which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To expand the availability of mental, emotional, behavioral, and substance use disorder health services, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2846A5264E434D65B908E32131212B98"><section section-type="section-one" id="H5A2DD4C82CD9475B8A5439E495ABA7FB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Care Capacity for Pediatric Mental Health Act of 2022</short-title></quote>.</text></section><section id="H240086E495A0476093000C4D0CA4A098"><enum>2.</enum><header>Programs to support pediatric mental, emotional, behavioral, and substance use disorder health care</header><text display-inline="no-display-inline">Subpart V of part D of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256">42 U.S.C. 256 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H18C9331E002241098EDA006E791B6EA0"><section id="H981F7413F0E14D4BB9F8B380C5B2CE4D"><enum>340A–1.</enum><header>Program to support pediatric mental, emotional, behavioral, and substance use disorder health care integration and coordination</header><subsection id="HEB937183F83C49F997DB55DE219ADC2C"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, in consultation with the Assistant Secretary for Mental Health and Substance Use, shall award grants, contracts, or cooperative agreements to eligible entities for the purpose of supporting pediatric mental, emotional, behavioral, and substance use disorder health care integration and coordination to meet local community needs in underserved and high-need communities.</text></subsection><subsection id="H5F07DEDA9F594861BB04C25DC8228E5E"><enum>(b)</enum><header>Eligible entities</header><text>Entities eligible for grants under subsection (a) include—</text><paragraph id="H041B68F3C8784BBDA34EBF49B6768525"><enum>(1)</enum><text>children’s hospitals;</text></paragraph><paragraph id="HC90341C1D33D45DC853D8A85B1C335EE"><enum>(2)</enum><text display-inline="yes-display-inline">facilities that provide trauma-informed, culturally-sensitive, developmentally-appropriate intensive pediatric mental, emotional, behavioral, or substance use disorder health services in partial hospital, day treatment, intensive outpatient program, or walk-in crisis assessment program settings; and</text></paragraph><paragraph id="idDAB7612063CC45E9B7DE977D7EF1CF75"><enum>(3)</enum><text>other entities providing trauma-informed, culturally-sensitive, developmentally-appropriate intensive pediatric mental, emotional, behavioral, or substance use disorder health services, as the Secretary determines appropriate.</text></paragraph></subsection><subsection id="H2DEF551FD5434B31AFBF40CFB370CC0C"><enum>(c)</enum><header>Prioritization</header><text display-inline="yes-display-inline">In making awards under subsection (a), the Secretary shall prioritize—</text><paragraph id="id66BBA613A1C6431B9B2F4CB113480362"><enum>(1)</enum><text display-inline="yes-display-inline">applicants that demonstrate plans to utilize funds to expand access to integrated care and care coordination for the prevention, screening, assessment, and treatment of pediatric mental health disorders, eating disorders, developmental disorders, and substance use disorders in high-need, rural, or underserved communities; </text></paragraph><paragraph id="id3CF147DD0049429F92821B27912C73C5"><enum>(2)</enum><text display-inline="yes-display-inline">applicants that demonstrate plans to coordinate with and complement initiatives to improve pediatric mental health and substance use disorder care implemented through other Federal programs; and</text></paragraph><paragraph id="idE6962C778D4F41BD8ACC59DF5057824F"><enum>(3)</enum><text>applicants that demonstrate a significant role in care for children in the region.</text></paragraph></subsection><subsection id="H16D62C3564A94D589E5B58F7762FEDFF"><enum>(d)</enum><header>Use of funds</header><text>Activities that may be funded through an award under subsection (a) include—</text><paragraph id="id23a69da2fbd142779cfda2afb12e2faa"><enum>(1)</enum><text>increasing the capacity of eligible entities to integrate trauma-informed, culturally-sensitive, developmentally-appropriate pediatric mental, emotional, behavioral, and substance use disorder health services, including through telehealth access to, and co-location of, mental, emotional, behavioral, and substance use disorder health providers; </text></paragraph><paragraph id="id1A9948F0D7A342BDAEEA4AA8CD40732B"><enum>(2)</enum><text>facilitating access to trauma-informed, culturally-sensitive, developmentally-appropriate intensive pediatric mental, emotional, behavioral, or substance use disorder health services in partial hospital, day treatment, intensive outpatient program, or walk-in crisis assessment program settings, in order to prevent hospitalizations and support children as they transition back to their homes and communities; </text></paragraph><paragraph id="id155667DE24284C138A5757594F37D6F0"><enum>(3)</enum><text>supporting the collection of data on pediatric mental, emotional, behavioral, and substance use disorder health care needs, service utilization and availability, and demographic data, to identify unmet needs and barriers in access to care, in a manner that protects personal privacy, consistent with applicable Federal and State privacy laws;</text></paragraph><paragraph id="idC5F3082B25714E8CA84F84F6B88AB0C1"><enum>(4)</enum><text>establishing or maintaining community-based pediatric mental health and substance use disorder partnerships, such as partnerships with schools, early childhood education programs, community-based organizations, and community-based mental health and substance use disorder care providers, to address identified gaps in access to care; and</text></paragraph><paragraph id="idCF09CE94C0C2423192E16A8B26ED533A"><enum>(5)</enum><text>training for non-clinical pediatric health care workers, including care coordinators, community health workers, and navigators, on providing trauma-informed, culturally-sensitive, developmentally-appropriate care for pediatric mental health disorders, eating disorders, developmental disorders, and substance use disorders, and on local resources to support children and their caregivers.