which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide Federal matching funding for State-level broadband programs.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Broadband Buildout Act of 2021</short-title></quote>.</text></section><section id="id52A16D24BF8746C99371EE38FAE7D226"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id206C275AC78144C59B2CEDEBEE22C28A"><enum>(1)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph><paragraph id="idBC87AB5379D54309A66A1DC9A1B21896"><enum>(2)</enum><header>Broadband availability maps</header><text>The term <term>broadband availability maps</term> means the maps created by the Federal Communications Commission under section 802(c)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/642">47 U.S.C. 642(c)(1)</external-xref>).</text></paragraph><paragraph id="id9E34AFA81CF540B28618569454745148"><enum>(3)</enum><header>Broadband internet access service</header><text>The term <term>broadband internet access service</term>—</text><subparagraph id="id77D4E289F2B444498BBDFEE2621D9374"><enum>(A)</enum><text>means mass-market retail service by wire or radio that provides the capability to transmit data to and receive data from all or substantially all internet endpoints, including any capabilities that are incidental to and enable the operation of the communications service, but excluding dial-up internet access service; and</text></subparagraph><subparagraph id="id198F095637094473BEC83872EBCF9779"><enum>(B)</enum><text>includes any service that the Commission finds to be providing a functional equivalent of the service described in subparagraph (A) or that is used to evade the protections set forth in part 8 of title 47, Code of Federal Regulations, or any successor thereto.</text></subparagraph></paragraph><paragraph id="idF23A1652B571493FB860ABD474421B30"><enum>(4)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="idFC0EE469EC624D5BB78597177747C5F3"><enum>(5)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="idF1249ED941094D9CAD423D127BB06726"><enum>(A)</enum><text>a State; or</text></subparagraph><subparagraph id="idC22FD2BFD0214B0F87B6305484580B3C"><enum>(B)</enum><text>an entity authorized by a State to spend funds for a purpose described in section 3 or 4.</text></subparagraph></paragraph><paragraph id="idF35E0045AD53401B89FAD8F29D77FE6E"><enum>(6)</enum><header>Last-mile infrastructure</header><text>The term <term>last-mile infrastructure</term> means infrastructure the predominant purpose of which is to provide broadband internet access service to end users or end user devices, including households, businesses, community anchor institutions, public safety entities, and critical community facilities.</text></paragraph><paragraph id="idA26E554885A3466898C84B12EC6176C4"><enum>(7)</enum><header>Overbuilding</header><subparagraph id="id29AC1C3050DE4D38B361FF4021B9F45F"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the term <term>overbuilding</term> means deploying broadband infrastructure in an area—</text><clause id="id2071656C45064140AA8588663F8CB145"><enum>(i)</enum><text>that already has—</text><subclause id="id18921F91F1E2483FBBAD5F732EBC75BB"><enum>(I)</enum><text>facilities capable of providing standard broadband service; or</text></subclause><subclause id="idc38b9ef002074a74ab3dffb26ba7022b"><enum>(II)</enum><text>broadband infrastructure that was built using funds from a Federal or State program that were provided for the express purpose of deploying broadband infrastructure;</text></subclause></clause><clause id="ida77617fa5dde40779eee8e1111d457b8"><enum>(ii)</enum><text>where Federal or State funding has already been committed for the deployment of facilities capable of providing standard broadband service, even if such service is not yet available, provided that the funding recipient is meeting any applicable buildout deadlines; or</text></clause><clause id="id7a5b75656ced47e5b45f22938ee6c0be" commented="no"><enum>(iii)</enum><text>with respect to which a broad­band internet access service provider has already made enforceable commitments to a Federal agency or State to deploy facilities capable of providing standard broad­band service, even if such service is not yet available, provided that the broadband internet access service provider is meeting any applicable buildout deadlines.