Technical and conforming amendments.</toc-entry></toc></subsection></section><title id="idAC7FD0B0C8454A48B44B3B42EA5A2DFC" style="OLC"><enum>I</enum><header>Countering Weapons of Mass Destruction Office</header><section id="idC8DB6EDC3C2C4437A85D1E3FDB054CB2"><enum>101.</enum><header>Countering Weapons of Mass Destruction Office</header><subsection id="idbe9481f8c28c48148c29f11000b70958"><enum>(a)</enum><header>Homeland Security Act of 2002</header><text>Title XIX of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/590">6 U.S.C. 590 et seq.</external-xref>) is amended—</text><paragraph id="idff2ec3bccde544128fab4f1d20239428"><enum>(1)</enum><text>in section 1901 (<external-xref legal-doc="usc" parsable-cite="usc/6/591">6 U.S.C. 591</external-xref>)—</text><subparagraph id="idA5C47D3C11E94BC580D6DD44AA8DD03E"><enum>(A)</enum><text>in subsection (c), by amending paragraphs (1) and (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf245692ff3ef450a9e6afd8fc13b1aec"><paragraph id="id657191be89e84662acf1d4adc215114e"><enum>(1)</enum><text>matters and strategies pertaining to—</text><subparagraph id="id8cfc8ba27f77452592371ba27693bc80"><enum>(A)</enum><text>weapons of mass destruction; and</text></subparagraph><subparagraph id="id83453070342b4e918a4aebc1936d71c9"><enum>(B)</enum><text>chemical, biological, radiological, nuclear, and other related emerging threats; and</text></subparagraph></paragraph><paragraph id="iddada3d92e84e4eb6b7e09821abb63f06"><enum>(2)</enum><text>coordinating the efforts of the Department to counter—</text><subparagraph id="idace06308945141f98d130289664a515b"><enum>(A)</enum><text>weapons of mass destruction; and</text></subparagraph><subparagraph id="idb43f20e7698c4177ab08ffe86eb97416"><enum>(B)</enum><text>chemical, biological, radiological, nuclear, and other related emerging threats.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id8BC7434FBE9C4F5486A15AC72B0E66E6"><enum>(B)</enum><text>by striking subsection (e);</text></subparagraph></paragraph><paragraph id="id6673da9020b745fc967f5c643ed1670f"><enum>(2)</enum><text>by amending section 1921 (<external-xref legal-doc="usc" parsable-cite="usc/6/591g">6 U.S.C. 591g</external-xref>) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id93FB3C1E9B9149768E4A19134DE047AA"><section section-type="subsequent-section" commented="no" id="idA8E119E37DA2461987528E866E56B11C"><enum>1921.</enum><header>Mission of the Office</header><text display-inline="no-display-inline">The Office shall be responsible for—</text><paragraph id="id49e685265f15459d85be5df4cb5207af"><enum>(1)</enum><text>coordinating the efforts of the Department to counter—</text><subparagraph id="iddd61c1f251fb4006b87834361dc8232f"><enum>(A)</enum><text>weapons of mass destruction; and</text></subparagraph><subparagraph id="idc2762d6dd4b14dbe8418b48c54ce07d6"><enum>(B)</enum><text>chemical, biological, radiological, nuclear, and other related emerging threats; and</text></subparagraph></paragraph><paragraph id="id74e3775ebcfb457a83560959c3a4d16e"><enum>(2)</enum><text>enhancing the ability of Federal, State, local, Tribal, and territorial partners to prevent, detect, protect against, and mitigate the impacts of attacks using—</text><subparagraph id="id9a15c31ff04c41cf99867d7a4ae2f760"><enum>(A)</enum><text>weapons of mass destruction against the United States; and</text></subparagraph><subparagraph id="id3b70b645758443e49ededc8b467e2a90"><enum>(B)</enum><text>chemical, biological, radiological, nuclear, and other related emerging threats against the United States.</text></subparagraph></paragraph></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id72cc31b653cf4e369ec88877ee77f6f8"><enum>(3)</enum><text>in section 1922 (<external-xref legal-doc="usc" parsable-cite="usc/6/591h">6 U.S.C. 591h</external-xref>)—</text><subparagraph id="id441eb469df81456794b4a8464975d9b6"><enum>(A)</enum><text>by striking subsection (b); and</text></subparagraph><subparagraph id="ida4fad9337a054ddc8dd102804d096b5a"><enum>(B)</enum><text>by redesignating subsection (c) as subsection (b);</text></subparagraph></paragraph><paragraph id="idc78eff2328bf441d9a45249a388952e1"><enum>(4)</enum><text>in section 1923 (<external-xref legal-doc="usc" parsable-cite="usc/6/592">6 U.S.C. 592</external-xref>)—</text><subparagraph id="ida1efadaaf13b49bfab45384d9b0155cf"><enum>(A)</enum><text>by redesignating subsections (a) and (b) as subsections (b) and (d), respectively;</text></subparagraph><subparagraph id="id931973e4db934b86a37c66d751849878"><enum>(B)</enum><text>by inserting before subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf5f9d2e8083945ba8dbe987b102e5dec"><subsection id="idbdbfedb6450a4dbfafd58e741b201b0f"><enum>(a)</enum><header>Office responsibilities</header><paragraph id="idB7A501EEC5B84FC19E14F30081BE6228"><enum>(1)</enum><header>In general</header><text>For the purposes of coordinating the efforts of the Department to counter weapons of mass destruction and chemical, biological, radiological, and nuclear threats, the Office shall—</text><subparagraph id="id80b1b5d95cf74129a05277b69337940e"><enum>(A)</enum><text>provide expertise and guidance to Department leadership and components on chemical, biological, radiological, and nuclear matters, subject to the research, development, testing, and evaluation coordination requirement described in subparagraph (G);</text></subparagraph><subparagraph id="ided1e282deb83450dbbbc714cc65f591f"><enum>(B)</enum><text>in coordination with the Office for Strategy, Policy, and Plans, lead development of policies and strategies to counter weapons of mass destruction and chemical, biological, radiological, and nuclear threats on behalf of the Department;</text></subparagraph><subparagraph id="iddbbdbc1ce90e4bfd9521cd83a0144213"><enum>(C)</enum><text>identify, assess, and prioritize capability gaps relating to the Department’s chemical, biological, radiological, and nuclear strategic and mission objectives;</text></subparagraph><subparagraph id="id429f2af827e7466d8f8bdeb250ce3258"><enum>(D)</enum><text>in coordination with the Office of Intelligence and Analysis, support components of the Department, and Federal, State, local, Tribal, and territorial partners, provide intelligence and information analysis and reports on weapons of mass destruction and chemical, biological, radiological, nuclear, and other related emerging threats;</text></subparagraph><subparagraph id="id95cb8d776e304ad4a0915a0f32ae1d25"><enum>(E)</enum><text>in consultation with the Science and Technology Directorate, assess