</text></paragraph></subsection><subsection id="H262B37A91EF448AEB03941C70D0F4131"><enum>(e)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated such sums as may be necessary for each of fiscal years 2023 through 2027.</text></subsection></section><section id="H4684613A29CD4BE8AB67DC0AE2A175FF"><enum>340A–2.</enum><header>Pediatric mental, emotional, behavioral, and substance use disorder health workforce training program</header><subsection id="HA1D8A7AEF05A4CE09BA47F07B0863C2D"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, in consultation with the Assistant Secretary for Mental Health and Substance Use and the Administrator of the Centers for Medicare &amp; Medicaid Services, shall award grants, contracts, or cooperative agreements to eligible entities for the purpose of supporting evidence-based pediatric mental, emotional, behavioral, and substance use disorder health workforce training.</text></subsection><subsection id="HD2278148EAB8492EBE555F00B0AAA117"><enum>(b)</enum><header>Eligible entities</header><text>Entities eligible for grants under subsection (a) include—</text><paragraph id="id71d615490d3f4727a0a050cf3a7838f1"><enum>(1)</enum><text>children’s hospitals; </text></paragraph><paragraph id="id619913d42e734e7aaa08cc1c01fda12a"><enum>(2)</enum><text>facilities that provide trauma-informed, culturally-sensitive, developmentally-appropriate intensive pediatric mental, emotional, behavioral, or substance use disorder health services in partial hospital, day treatment, intensive outpatient program, or walk-in crisis assessment program settings, that can prevent hospitalizations and support children as they transition back to their homes and communities; and</text></paragraph><paragraph id="idcf7685dec7f3429796ad1d32c625d88c"><enum>(3)</enum><text>other entities providing trauma-informed, culturally-sensitive, developmentally-appropriate intensive pediatric mental, emotional, behavioral, or substance use disorder health services, as the Secretary determines appropriate. </text></paragraph></subsection><subsection id="id7991744e08a84286bf82a9e599bfbbe6"><enum>(c)</enum><header>Prioritization</header><text>In making awards under subsection (a), the Secretary shall prioritize applicants that serve high-need, rural, or underserved communities, and that demonstrate plans to utilize funds to expand access to prevention, screening, assessment, and treatment of pediatric mental health disorders, eating disorders, developmental disorders, and substance use disorders. </text></subsection><subsection id="H18D0319C15FE4854A1E1FE5B584D63DA"><enum>(d)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Activities that may be supported through an award under subsection (a) include expanded training to enhance the capabilities of the existing workforce, including primary care providers, pediatricians, psychiatrists, psychologists, nurses, social workers, counselors, and other health care providers, as the Secretary determines appropriate, to provide trauma-informed, culturally-sensitive, developmentally-appropriate care for pediatric mental health disorders, eating disorders, developmental disorders, and substance use disorders. </text></subsection><subsection id="id6eed4307ba2e46e2b6018ac4886a765b"><enum>(e)</enum><header>Reporting</header><paragraph id="id2fc1e4337dcf40da85e49baf03ea5562"><enum>(1)</enum><header>Reports from award recipients</header><text>Not later than 180 days after the completion of activities funded by an award under this section, the entity that received such award shall submit a report to the Secretary on the activities conducted using funds from such award, and other information as the Secretary may require.</text></paragraph><paragraph id="id8da02fe25e0e48b19a707982642bf982"><enum>(2)</enum><header>Reports to Congress</header><text>Not later than 180 days after receiving reports from all award recipients, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the projects and activities conducted with funds awarded under this section, and the outcome of such projects and activities. Such report shall include—</text><subparagraph id="idfbf5b6f163784513b7bbc4894a1e935c"><enum>(A)</enum><text>the number of projects supported by awards made under this section;</text></subparagraph><subparagraph id="id35f648284ce54874ab91b579f51cdc35"><enum>(B)</enum><text>an overview of the impact, if any, of such projects on access to pediatric mental, emotional, behavioral, and substance use disorder health services;</text></subparagraph><subparagraph id="id9df3aaae8aa1418194b6097b8843511f"><enum>(C)</enum><text>recommendations for improving the investment program under this section; and</text></subparagraph><subparagraph id="id04faac3674ca49d9b42ad915667ece8f"><enum>(D)</enum><text>any other considerations as the Secretary determines appropriate. </text></subparagraph></paragraph></subsection><subsection id="HC985922050704E9988016AF4CA59BF2C"><enum>(f)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated such sums as may be necessary for each of fiscal years 2023 through 2027.