</text></clause></subparagraph><subparagraph commented="no" id="id973DDF30291C402CA59437EBC0BE0C44"><enum>(B)</enum><header>Interconnect points</header><text>The term <term>overbuilding</term> does not include deploying broadband infrastructure in an area described in subparagraph (A) if the infrastructure is deployed for the purpose of reaching interconnect points of standard broadband service to meet the needs of broadband users in another area that is an unserved area.</text></subparagraph></paragraph><paragraph id="idC086A170267B41B2BFCC3A243BC6F416"><enum>(8)</enum><header>Qualifying project</header><text>The term <term>qualifying project</term> means a project—</text><subparagraph id="idB191ED7501544BCF87438FCA9FB80BAA"><enum>(A)</enum><text>to construct last-mile infrastructure that will provide broadband internet access service at a speed of not less than 100 megabits per second for downloads and 10 megabits per second for uploads in an unserved area, without engaging in overbuilding; and</text></subparagraph><subparagraph id="id3DEB0B19399D4CD78A262F8B52F79DCA"><enum>(B)</enum><text>that is funded by a public-private partnership in which—</text><clause id="idE6F238906D2D480E907FDC4D1317B95A"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idBA94779C093241C0BEF115DAEC24F0C0"><enum>(I)</enum><text>the State in which the project is located provides a portion of the funds; or</text></subclause><subclause id="id789A66374F5242939F47711551EE4573" indent="up1" commented="no"><enum>(II)</enum><text>the State in which the project is located and another entity, which may be a political subdivision of the State in which the project is located, together provide not less than 25 percent of the funds; and</text></subclause></clause><clause id="id44D1BBC2891F4B1984525712EF693E8C" commented="no"><enum>(ii)</enum><text>the private company or electric cooperative that will provide broadband internet access service to customers connected to the last-mile infrastructure provides not less than 25 percent of the funds.</text></clause></subparagraph></paragraph><paragraph id="idc34723e6ad294d179c2328d2b5a97849"><enum>(9)</enum><header>Standard broadband service</header><text>The term <term>standard broadband service</term> means broad­band internet access service with a speed of not less than—</text><subparagraph id="id0B4FCBD6842B415CA8096D040C79E4BE"><enum>(A)</enum><text>25 megabits per second for downloads; and</text></subparagraph><subparagraph id="idA3D1CC8C9D4440A98B5736B3D5290D4E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>3 megabits per second for uploads.</text></subparagraph></paragraph><paragraph id="idF840E10C8C564916B22EF72C1CB71035"><enum>(10)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph><paragraph id="idc6c3109b44274724b9cbf3b291ae5ebb"><enum>(11)</enum><header>Unserved area</header><text>The term <term>unserved area</term> means a census block in which standard broadband service is not available to all households according to—</text><subparagraph id="id6D0B67C25F9C4F7A82E9BD62BF6CE733"><enum>(A)</enum><text>the broadband availability maps; or</text></subparagraph><subparagraph id="idC38B08E365F344FEB207166F30E7CD8B"><enum>(B)</enum><text>if the maps described in subparagraph (A) have not been completed at the time when the relevant grant is being awarded, any existing broadband availability data of the Commission, as well as any relevant data from the National Broadband Availability Map produced by the Assistant Secretary.</text></subparagraph></paragraph></section><section id="idAD36D6031D2841FE83C9C6ECFDE151EF"><enum>3.</enum><header>Last-mile broadband infrastructure</header><subsection id="ide132c08cbecb41d8a29d9b38439e295a"><enum>(a)</enum><header>Grants</header><paragraph id="id7F5673585C4742C788E6C5AA6A54981D"><enum>(1)</enum><header>In general</header><text>The Commission shall award grants to eligible entities for qualifying projects.</text></paragraph><paragraph id="id0F6FB9FB11A54C95B183243C849DC8DC"><enum>(2)</enum><header>Advisory role of NTIA</header><text>The Commission shall carry out paragraph (1) in consultation with the Assistant Secretary, including by soliciting and taking into account the advice of the Assistant Secretary.