which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 41, United States Code, to prohibit the Federal Government from entering into contracts with an entity that discriminates against firearm or ammunition industries, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBA740EEA513B4877A82D5414F1D63B55"><section section-type="section-one" id="H497E4C2C2D894D01870A1CBC8BCD6BB3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Firearm Industry Non-Discrimination Act</short-title></quote> or the <quote><short-title>FIND Act</short-title></quote>.</text></section><section id="H2C5C3AAE300E4BEAB2C2CE48EA1A81FB"><enum>2.</enum><header>Prohibition on entering into contracts with entities discriminating against firearm or ammunition industries</header><subsection id="HD20AEF73798840D6814CC2AF8339591F"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/47">Chapter 47</external-xref> of title 41, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="H7CD27637B3714E32857A5D7A7BCE4DEA"><section id="HA8F6D2F432B7462A83E286EEAC985F11"><enum>4715.</enum><header>Prohibition on entering into contracts with entities discriminating against firearm or ammunition industries</header><subsection id="H4B50EDBCF90A4F1385BEF0B3A0C1525D"><enum>(a)</enum><header>Prohibition</header><paragraph id="H25F5D06BCB1344D0A9A6A764E12259CC"><enum>(1)</enum><header>In general</header><text>The head of an executive agency shall include in each contract for the procurement of goods or services awarded by the executive agency, a clause requiring the prime contractor to certify that the contractor—</text><subparagraph id="H1DE9912793EA4D0F9D43449E994C20D0"><enum>(A)</enum><text>has no policy, practice, guidance, or directive that discriminates against a firearm entity or firearm trade association; and </text></subparagraph><subparagraph commented="no" id="H8AC46007BB1A4D068307299F81E9BF3D"><enum>(B)</enum><text>will not adopt a policy, practice, guidance, or directive that discriminates against a firearm entity or firearm trade association during the term of the contract. </text></subparagraph></paragraph><paragraph id="HD0258842B8FC4367A4C6AFCADD3EC31E"><enum>(2)</enum><header>Subcontracts</header><text>The head of an executive agency shall include in each contract for the procurement of goods or services awarded by the executive agency, a clause that prohibits the prime contractor on such contract from—</text><subparagraph id="HFA7BA37C6BCE4993A7FA2E8E9D3F7243"><enum>(A)</enum><text>awarding a first-tier subcontract with a value greater than 10 percent of the total value of the prime contract to an entity that fails to certify in writing to the prime contractor that the entity—</text><clause id="HFC0147F2DD6749A2A60EA43B33301019"><enum>(i)</enum><text>has no policy, practice, guidance, or directive that discriminates against a firearm entity or firearm trade association; and</text></clause><clause commented="no" id="H073C09BC51C242578E258D9A9362FC80"><enum>(ii)</enum><text>will not adopt a policy, practice, guidance, or directive that discriminates against a firearm entity or firearm trade association during the term of the contract; and </text></clause></subparagraph><subparagraph id="H5F318199BA5C45A5845A8EF514A29C70"><enum>(B)</enum><text>structuring subcontract tiers in a manner designed to avoid violating subparagraph (A) by enabling a subcontractor to perform more than 10 percent of the total value of the prime contract as a lower-tier subcontractor.</text></subparagraph></paragraph><paragraph id="H263F4FEC9BD54158AE522069514422B1"><enum>(3)</enum><header>Penalties</header><text>The clause included in contracts pursuant to paragraph (1) or paragraph (2) shall provide that, in the event that the prime contractor violates the clause—</text><subparagraph id="HD9EBD57EF3B048EFAFD65CAD8F1BCBA0"><enum>(A)</enum><text>the prime contract shall be terminated for default; and</text></subparagraph><subparagraph commented="no" id="HB006B0D98F3642FCB99F2395F8F8DD4D"><enum>(B)</enum><text>a suspension or debarment proceeding will be initiated for the contractor on the basis of the violation. </text></subparagraph></paragraph></subsection><subsection id="HDDED82F52F414E4C83EF47C1AF76D7D1"><enum>(b)</enum><header>Exception</header><text>Subsection (a) shall not apply to a contract for the procurement of goods or services that is a sole-source contract.</text></subsection><subsection display-inline="no-display-inline" id="H7003ADBD9F474AB9809BC3BDDBAF86F6"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="H4279355BF1FA429086CFE2EC5A821299"><enum>(1)</enum><header>Discriminate</header><text>The term <term>discriminate</term> means to—</text><subparagraph commented="no" id="H796C591CBB534A7A96C00F8C8F703AAA"><enum>(A)</enum><text>make a judgement about a policy, practice, guidance, or directive on the basis of—</text><clause commented="no" id="HC85739913CE2490AA6E57CD4C495F844"><enum>(i)</enum><text>partial criteria or a category-based assessment analysis, rather than—</text><subclause commented="no" id="HFC97EB97C0BB437BA095D8A855196638"><enum>(I)</enum><text display-inline="yes-display-inline">on a case-by-case basis; or </text></subclause><subclause commented="no" id="H937B1E3AAF104626BEE377487126636A"><enum>(II)</enum><text>using empirical data evaluated