<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4382</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220613">June 13, 2022</action-date><action-desc><sponsor name-id="S413">Mr. Padilla</sponsor> (for himself, <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>, and <cosponsor name-id="S401">Mr. Romney</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of the Treasury to mint coins in commemoration of the 2028 Olympic and Paralympic Games in Los Angeles, California.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>LA28 Olympic and Paralympic Games Commemorative Coin Act</short-title></quote>.</text></section><section id="idf617b37162094316bcc02b68d66666d9"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id3aafa53d8fa34f239047dfda19ac58da"><enum>(1)</enum><text>The 2028 Olympic and Paralympic Games, officially known as the Games of the XXXIV Olympiad or <quote>LA28</quote>, will be held in Los Angeles, California.</text></paragraph><paragraph id="id3a5476a054e74095992cb2cea2ee632f"><enum>(2)</enum><text>This will be the first time the Olympic and Paralympic Games have been held in the United States in 26 years.</text></paragraph><paragraph id="id9a8697ab214e452a86e12670072490be"><enum>(3)</enum><text>The United States has hosted the modern Olympic Games 9 times, with the 2028 Games becoming the third time Los Angeles will host the summer Olympic Games.</text></paragraph><paragraph id="id3ae7f98763bf462c9e1589b9bee7d699"><enum>(4)</enum><text>The Paralympic Games will celebrate its 80th anniversary in 2028, with Los Angeles hosting the Paralympic Games for the first time.</text></paragraph><paragraph id="id928e2290ea8d4b2fa36c9fa47db72fea"><enum>(5)</enum><text>Unlike some other countries, Olympic Games in the United States are privately funded. The LA28 Games maintain this model with its revenue generated by corporate partners, broadcast rights, licensing, hospitality and ticket sales.</text></paragraph><paragraph id="id4820ccf38d6643019fff4c78af0cffd1"><enum>(6)</enum><text>With Los Angeles hosting the Paralympic Games for the first time in 2028, the 2028 Olympic and Paralympic Games Commemorative Coin Program has the opportunity to increase awareness and create more inclusivity for people with disabilities with the creation of a single, unifying coin to commemorate the Games.</text></paragraph></section><section id="ida6dadb79505c4f518191790cf7aba115"><enum>3.</enum><header>Coin specifications</header><subsection id="id45abb94e8ee34135a8102b83727d46c3"><enum>(a)</enum><header>Denominations</header><text>The Secretary of the Treasury (in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coins in commemoration of the 2028 Olympic and Paralympic Games in Los Angeles, California:</text><paragraph id="id938807a570a242f980dba2aa94efcd4f"><enum>(1)</enum><header>$5 Gold coins</header><text>Not more than 100,000 $5 coins, each of which shall—</text><subparagraph id="iddff872ab367641bbb8ee19da6e94f9b9"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph><subparagraph id="id1e1b29dce4ec41c6a380ff88a94fdf10"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph><subparagraph id="id3ed3bbd1e5b847a0a66d346bd507c63e"><enum>(C)</enum><text>contain not less than 90 percent gold.</text></subparagraph></paragraph><paragraph id="idc1fe88b975f44c6dbf689e6c9402298d"><enum>(2)</enum><header>$1 silver coins</header><text>Not more than 500,000 $1 coins, each of which shall—</text><subparagraph id="id97df23dcfda8446cac77d16316840179"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph><subparagraph id="ideca537e0d2a44cf19c321a5006219c46"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph><subparagraph id="ida0d9ca5a616248c197eda3c05c2dd657"><enum>(C)</enum><text>contain not less than 90 percent silver.</text></subparagraph></paragraph><paragraph id="id23ba2900d4a446bfb7a16997fe41b888"><enum>(3)</enum><header>Half dollar clad coins</header><text>Not more than 300,000 half-dollar coins, each of which shall—</text><subparagraph id="id4e3bf0df9c954dabaefb1dc0f65ca2fb"><enum>(A)</enum><text>weigh 11.34 grams;</text></subparagraph><subparagraph id="id0680416d5d6145a29c58d9337bf11aaa"><enum>(B)</enum><text>have a diameter of 1.205 inches; and</text></subparagraph><subparagraph id="id9947b9e0221f4bdaa7c874788d020f7f"><enum>(C)</enum><text>be minted to the specifications for half-dollar coins contained in section 5112(b) of title 31, United States Code.