</text></paragraph></subsection><subsection id="ida83623ae7ab741d4bbd6fbd71184d456"><enum>(b)</enum><header>Prioritization</header><text>The Commission shall give priority to qualifying projects in States in which, according to the broadband availability maps—</text><paragraph id="id0c401c40915246619a3b2b1b0d4c161e"><enum>(1)</enum><text>less than 68 percent of households subscribe to fixed terrestrial broadband internet access service with a speed of not less than—</text><subparagraph id="id9ffa8c23fa244d84885eee4935593296"><enum>(A)</enum><text>10 megabits per second for downloads; and</text></subparagraph><subparagraph id="idc3a802613ea94ff0a5851350249b7b00"><enum>(B)</enum><text>1 megabit per second for uploads; and</text></subparagraph></paragraph><paragraph id="ida38e262850944e6882a1c4749cdf0b39"><enum>(2)</enum><text>less than 40.5 percent of households subscribe to fixed terrestrial standard broadband service.</text></paragraph></subsection><subsection id="id7eefd6a1933f4153833818722f07bc67"><enum>(c)</enum><header>High-Cost, geographically challenged areas</header><text>The Commission shall ensure that not less than 15 percent of the amounts awarded under this section are used in unserved areas that are high-cost and geographically challenged, as determined by the Commission.</text></subsection><subsection id="id10a2a65e480c4f2a9283bf3bbbb11216"><enum>(d)</enum><header>Population-Based allocation</header><paragraph id="idd85156b045e1405eaa5d8723760182af"><enum>(1)</enum><header>In general</header><text>In awarding grants under this section, the Commission shall allocate not less than $5,000,000,000 among the States based on the proportion that the population of each State bears to the population of all States.</text></paragraph><paragraph id="idb1ff4caa572b40bab98bbcae2d336b52"><enum>(2)</enum><header>Excess funds</header><text>If the amount allocated for a State under paragraph (1) exceeds the allowable Federal share of the costs of projects of the State (or other eligible entity acting on behalf of the State) that are eligible for funding under this section, the Commission shall withhold the excess amount, which shall revert to the general fund of the Treasury.</text></paragraph><paragraph id="id056355667ac34d8998ee16832fbdd8e8"><enum>(3)</enum><header>Failure to apply</header><text>If an eligible entity does not apply for a grant under this section by the last day of fiscal year 2022, the amount that would have been awarded to the eligible entity under paragraph (1) shall revert to the general fund of the Treasury.</text></paragraph></subsection></section><section id="id2AA87FCE0FBD4EF2B874E10D9197BDF3"><enum>4.</enum><header>Public awareness campaigns; digital literacy programs</header><text display-inline="no-display-inline">The Commission shall award grants to eligible entities—</text><paragraph id="id650F746F6C6C427C86F7FCE098D2F483"><enum>(1)</enum><text>to carry out public awareness campaigns designed to highlight the value and benefits of broadband internet access service, in order to increase the adoption of broadband internet access service; and</text></paragraph><paragraph id="id9381651FAD6141E88F3C8FF74BE360A3"><enum>(2)</enum><text>to support digital literacy programs in areas in which a qualifying project that receives funding under section 3 is located.</text></paragraph></section><section id="idA42669DAF8594FB7928FF5F603CB8310"><enum>5.</enum><header>Federal share</header><subsection id="id4965268D2E5B4EC0A0CB60AA1405B97F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal share of the cost of a project, campaign, or program that receives funding under this Act shall be not more than 50 percent.</text></subsection><subsection id="id142c4f8e50b947bfb835f10caba6041f"><enum>(b)</enum><header>Use of certain Federal funds for non-Federal share</header><paragraph id="id739074B7C0FC4C5E98176413EC3C913B"><enum>(1)</enum><header>In general</header><text>A State may use any amounts described in paragraph (2) for the non-Federal share of the cost of a project, campaign, or program that receives funding under this Act.