which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To transition the nontactical vehicle fleet of the Department of Defense to electric or other zero emission vehicles, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC2D4BE35302849B6AFB758B4005895A3"><section section-type="section-one" id="HEA4C06EF357D435DBFA28076BD465309"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Vehicle Fleet Electrification Act</short-title></quote>.</text></section><section id="H75D6E51A2BB7425A8F9AD0A5AE620EE1" commented="no"><enum>2.</enum><header>Procurement of electric or zero emission vehicles for the Department of Defense</header><subsection id="HC49D762936254113B76CE6D267499F86" commented="no"><enum>(a)</enum><header>Procurement requirement</header><paragraph id="H437B19C9B18241CC9654B0DBBCF7F6FE" commented="no"><enum>(1)</enum><header>In general</header><text>Section 2922g of title 10, United States Code, is amended to read as follows:</text><quoted-block style="USC" id="H5B66529413944F4AAB9992F0D56CCE02" display-inline="no-display-inline"><section id="HCE88C71A976940E592F1AD33C324D3BA" commented="no"><enum>2922g.</enum><header>Procurement of electric or zero emission vehicles</header><subsection id="H4B933AF9AD0749DB8D186CE6088CF2D0" commented="no"><enum>(a)</enum><header>Requirement To procure electric or zero emission vehicles</header><text display-inline="yes-display-inline">Not less than 75 percent of the total number of covered nontactical vehicles purchased or leased by or for the use of the Department of Defense shall—</text><paragraph id="HA8C06E31E0924BF99787B56972083A89" commented="no"><enum>(1)</enum><text>be electric or zero emission vehicles; and</text></paragraph><paragraph id="HD06B4B64D1B7451CA6F44411B5B8F629" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">use a charging connector type (or other means to transmit electricity to the vehicle) that meets applicable industry accepted standards for interoperability and safety.</text></paragraph></subsection><subsection id="HD41251FF71274ADB8EBC83797886752D"><enum>(b)</enum><header>Relation to other vehicle technologies that reduce consumption of fossil fuels</header><text display-inline="yes-display-inline">The head of the department or agency of the Federal Government concerned may authorize the purchase or lease of covered nontactical vehicles that use a technology other than electric or zero emission technology only if the head of such department or agency determines, on a case by case basis, that—</text><paragraph id="HCCB9B62BA7B8425891FD92FD8E124F0E"><enum>(1)</enum><text>the technology used in the vehicles to be purchased or leased reduces the consumption of fossil fuels compared to any vehicles being replaced by the newly purchased or leased vehicles (regardless of the engine technology used in the vehicles being replaced);</text></paragraph><paragraph id="H314119C1A5A44AB2BCF704CD8E3D648D"><enum>(2)</enum><text>the purchase or lease of such vehicles is consistent with the energy performance goals and master plan of the Department of Defense required by subsections (c) and (d) of section 2911 of this title;</text></paragraph><paragraph id="H9896A0BF4F0842688CAE759D12D68786"><enum>(3)</enum><text display-inline="yes-display-inline">the purchase or lease of such vehicles will not result in a total number of non-electric or non-zero emission vehicles in excess of the threshold specified in subsection (a); and</text></paragraph><paragraph id="HF9EF29475B5146E198891C76EE4A6426"><enum>(4)</enum><text>the purchase or lease of electric or zero emission vehicles is impracticable under the circumstances.</text></paragraph></subsection><subsection id="HFD6137706E4B40B58C3F7C930ADB73F7" display-inline="no-display-inline"><enum>(c)</enum><header>Domestic sourcing requirements</header><paragraph id="H78BB9BCD2CAE47A7AA7D86D39BFAEC29"><enum>(1)</enum><header>In general</header><text>The following provisions of law shall apply to the purchase or lease of covered nontactical vehicles under this section:</text><subparagraph id="H33A1B375749747119D95BF977D3161D6"><enum>(A)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">Chapter 83</external-xref> of title 41 (commonly referred to as the <quote>Buy American Act</quote>).</text></subparagraph><subparagraph id="HEDD2BAF9A2234629BCB22DF2FA876700"><enum>(B)</enum><text>Section 4862 of this title (commonly referred to as the <quote>Berry Amendment</quote>).</text></subparagraph><subparagraph id="H8C7A453E0849461396EE52DD603DE599"><enum>(C)</enum><text display-inline="yes-display-inline">Section 4863 of this title (commonly referred to as the <quote>Specialty Metal Clause</quote>).</text></subparagraph></paragraph><paragraph id="H5D911901E0B048A8A2E2E9C2226FC015" commented="no"><enum>(2)</enum><header>Domestic sourcing of batteries</header><text display-inline="yes-display-inline">Any vehicle battery included in a covered nontactical vehicle shall be sourced from a manufacturer—</text><subparagraph id="H4BD880088DE844B292486BF633377BAE" commented="no"><enum>(A)</enum><text>within the national technology and industrial base; or</text></subparagraph><subparagraph id="H1F3698C568B64D1DAA897FA40C0D52D5" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">from a qualifying country (as defined in section 225.003 of title 48, Code of Federal Regulations, or successor regulations).