which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Commerce to establish the Sea Turtle Rescue Assistance Grant Program.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H32F50287D0A741A4B5D8BE2D6EE79DA4"><section section-type="section-one" id="H1975A8630FAF475386141D6EFEBDE212"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sea Turtle Rescue Assistance Act of 2022</short-title></quote>. </text></section><section id="H0ACF6D07EC7342B3AE31C7DB99ED569A"><enum>2.</enum><header>Sea Turtle Rescue Assistance Grant program</header><subsection id="H9E8031C3614D43C1BCC71DE7BAC7C1FB"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a grant program to be known as the <quote>Sea Turtle Rescue Assistance Grant Program</quote>, to encourage and facilitate coordinated rapid response and rescue by awarding grants for the purposes described in subsection (c).</text></subsection><subsection id="H95E9DCFB5F904C1FA49211434293B9A9"><enum>(b)</enum><header>Designation of stranding regions</header><text>The Secretary shall designate geographic regions of the United States as stranding regions for the purposes of carrying out this section.</text></subsection><subsection id="H3AB0742727D84FF28CB462B22BBA0866"><enum>(c)</enum><header>Purposes</header><text>The purposes of the Program are to provide for—</text><paragraph id="H8CDA928CBEB9436FB13D92DEB75F5A3C"><enum>(1)</enum><text>the recovery, short- or long-term care, transportation, and treatment of stranded marine turtles;</text></paragraph><paragraph id="id57db8c700b8b4e07946c364855f11c7d"><enum>(2)</enum><text>the release of rescued and recovered marine turtles;</text></paragraph><paragraph id="HD5A3B2D874D540EBB2FCD12CF1A9A012"><enum>(3)</enum><text>the collection of data and samples from stranded marine turtles for scientific research or assessments regarding marine turtle health, including tagging information; and</text></paragraph><paragraph id="H1667313D4C84459797E2E7D679DAFEC4"><enum>(4)</enum><text>facility operation costs that are directly related to activities described in paragraphs (1), (2), and (3).</text></paragraph></subsection><subsection id="H9C9FE8C084FA4F0DB1CACE37D03BA691"><enum>(d)</enum><header>Equitable distribution of funds</header><text display-inline="yes-display-inline">The Secretary shall ensure, to the extent practicable, that funds awarded under this section are distributed equitably among stranding regions, taking into account—</text><paragraph id="H35C350CF47AA40A89FEA71F534441215"><enum>(1)</enum><text>the number of stranding events that occurred in each stranding region in the preceding 5 years;</text></paragraph><paragraph id="HC15A73731F564901A7AAB27E2B95186F"><enum>(2)</enum><text>region-specific factors that increase risks of marine turtle stranding events; and</text></paragraph><paragraph id="HB693B5EF849F4419AA697A026253E98D"><enum>(3)</enum><text>the conservation priorities and recovery needs of species of marine turtles that are threatened or endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph></subsection><subsection id="HF1CA5E7ECAA44DA59662773816B2ADF7"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">An applicant for a grant under this section shall submit an application in such form and manner as the Secretary shall prescribe.</text></subsection><subsection id="H15E64D68967A4D24952B585798618985"><enum>(f)</enum><header>Grant criteria</header><paragraph id="H3D49B3CD78EA4AD18ADA3ED11851BE47"><enum>(1)</enum><header>Development of criteria</header><text display-inline="yes-display-inline">The Secretary shall, in consultation with the Director of the United States Fish and Wildlife Service, develop criteria for awarding grants under this section and provide such criteria for formal public notice and comment. </text></paragraph><paragraph id="idf52af255661c40999f86f631a89892dd"><enum>(2)</enum><header>Stakeholder engagement</header><text>As part of the process for developing and finalizing criteria under paragraph (1), the Secretary shall, in consultation with the Director of the United States Fish and Wildlife Service, provide opportunities for engagement with representatives from stranding regions and representatives of public and private organizations with an established record in rescue, rehabilitation, and release, as well as related scientific research, marine conservation, and forensic science, with respect to stranded marine turtles.