</text></paragraph><paragraph id="id9E214C9BEA6A4CA5A513F090F9B7EB56"><enum>(2)</enum><header>Eligible amounts</header><text>The amounts referred to in paragraph (1) are amounts received from—</text><subparagraph id="id9F8FCA2865434AC78D8224423AF7D9A7"><enum>(A)</enum><text>the Secretary of Housing and Urban Development under the community development block grant program under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> et seq.);</text></subparagraph><subparagraph id="idE1D84E168BC040699C98E892A3DB5CE7"><enum>(B)</enum><text>the Appalachian Regional Commission established under section 14301(a) of title 40, United States Code;</text></subparagraph><subparagraph id="id472CB9D9E4DC44E4AEE025A89CD73C40"><enum>(C)</enum><text>the Economic Development Administration of the Department of Commerce;</text></subparagraph><subparagraph id="id44FF594B4EAE453CAF252F84BAFD8386"><enum>(D)</enum><text>any rural telehealth program of the Commission; or</text></subparagraph><subparagraph id="idBE19F485437D4C0AA134D48D02DCC2E3"><enum>(E)</enum><text>the Northern Border Regional Commission established under section 15301(a)(3) of title 40, United States Code.</text></subparagraph></paragraph></subsection></section><section id="idEE0CDAEF9B954FCC95677D4C5A312667"><enum>6.</enum><header>Technology neutrality required</header><text display-inline="no-display-inline">The Commission shall award grants to eligible entities under this Act in a manner that does not favor the use of any particular technology.</text></section><section id="idfa1ad4dd07c14df09b796e8b53c37c92"><enum>7.</enum><header>Transparency and accountability</header><subsection id="idee439fe64adc4ee4bdac1649e1e07103"><enum>(a)</enum><header>Last-Mile broadband infrastructure grants</header><text>For grants awarded under section 3, the Commission shall establish transparency and accountability rules under which—</text><paragraph id="idA8D6B9B675AA477AA576474133A24B34"><enum>(1)</enum><text>after receiving an application for a grant to carry out a qualifying project in an area, the Commission shall determine whether the area is served or unserved using accurate and granular information regarding the availability of broadband internet access service at the sub-census block level;</text></paragraph><paragraph id="id444b22684c944807be65052b4f5c1edb"><enum>(2)</enum><text>the Commission shall—</text><subparagraph id="idEDFE3182D6F140958593B7CB5B31231D"><enum>(A)</enum><text>permit a person or entity to challenge an initial determination of the Commission under paragraph (1); and</text></subparagraph><subparagraph id="id69A2052C7B4E419CAC93E3B16F7267E6"><enum>(B)</enum><text>provide a period of not less than 45 days, after the Commission makes an initial determination under paragraph (1) with respect to an area, during which a provider of broad­band internet access service may voluntarily submit information concerning the broadband internet access service that the provider offers in the area;</text></subparagraph></paragraph><paragraph id="id4ef71af97e7849ef832ea851ca05f20b"><enum>(3)</enum><text>the Commission shall provide the public with notice of—</text><subparagraph id="idea34b12e5d79419e9e1dec49260ffc5e"><enum>(A)</enum><text>an initial determination with respect to an area under paragraph (1);</text></subparagraph><subparagraph id="ide1f218588b3d44eb9f976575665dfcd3"><enum>(B)</enum><text>the final determination of whether an area is served or unserved after the process for challenging the initial determination, as described in paragraph (2), has concluded;</text></subparagraph><subparagraph id="id33de3ad668ef426da6f1f57744a3ae92"><enum>(C)</enum><text>the entities that have applied for a grant; and</text></subparagraph><subparagraph id="id956251c93c4949c6ba7db4a089701ce3"><enum>(D)</enum><text>the results of any decision regarding a grant application, including by identifying—</text><clause id="id4C0990609B0949D5BFAF49564E257253"><enum>(i)</enum><text>each eligible entity that was awarded a grant;</text></clause><clause id="idB0C3E9CBD78B4F88A8F5A07B96E0AB9F"><enum>(ii)</enum><text>the areas that each grantee will serve using the grant funds;</text></clause><clause id="id884466435E6C4A58B77DD7F9D6AD25B0"><enum>(iii)</enum><text>the nature of the service that each grantee will provide in each area described in clause (ii); and</text></clause><clause id="id5BF5D2DACCC04F5F9113F0C7987FF17F"><enum>(iv)</enum><text>the amount that the Commission has authorized each grantee to use to carry out a qualifying project in each unserved area; and</text></clause></subparagraph></paragraph><paragraph id="id3dd6df9345a5451184094d02a277e88c"><enum>(4)</enum><text>the Commission shall establish—</text><subparagraph id="idd13f90bf3381427886408ba718be1750"><enum>(A)</enum><text>broadband buildout milestones and periodic certifications that a grantee must submit to demonstrate compliance with the broad­band buildout milestones;</text></subparagraph><subparagraph