</text></subparagraph></paragraph><paragraph id="H8A3EF1EF8E2A4E489B10BA82EA49FAE4"><enum>(3)</enum><header>Applicability to leased vehicles</header><text>The requirements of paragraphs (1) and (2) shall apply to leased vehicles in the same manner that such requirements apply to purchased vehicles.</text></paragraph><paragraph id="HF3D056A4C01442BA9A58FC02D187BFBF"><enum>(4)</enum><header>Prohibition on waiver</header><text display-inline="yes-display-inline">No provision of a memorandum of understanding or related agreement referred to in section 4851 of this title (commonly referred to as a <quote>Reciprocal Defense Procurement Agreement</quote>) may waive or supercede the requirements of paragraphs (1) and (2). </text></paragraph></subsection><subsection id="H0AE7772515874EBA9460F4C5B5225000"><enum>(d)</enum><header>Prohibition on sourcing from non-Allied foreign nations</header><text display-inline="yes-display-inline">A covered nontactical vehicle that is an electric or zero emission vehicle purchased or leased by or for the use of the Department of Defense may not—</text><paragraph id="id78CDB37F013B40EFAF8E1CBD6C208905"><enum>(1)</enum><text display-inline="yes-display-inline">include an automotive item, including a vehicle battery, battery pack, or battery cell, sourced from a covered nation; or</text></paragraph><paragraph id="id2fccbea9299043348ab8a7b58e6455ec"><enum>(2)</enum><text>be sourced, including final assembly, from—</text><subparagraph id="id16712ec6b54c42879a0fa824933e3eea"><enum>(A)</enum><text>a covered nation;</text></subparagraph><subparagraph id="id651339933c024964b2cbdfff7e5613ea"><enum>(B)</enum><text>a country that is not part of the national technology and industrial base; or</text></subparagraph><subparagraph id="ida4ebc6f001064e35a2c19e633c38245a"><enum>(C)</enum><text>a country that does not have a memorandum of understanding or related agreement referred to in section 4851 of this title with the United States (commonly referred to as a <quote>reciprocal defense procurement agreement</quote>).</text></subparagraph></paragraph></subsection><subsection id="H6DD1AFA823884FA59759860AEC19FCCB" commented="no"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="idF6AE15A347B84ECB8F0DEB2E7412169B"><enum>(1)</enum><header>Covered nation</header><text>The term <term>covered nation</term> has the meaning given that term in section 4872(d) of this title.</text></paragraph><paragraph commented="no" id="idE2A7E878D8C944B89951C2BA675529BE"><enum>(2)</enum><header>Covered nontactical vehicle</header><text>The term <term>covered nontactical vehicle</term> means any vehicle—</text><subparagraph id="H5211C6AC67204879B107194AEB31847F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">that is not a tactical vehicle designed for use in combat; and</text></subparagraph><subparagraph id="HD86C5C4E63564622900F5FB453953754" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">that is purchased or leased by the Department of Defense, or by another department or agency of the Federal Government for the use of the Department of Defense, pursuant to a contract entered into, renewed, modified, or amended on or after October 1, 2022.</text></subparagraph></paragraph><paragraph commented="no" id="idBA97F765102A4DA0A4448C832B4F957F"><enum>(3)</enum><header>National technology and industrial base</header><text display-inline="yes-display-inline">The term <term>national technology and industrial base</term> has the meaning given that term in section 4801 of this title.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE6D1FAB4BA264FEA8EB25E67FBBF5AD6" commented="no"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/173">chapter 173</external-xref> of title 10, United States Code, is amended by striking the item relating to section 2922g and inserting the following new item:</text><quoted-block style="USC" id="H1A685BF09C6A412B8D85CB12FE57439E" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">2922g. Procurement of electric or zero emission vehicles.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF851B8DD1945439482337F032E2D3904" commented="no"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on October 1, 2022.</text></subsection></section><section id="H517636E1611D4BC6A1B0409F6E1A1672" commented="no"><enum>3.</enum><header>Electric vehicle charging stations at military installations</header><subsection id="H7F40B438B52B42A399552CCD34C3A574" commented="no"><enum>(a)</enum><header>Charging stations at commissary stores and military exchanges</header><paragraph id="H43DB43AE30AA48B2B02805ACFDCDFF2A"><enum>(1)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/147">chapter 147</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="H850F6B79730D4F5582A7D5F5A2D87323" display-inline="no-display-inline"><section id="HA31A77B59C6E4D1E9526BEE8740F7C0B" commented="no"><enum>2486.</enum><header>Electric vehicle charging stations at commissary stores and military exchanges</header><subsection id="H18BE6F3D421640CEA33F42B247AC5416" commented="no"><enum>(a)</enum><header>Authority</header><text>The Secretary of Defense may furnish electric vehicle charging stations at a commissary store or MWR retail facility for commercial use by individuals authorized to access such facilities.