which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 303(g) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(g)</external-xref>) to eliminate the separate registration requirement for dispensing narcotic drugs in schedule III, IV, or V, such as buprenorphine, for maintenance or detoxification treatment, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H22C71D05C0874D32A3BC1F3BBD62892E"><section section-type="section-one" id="H29608BABC0EE4C2C88E56B07043910B5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mainstreaming Addiction Treatment Act of 2021</short-title></quote>.</text></section><section id="H4B4D3834287E4E349172166B482F0F7C"><enum>2.</enum><header>Eliminating separate registration requirement for dispensing narcotic drugs in schedules III, IV, and V for maintenance or detoxification treatment</header><subsection id="HAC18FE78441941AFADEBD0FAC68B7F0C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 303(g) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(g)</external-xref>) is amended—</text><paragraph id="HE928DF78FA8141B38230537CB1208FA5"><enum>(1)</enum><text>by striking paragraph (2);</text></paragraph><paragraph id="H4D34B1BDDDBE404DA2FC09E148EEC163"><enum>(2)</enum><text>by striking <quote>(g)(1) Except as provided in paragraph (2), practitioners who dispense narcotic drugs to individuals for maintenance treatment or detoxification treatment</quote> and inserting <quote>(g) Practitioners who dispense narcotic drugs (other than narcotic drugs in schedule III, IV, or V) to individuals for maintenance treatment or detoxification treatment</quote>;</text></paragraph><paragraph id="HD3D5BE704BC44FFEB0C03355DDD0D209"><enum>(3)</enum><text>by redesignating subparagraphs (A), (B), and (C) as paragraphs (1), (2), and (3), respectively; and</text></paragraph><paragraph id="HF5930C9CCDED4A07B52BC94472309CC5"><enum>(4)</enum><text>in paragraph (2), as so redesignated, by redesignating clauses (i) and (ii) as subparagraphs (A) and (B), respectively.</text></paragraph></subsection><subsection id="H029C474DD4804193BB7E7EC613E5E73D"><enum>(b)</enum><header>Technical and conforming edits</header><paragraph id="HA07CB7FFCF1B4055B4682EE454846D5F"><enum>(1)</enum><text>Section 304 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/824">21 U.S.C. 824</external-xref>) is amended—</text><subparagraph id="id2679CB7B2BAA4A128B2F259BE55266DE"><enum>(A)</enum><text>in subsection (a), by striking <quote>303(g)(1)</quote> each place it appears and inserting <quote>303(g)</quote>; and</text></subparagraph><subparagraph id="id16AD1580DC9E4017B8AE60A538A43FF0"><enum>(B)</enum><text>in subsection (d)(1), by striking <quote>303(g)(1)</quote> and inserting <quote>303(g)</quote>.</text></subparagraph></paragraph><paragraph id="HED763B352C734B55932CCD58F16EC8F5"><enum>(2)</enum><text>Section 309A(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/829a">21 U.S.C. 829a(a)</external-xref>) is amended by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5C192F20D9BA4D489E43C7788343AE4F"><paragraph id="id2EB92102E1AF4ECB83D18139ABC81F0D"><enum>(2)</enum><text>the controlled substance—</text><subparagraph id="id1FA6DB000E88498BB7C2E9B07453BA90"><enum>(A)</enum><text>is a narcotic drug in schedule III, IV, or V to be administered for the purpose of maintenance or detoxification treatment; and</text></subparagraph><subparagraph id="id27E2ADD4CF1E46BDB34347473C3D8219"><enum>(B)</enum><text>is to be administered by injection or implantation;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HFE8D469689214C6CB1AF957BACD224A9"><enum>(3)</enum><text>Section 520E–4(c) of the Public Health Service Act (42 U.S.C. 290bb–36d(c)) is amended, in the matter preceding paragraph (1), by striking <quote>information on any qualified practitioner that is certified to prescribe medication for opioid dependency under section 303(g)(2)(B) of the Controlled Substances Act</quote> and inserting <quote>information on any practitioner who prescribes narcotic drugs in schedule III, IV, or V of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>) for the purpose of maintenance or detoxification treatment</quote>.</text></paragraph><paragraph id="H78B35A53FE08442F83D168A6379BE404"><enum>(4)</enum><text>Section 544(a)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd-3">42 U.S.C. 290dd–3(a)(3)</external-xref>) is amended by striking <quote>any practitioner dispensing narcotic drugs pursuant to section 303(g) of the Controlled Substances Act</quote> and inserting <quote>any practitioner dispensing narcotic drugs for the purpose of maintenance or detoxification treatment</quote>.</text></paragraph><paragraph commented="no" id="HE3FD6AB604E1461AB6D8C3C0BBCB4FB2"><enum>(5)</enum><text display-inline="yes-display-inline">Section 1833 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l</external-xref>) is amended by striking subsection (bb).</text></paragraph><paragraph id="HA147E5A98E904E75ABF9B909D8966987" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">Section 1834(o) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(o)</external-xref>) is amended by striking paragraph (3).</text></paragraph><paragraph commented="no" id="HDF2EEC7BDF90483C8052828BB9B150AF"><enum>(7)</enum><text>Section 1866F(c)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc-6">42 U.S.C. 1395cc–6(c)(3)</external-xref>) is amended—</text><subparagraph commented="no" id="H94178C7D416F4F3FAEF89FE71E645975"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" id="HFDF3957D12C643A598D5D44288930399"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>; and</quote> and inserting a period; and</text></subparagraph><subparagraph commented="no" id="HF9559642318E4C76A6B20184E5AADD75"><enum>(C)</enum><text>by striking subparagraph (C).