</text></subparagraph></paragraph><paragraph id="id2b018d3f34b247e8bb63178b0dff323d"><enum>(4)</enum><header>Proof silver $1 coins</header><text>Not more than 100,000 proof silver $1 coins, each of which shall—</text><subparagraph id="ideca2068093804d958a3ba3c0efe70d95"><enum>(A)</enum><text>weigh 5 ounces;</text></subparagraph><subparagraph id="idec1892c1686642ba8e3455d58426f670"><enum>(B)</enum><text>have a diameter of 3 inches; and</text></subparagraph><subparagraph id="id35c1d1de73bc41fa9d189aadef6d07b9"><enum>(C)</enum><text>contain .999 fine silver.</text></subparagraph></paragraph></subsection><subsection id="id877d42de8c5940bbb9df1990732fd90d"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in section 5103 of title 31, United States Code.</text></subsection><subsection id="id1e1b51d1ab7a497eb41af8bb6cc91570"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of section 5134 of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection><subsection id="id074e5deefc294e598aba26d4680d6660"><enum>(d)</enum><header>Mintage limit exception</header><text>If the Secretary determines, based on independent, market based research conducted by the U.S. Olympic and Paralympic Committee, that the mintage levels described under this subsection are not adequate to meet public demand, the Secretary may increase the mintage levels as the Secretary determines is necessary to meet public demand.</text></subsection></section><section id="id52beb1b30ee64a8db639783d93c7a531"><enum>4.</enum><header>Designs of coins</header><subsection id="id468b428d27cb4a9e995809c5909fdea3"><enum>(a)</enum><header>Design requirements</header><paragraph id="id4313aaa16ef3460db98c4ff68f4936ca"><enum>(1)</enum><header>In general</header><text>The designs of the coins minted under this Act shall be emblematic of the participation of United States athletes in the LA28 Games.</text></paragraph><paragraph id="idc88aafe4ddc3474a85ed3a3a00c2d240"><enum>(2)</enum><header>Designation and inscriptions</header><text>On each coin minted under this Act there shall be—</text><subparagraph id="idb8274d2056b143eb9e6a74eacbec9897"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph><subparagraph id="id0e3aebd420f94de3ba1678ac0233e857"><enum>(B)</enum><text>an inscription of the year <quote>2028</quote>; and</text></subparagraph><subparagraph id="id7265107a2deb41dd8ed01e3a70b2cd67"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty,</quote><quote>In God We Trust,</quote><quote>United States of America,</quote> and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph><paragraph id="id9bb27aa69ade4ed9a0aa9f563bfc1da9"><enum>(3)</enum><header>Selection of designs</header><text>The designs for the coins minted under this Act shall be—</text><subparagraph id="id1dc7820baf884bd08934e6b721a395db"><enum>(A)</enum><text>selected by the Secretary after consultation with—</text><clause id="id60323cb76db440a583f22674e7ef0cf4"><enum>(i)</enum><text>the United States Olympic and Paralympic Properties; and</text></clause><clause id="idc00e04bf4c5c49b48ccc979fe75950d9"><enum>(ii)</enum><text>the Commission of Fine Arts; and</text></clause></subparagraph><subparagraph id="iddc1b906850394381989397649725e0f2"><enum>(B)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></subparagraph></paragraph></subsection></section><section id="id691bf2ef4290481aa962ffc6e3768a0f"><enum>5.</enum><header>Issuance of coins</header><subsection id="idbf2599f9c8c54051a4c5ae866944c32d"><enum>(a)</enum><header>Quality of coins</header><text>The Secretary may issue coins minted under this Act in uncirculated and proof qualities.</text></subsection><subsection id="idd2285befb8494fd588049787d47a9a76"><enum>(b)</enum><header>Period of issuance</header><text>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2028.</text></subsection></section><section id="idd82e421a12c6433fafd77a84bc5f2a13"><enum>6.