risk to the United States from weapons of mass destruction and chemical, biological, radiological, nuclear, and other related emerging threats;</text></subparagraph><subparagraph id="id3c42bc8469214f378074c78ad9d7ccdb"><enum>(F)</enum><text>lead development and prioritization of Department requirements to counter weapons of mass destruction and chemical, biological, radiological, and nuclear threats, subject to the research, development, testing, and evaluation coordination requirement described in subparagraph (G), which requirements shall be—</text><clause id="idE008F0D99C834B9B874393CF215725F9"><enum>(i)</enum><text>developed in coordination with end users; and</text></clause><clause id="idF5B957070FD64A959D21A8022203C001"><enum>(ii)</enum><text>reviewed by the Joint Requirements Council, as directed by the Secretary;</text></clause></subparagraph><subparagraph id="id2cc220bc53c0495bac72d922bc32fccf"><enum>(G)</enum><text>in coordination with the Science and Technology Directorate, direct, fund, and coordinate capability development activities to counter weapons of mass destruction and all chemical, biological, radiological, and nuclear research, development, test, and evaluation matters, including research, development, testing, and evaluation expertise, threat characterization, technology maturation, prototyping, and technology transition; </text></subparagraph><subparagraph id="id25633e6894da4f1da38ce61c12cbe947"><enum>(H)</enum><text>acquire, procure, and deploy counter weapons of mass destruction capabilities, and serve as the lead advisor of the Department on component acquisition, procurement, and deployment of counter-weapons of mass destruction capabilities; </text></subparagraph><subparagraph id="idf3b4318e05fe47fca1fb48c45fc93e7a"><enum>(I)</enum><text>in coordination with the Office of Health Security, support components of the Department, and Federal, State, local, Tribal, and territorial partners on chemical, biological, radiological, and nuclear health matters; </text></subparagraph><subparagraph id="id892B731700564FBAB083C7D422A65A3B"><enum>(J)</enum><text>provide chemical, biological, radiological, and nuclear expertise to Department and Federal partners to support engagements and efforts with international partners subject to the research, development, testing, and evaluation coordination requirement under subparagraph (G); and</text></subparagraph><subparagraph id="id6C0C9A3DB2E24340B865177D3C37D113"><enum>(K)</enum><text>carry out any other duties assigned to the Office by the Secretary. </text></subparagraph></paragraph><paragraph id="id429882CDF29945FD95B11E5A97C59075"><enum>(2)</enum><header>Detection and reporting</header><text>For purposes of the chemical, biological, radiological, and nuclear detection and reporting responsibilities of the Office, the Office shall—</text><subparagraph id="id66646dc072e2434491193e0c596a0096"><enum>(A)</enum><text>in coordination with end users, including State, local, Tribal, and territorial partners, as appropriate—</text><clause id="id46911CBB45404454B85E8B56FCCB28ED"><enum>(i)</enum><text>carry out a program to test and evaluate technology, in consultation with the Science and Technology Directorate, to detect and report on chemical, biological, radiological, and nuclear weapons or unauthorized material, in coordination with other Federal agencies, as appropriate, and establish performance metrics to evaluate the effectiveness of individual detectors and detection systems in detecting those weapons or material—</text><subclause id="id6147b84e271040359b7b28ed88c8a625"><enum>(I)</enum><text>under realistic operational and environmental conditions; and</text></subclause><subclause id="id16a6aa190d784a278c1fed974a4dda1a"><enum>(II)</enum><text>against realistic adversary tactics and countermeasures; </text></subclause></clause></subparagraph><subparagraph id="id21A5246FF0E940A2BFA01440EEEFDB3E"><enum>(B)</enum><text>in coordination with end users, conduct, support, coordinate, and encourage a transformational program of research and development to generate and improve technologies to detect, protect against, and report on the illicit entry, transport, assembly, or potential use within the United States of chemical, biological, radiological, and nuclear weapons or unauthorized material, and coordinate with the Under Secretary for Science and Technology on research and development efforts relevant to the mission of the Office and the Under Secretary for Science and Technology; </text></subparagraph><subparagraph id="id4BF607BCB0C2429DB54635019CD43F1F"><enum>(C)</enum><text>before carrying out operational testing under subparagraph (A), develop a testing and evaluation plan that articulates the requirements for the user and describes how these capability needs will be tested in developmental test and evaluation and operational test and evaluation;</text></subparagraph><subparagraph id="idf2ac7435cf39407a8603aa42a4450327"><enum>(D)</enum><text>develop, acquire, and deploy equipment to detect and report on chemical, biological, radiological, and nuclear weapons or unauthorized material in support of Federal, State, local, Tribal, and territorial governments;</text></subparagraph><subparagraph id="id1b215eeb32c24b2bbaa17b641defee4b"><enum>(E)</enum><text>support and enhance the effective sharing and use of appropriate information on chemical, biological, radiological, and nuclear threats and related emerging issues generated by elements of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)), law enforcement agencies, other Federal agencies, State, local, Tribal, and territorial governments, and foreign governments, as well as provide appropriate information to those entities;</text></subparagraph><subparagraph id="id8dd0299650da434c8a8f8f7158bb340f"><enum>(F)</enum><text>consult, as appropriate, with the Federal Emergency Management Agency and other departmental components, on chemical, biological, radiological, and nuclear threats and efforts to mitigate, prepare, and respond to all threats in support of the State, local, and Tribal communities; and</text></subparagraph><subparagraph id="id82b1cb84b2604f77ac12ba5da06b08c8"><enum>(G)</enum><text>perform other duties as assigned by the Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id1263ce0b6b6446178df6db1f8b9ab803"><enum>(C)</enum><text>in subsection (b), as so redesignated—</text><clause id="id2ecf6aee84374f71be50804e1a8b13a9"><enum>(i)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">Mission</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">Radiological