<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4379</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220613">June 13, 2022</action-date><action-desc><sponsor name-id="S380">Mr. Peters</sponsor> (for himself and <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To include State active duty in the calculation of creditable service for members of the National Guard under certain circumstances.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Guardsman Left Behind Act of 2022</short-title></quote>.</text></section><section section-type="subsequent-section" id="id2D3EC38A87FB425295911C1A45F0FE00"><enum>2.</enum><header>Inclusion of State active duty in calculation of creditable service for members of National Guard</header><text display-inline="no-display-inline">Section 12732 of title 10, United States Code, is amended—</text><paragraph id="idA92AE247B74F457E9E829130DBFE2F84"><enum>(1)</enum><text>in subsection (b)(4), by striking <quote>Service</quote> and inserting <quote>Except as provided in subsection (c), service</quote>; and</text></paragraph><paragraph id="id985AE2E1E795429C99DC72932DD88CFC"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA68DDF98020F454BA802A57C6631B3CF"><subsection id="idFD95AC635C3A4338A54A7AA67B543E57"><enum>(c)</enum><header>Special rule for State active duty</header><paragraph id="id9993DB305CBB413A8E710F661877F365"><enum>(1)</enum><header>In general</header><text>Subject to regulations prescribed by the Secretary of Defense, in the case of a member of the National Guard who serves on State active duty during a one-year period during which the member would, but for this subsection, be credited with fewer than 50 points under subsection (a), such service may be counted under subsection (a).</text></paragraph><paragraph id="id673766498AA14F5BAF6B88B61D15040D"><enum>(2)</enum><header>Computation</header><text>Subject to paragraph (3), a member of the National Guard described in paragraph (1) shall be credited with 1 point for each day of State active duty during a one-year period described in that paragraph.</text></paragraph><paragraph id="id4CBDBB62A18942E298A21CF15933A7F9"><enum>(3)</enum><header>Limitation</header><text>A member of the National Guard described in paragraph (1) may be credited in a one-year period under this subsection not more than the lesser of—</text><subparagraph id="id4540B50F272F452284E641EFF0EB7C67"><enum>(A)</enum><text>the number of points required for the member to be credited with 50 points under this section for that one-year period; or</text></subparagraph><subparagraph id="idBF3F48BBD84944D2A3C47C2B1737F675"><enum>(B)</enum><text>15 points.</text></subparagraph></paragraph><paragraph id="id8CBF34F0C1FE48DB91D3CC31A503CF4B"><enum>(4)</enum><header>State active duty defined</header><text>In this subsection, the term <term>State active duty</term> means full-time service at the order of the Governor of a State or the Commonwealth of Puerto Rico, Guam, or the Virgin Islands, or the commanding general of the District of Columbia National Guard, pursuant to the law of the State, the Commonwealth of Puerto Rico, Guam, the Virgin Islands, or the District of Columbia, as the case may be.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
