89A0C6B926120E8DC" indent="up1"><enum>(B)</enum><text>The hours specified in this subparagraph are, subject to subparagraph (C), as follows:</text><clause id="H1B854EEF28F14C3F98368F469D004C62"><enum>(i)</enum><text>Beginning on January 1, 2023, fifty-five hours in any workweek.</text></clause><clause id="H89556F453D07479194467D49DB9C5B79"><enum>(ii)</enum><text>Beginning on January 1, 2024, fifty hours in any workweek.</text></clause><clause id="H26CDA2F516AB445CB76201025EF6FCDC"><enum>(iii)</enum><text>Beginning on January 1, 2025, forty-five hours in any workweek.</text></clause><clause id="HEE1AD2A73A494A358D5A4FC679BA315D"><enum>(iv)</enum><text>Beginning on January 1, 2026, forty hours in any workweek.</text></clause></subparagraph><subparagraph id="H458650EA3563468096954FBC843E17BD" indent="up1"><enum>(C)</enum><text>With respect to any employer that employs 25 or fewer employees—</text><clause id="HE3EEB68142B5436B80EB4F0017ABB477"><enum>(i)</enum><text>the requirement under subparagraph (A) shall begin on January 1, 2026; and</text></clause><clause id="H94DE042074464A22BFA503869CF54CF0"><enum>(ii)</enum><text>the hours specified under subparagraph (B) shall apply as follows:</text><subclause id="H119DED6D68AB424783B97AB4083DCB8C"><enum>(I)</enum><text>The number of hours specified under subparagraph (B)(i) shall begin on January 1, 2026.</text></subclause><subclause id="H469ECED3218F4A9FBCBBAFEE4152BEA6"><enum>(II)</enum><text>The number of hours specified under subparagraph (B)(ii) shall begin on January 1, 2027.</text></subclause><subclause id="H138E7AF0421548B8A27C18C12559BE69"><enum>(III)</enum><text>The number of hours specified under subparagraph (B)(iii) shall begin on January 1, 2028.</text></subclause><subclause id="HC07DC828DD1C42648AE469141A232AAF"><enum>(IV)</enum><text>The number of hours specified under subparagraph (B)(iv) shall begin on January 1, 2029.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H579E5593502842A98CBAE554D8887175"><enum>(2)</enum><text>by repealing subsection (m).</text></paragraph></subsection><subsection id="H26861E7923514B70A843AFE77E16EF81"><enum>(b)</enum><header>Removing certain exemptions for agricultural work</header><text>Section 13 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213</external-xref>) is amended—</text><paragraph id="H70953C51DF704590829395DA941B8DFE"><enum>(1)</enum><text>in subsection (a)(6), by striking <quote>(A)</quote> and all that follows through the semicolon and inserting <quote>if such employee is the parent, spouse, child, or other member of the employer’s immediate family;</quote>;</text></paragraph><paragraph id="H56BBCF2ABF584A48B4BBF9187D1CCD11"><enum>(2)</enum><text>in subsection (b), by repealing paragraphs (12) through (16); and</text></paragraph><paragraph id="H3D2EC52D67044BBCA9D2A9C3806855C8"><enum>(3)</enum><text>by striking subsections (h) through (j).</text></paragraph></subsection><subsection id="HF712E4D5F53E4BE78F0E5B199812C8D5"><enum>(c)</enum><header>Effective dates</header><text>The amendments made by—</text><paragraph id="H10C5286F64204BC3AF75FCB89FD1F761"><enum>(1)</enum><text>subsections (a)(2), (b)(1), (b)(3), and (d) shall take effect—</text><subparagraph id="H34331FA5689C44A2B8E140B4394FB015"><enum>(A)</enum><text>with respect to an employer that employs more than 25 employees, on January 1, 2026; and</text></subparagraph><subparagraph id="HAE577C85AEC84759986016DEF339B4D7"><enum>(B)</enum><text>with respect to an employer that employs 25 or fewer employees, on January 1, 2029; and</text></subparagraph></paragraph><paragraph id="HFEF450F828654B3490CCC3949638CFF2"><enum>(2)</enum><text>subsection (b)(2) shall take effect—</text><subparagraph id="HDC2A258B063F41DFB64FC42B41FDFE9E"><enum>(A)</enum><text>with respect to an employer that employs more than 25 employees, on January 1, 2023; and</text></subparagraph><subparagraph id="HE78987A44BAA4953840EF44CE5CF3307"><enum>(B)</enum><text>with respect to an employer that employs 25 or fewer employees, on January 1, 2026.</text></subparagraph></paragraph></subsection><subsection id="H9CA02C003E734526B6D196C3098756F7"><enum>(d)</enum><header>Conforming amendments</header><paragraph id="H1A3CD39FA1FA42A89041910BBD94BF70"><enum>(1)</enum><header>Fair Labor Standards Act of 1938</header><text>Section 13(c)(1)(A) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(c)(1)(A)</external-xref>) is amended by striking <quote>none of the employees</quote> and all that follows through <quote>section 6(a)(5)</quote> and inserting <quote>all of the employees of which are employed in agriculture and are employed by an employer who did not, during any calendar quarter during the preceding calendar year, use more than 500 man-days of agricultural labor (within the meaning of the exemption under subsection (a)(6)(A), as in effect on the day before the date of enactment of the <short-title>Fairness for Farm Workers Act</short-title>)</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H98C51C634D2F4D559F8B1929BDDFDBA3"><enum>(2)</enum><header>Migrant and Seasonal Agricultural Worker Protection Act</header><text>Section 4(a)(2) of the Migrant and Seasonal Agricultural Worker Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1803">29 U.S.C. 1803(a)(2)</external-xref>) is amended by striking <quote>for whom the man-days exemption</quote> and all that follows through the period and inserting <quote>who did not, during any calendar quarter during the preceding calendar year, use more than 500 man-days of agricultural labor (within the meaning of the exemption under section 13(a)(6)(A) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)(6)(A)</external-xref>), as in effect on the day before the date of enactment of the Fairness for Farm Workers Act).</quote>.</text></paragraph></subsection></section></legis-body></bill>