and nuclear responsibilities</header-in-text></quote>;</text></clause><clause id="idbc6510459a884a68bcde8c7721257cbb"><enum>(ii)</enum><text>in paragraph (1)—</text><subclause id="iddc9b0af680e04459aec5c497442a52d9"><enum>(I)</enum><text>by inserting <quote>deploy,</quote> after <quote>acquire,</quote>; and</text></subclause><subclause id="id6504ddfa699b4d6fadea7be1a02cc8d0"><enum>(II)</enum><text>by striking <quote>deployment</quote> and inserting <quote>operations</quote>;</text></subclause></clause><clause id="id66b3b363aaeb462d8dee605fbf4cca7a"><enum>(iii)</enum><text>by striking paragraphs (6) through (10);</text></clause><clause id="id60265ec747684cde93cafa8f70b5be7d"><enum>(iv)</enum><text>redesignating paragraphs (11) and (12) as paragraphs (6) and (7), respectively;</text></clause><clause id="ida5c186c888cf435a9f2a9a699c0badbd"><enum>(v)</enum><text>in paragraph (6)(B), as so redesignated, by striking <quote>national strategic five-year plan referred to in paragraph (10)</quote> and inserting <quote>United States national technical nuclear forensics strategic planning</quote>;</text></clause><clause id="idd3463de020a44d94aab863be1f3520b3"><enum>(vi)</enum><text>in paragraph (7)(C)(v), as so redesignated—</text><subclause id="idca460c08ae9f40b6af403cca966a22aa"><enum>(I)</enum><text>in the matter preceding subclause (I), by inserting <quote>except as otherwise provided,</quote> before <quote>require</quote>; and</text></subclause><subclause id="idd1dc85364f994cfca4936c60b3dd3f8c"><enum>(II)</enum><text>in subclause (II)—</text><item id="id09AAB48A25F1443994F9DB9E1C3D2CF3"><enum>(aa)</enum><text>in the matter preceding item (aa), by striking <quote>death or disability</quote> and inserting <quote>death, disability, or a finding of good cause as determined by the Assistant Secretary (including extreme hardship, extreme need, or the needs of the Office) and for which the Assistant Secretary may grant a waiver of the repayment obligation</quote>; and</text></item><item id="idAFB783BE7C1C4955877110A1095ABF7B"><enum>(bb)</enum><text>in item (bb), by adding <quote>and</quote> at the end;</text></item></subclause></clause><clause id="id99515a341ac8477096504c48075625f9"><enum>(vii)</enum><text>by striking paragraph (13); and</text></clause><clause id="ideb68de0ee84943b7b949cfb3cf0b2773"><enum>(viii)</enum><text>by redesignating paragraph (14) as paragraph (8); and</text></clause></subparagraph><subparagraph id="id813081c338f94ed6940bbb00de76bc0e"><enum>(D)</enum><text>by inserting after subsection (b), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4F6342248C024CD2B17F3720351F1ABB"><subsection id="id4f36a618e7ef42b79739c1b755774a4e"><enum>(c)</enum><header>Chemical and biological responsibilities</header><text>The Office—</text><paragraph id="id68025170D9144A98B6CDC0D45C4D0353"><enum>(1)</enum><text>shall be responsible for coordinating with other Federal efforts to enhance the ability of Federal, State, local, and Tribal governments to prevent, detect, protect against, and mitigate the impacts of chemical and biological threats against the United States; and </text></paragraph><paragraph id="idA93456DA10704B828C6CFE5C635B0502"><enum>(2)</enum><text>shall—</text><subparagraph id="idca90d1b9eeec410391c849b360c3f40f"><enum>(A)</enum><text>serve as a primary entity of the Federal Government to further develop, acquire, deploy, and support the operations of a national biosurveillance system in support of Federal, State, local, Tribal, and territorial governments, and improve that system over time; </text></subparagraph><subparagraph id="id70a65b3989ac4a008e9682c7ff87f5ff"><enum>(B)</enum><text>enhance the chemical and biological detection efforts of Federal, State, local, Tribal, and territorial governments and provide guidance, tools, and training to help ensure a managed, coordinated response; and</text></subparagraph><subparagraph id="id2f306b6082ab4ae1870578d45c0fd908"><enum>(C)</enum><text>collaborate with the Biomedical Advanced Research and Development Authority, the Office of Health Security, the Defense Advanced Research Projects Agency, and the National Aeronautics and Space Administration, and other relevant Federal stakeholders, and receive input from industry, academia, and the national laboratories on chemical and biological surveillance efforts.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idcb208cffbc3949e0ac405fa852287dfa"><enum>(5)</enum><text>in section 1924 (<external-xref legal-doc="usc" parsable-cite="usc/6/593">6 U.S.C. 593</external-xref>), by striking <quote>section 11011 of the Strom Thurmond National Defense Authorization Act for Fiscal Year 1999 (<external-xref legal-doc="usc" parsable-cite="usc/5/3104">5 U.S.C. 3104</external-xref> note).</quote> and inserting <quote>section 4092 of title 10, United States Code, except that the authority shall be limited to facilitate the recruitment of experts in the chemical, biological, radiological, or nuclear specialties.</quote>;</text></paragraph><paragraph id="id3c80f1e1e4da498996c0b9194fd06153"><enum>(6)</enum><text>in section 1927(a)(1)(C) (<external-xref legal-doc="usc" parsable-cite="usc/6/596a">6 U.S.C. 596a(a)(1)(C)</external-xref>)—</text><subparagraph id="id0dd50f2081ff4e3a9996b38982e58f42"><enum>(A)</enum><text>in clause (i), by striking <quote>required under section 1036 of the National Defense Authorization Act for Fiscal Year 2010</quote>;</text></subparagraph><subparagraph id="ida0bba847c0a649708ead5747734384f5"><enum>(B)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id2b505c756a5840bda94f147b63d65891"><enum>(C)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id9c152dc2de004e22bb1debe38db16e7e"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1b09522cc79c4f139d4c85256b804bd2"><clause id="idf47fe3c9c79d479c85ae64b08036cc57"><enum>(iv)</enum><text>includes any other information regarding national technical nuclear forensics activities carried out under section 1923.