</text></subsection><subsection id="H8780F9C89AE144148DB3A48F3C77D4D9" commented="no"><enum>(b)</enum><header>Rates and procedures</header><text display-inline="yes-display-inline">If the Secretary of Defense furnishes electric vehicle charging stations pursuant to subsection (a)—</text><paragraph id="H77AE4AD4D33E402F8010261EDA149A62" commented="no"><enum>(1)</enum><text>the Secretary shall establish rates and procedures that the Secretary determines appropriate for the purchase of electric power from the charging stations; and</text></paragraph><paragraph id="HBF0083506191411491EC0FAF3BB5A1EE"><enum>(2)</enum><text display-inline="yes-display-inline">such charging stations may be installed and operated by a contractor on a for-profit basis.</text></paragraph></subsection><subsection id="H8A881947519240FA91EA332AC1D99AB3"><enum>(c)</enum><header>Interoperability</header><text display-inline="yes-display-inline">Any vehicle charging station provided under this section shall use a charging connector type (or other means to transmit electricity to the vehicle) that—</text><paragraph id="H152B9F5BE92143CF8C17CC01C4EF9820"><enum>(1)</enum><text>meets applicable industry accepted standards for interoperability and safety; and</text></paragraph><paragraph id="H0444F4E53E1F4F519A55D48FB89D52D1"><enum>(2)</enum><text display-inline="yes-display-inline">is compatible with—</text><subparagraph id="H9521F5A82A2E4515BF5D970D8F8E48D3"><enum>(A)</enum><text>electric vehicles commonly available for purchase by a member of the general public; and</text></subparagraph><subparagraph id="HF67DE871488D4C00BECA9F76B04F8457"><enum>(B)</enum><text display-inline="yes-display-inline">covered nontactical vehicles (as defined in section 2922g(e) of this title) for which charging is required.</text></subparagraph></paragraph></subsection><subsection id="id1F54CD328012487AADD5838FDB6FDFD7"><enum>(d)</enum><header>MWR retail facility defined</header><text display-inline="yes-display-inline">In this section, the term <term>MWR retail facility</term> has the meaning given the term <term>MWR retail facilities</term> in section 1063(e) of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HFDBB7E15C9414A37A2C0456501197C93" commented="no"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such subchapter is amended by adding at the end the following new item:</text><quoted-block style="USC" id="H54A9462287914B48B4BA1C1E0D312F06" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">2486. Electric vehicle charging stations at commissary stores and military exchanges.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5EE087AA074A425E9C179433F07B30DA"><enum>(b)</enum><header>Additional requirements and authorities</header><paragraph id="H7162F25FCAC341FFA5C34E76E8A340F2"><enum>(1)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/173">chapter 173</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="H86497CF6E2034EC980013DE350C3CC05" display-inline="no-display-inline"><section id="H302F82AFAC1F43BDA5A204FDDB666207"><enum>2922j.</enum><header>Requirements and authorities relating to electric vehicle charging stations</header><subsection id="HBA4E5D1706E7455DB551F50176DEE53E"><enum>(a)</enum><header>Use of qualified electricians</header><text>Any electrical work (including installation, maintenance, repair, rehabilitation, or replacement) required for an electric vehicle charging station located at a military installation shall be carried out by a qualified electrician who—</text><paragraph id="H06D2EDA20BCC4C62BF06A6B9D05C33F4"><enum>(1)</enum><text>is licensed to perform such work in the State in which the work is performed;</text></paragraph><paragraph id="H26C23ABB552D41AFBD630C526AF3862C"><enum>(2)</enum><text display-inline="yes-display-inline">is paid wages not less than those prevailing for similar work in the locality, as determined by the Secretary of Labor under subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40 (commonly referred to as the <quote>Davis-Bacon Act</quote>); and</text></paragraph><paragraph id="H88686B0D54A54FDDB38039FFC9FE5AED"><enum>(3)</enum><text>holds a valid certification from the nongovernmental Electric Vehicle Infrastructure Training Program.</text></paragraph></subsection><subsection id="HC73C3B0E5AF346EAA15E14EFF82D50A9"><enum>(b)</enum><header>Authority To carry out unspecified minor military construction projects</header><text display-inline="yes-display-inline">The Secretary of Defense may use the authority provided under section 2805 of this title for the installation, maintenance, repair, rehabilitation, or replacement of an electric vehicle charging station on a military installation.</text></subsection><subsection id="H7EE6865D986043FB83F40DE53CEEF495"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1D28133C81F845DA8A0AD4C7693FCBFB"><enum>(1)</enum><text>The term <term>military installation</term> has the meaning given that term in section 2801 of this title.</text></paragraph><paragraph id="HE5EB53F01C814D44AC811AAFBF6585A3"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>State</term> means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HEBC93F428A43446582352BC292BC06E0" commented="no"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such subchapter is amended by adding at the end the following new item:</text><quoted-block style="USC" display-inline="no-display-inline" id="HDC6C1AA8AEF14BE6B34B47BC33DCBB39"><toc regeneration="no-regeneration"><toc-entry level="section">2922j.