under quantifiable standards; or</text></subclause></clause><clause commented="no" id="HC9A559653FBC4F6AB801DF196DC8F6E2"><enum>(ii)</enum><text>criteria other than criteria free from—</text><subclause commented="no" id="HB706BD89339D4BE999DCAB7ED96A2666"><enum>(I)</enum><text>favoritism or prejudice against or dislike for the firearm entity or trade association or the products or services sold by the firearm entity or trade association; or </text></subclause><subclause commented="no" id="H35E199F38093418AB35832D209A70069"><enum>(II)</enum><text>favoritism for market alternatives to the business of the firearm entity or the trade association;</text></subclause></clause></subparagraph><subparagraph commented="no" id="H3D8AA81DAAFB40B98D0F273656C4F57F"><enum>(B)</enum><text>refuse to provide services, or deny, cancel, or limit services, to the firearm entity or trade association on the basis of criteria other than—</text><clause commented="no" display-inline="no-display-inline" id="H5DF51A3602D74D02AA328C7870228B41"><enum>(i)</enum><text>criteria free from—</text><subclause commented="no" id="H777F322E28F446E7A94D566C956CC152"><enum>(I)</enum><text>favoritism or prejudice against or dislike for the firearm entity or trade association or the products or services sold by the firearm entity or trade association; or</text></subclause><subclause commented="no" id="HA3187F99337D4EE7A1C91F7FB9C32617"><enum>(II)</enum><text>favoritism for market alternatives to the business of the firearm entity or the trade association;</text></subclause></clause><clause commented="no" id="H4A98F12A5CF04C0482FE15EEA3AB2A86"><enum>(ii)</enum><text>criteria related to credit history and financial risk specific to a customer or potential customer; or</text></clause><clause commented="no" id="H7E3F35718FEB430BBCC76071503B4405"><enum>(iii)</enum><text>criteria related to noncompliance with Federal, State, or local law; or </text></clause></subparagraph><subparagraph commented="no" id="H015E1B4EB8344B3E941E963A01FAD99C"><enum>(C)</enum><text>limit the operations of the firearm entity or trade association in manner not required by—</text><clause commented="no" id="HDDB0469C5C4D4F878D3F0871ADB5EEFF"><enum>(i)</enum><text>Federal, State, or local law; or</text></clause><clause commented="no" id="HC488C55666204B9198921D9B218309E8"><enum>(ii)</enum><text>Federal, State, or local regulation.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H9CAE6FDBA1E44BC281D381D85EC6285E"><enum>(2)</enum><header>Firearm entity</header><text display-inline="yes-display-inline">The term <term>firearm entity</term> means any—</text><subparagraph id="H3E05E887E3484C1EBBF790D2E0253829"><enum>(A)</enum><text>person who is licensed under section 923 of title 18 to import, manufacture, or deal in firearms;</text></subparagraph><subparagraph id="H77A046F82F4F477E90D6AA605AB6D454"><enum>(B)</enum><text display-inline="yes-display-inline">seller of ammunition, as defined in section 7903 of title 15;</text></subparagraph><subparagraph id="HA2A47795AD9D4EB2A781723FB1C13BBC"><enum>(C)</enum><text display-inline="yes-display-inline">manufacturer or importer of, or dealer in, a secure gun storage or safety device, as defined in section 921(a) of title 18; and</text></subparagraph><subparagraph id="H95825FCD89264C638E53B6AF7D3403A3"><enum>(D)</enum><text display-inline="yes-display-inline">manufacturer or importer of, or dealer in, a component part or accessory of a firearm or ammunition.</text></subparagraph></paragraph><paragraph commented="no" id="H78E3BDB6C0314D64A4FF638DE0F4CE51"><enum>(3)</enum><header>Firearm trade association</header><text display-inline="yes-display-inline">The term <term>firearm trade association</term> has the meaning in section 7903 of title 15. </text></paragraph><paragraph id="HF24AD4BD6B7D4A64A65D51643D509F7C"><enum>(4)</enum><header>First-tier subcontract</header><text>The term <term>first-tier subcontract</term> means a subcontract entered into by a subcontractor with the prime contractor for the purposes of carrying out the prime contract.</text></paragraph><paragraph id="HBB08C60829BF40F6B38DB15808E03A75"><enum>(5)</enum><header>Lower-tier subcontractor</header><text>The term <term>lower-tier subcontractor</term> means any person entering into a contract with a subcontractor of a prime contractor for the purposes of carrying out the prime contract. </text></paragraph><paragraph commented="no" id="HD8A9F7B83FDB4C61BD4CE8847ECEC922"><enum>(6)</enum><header>Prime contract; prime contractor</header><text>The terms <term>prime contract</term> and <term>prime contractor</term> have the meaning given those terms in section 8701 of title 41.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HAE52C157E4B54472B638D4508A0AF1E0"><enum>(b)</enum><header>Application</header><text>Section 4715 of title 41, United States Code, as added by subsection (a), shall apply with respect to contracts awarded on or after the date of the enactment of this Act.</text></subsection><subsection id="HB92C2CEDBD9B4027817FE9C6A6CEAA52"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/47">chapter 47</external-xref> of title 41, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H0EDA4E84A5FB4429BE1571FD0E7EDC1C"><toc regeneration="no-regeneration"><toc-entry level="section">4715.