</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id32a6d547a04f4987bfa0d103ac5f6197"><enum>(7)</enum><text>in section 1928 (<external-xref legal-doc="usc" parsable-cite="usc/6/596b">6 U.S.C. 596b</external-xref>)—</text><subparagraph id="id2e2b1c2696964eaa8b8119854ec74280"><enum>(A)</enum><text>in subsection (c)(1), by striking <quote>from among high-risk urban areas under section 2003</quote> and inserting <quote>based on the capability and capacity of the jurisdiction, as well as the relative threat, vulnerability, and consequences from terrorist attacks and other high-consequence events utilizing nuclear or other radiological materials</quote>; and </text></subparagraph><subparagraph id="ide77ed7700aa4474896c6428854b6d2f8"><enum>(B)</enum><text>by striking subsection (d) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6EC7843B93B348BFAE9CC779674BCD27"><subsection id="idDB7FAC9F1BF5475D9265DB37A02B7795"><enum>(d)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of the <short-title>Offices of Countering Weapons of Mass Destruction and Health Security Act of 2022</short-title>, the Secretary shall submit to the appropriate congressional committees an update on the STC program.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idC7BA8589427A4330B23D909D44EDAC81"><enum>(8)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0D724C91616D4495A748649C5E9CD8B2"><section id="id7E14D023A29542879D5EA57390238834"><enum>1929.</enum><header>Accountability</header><subsection id="id3e0b4dfe390f4fbe94c5cbcdea4788d1"><enum>(a)</enum><header>Departmentwide strategy</header><text>Not later than 180 days after the date of enactment of <short-title>Offices of Countering Weapons of Mass Destruction and Health Security Act of 2022</short-title>, and every 4 years thereafter, the Secretary, in coordination with the Deputy Secretary, shall create a Departmentwide strategy and implementation plan to counter weapons of mass destruction and chemical, biological, radiological, and nuclear threats, which should—</text><paragraph id="id869f6154cf4e4a9eb466dc906c9e9b92"><enum>(1)</enum><text>have clearly identified authorities, specified roles, objectives, benchmarks, accountability, and timelines;</text></paragraph><paragraph id="id908b68df393d452e8ddc0200f576bf5a"><enum>(2)</enum><text>incorporate the perspectives of non-Federal and private sector partners; and</text></paragraph><paragraph id="id8382c1f9c5c348d3b30db80c0ab25904"><enum>(3)</enum><text>articulate how the Department will contribute to relevant national-level strategies and work with other Federal agencies.</text></paragraph></subsection><subsection id="id1ABFD69A144C466BA79BF05254E23A34"><enum>(b)</enum><header>Consideration</header><text>The Secretary shall appropriately consider chemical, biological, radiological, nuclear, and emerging threats when creating the strategy and implementation plan required under subsection (a).</text></subsection><subsection id="idB7F282E1D59942D495E70861205689AA"><enum>(c)</enum><header>Report</header><text>The Office shall submit to the appropriate congressional committees a report on the updated Departmentwide strategy and implementation plan required under subsection (a). </text></subsection><subsection id="id17D6ADC378C74245A3E50B7FDEE728BA"><enum>(d)</enum><header>Employee morale</header><text>Not later than 180 days after the date of enactment of the <short-title>Offices of Countering Weapons of Mass Destruction and Health Security Act of 2022</short-title>, the Office shall submit to and brief the appropriate congressional committees on a strategy and plan to continuously improve morale within the Office. </text></subsection><subsection id="idFEBB2618465B4817AAB4F71959E7987E"><enum>(e)</enum><header>Comptroller General</header><text>Not later than 1 year after the date of enactment of the <short-title>Offices of Countering Weapons of Mass Destruction and Health Security Act of 2022</short-title>, the Comptroller General of the United States shall conduct a review of and brief the appropriate congressional committees on—</text><paragraph id="idaef793df584e41d5bfbd23352e1f6d1d"><enum>(1)</enum><text>the efforts of the Office to prioritize the programs and activities that carry out the mission of the Office, including research and development;</text></paragraph><paragraph id="idff45016447fc42fd8c10524979dcafb2"><enum>(2)</enum><text>the consistency and effectiveness of stakeholder coordination across the countering weapons of mass destruction mission, including operational and support components of the Department and State and local entities; and</text></paragraph><paragraph id="idA9195EF4241248579B06D5F314309980"><enum>(3)</enum><text>the efforts of the Office to manage and coordinate the lifecycle of research and development within the Office and with other components of the Department, including the Science and Technology Directorate.</text></paragraph></subsection><subsection id="id7197d8c31390433c8524a86a40ab9310"><enum>(f)</enum><header>National Academies of Sciences, Engineering, and Medicine</header><paragraph id="id19527A8D02D349C387B6D49B9290EE54"><enum>(1)</enum><header>Study</header><text>The Secretary shall enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to conduct a consensus study and report to the Secretary and the appropriate congressional committees on—</text><subparagraph id="id5A943038CF544824BE16CD1B09151073"><enum>(A)</enum><text>the role of the Department in preparing, detecting, and responding to biological and health security threats to the homeland; </text></subparagraph><subparagraph id="idE6FAA024768646F4858CFF62EC1D3DBD"><enum>(B)</enum><text>recommendations to improve departmental biosurveillance efforts against biological threats, including any relevant biological detection methods and technologies; and</text></subparagraph><subparagraph id="id1C4AB71A226743C7ADE6D0D7D826340D"><enum>(C)</enum><text>the feasibility of different technological advances for biodetection compared to the cost, risk reduction, and timeliness of those advances.</text></subparagraph></paragraph><paragraph id="id73AD9806A1274521B261FD981370737C"><enum>(2)</enum><header>Briefing</header><text>Not later than 1 year after the date on which the Secretary receives the report required under paragraph (1), the Secretary shall brief the appropriate congressional committees on—</text><subparagraph id="id09859F99BA954080952FE573D02C22C4"><enum>(A)</enum><text>the implementation of the recommendations included in the report; and</text></subparagraph><subparagraph id="idAB91496B86D245BE96264E387DFD108E"><enum>(B)</enum><text>the status of biological detection at the Department, and, if applicable, timelines for the transition from Biowatch to updated technology.