which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the purchase of domestically made flags of the United States of America for use by the Federal Government.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>All-American Flag Act</short-title></quote>.</text></section><section id="idD7BD7872EF1A4D8895BA7B00E2659C50"><enum>2.</enum><header>Requirement for agencies to buy domestically made United States flags</header><subsection id="id078A73362AFA44A2A334FC92AFEA0F1A"><enum>(a)</enum><header>Requirement for agencies To buy domestically made United States flags</header><paragraph id="idFB9CD126A1D44CA8873C0F02370A5083"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/63">Chapter 63</external-xref> of title 41, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="idFA940E5E7F404928AA21B386F41D2051"><section id="idBC75387F2D144EDAB7C080AE23EA151D"><enum>6310.</enum><header>Requirement for agencies to buy domestically made United States flags</header><subsection id="id1AE29121CD534AD5974D2A1FA0125111"><enum>(a)</enum><header>Requirement</header><text>Except as provided in subsections (b) through (d), funds appropriated or otherwise available to an agency may not be used for the procurement of any flag of the United States, unless such flag has been 100 percent manufactured in the United States from articles, materials, or supplies that have been grown or 100 percent produced or manufactured in the United States.</text></subsection><subsection id="idC9D02517BE384C8F8BA37D1F375F8CF0"><enum>(b)</enum><header>Availability exception</header><text>Subsection (a) does not apply to the extent that the head of the agency concerned determines that satisfactory quality and sufficient quantity of a flag described in such subsection cannot be procured as and when needed at United States market prices.</text></subsection><subsection id="id0B5E45CF87B34B20A9C39D22EA888D66"><enum>(c)</enum><header>Exception for certain procurements</header><text>Subsection (a) does not apply to the following:</text><paragraph id="id23EAE874275C4FD0A0AC39378392E770"><enum>(1)</enum><text>Procurements by vessels in foreign waters.</text></paragraph><paragraph id="id9E86C3A453A04DEE856D458D26EF006B"><enum>(2)</enum><text>Procurements for resale purposes in any military commissary, military exchange, or nonappropriated fund instrumentality operated by an agency.</text></paragraph><paragraph id="id6DA424559040412495728113E7EBCEC9"><enum>(3)</enum><text>Procurements for amounts less than the simplified acquisition threshold.</text></paragraph></subsection><subsection id="idF0EDEF9C2AD94932B6E7C0403A93063D"><enum>(d)</enum><header>Presidential waiver</header><paragraph id="id06CA94C7EA4E410082CEC5B9535EBBB4"><enum>(1)</enum><header>In general</header><text>The President may waive the requirement in subsection (a) if the President determines a waiver is necessary to comply with any trade agreement to which the United States is a party.</text></paragraph><paragraph id="id1C4BA60B4BA64D14BDE93E03B177C31A"><enum>(2)</enum><header>Notice of waiver</header><text>Not later than 30 days after granting a waiver under paragraph (1), the President shall publish a notice of the waiver in the Federal Register.</text></paragraph></subsection><subsection id="idCFBE2393EFBB4815BA76629D5F671A93"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idBB8CC0F2E5664BE1864005686AC5BC84"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term <term>executive agency</term> in section 102 of title 40.</text></paragraph><paragraph id="id2BBDF8E758D6471BBD9950FD2E094742"><enum>(2)</enum><header>Simplified acquisition threshold</header><text>The term <term>simplified acquisition threshold</term> has the meaning given that term in section 134.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id69786A5988734B7998624945E3D032A0"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9212A873620E4029BE80946C80B267C1"><toc><toc-entry bold="off" level="section">6310. Requirement for agencies to buy domestically made United States flags.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id86E689A07B99463DBF9EDB8AB3B9FC1B"><enum>(b)</enum><header>Applicability</header><text>Section 6310 of title 41, United States Code, as added by subsection (a)(1), shall apply with respect to any contract entered into on or after the date that is 180 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
