which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to criminalize any abortion or sterilization procedure performed without the informed consent of the person on whom such procedure is performed, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H84C6ABC4844F43D7AADB1AB6E41958B9"><section section-type="section-one" id="H46FBA77AE237442A9E61D5A93C6ADCBF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Informed Consent Act</short-title></quote>.</text></section><section id="HF5A48231CB1B40759F378D18E0F21700"><enum>2.</enum><header>Abortion and sterilization</header><subsection id="HAB1B5600A625475A91E3553B198ABDD0"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">Chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H6147287601AE4D8CB53370E941A94004"><section id="H42B8B23B04BC4D59932A86FDA7E9C2B6"><enum>120.</enum><header>Abortion and sterilization without informed consent</header><subsection id="H0BCC5E9133D6401EAECA19C3B8B70E4E"><enum>(a)</enum><header>Offense</header><text>Whoever, under the circumstances described in subsection (b), knowingly performs an abortion or a sterilization procedure on a person without the informed consent of such person shall be fined under this title, imprisoned not more than 10 years, or both.</text></subsection><subsection id="HDE1BBB95C6AE47EDBC3CD4AC7064E905"><enum>(b)</enum><header>Circumstances described</header><text>For purposes of subsection (a), the circumstances described in this subsection are that—</text><paragraph id="H33790CB9F6EA49C88275ABE980D60176"><enum>(1)</enum><text>the defendant is an officer, employee, or contractor of the Federal Government;</text></paragraph><paragraph id="HD12BD803D75941EB8BB91D8A19884BF0"><enum>(2)</enum><text>the defendant is a recipient of Federal funds from the Secretary of Health and Human Services or a program administered by the Secretary of Health and Human Services; or</text></paragraph><paragraph id="H7881413EA8484BB1A67EF71A3B20E2C4"><enum>(3)</enum><text>the conduct described in subsection (a) occurred in or affected interstate commerce.</text></paragraph></subsection><subsection id="H0827F12243BA4B9297BD6DC619FA1FE1"><enum>(c)</enum><header>Exceptions</header><paragraph id="HF0D399A6599A47DF8A461134AF1B7D25"><enum>(1)</enum><header>In general</header><text>Subsection (a) does not apply—</text><subparagraph id="H5A477C2B1CB048A98BEE9D215CD233DC"><enum>(A)</enum><text display-inline="yes-display-inline">in the case that a woman suffers from a physical disorder, physical injury, or physical illness that would, as certified by a physician, place the woman in danger of death unless an abortion is performed, including a life-endangering physical condition caused by or arising from the pregnancy itself and not including psychological or emotional conditions; or</text></subparagraph><subparagraph id="HCE5418B6E2C640A0B66A7F7DF8C7C50D"><enum>(B)</enum><text>if, in reasonable medical judgement, a sterilization procedure is necessary to—</text><clause id="H5E70BAA81166474F89502B35CDD4FD7D"><enum>(i)</enum><text display-inline="yes-display-inline">save the life of an individual whose life is endangered by a physical disorder, physical illness, or physical injury, including a life-endangering physical condition caused by or arising from the reproductive organs of the individual and not including psychological or emotional conditions; or</text></clause><clause id="H1F2E444877BD44C4BA983D0D020CF533"><enum>(ii)</enum><text>prevent serious risk of substantial and irreversible impairment of a major bodily function created by a delay.</text></clause></subparagraph></paragraph><paragraph id="HC0FBA8E7A2014BE59D08FEE46FC9460F"><enum>(2)</enum><header>Withholding of consent</header><text>Paragraph (1) shall not apply if the individual on whom an abortion or sterilization procedure is performed has explicitly refused to consent to the abortion or sterilization procedure.</text></paragraph></subsection><subsection id="HDCEAE278F27A438BA1C6A3DF92DEC35F"><enum>(d)</enum><header>Conduct of individuals with knowledge of violations</header><text display-inline="yes-display-inline">Whoever, being an officer, employee, or contractor of the Federal Government or an employee or contractor of a recipient of Federal funds from the Secretary of Health and Human Services or a program administered by the Secretary of Health and Human Services, has knowledge of a failure to comply with subsection (a) and does not, as soon as possible, make known the same to a Federal or State law enforcement agency, shall be fined under this title or imprisoned not more than three years, or both.</text></subsection><subsection id="H788A25AF22304CC5B1C994C229AD7705"><enum>(e)</enum><header>Definitions</header><paragraph id="H733B44716BEB441EA610B5053748F371"><enum>(1)</enum><header>Abortion</header><text>The term <term>abortion</term> means the use or prescription of any instrument, medicine, drug, or any other substance or device—</text><subparagraph id="HCA17EE0561F3418291B0CAECC51570BB"><enum>(A)</enum><text>to intentionally kill the unborn child of a woman known to be pregnant; or</text></subparagraph><subparagraph id="HC8CFCDF4905D4D44A3741073C74D2E27"><enum>(B)</enum><text>to intentionally terminate the pregnancy of a woman known to be pregnant, with an intention other than—</text><clause id="HCC0BB3BD5C874688BAA9455BC468FA41"><enum>(i)</enum><text>after viability to produce a live birth and preserve the life and health of the child born alive; or</text></clause><clause id="H52D3ABA75834479DA32FF5C841F37253"><enum>(ii)</enum><text>to remove a dead unborn child.</text></clause></subparagraph></paragraph><paragraph id="H8E93E82EC2E84B40BD06858BCF28EC92"><enum>(2)</enum><header>Reasonable medical judgment</header><text>The term <term>reasonable medical judgment</term> means a medical judgment that would be made by a reasonably prudent physician, knowledgeable about the case and the treatment possibilities with respect to the medical conditions involved.</text></paragraph><paragraph id="HE62DDA3B1E394999BF34100E92028FC2"><enum>(3)</enum><header>Sterilization procedure</header><text display-inline="yes-display-inline">The term <term>sterilization procedure</term> means any medical procedure, treatment, or operation for the purpose of rendering an individual permanently incapable of reproducing.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBF47BEBBC2694925A9AADB9282492D05"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H966B49923E8A42788CA372197C3B3951"><toc regeneration="no-regeneration"><toc-entry level="section">120.