</text></subparagraph></paragraph></subsection><subsection id="id069bf305f30c44cb81c9e31de88cab87"><enum>(g)</enum><header>Advisory Council</header><paragraph id="id88C64359623C42F7BD8E64390BF9E2C6"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of the <short-title>Offices of Countering Weapons of Mass Destruction and Health Security Act of 2022</short-title>, the Secretary shall establish an advisory body to ensure effective and ongoing coordination of the efforts of the Department to counter weapons of mass destruction, to be known as the Advisory Council for Countering Weapons of Mass Destruction (in this subsection referred to as the <term>Advisory Council</term>).</text></paragraph><paragraph id="idB50B67DCBD80443AA2D3FA23E94A21DA"><enum>(2)</enum><header>Membership</header><text>The members of the Advisory Council shall—</text><subparagraph id="id91C5BD3DBA3F4E6491DB658AE9583650"><enum>(A)</enum><text>be appointed by the Assistant Secretary; and</text></subparagraph><subparagraph id="idB10A54F6DE5D4A5D813A5341B32DD569"><enum>(B)</enum><text>to the extent practicable, represent a geographic (including urban and rural) and substantive cross section of officials, from State, local, and Tribal governments, academia, the private sector, national laboratories, and nongovernmental organizations, including, as appropriate—</text><clause id="id1B9818A5CF6248FCAC293DA65199074A"><enum>(i)</enum><text>members selected from the emergency management field and emergency response providers;</text></clause><clause id="id5252FAF289614CB5940F8BD2F8290F4E"><enum>(ii)</enum><text>State, local, and Tribal government officials; </text></clause><clause id="idDEDB7ECDCF8B49AE9F94C65351E1DCB8"><enum>(iii)</enum><text>experts in the public and private sectors with expertise in chemical, biological, radiological, and nuclear agents and weapons; </text></clause><clause id="id7DBC9B770D27428B84EE6F639CAE28D6"><enum>(iv)</enum><text>representatives from the national laboratories; and </text></clause><clause id="id699738002391418FB3A2BA2228BA0B41"><enum>(v)</enum><text>such other individuals as the Assistant Secretary determines to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="idF53A88E451BF49E185DEBDAA924C1259"><enum>(3)</enum><header>Responsibilities</header><text> The Advisory Council shall—</text><subparagraph id="id105CAC5C37744324B9DE74CE4A5E7197"><enum>(A)</enum><text>advise the Assistant Secretary on all aspects of countering weapons of mass destruction;</text></subparagraph><subparagraph id="idBFB513FAEA5C4F5484C9C08221ADD4C5"><enum>(B)</enum><text>incorporate State, local, and Tribal government, national laboratories, and private sector input in the development of the strategy and implementation plan of the Department for countering weapons of mass destruction; and</text></subparagraph><subparagraph id="id723C97E1D8AD4504ADD61C34FD1BF687"><enum>(C)</enum><text>establish performance criteria for a national biological detection system and review the testing protocol for biological detection prototypes. </text></subparagraph></paragraph><paragraph id="id1820BB2028C34B35B01C2DD5D8302A54"><enum>(4)</enum><header>Consultation</header><text>To ensure input from and coordination with State, local, and Tribal governments, the Assistant Secretary shall regularly consult and work with the Advisory Council on the administration of Federal assistance provided by the Department, including with respect to the development of requirements for countering weapons of mass destruction programs, as appropriate.</text></paragraph><paragraph id="id149415EE35E645BC9198673C0FB9DDD1"><enum>(5)</enum><header>Voluntary service</header><text>The members of the Advisory Council shall serve on the Advisory Council on a voluntary basis.</text></paragraph><paragraph id="id0DE3A535B461411AA5ED13BDD3E9EEB5"><enum>(6)</enum><header>FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Council.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id001da2b637da4b959e8af2ef7847ca8b" commented="no"><enum>(b)</enum><header>Countering Weapons of Mass Destruction Act of 2018</header><text>Section 2 of the Countering Weapons of Mass Destruction Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/387">Public Law 115–387</external-xref>; 132 Stat. 5162) is amended—</text><paragraph id="id158c3493f8864be18fe6dba29cb6d783" commented="no"><enum>(1)</enum><text>in subsection (b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/6/591">6 U.S.C. 591</external-xref> note), by striking <quote>1927</quote> and inserting <quote>1926</quote>; and</text></subparagraph><subparagraph id="id16fbd660ccac4fdfb2c0f0a37908b1b4"><enum>(B)</enum><text>setting standards for technology used by the components of the Department regarding the collection, storage, and oversight of medical records;</text></subparagraph></paragraph><paragraph id="idb09b3a9fe06143a2bf009c05c4c9f397"><enum>(10)</enum><text>advising the Secretary and the head of each component of the Department that delivers direct patient care regarding contracts for the delivery of direct patient care, other medical services, and medical supplies;</text></paragraph><paragraph id="id0be8f6585a0b4d1c8543eb638a69180e"><enum>(11)</enum><text>coordinating with the Countering Weapons of Mass Destruction Office and other components of the Department as directed by the Secretary to enhance the ability of Federal, State, local, Tribal, and territorial governments to prevent, detect, protect against, and mitigate the health effects of chemical, biological, radiological, and nuclear issues; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id4621c5f18f004544b22a314eb2e6239c"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbcadf0ec95cf44db88b0b6c22ed30638"><subsection id="idca250c3f1bc04f6cae3e208568b038ae"><enum>(d)</enum><header>Assistance and agreements</header><text>The Secretary, acting through the Chief Medical Officer, in support of the medical and public health activities of the Department, may—</text><paragraph id="ided41f9f0c76844dab3cad77b39fd27f0"><enum>(1)</enum><text>provide technical assistance, training, and information and distribute funds through grants and cooperative agreements to State, local, Tribal, and territorial governments and nongovernmental organizations;</text></paragraph><paragraph id="id96e2ef4a38964d71b908cd7c9607069f"><enum>(2)</enum><text>enter into other transactions;</text></paragraph><paragraph id="idc5144d5781a04cd4be0eec2529f095a5"><enum>(3)</enum><text>enter into agreements with other Federal agencies; and</text></paragraph><paragraph id="idd3eefa8996ca4315843e896c1e152afb"><enum>(4)</enum><text>accept services from personnel of components of the Department and other Federal agencies on a reimbursable or nonreimbursable basis.