<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4469</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220623">June 23, 2022</action-date><action-desc><sponsor name-id="S306">Mr. Menendez</sponsor> (for himself, <cosponsor name-id="S366">Ms. Warren</cosponsor>, <cosponsor name-id="S361">Ms. Hirono</cosponsor>, <cosponsor name-id="S353">Mr. Schatz</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S394">Ms. Smith</cosponsor>, <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>, <cosponsor name-id="S313">Mr. Sanders</cosponsor>, <cosponsor name-id="S229">Mrs. Murray</cosponsor>, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, <cosponsor name-id="S331">Mrs. Gillibrand</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, and <cosponsor name-id="S327">Mr. Warner</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Federal Trade Commission to prescribe rules prohibiting disinformation in the advertising of abortion services, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3E5C549E8B0F478384006FE7605057C0"><section section-type="section-one" id="H672D5674F2D141868AF77037D8A6BD9D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Anti-Abortion Disinformation Act</short-title></quote> or the <quote><short-title>SAD Act</short-title></quote>.</text></section><section commented="no" id="HBD9743D0A7BC42C5A4DDCCFC30FEC6E1"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph commented="no" id="H4FFED15F470145E0960819D5DE7DDCB8"><enum>(1)</enum><text>Abortion services are an essential component of reproductive health care.</text></paragraph><paragraph commented="no" id="H9B7B96699720476885B8BE6FEE50F0B7"><enum>(2)</enum><text>The freedom to decide whether and when to have a child is key to the ability of an individual to participate fully in our democracy.</text></paragraph><paragraph commented="no" id="H0EF72F740C87426F85C8D482FDA988A8"><enum>(3)</enum><text display-inline="yes-display-inline">Crisis pregnancy centers (CPCs) are anti-abortion organizations that present themselves as comprehensive reproductive health care providers with the intent of discouraging pregnant people from having abortions.</text></paragraph><paragraph commented="no" id="H7C8E088F34424D37B6D3CEC9C2D28815"><enum>(4)</enum><text display-inline="yes-display-inline">According to the Journal of Medical Internet Research (JMIR) Public Health and Surveillance, there are more than 2,500 CPCs in the United States, though some anti-abortion groups claim that the number is closer to 4,000.</text></paragraph><paragraph commented="no" id="H4FF0A870FB874F4587A07DA5590A7AB0"><enum>(5)</enum><text display-inline="yes-display-inline">According to 2020 data from JMIR Public Health and Surveillance, on average, CPCs outnumber abortion clinics nationwide by an average of 3 to 1. In some States, this statistic is higher. For example, The Alliance: State Advocates for Women’s Rights &amp; Gender Equality (<quote>The Alliance</quote>) found that in Pennsylvania, CPCs outnumber abortion clinics by 9 to 1. The Alliance also found that in Minnesota, CPCs outnumber abortion clinics by 11 to 1.</text></paragraph><paragraph commented="no" id="H99FCAF53CA194C4BBD97C1D21C76BABB"><enum>(6)</enum><text display-inline="yes-display-inline">CPCs routinely engage in a variety of deceptive tactics, including making false claims about reproductive health care and providers, disseminating inaccurate, misleading, and stigmatizing information about the risks of abortion and contraception, and using illegitimate or false citations to imply that deceptive claims are supported by legitimate medical sources.</text></paragraph><paragraph commented="no" id="HD27F2CA848FB46E28FF2073CC94A8A78"><enum>(7)</enum><text display-inline="yes-display-inline">CPCs typically advertise themselves as providers of comprehensive health care. However, most CPCs in the United States do not employ licensed medical personnel or provide referrals for birth control or abortion care.</text></paragraph><paragraph id="H3C002DC1CFDD40A782BD25D3D89D83E7"><enum>(8)</enum><text display-inline="yes-display-inline">By using these deceptive tactics, CPCs prevent people from accessing reproductive health care and intentionally delay access to time-sensitive abortion services.</text></paragraph><paragraph id="id79043CCA34DE410B8FB70FB582B7F948"><enum>(9)</enum><text>CPCs target under-resourced neighborhoods and communities of color, including Black, Latino, Indigenous, Asian American, Pacific Islander, and immigrant communities, by locating their facilities near social services centers and comprehensive reproductive health care providers. CPCs place advertisements in these neighborhoods that mislead and draw people away from nearby providers that offer evidence-based sexual and reproductive health care, including abortion care. This exacerbates existing health barriers and delays access to time-sensitive care. </text></paragraph><paragraph commented="no" id="H4A9E47030F0E4CDCB7DC8429817E0608"><enum>(10)</enum><text display-inline="yes-display-inline">People are entitled to honest, accurate, and timely information when seeking reproductive health care.</text></paragraph></section><section id="H1591CE2D84D84520B7A059B2A5974E95"><enum>3.