Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to allow for special rollovers to Roth IRAs from long-term qualified tuition programs.</official-title></form><legis-body><section id="id69828d35dea3469da0454811bee656c7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>College Savings Recovery Act.</short-title></quote></text></section><section id="H8DEC305F187E4F5A82C412CDFFC6E225" section-type="subsequent-section"><enum>2.</enum><header>Special rollover to Roth IRA from long-term qualified tuition program</header><subsection id="H461D42943B4449E9836A96D1D99229F1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (3) of <external-xref legal-doc="usc" parsable-cite="usc/26/529">section 529(c)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H66A81A393C314D0BBBFA14D622D2FE72" style="OLC"><subparagraph id="H6AEB365EBE7143818F4420631BCB4D4D"><enum>(E)</enum><header>Special rollover to Roth IRA from long-term qualified tuition program</header><text display-inline="yes-display-inline">For purposes of this section—</text><clause id="HC6389053C9054A9293140FA807719499"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a distribution from a qualified tuition program which has been maintained by an account owner in one or more qualified tuition programs for the 10-year period ending on the date of such distribution—</text><subclause id="H3143918AD3F74341A5D543AE36A4CDCA"><enum>(I)</enum><text>subparagraph (A) shall not apply to any portion of such distribution which is paid in a direct trustee-to-trustee transfer to a Roth IRA maintained for the benefit of such account owner or the designated beneficiary under such qualified tuition program, and</text></subclause><subclause id="HD2279ECD31BA43D6A1DE45C4490D9FC9" commented="no"><enum>(II)</enum><text>such portion shall be treated as a rollover contribution for purposes of section 408A(e).</text></subclause></clause><clause id="H3F89E451C73F4141874CEA1D6863B056"><enum>(ii)</enum><header>Limitation</header><text>Clause (i) shall only apply to so much of any distribution as does not exceed the lesser of—</text><subclause id="H2236F393BD9E4A3E91F5F9AE4B78D653"><enum>(I)</enum><text>the amount applicable to the account owner or the designated beneficiary, as the case may be, under section 408A(c)(2) for the taxable year (reduced by the amount of aggregate contributions made during the taxable year before the date of such distribution to all individual retirement plans maintained for the benefit of the account owner or designated beneficiary, as the case may be), or</text></subclause><subclause id="H97F144CCD16044C6802B7E6A7F86AA07"><enum>(II)</enum><text>the aggregate amount contributed to the program (and earnings attributable thereto) before the 5-year period ending on the date of the distribution.</text></subclause></clause><clause id="id6805A3B93C104B769A2A7411B0868071"><enum>(iii)</enum><header>Account owner</header><text>For purposes of this subparagraph, the term <term>account owner</term> means the individual who established the qualified tuition program account under applicable State law.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD122786E17A64581A1D9699B5C2380A7"><enum>(b)</enum><header>Qualified rollover contribution</header><text>Paragraph (1) of section 408A(e) of such Code is amended—</text><paragraph id="idF3472ED692D046BC8738184919DE2F1E"><enum>(1)</enum><text>by striking the period at the end of subparagraph (B) and inserting <quote>, and</quote>,</text></paragraph><paragraph id="id3F452BCCEB4940C7BE4210C9B1D27367"><enum>(2)</enum><text>by inserting after subparagraph (B) the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="HBE8674F03AC7455E9FA7B38CE4EB8D5A" style="OLC"><subparagraph commented="no" id="H10F7447CA02C4EA2993780CA2939A151"><enum>(C)</enum><text display-inline="yes-display-inline">from a qualified tuition program to the extent provided in section 529(c)(3)(E).</text></subparagraph><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph><paragraph id="id52B27204AE8E49D388DDFC828ADE33AC"><enum>(3)</enum><text>by adding at the end the following new sentence: <quote>Under regulations established by the Secretary, the earnings and contributions of any qualified tuition program from which a qualified rollover contribution is made under subparagraph (C) shall be treated in the same manner as the earnings and contributions of a Roth IRA from which a qualified rollover contribution is made under subparagraph (A).</quote>.</text></paragraph></subsection><subsection id="idBDE5D9D6CBA44C5092DD9CF76DC9E349"><enum>(c)</enum><header>Reporting</header><text>Section 529(d) of such Code is amended—</text><paragraph id="id4F5C14DF1E7C4F319C3099E2428EC722"><enum>(1)</enum><text>by striking <quote>Each officer</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id368AB3386F264D74B8203A55796B7693"><paragraph id="id74FDA8BD1F28408FA735F203BE44109B"><enum>(1)</enum><header>In general</header><text>Each officer</text></paragraph><after-quoted-block>,</after-quoted-block></quoted-block></paragraph><paragraph id="id3A38986EE93247DA8B3F3AF642345A93"><enum>(2)</enum><text>by striking <quote>by this subsection</quote> and inserting <quote>by this paragraph</quote>, and</text></paragraph><paragraph id="idB2626EE1B28D47C1B8A2C0201DB09398"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id657AEBECB38C4247825B74AAF4F4F348"><paragraph id="id3913EEF5F57F490EBA2C55251932FD9C"><enum>(2)</enum><header>Rollover distributions</header><text>In the case of any distribution described in subsection (c)(3)(A), the officer or employee having control of the qualified tuition program (or their designee) shall provide a report to the trustee of the Roth IRA to which the distribution is made. Such report shall be filed at such time and in such manner as the Secretary may require and shall include information with respect to the contributions, distributions, and earnings of the qualified tuition program as of the date of the distribution described in subsection (c)(3)(A), together with such other matters as the Secretary may require.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6502244D2C0D40C3AF7A42F66362FA76" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to distributions after December 31, 2022. </text></subsection></section></legis-body></bill>