</text></paragraph></subsection><subsection id="id35ba24896f954179bae2e0bcd6a347e4" commented="no"><enum>(e)</enum><header>Office of Health Security Privacy Officer</header><text>There shall be a Privacy Officer in the Office of Health Security with primary responsibility for privacy policy and compliance within the Office, who shall—</text><paragraph id="idfdfc21f15a1f4c9eb849afe9a7b36f16" commented="no"><enum>(1)</enum><text>report directly to the Chief Medical Officer; and</text></paragraph><paragraph id="idebdd19b631894e4594f769c7f320f7ea" commented="no"><enum>(2)</enum><text>ensure privacy protections are integrated into all Office of Health Security activities, subject to the review and approval of the Privacy Officer of the Department to the extent consistent with the authority of the Privacy Officer of the Department under section 222.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id6960622101f240d9b5a70abfcc74a236"><enum>(5)</enum><text>by redesignating section 710 (<external-xref legal-doc="usc" parsable-cite="usc/6/350">6 U.S.C. 350</external-xref>) as section 2302 and transferring such section to appear after section 2301, as so redesignated;</text></paragraph><paragraph id="id12f6cb5c1b054015b3d0ad1234643571"><enum>(6)</enum><text>in section 2302, as so redesignated—</text><subparagraph id="id2d1bac4b248940a79bc00d2a7df9e973"><enum>(A)</enum><text>in subsection (a), by striking <quote>Under Secretary for Management</quote> each place that term appears and inserting <quote>Chief Medical Officer</quote>; and</text></paragraph><paragraph id="id1d7203aba94649d7b03f029eee03361e"><enum>(8)</enum><text>in section 2303(a), as so redesignated, by striking <quote>Assistant Secretary for the Countering Weapons of Mass Destruction Office</quote> and inserting <quote>Chief Medical Officer</quote>.</text></paragraph></subsection><subsection id="id55388fc47c90408e9b5e96d0a9cc63e2"><enum>(b)</enum><header>Transition and transfers</header><paragraph id="id97c43aa3d3a54fdaa88024d41707ffa9"><enum>(1)</enum><header>Transition</header><text>The individual appointed pursuant to section 1931 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/597">6 U.S.C. 597</external-xref>) of the Department of Homeland Security, as in effect on the day before the date of enactment of this Act, and serving as the Chief Medical Officer of the Department of Homeland Security on the day before the date of enactment of this Act, shall continue to serve as the Chief Medical Officer of the Department on and after the date of enactment of this Act without the need for reappointment.</text></paragraph><paragraph id="id081a7ef680404665b4b719cc7d48f7f0"><enum>(2)</enum><header>Rule of construction</header><text>The rule of construction described in section 2(hh) of the Presidential Appointment Efficiency and Streamlining Act of 2011 (<external-xref legal-doc="usc" parsable-cite="usc/5/3132">5 U.S.C. 3132</external-xref> note) shall not apply to the Chief Medical Officer of the Department of Homeland Security, including the incumbent who holds the position on the day before the date of enactment of this Act, and such officer shall be paid pursuant to section 3132(a)(2) or 5315 of title 5, United States Code.</text></paragraph><paragraph id="ideebc9416e01446bfbc7e05b628ca6988"><enum>(3)</enum><header>Transfer</header><text>The Secretary of Homeland Security shall transfer to the Chief Medical Officer of the Department of Homeland Security—</text><subparagraph id="id27d74af8be504754ad4537ab02b619e7"><enum>(A)</enum><text>all functions, personnel, budget authority, and assets of the Under Secretary for Management relating to workforce health and medical support, as in existence on the day before the date of enactment of this Act;</text></subparagraph><subparagraph id="id9941733400d44216b95bf98d8e93de99"><enum>(B)</enum><text>all functions, personnel, budget authority, and assets of the Assistant Secretary for the Countering Weapons of Mass Destruction Office relating to the Chief Medical Officer, including the Medical Operations Directorate of the Countering Weapons of Mass Destruction Office, as in existence on the day before the date of enactment of this Act; and</text></subparagraph><subparagraph id="ida725355938db41738ee35ddff465f593"><enum>(C)</enum><text>all functions, personnel, budget authority, and assets of the Assistant Secretary for the Countering Weapons of Mass Destruction Office associated with the efforts pertaining to the program coordination activities relating to defending the food, agriculture, and veterinary defenses of the Office, as in existence on the day before the date of enactment of this Act.</text></subparagraph></paragraph></subsection></section><section id="ida819f6b0a2da47a3a699f422a58132a1"><enum>202.</enum><header>Medical countermeasures program</header><text display-inline="no-display-inline">The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended by redesignating section 1932 (<external-xref legal-doc="usc" parsable-cite="usc/6/597a">6 U.S.C. 597a</external-xref>) as section 2304 and transferring such section to appear after section 2303, as so redesignated by section 201 of this Act.</text></section><section id="id1acd66bfdaec4cbc97a4b4278d1111f3"><enum>203.</enum><header>Confidentiality of medical quality assurance records</header><text display-inline="no-display-inline">Title XXIII of the Homeland Security Act of 2002, as added by this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf0a4b20bcd4b425d9523b035a3e8a21c"><section id="id1b133094c06b49a298bdf6b17583e568"><enum>2305.</enum><header>Confidentiality of medical quality assurance records</header><subsection id="id1a22a8f0cc78416b9924056bc36a31c5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ida9a9f91a6f054070b6ae7238aefe4527"><enum>(1)</enum><header>Health care provider</header><text>The term <term>health care provider</term> means an individual who—</text><subparagraph id="id9e2ab6a215de4f228f764b89aa4a2e13"><enum>(A)</enum><text>is—</text><clause id="idde7f38b4e0254edfb76b4d9169190571"><enum>(i)</enum><text>an employee of the Department;</text></clause><clause id="id39c817d7f40f487e8db65befbc4bbca0"><enum>(ii)</enum><text>a detailee to the Department from another Federal agency;</text></clause><clause id="id991db06acf5a4988ae0c122d4bf8f651"><enum>(iii)</enum><text>a personal services contractor of the Department; or</text></clause><clause id="id6d85df85d48642d6b5a3a294df911085"><enum>(iv)</enum><text>hired under a contract for services;</text></clause></subparagraph><subparagraph id="id2f54ec977e93449ca8ebc246988113c3"><enum>(B)</enum><text>performs health care services as part of duties of the individual in that capacity; and</text></subparagraph><subparagraph id="ide9d3c9063f3947cd91263cfea4b41a00"><enum>(C)</enum><text>has a current, valid, and unrestricted license or certification—</text><clause id="id09c81fec43594d66ae1573d57cbd7df5"><enum>(i)</enum><text>that is issued by a State, the District of Columbia, or a commonwealth, territory, or possession of the United States; and</text></clause><clause id="id58061f2390b24177beb9179805a1fd98"><enum>(ii)</enum><text>that is for the practice of medicine, osteopathic medicine, dentistry, nursing, emergency medical services, or another health profession.