</text></paragraph><paragraph id="H11D5198B75E6404D895FECA9F9608C9D"><enum>(3)</enum><header>Required criteria</header><text>The criteria developed under paragraph (1) shall prioritize applicants with an established record of rescuing, rehabilitation, scientific research, and forensic science with respect to stranded marine turtles or conducting scientific research and forensic science on stranded marine turtles. </text></paragraph></subsection><subsection id="idA0359E2CE99A4E398E7D0F5E45B46AA3"><enum>(g)</enum><header>Acceptance of donations</header><text>For the purposes of carrying out this section, the Secretary may solicit, accept, receive, hold, administer, and use gifts, devises, and bequests without any further approval or administrative action.</text></subsection><subsection id="idb7561303c463420db88b15fead69f118"><enum>(h)</enum><header>Liability waiver </header><paragraph id="id80C8957ADE9343619541A8464DE25937" commented="no"><enum>(1)</enum><header>In general</header><text>A person who is acting under the authority of an entity awarded a grant under this section is deemed to be an employee of the government for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code, with respect to actions of the person that—</text><subparagraph id="id48649cd8ecae4e21bba5775ef88325d6" commented="no"><enum>(A)</enum><text>are in support of rescue efforts;</text></subparagraph><subparagraph id="id5def1d699d8947c4a6498c88c81e7a13" commented="no"><enum>(B)</enum><text>are in accordance with the purposes of subsection (c); and</text></subparagraph><subparagraph id="id6349834ea10e43a9b3901ff760067663" commented="no"><enum>(C)</enum><text>reflect sound professional judgment and are consistent with the directions of any on-site coordinator or incident commander.</text></subparagraph></paragraph><paragraph id="id02511ee57bbd40d6a249e8734d6cc1e2" commented="no"><enum>(2)</enum><header>Limitation</header><text>Paragraph (1) does not apply to actions of a person described in that paragraph that are grossly negligent or that constitute willful misconduct.</text></paragraph></subsection><subsection id="H05FB617592F64371B4126C7C634600D5"><enum>(i)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary to carry out this section $5,000,000 for each of fiscal years 2023 through 2028 to remain available until expended.</text></subsection><subsection id="H814AFF0D7D50490EB0A212307D23B7BA"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF2F42F6D46704E14AD2B80949BF17CD7"><enum>(1)</enum><header>Marine turtle</header><text>The term <term>marine turtle</term> means any member of the family Cheloniidae or Dermochelyidae.</text></paragraph><paragraph id="HE7D21EC2ECA542F6BC9E661512BB05FC"><enum>(2)</enum><header>Program</header><text>The term <term>Program</term> means the Sea Turtle Rescue Assistance Grant Program established under subsection (a).</text></paragraph><paragraph id="H5D717AEBB71D457084E9205D63716F41"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="HC1551E7E197C4E45822C63FF7E576F4F"><enum>(4)</enum><header>Stranding</header><text>The term <term>stranding</term> means an event in which—</text><subparagraph id="HAF743F095B444D8B97717F1727260DE1"><enum>(A)</enum><text>a marine turtle is dead and is—</text><clause id="H4583E7F74A7848B29B4DB50065599BE7"><enum>(i)</enum><text>on a beach or shore of the United States; or</text></clause><clause id="HB6593BA5876F4453BEA9BD4CCDAF2110"><enum>(ii)</enum><text display-inline="yes-display-inline">in waters under the jurisdiction of the United States (including any navigable waters); or</text></clause></subparagraph><subparagraph id="HD628971ABEE7438ABC869813F73BEFCA"><enum>(B)</enum><text>a marine turtle is alive and is—</text><clause id="H7640869CDF404A4480AAA5E1A8D804DD"><enum>(i)</enum><text>on a beach or shore of the United States and unable to return to the water;</text></clause><clause id="HDE9B83C350A5424B9213D4CC2F53ECAD"><enum>(ii)</enum><text>on a beach or shore of the United States and in need of medical attention; or</text></clause><clause id="H13232F87F75547078FC58C3E34BE0898"><enum>(iii)</enum><text display-inline="yes-display-inline">in the waters under the jurisdiction of the United States (including any navigable waters), and in need of medical attention or other necessary intervention to aid its likelihood of survival. </text></clause></subparagraph></paragraph><paragraph id="HD51D63143D13486C9D396739F85043D2"><enum>(5)</enum><header>Stranding region</header><text>The term <term>stranding region</term> means a geographic region designated by the Secretary under subsection (b).</text></paragraph></subsection></section></legis-body></bill>