</enum><header>Sale of coins</header><subsection id="id1ff8e764e2834a909d323bd109c174a9"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text><paragraph id="idc2070a577f5e46f98f324c95d582933b"><enum>(1)</enum><text>the face value of the coins;</text></paragraph><paragraph id="id2cf559666da84581af0c928e8b20327d"><enum>(2)</enum><text>the surcharge provided in section 7(a) with respect to such coins; and</text></paragraph><paragraph id="ide43fec4fc78e4de2b7ceaf61bd2df861"><enum>(3)</enum><text>the cost of designing and issuing such coins (including labor, materials, dies, use of machinery, overhead expenses, and marketing, and shipping).</text></paragraph></subsection><subsection id="id601a5712ef6a464093436b1aa5dd4520"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection><subsection id="id2a7da1ae0bc24e5a8d56022a1e6c2086"><enum>(c)</enum><header>Prepaid orders</header><paragraph id="idFAB543DE6CB94473A487B3136AEF1588"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph><paragraph id="id4B8202B0471D41FFA040CB85308D37FC"><enum>(2)</enum><header>Discount</header><text>Sales with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section><section id="idf57f98c60c584af5b404c979f1709ce9"><enum>7.</enum><header>Surcharges</header><subsection id="idb1974d15a9574ba287ace36b80d3f4cf"><enum>(a)</enum><header>In general</header><text>All sales of coins issued under this Act shall include a surcharge of—</text><paragraph id="id6d1f13b509b34da2a4428adf153ffea4"><enum>(1)</enum><text>$35 per coin for the $5 coin;</text></paragraph><paragraph id="id792ef3de44b445bea2696b2fc6c5d059"><enum>(2)</enum><text>$10 per coin for the $1 coin described under section 3(a)(2);</text></paragraph><paragraph id="id661da743806c4a5994b1abbcd3600586"><enum>(3)</enum><text>$5 per coin for the half-dollar coin; and</text></paragraph><paragraph id="id8cb17c56846643dfa7cf6d8050111378"><enum>(4)</enum><text>$50 per coin for the $1 proof silver coin.</text></paragraph></subsection><subsection id="id7d38c2fae8d84fde8fbbff4ac02dd5d7"><enum>(b)</enum><header>Distribution</header><text>Subject to section 5134(f) of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the United States Olympic and Paralympic Properties for the objects and purposes related to the hosting of the 2028 Olympic and Paralympic Games and to aid in the execution of its legacy programs, including the promotion of youth sports in the United States.</text></subsection><subsection id="idca28c3fe07e84f189d76ee28573dbb10"><enum>(c)</enum><header>Audits</header><text>The United States Olympic and Paralympic Properties shall be subject to the audit requirements of section 5134(f)(2) of title 31, United States Code, with regard to the amounts received under subsection (b).</text></subsection><subsection id="id4a853b49e3584ad79d7ce106cc19dfb2"><enum>(d)</enum><header>Limitation</header><text>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin programs issuance limitation under section 5112(m)(1) of title 31, United States Code (as in effect on the date of the enactment of this Act). The Secretary may issue guidance to carry out this subsection.</text></subsection></section><section id="id4aacaef0ddc34bf5bd20841bd145bdb8"><enum>8.</enum><header>Marketing and financial assurances</header><subsection id="id2ab4889ce5e74a63ab42491dae4df41c"><enum>(a)</enum><header>In general</header><text>The Secretary shall take such actions as may be necessary to ensure that—</text><paragraph id="id7605520c82a44fc29110a1d819372a29"><enum>(1)</enum><text>minting and issuing coins under this Act result in no net cost to the Federal Government; and</text></paragraph><paragraph id="id863b1fe25cb24243b9b8e066fe072b1b"><enum>(2)</enum><text>no funds, including applicable surcharges, shall be disburses to any recipient designated in section 7(b) until the total cost of designing and issuing all of the coins authorized by this Act, including labor, materials, dies, use of machinery, overhead expenses, marketing and shipping, is recovered by the United States Treasury, consistent with sections 5112(m) and 5134(f) of title 31, United States Code.</text></paragraph></subsection><subsection id="id024834b724084cd29979ed3b86f5edf3"><enum>(b)</enum><header>Marketing and educational program</header><text>The Secretary is encouraged to develop and execute a marketing and educational program, including appropriate cooperative marketing opportunities with the United States Olympic and Paralympic Properties and its licensees, to promote and sell the coins authorized under this Act. </text></subsection></section></legis-body></bill>