</text></clause></subparagraph></paragraph><paragraph id="idf5007912d2ae43d384ce08587c5373fe"><enum>(2)</enum><header>Medical quality assurance program</header><text>The term <term>medical quality assurance program</term> means any activity carried out by the Department to assess the quality of medical care, including activities conducted by individuals, committees, or other review bodies responsible for quality assurance, credentials, infection control, incident reporting, the delivery, advisement, and oversight of direct patient care and assessment (including treatment procedures, blood, drugs, and therapeutics), medical records, health resources management review, and identification and prevention of medical, mental health, or dental incidents and risks.</text></paragraph><paragraph id="idceddfb6367c840c8ad91f92f86331629"><enum>(3)</enum><header>Medical quality assurance record of the Department</header><text>The term <term>medical quality assurance record of the Department</term> means all information, including the proceedings, records (including patient records that the Department creates and maintains as part of a system of records), minutes, and reports that—</text><subparagraph id="idF26F2307DC5A418FB2F4B56CC78E1F19"><enum>(A)</enum><text>emanate from quality assurance program activities described in paragraph (2); and </text></subparagraph><subparagraph id="id4182C17BBA1646F290C3D1049AD2631C"><enum>(B)</enum><text>are produced or compiled by the Department as part of a medical quality assurance program.</text></subparagraph></paragraph></subsection><subsection id="id074a7c74e21a4324bd1473d976533754"><enum>(b)</enum><header>Confidentiality of records</header><text>A medical quality assurance record of the Department that is created as part of a medical quality assurance program—</text><paragraph id="id63EFCD4680854CF6B221A37CDD8C4158"><enum>(1)</enum><text>is confidential and privileged; and</text></paragraph><paragraph id="id518C4D938C4D49F3BA0DF42C9560CB9D"><enum>(2)</enum><text>except as provided in subsection (d), may not be disclosed to any person or entity.</text></paragraph></subsection><subsection id="idfb2de2cc1fcd4fb5a5f42a5cb81ac2aa"><enum>(c)</enum><header>Prohibition on disclosure and testimony</header><text>Except as otherwise provided in this section—</text><paragraph id="id7c6cda300da14ac0a954b8896e629f72"><enum>(1)</enum><text>no part of any medical quality assurance record of the Department may be subject to discovery or admitted into evidence in any judicial or administrative proceeding; and</text></paragraph><paragraph id="idd69c2a70b48a4cdba0cf0afda199bd44"><enum>(2)</enum><text>an individual who reviews or creates a medical quality assurance record of the Department or who participates in any proceeding that reviews or creates a medical quality assurance record of the Department may not be permitted or required to testify in any judicial or administrative proceeding with respect to the record or with respect to any finding, recommendation, evaluation, opinion, or action taken by that individual in connection with the record.</text></paragraph></subsection><subsection id="id11b2439656604c22a2b5440185128941"><enum>(d)</enum><header>Authorized disclosure and testimony</header><paragraph id="id9cfdecb248cb4ec988fb86e8b4ddee0f"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), a medical quality assurance record of the Department may be disclosed, and a person described in subsection (c)(2) may give testimony in connection with the record, only as follows:</text><subparagraph id="id79eaafcb5f24469d8eb8ce1945f01c39"><enum>(A)</enum><text>To a Federal agency or private organization, if the medical quality assurance record of the Department or testimony is needed by the Federal agency or private organization to—</text><clause id="idf3ba4f62eef343aab8012d6ceda8b72f"><enum>(i)</enum><text>perform licensing or accreditation functions related to Department health care facilities, a facility affiliated with the Department, or any other location authorized by the Secretary for the performance of health care services; or</text></clause><clause id="idd85a2b0b3aca416cac61c0ffbad0f1bf"><enum>(ii)</enum><text>perform monitoring, required by law, of Department health care facilities, a facility affiliated with the Department, or any other location authorized by the Secretary for the performance of health care services.</text></clause></subparagraph><subparagraph id="id2a27de5305c84deab6a1832b665ece3a"><enum>(B)</enum><text>To an administrative or judicial proceeding concerning an adverse action related to the credentialing of or health care provided by a present or former health care provider by the Department.</text></subparagraph><subparagraph id="id4420385770c74adc9a9f3e510d4d3fbd"><enum>(C)</enum><text>To a governmental board or agency or to a professional health care society or organization, if the medical quality assurance record of the Department or testimony is needed by the board, agency, society, or organization to perform licensing, credentialing, or the monitoring of professional standards with respect to any health care provider who is or was a health care provider for the Department.</text></subparagraph><subparagraph id="idee26e5d9d36441fd9e79ca91f671d6aa"><enum>(D)</enum><text>To a hospital, medical center, or other institution that provides health care services, if the medical quality assurance record of the Department or testimony is needed by the institution to assess the professional qualifications of any health care provider who is or was a health care provider for the Department and who has applied for or been granted authority or employment to provide health care services in or on behalf of the institution.</text></subparagraph><subparagraph id="idae83ea3598f54e079eeb39ca2591b291"><enum>(E)</enum><text>To an employee, a detailee, or a contractor of the Department who has a need for the medical quality assurance record of the Department or testimony to perform official duties or duties within the scope of their contract.