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF2D2059362414D398BFB4CA5EF287B14"><enum>3.</enum><header>Increasing Federal investment in pediatric mental, emotional, behavioral, and substance use disorder health services</header><text display-inline="no-display-inline">The Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/201">42 U.S.C. 201 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HAE5EB9CDAD8F4C10A92221A24A0D5985"><title id="H337A2FDC25CB4DD5AC2D3DF6B3E6BBCC"><enum>XXXIV</enum><header>Assistance for modernization of pediatric mental, emotional, behavioral, and substance use disorder health care infrastructure</header><section id="HA24860CAA4F640E3A31D8B4EE44615DC"><enum>3401.</enum><header>Increasing Federal investment in pediatric mental, emotional, behavioral, and substance use disorder health services</header><subsection id="H7CEDFDEF1B3145B3A3341E3E77642602"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, in consultation with the Assistant Secretary for Mental Health and Substance Use, shall award grants, contracts, or cooperative agreements to eligible entities for the purpose of improving their ability to provide trauma-informed, culturally-sensitive, developmentally-appropriate pediatric mental, emotional, behavioral, and substance use disorder health services, including by—</text><paragraph id="HE5CA1118A54E472191924C40C880DEA2"><enum>(1)</enum><text>constructing or modernizing sites of care for trauma-informed, culturally-sensitive, developmentally-appropriate pediatric mental, emotional, behavioral, and substance use disorder health services; </text></paragraph><paragraph id="id2F2D625FBDA945CAACB09F7330CEC097"><enum>(2)</enum><text>expanding capacity to provide trauma-informed, culturally-sensitive, developmentally-appropriate pediatric mental, emotional, behavioral, or substance use disorder health services, including enhancements to digital infrastructure, telehealth capabilities, or other improvements to patient care infrastructure; and</text></paragraph><paragraph id="id70935EDD7646488A9D7205CE564F6A5D"><enum>(3)</enum><text>supporting the reallocation of existing resources to accommodate pediatric mental, emotional, and behavioral health and substance use disorder patients, including by converting or adding sufficient capacity to establish or increase the entity’s inventory of licensed and operational, trauma-informed, culturally-sensitive, developmentally-appropriate intensive pediatric mental, emotional, behavioral, and substance use disorder health care programs, such as partial hospital, day treatment, intensive outpatient programs, or walk-in crisis assessment programs, in order to prevent hospitalizations and support children as they transition back to their homes and communities.</text></paragraph></subsection><subsection id="HD4BE525F9F8B43DBA2C3155A907A5E2C"><enum>(b)</enum><header>Eligible entities</header><text>Entities eligible for grants under subsection (a) include—</text><paragraph id="HD5519AA7E5A541F9924531F667FBBBA6"><enum>(1)</enum><text>children’s hospitals; </text></paragraph><paragraph id="id4c400764d7a14b21932e117662332ba9"><enum>(2)</enum><text>facilities that provide trauma-informed, culturally-sensitive, developmentally-appropriate intensive pediatric mental, emotional, behavioral, or substance use disorder health services in partial hospital, day treatment, intensive outpatient program, or walk-in crisis assessment program settings, that can prevent hospitalizations and support children as they transition back to their homes and communities; and</text></paragraph><paragraph id="idac6f07aed69d4a138eceba5973cad659"><enum>(3)</enum><text>other entities providing trauma-informed, culturally-sensitive, developmentally-appropriate intensive pediatric mental, emotional, behavioral, or substance use disorder health services, as the Secretary determines appropriate. </text></paragraph></subsection><subsection id="id577389d7b3fc4155b3989960005f99ad"><enum>(c)</enum><header>Prioritization</header><text>In making awards under subsection (a), the Secretary shall prioritize applicants that serve high-need, rural, or underserved communities, and that demonstrate plans to utilize funds to expand access to prevention, screening, assessment, and treatment of pediatric mental health disorders, eating disorders, developmental disorders, and substance use disorders. </text></subsection><subsection id="id8CCADC3EC2BC446BA58D3A2F904C87FF"><enum>(d)</enum><header>Supplement, not supplant</header><text>Funds provided under this section shall be used to supplement, and not supplant, Federal and non-Federal funds available for carrying out the activities described in this section.</text></subsection><subsection id="ide7c1b6f4029347e981f935e1cc6f1459"><enum>(e)</enum><header>Reporting</header><paragraph id="id25C2D23BA5CE497A8CCF9D6372573BB8"><enum>(1)</enum><header>Reports from award recipients</header><text>Not later than 180 days after the completion of activities funded by an award under this section, the entity that received such award shall submit a report to the Secretary on the activities conducted using funds from such award, and other information as the Secretary may require.</text></paragraph><paragraph id="id765D52C5E37240FC8D6FB0EE13593B38"><enum>(2)</enum><header>Reports to Congress</header><text>Not later than 180 days after receiving reports from all award recipients under paragraph (1), the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the projects and activities conducted with funds awarded under this section, and the outcome of such projects and activities.