</text></subparagraph></paragraph><paragraph commented="no" id="HDF3F1DFBC75743B38F8FC319D646D410"><enum>(8)</enum><text>Section 1903(aa)(2)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(aa)(2)(C)</external-xref>) is amended—</text><subparagraph commented="no" id="HFA48FF81036246F9AC15E93FFDA3CA59"><enum>(A)</enum><text>in clause (i), by inserting <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" id="H7C155EF5178F45CBAF6CDE0B32705580"><enum>(B)</enum><text>by striking clause (ii); and</text></subparagraph><subparagraph commented="no" id="idDC431996FA434580AFC0BA7696F404FD"><enum>(C)</enum><text>by redesignating clause (iii) as clause (ii).</text></subparagraph></paragraph></subsection></section><section id="HE112BC33AC0445CBB0656A1401F62825"><enum>3.</enum><header>National education campaign</header><subsection id="H42E1842056424F509A85B36FE1F65588"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, acting through the Assistant Secretary for Mental Health and Substance Use, shall conduct a national campaign to educate practitioners with respect to the elimination of the separate registration requirement under section 303(g) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(g)</external-xref>), as in effect on the day before the date of enactment of this Act, for dispensing narcotic drugs in schedule III, IV, and V for maintenance or detoxification treatment.</text></subsection><subsection id="H940ABDF9D0054FC98D6E09E6357DC9EE"><enum>(b)</enum><header>Required components</header><text>The national education campaign under subsection (a) shall—</text><paragraph id="H5BB0DF983CE24D67BC777283AE64A120"><enum>(1)</enum><text>encourage practitioners to integrate substance use treatment into their practices; and</text></paragraph><paragraph id="H1D5472AD5C1B4B6ABC3B1FE7074BB955"><enum>(2)</enum><text>include education on publicly available educational resources and training modules that can assist practitioners in treating patients with a substance use disorder.</text></paragraph></subsection></section><section id="idBCD193FC8BEA4735B795DE86EA46D246"><enum>4.</enum><header>Community health aides and community health practitioners</header><subsection id="idD8793BEDFD984B37A812C88850741971"><enum>(a)</enum><header>Practice of telemedicine</header><text display-inline="yes-display-inline">Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>) is amended—</text><paragraph id="id88649A6CD33C498587D884E12392F7F6"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (54)(A), by striking clause (i) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id60A798E4F1594EB2BC1D0DE9D7C3F97E"><clause commented="no" display-inline="no-display-inline" id="ID5E739220CBB74249889E7E52D7A675BD" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">while the patient is—</text><subclause commented="no" display-inline="no-display-inline" id="idDF5361389BA94AC3A2349473198CE594"><enum>(I)</enum><text display-inline="yes-display-inline">being treated by, and physically located in, a hospital or clinic registered under section 303(f); or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idD2124E9A1B6F42F0B8A086743388C3E4"><enum>(II)</enum><text display-inline="yes-display-inline">for purposes of section 302(h), being treated by a community health aide or community health practitioner; and</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id528A73602BC94AA6A9BE935DD1492428"><enum>(2)</enum><text>by redesignating paragraph (58) as paragraph (59);</text></paragraph><paragraph id="id27957F562B224624B25644CA1376954E"><enum>(3)</enum><text>by redesignating the second paragraph designated as paragraph (57) (relating to the definition of <quote>serious drug felony</quote>) as paragraph (58);</text></paragraph><paragraph id="idBA355388190A4A719629550EFF853A37"><enum>(4)</enum><text>by moving paragraphs (57), (58) (as so redesignated), and (59) (as so redesignated) 2 ems to the left; and</text></paragraph><paragraph id="idFFE849FDED7245549618DBAABCD2E55F"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB039EE8B8ADD4F0D93908568C77D261B"><paragraph id="idEC5B1AEA79A045ACABF3BCA98A6A31E3" indent="up1"><enum>(60)</enum><text>The terms <term>community health aide</term> and <term>community health practitioner</term> have the meanings within the meaning of section 119 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1616l">25 U.S.C. 1616l</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC08E2B64B71242A38DECFCE9F8C08E32"><enum>(b)</enum><header>Dispensation of narcotic drugs in schedule III, IV, or V</header><text>Section 302 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/822">21 U.S.C. 822</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3800C7B4848647E09AC62D602B3F20B7"><subsection id="idA54A2DF1C55C41BC8210460557C5D5F2"><enum>(h)</enum><header>Dispensation of narcotic drugs in schedule III, IV, or V by certain practitioners</header><paragraph id="idDB56DDCBE6D44A0982F5FC0D03C46203"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (a)(2), a community health aide or community health practitioner may dispense a narcotic drug in schedule III, IV, or V, such as buprenorphine, or a combination of such drugs, to an individual for maintenance treatment or detoxification treatment (or both) without being registered under this title if the drug is prescribed by a practitioner through the practice of telemedicine.</text></paragraph><paragraph id="id7A4C423EA12149ADB18A0194B42320AB"><enum>(2)</enum><header>Preemption</header><text>Notwithstanding section 708, a State may not require a community health aide or community health practitioner to be licensed by the State in order to dispense narcotic drugs in accordance with paragraph (1) of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