</text></subparagraph><subparagraph id="id754bd97f8b454d7faa0cc2529aa16109"><enum>(F)</enum><text>To a criminal or civil law enforcement agency or instrumentality charged under applicable law with the protection of the public health or safety, if a qualified representative of the agency or instrumentality makes a written request that the medical quality assurance record of the Department or testimony be provided for a purpose authorized by law.</text></subparagraph><subparagraph id="id826be01c7d0c4b1cb0bde6b9fe19ff97"><enum>(G)</enum><text>In an administrative or judicial proceeding commenced by a criminal or civil law enforcement agency or instrumentality described in subparagraph (F), but only with respect to the subject of the proceeding.</text></subparagraph></paragraph><paragraph id="ide824bb23566242e39533017133791107"><enum>(2)</enum><header>Personally identifiable information</header><subparagraph id="idF43E54F470904F02AA1B882E8BCF76BF"><enum>(A)</enum><header>In general</header><text>With the exception of the subject of a quality assurance action, personally identifiable information of any person receiving health care services from the Department or of any other person associated with the Department for purposes of a medical quality assurance program that is disclosed in a medical quality assurance record of the Department shall be deleted from that record before any disclosure of the record is made outside the Department. </text></subparagraph><subparagraph id="idB5B2C55EC1454650855AA6F48971EC37"><enum>(B)</enum><header>Application</header><text>The requirement under subparagraph (A) shall not apply to the release of information that is permissible under section 552a of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>).</text></subparagraph></paragraph></subsection><subsection id="ide1d93641a42e4a3aa1e94c2d0fcc0108"><enum>(e)</enum><header>Disclosure for certain purposes</header><text>Nothing in this section shall be construed—</text><paragraph id="idA1282929657A4CA8AF8EFBB18E03B8FB"><enum>(1)</enum><text>to authorize or require the withholding from any person or entity aggregate statistical information regarding the results of medical quality assurance programs; or</text></paragraph><paragraph id="id4ff484fd4fc441cbaf2bda6dc64e13a8"><enum>(2)</enum><text>to authorize the withholding of any medical quality assurance record of the Department from a committee of either House of Congress, any joint committee of Congress, or the Comptroller General of the United States if the record pertains to any matter within their respective jurisdictions.</text></paragraph></subsection><subsection id="id733ca17ebd104554b8309aae492149e8"><enum>(f)</enum><header>Prohibition on disclosure of information, record, or testimony</header><text>A person or entity having possession of or access to a medical quality assurance record of the Department or testimony described in this section may not disclose the contents of the record or testimony in any manner or for any purpose except as provided in this section.</text></subsection><subsection id="idc3ef44846b5c449e96e9f7596bfb4d05"><enum>(g)</enum><header>Exemption from Freedom of Information Act</header><text>A medical quality assurance record of the Department shall be exempt from disclosure under section 552(b)(3) of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>).</text></subsection><subsection id="id3c45c7e8f19a4c0f8b7e6a94b7af9b23"><enum>(h)</enum><header>Limitation on civil liability</header><text>A person who participates in the review or creation of, or provides information to a person or body that reviews or creates, a medical quality assurance record of the Department shall not be civilly liable for that participation or for providing that information if the participation or provision of information was provided in good faith based on prevailing professional standards at the time the medical quality assurance program activity took place.</text></subsection><subsection id="id0972f07793454e2ca482ef5e07c231b5"><enum>(i)</enum><header>Application to information in certain other records</header><text>Nothing in this section shall be construed as limiting access to the information in a record created and maintained outside a medical quality assurance program, including the medical record of a patient, on the grounds that the information was presented during meetings of a review body that are part of a medical quality assurance program.</text></subsection><subsection id="id1155501515504fba8c48573d20938a57"><enum>(j)</enum><header>Penalty</header><text>Any person who willfully discloses a medical quality assurance record of the Department other than as provided in this section, knowing that the record is a medical quality assurance record of the Department shall be fined not more than $3,000 in the case of a first offense and not more than $20,000 in the case of a subsequent offense.</text></subsection><subsection id="id6bf2da7538ea495dbf05bf0b7d0591d1"><enum>(k)</enum><header>Relationship to Coast Guard</header><text>The requirements of this section shall not apply to any medical quality assurance record of the Department that is created by or for the Coast Guard as part of a medical quality assurance program.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id536a86e091884f5e9ddd261caeefbd1d"><enum>204.</enum><header>Portability of licensure</header><subsection id="idA2139DA4169148F0A72C04EE928CC1E3"><enum>(a)</enum><header>Transfer</header><text>Section 16005 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/6/320">6 U.S.C. 320</external-xref> note) is redesignated as section 2306 of the Homeland Security Act of 2002 and transferred so as to appear after section 2305, as added by section 203 of this Act.</text></subsection><subsection id="id03A0BB3EB7FB4781882D5D8CAF4A528A"><enum>(b)</enum><header>Repeal</header><text>Section 2306 of the Homeland Security Act of 2002, as so redesignated by subsection (a), is amended by striking subsection (c).</text></subsection></section><section id="id202ba18d81d24a2bbc77c3235017369d"><enum>205.</enum><header>Technical and conforming amendments</header><text display-inline="no-display-inline">The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended—</text><paragraph id="id09a1058267314c109e617f7139469326"><enum>(1)</enum><text>in the table of contents in section 1(b) (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>;