</enum><header>Prohibition on disinformation of abortion services</header><subsection id="H856BBFED9A4E40E8B9DC9C2EDD33D58B"><enum>(a)</enum><header>Conduct prohibited</header><paragraph id="H7EA6CFC03B3C4B42A327ED4C09E0E003"><enum>(1)</enum><header>Rule required</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Commission shall, in accordance with section 553 of title 5, United States Code, promulgate rules to prohibit a person from advertising with the use of misleading statements related to the provision of abortion services.</text></paragraph><paragraph id="H01DDFBA363204203A22299CC709D17AE"><enum>(2)</enum><header>Enforcement by the Commission</header><text>A violation of a rule promulgated under paragraph (1) shall be treated as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>). Except as otherwise provided, the Commission shall enforce such rule in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act were incorporated into and made a part of this section. Any person who violates this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></paragraph><paragraph id="HD1F4BC0B41CF4D37B2E25F8BA182E233"><enum>(3)</enum><header>Nonprofit organizations</header><text>The Commission shall enforce this section with respect to an organization that is not organized to carry on business for its own profit or that of its members as if such organization were a person over which the Commission has authority pursuant to section 5(a)(2) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(2)</external-xref>).</text></paragraph><paragraph id="HE0882FDA24D74E219BC9DD069636A3EF"><enum>(4)</enum><header>Civil penalty</header><text display-inline="yes-display-inline">In addition to any other penalty as may be prescribed by law, in an action brought by the Commission under this section, the total civil penalty shall not exceed the greater of—</text><subparagraph id="H7B522B777C9142A38FF235784F4E746A"><enum>(A)</enum><text>$100,000; or </text></subparagraph><subparagraph id="H620F8381497742D18BC0B3E98CAFAE37"><enum>(B)</enum><text>50 percent of the revenues earned by the ultimate parent entity of a person during the preceding 12-month period.</text></subparagraph></paragraph><paragraph id="HB2FCDA15608F4FE09F6ED09AED129AE3"><enum>(5)</enum><header>Independent litigation authority</header><text>If the Commission has reason to believe that a person has violated this section, the Commission may bring a civil action in any appropriate United States district court to—</text><subparagraph id="HDBBBADA566C7416FAEFA4665AC0A3B4B"><enum>(A)</enum><text>enjoin any further such violation by such person;</text></subparagraph><subparagraph id="H514FA5CBB4734A15B562EBF59FFF1283"><enum>(B)</enum><text>enforce compliance with this section;</text></subparagraph><subparagraph id="HB658066F32AA493181075B7D00E3C4FF"><enum>(C)</enum><text>obtain a permanent, temporary, or preliminary injunction;</text></subparagraph><subparagraph id="H095E641F7AE04B59815C4FE147198F7A"><enum>(D)</enum><text>obtain civil penalties;</text></subparagraph><subparagraph id="H2F690BA57B2A4527ACCEE36A927E1B03"><enum>(E)</enum><text>obtain damages, restitution, or other compensation on behalf of aggrieved consumers; or</text></subparagraph><subparagraph id="HC747CDF35EE44B4F92EB69FA86E1AD66"><enum>(F)</enum><text display-inline="yes-display-inline">obtain any other appropriate equitable relief.</text></subparagraph></paragraph></subsection><subsection id="H7679BD96C3A8435AA1CF318CE65C17B7"><enum>(b)</enum><header>Reports</header><paragraph id="HB4D151A9881A452EB2E05EBAD210725E"><enum>(1)</enum><header>Report on plan for enforcement</header><text>Not later than 60 days after the date on which a final rule under subsection (a)(1) is issued, the Commission shall submit to Congress a report detailing a plan to enforce the rule.</text></paragraph><paragraph id="H741E79E306454F14BEA28CC1D90BED00"><enum>(2)</enum><header>Biannual reports</header><text>Beginning one year after the date of the enactment of this Act, and every 2 years thereafter, the Commission shall submit to Congress a report that includes, with respect to the previous year, a description of any enforcement action by the Commission under this Act, any rule promulgated pursuant to this Act, and the outcomes of such actions.</text></paragraph></subsection><subsection id="HEC84922E83F4495E97EA28298DB2CF78"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="H79B551A48AC7481EBC8CBE24F04DF77E"><enum>(1)</enum><header>Abortion services</header><text>The term <term>abortion services</term> means the provision of surgical and non-surgical procedures to terminate a pregnancy or a referral for such procedures.</text></paragraph><paragraph id="H0EAEB13A88584A63928D9B6AC0E70E00"><enum>(2)</enum><header>Advertise</header><text>The term <term>advertise</term> means offering or providing goods or services to the public, regardless of whether such goods or services are offered for payment or result in a profit.</text></paragraph><paragraph id="H800FC7543231443693F2F834843AF639"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="HD23E372E2E1D400F8C1BD63C39E0BE31"><enum>(4)</enum><header>Person</header><text>The term <term>person</term> has the meaning given that term in section 551(2) of title 5, United States Code.</text></paragraph></subsection></section></legis-body></bill>