id="id7421c09548b6479bb5e8a3c442628388"><enum>(B)</enum><text>a maximum buildout timeframe of 5 years from the date on which the Commission first awards a grant to an eligible entity;</text></subparagraph><subparagraph id="id029d1f0d97064fd3b0f3bca5f3de1a07"><enum>(C)</enum><text>requirements for grantees to submit to the Commission and to the broadband office or other applicable authority of the State in which the grantee is carrying out the project periodic reports that identify—</text><clause id="id166C8353013A439489C079B0CE11E4B5"><enum>(i)</enum><text>the nature of the service provided in each unserved area; and</text></clause><clause id="id7202DF8D34A94760B30164AED6BD9B70"><enum>(ii)</enum><text>the latitude and longitude coordinates of each location to which the grantee has provided broadband internet access service in each census block;</text></clause></subparagraph><subparagraph id="id6c7d2205d0814a8b97f1ef668407be3d"><enum>(D)</enum><text>penalties for noncompliance with—</text><clause id="idE671A23D46F943FEA083CC38A0D8DE52"><enum>(i)</enum><text>the broadband buildout milestones under subparagraph (A);</text></clause><clause id="id07456B3C051449258C456E3A7A8BC260"><enum>(ii)</enum><text>the certification requirements under subparagraph (A); and</text></clause><clause id="idDE911EA5704744278398678B8683AF4E"><enum>(iii)</enum><text>the reporting requirements under subparagraph (C);</text></clause></subparagraph><subparagraph id="id448b75af96db4c56b0324428e8dc4cd0"><enum>(E)</enum><text>procedures through which the Commission may recover grant funds, in whole or in part, from a grantee if the grantee defaults or does not comply with the requirements under this Act; and</text></subparagraph><subparagraph id="id4c34a4e02f874681b53ac572aa6c7366"><enum>(F)</enum><text>any additional methods or reporting necessary to reduce waste, fraud, and abuse within the grant program.</text></subparagraph></paragraph></subsection><subsection id="idde3275c3246449e3868cf109bed4d8a4"><enum>(b)</enum><header>Public awareness and digital literacy grants</header><text>For grants awarded under section 4, the Commission shall establish transparency and accountability rules that—</text><paragraph id="idbbc8d754ba654f43a1498592fb2941d2"><enum>(1)</enum><text>require the Commission to provide the public with notice of—</text><subparagraph id="idad481d0e387848ec94692d438d376635"><enum>(A)</enum><text>the entities that have applied for a grant; and</text></subparagraph><subparagraph id="id45099709a0e044bf8c78ebdd1916e6a5"><enum>(B)</enum><text>the results of any decision regarding a grant application, including by—</text><clause id="idA250D61C5E3945E9A0899D6747883749"><enum>(i)</enum><text>identifying each eligible entity that was awarded a grant;</text></clause><clause id="id59F22F0680B44AED820807A0EECDFDFA"><enum>(ii)</enum><text>identifying the areas that each grantee will serve using the grant funds;</text></clause><clause id="idBB293A68345E480889C379E9E9EF196D"><enum>(iii)</enum><text>providing a summary of the projects that each grantee will carry out in each area described in clause (ii); and</text></clause><clause id="id14F53D61A57C4F998352ABE3DF9A6B90"><enum>(iv)</enum><text>the amount that the Commission has authorized a grantee to use to carry out a public awareness campaign or support digital literacy programs in each area described in clause (ii); and</text></clause></subparagraph></paragraph><paragraph id="id3bf55a7e179b4b83a2d6cede7949d7aa"><enum>(2)</enum><text>establish—</text><subparagraph id="id1c7b674ab25d48c2b86140e3eed6b948"><enum>(A)</enum><text>project milestones and periodic certifications that a grantee must submit to demonstrate compliance with the project milestones;</text></subparagraph><subparagraph id="idfa788fa852764f69b937c35107d63fbb"><enum>(B)</enum><text>a maximum project completion timeframe of 5 years from the date on which the Commission first awards a grant to an eligible entity;</text></subparagraph><subparagraph id="idfeae6437b95240f9a701e250f9b9b754"><enum>(C)</enum><text>periodic reporting requirements for grantees to demonstrate progress in meeting the project milestones under subparagraph (A);</text></subparagraph><subparagraph id="idf5cba6dca5114778a7aa2cdc05a8f039"><enum>(D)</enum><text>penalties for noncompliance with—</text><clause id="idCA1451A3C0194E58903211118274767B"><enum>(i)</enum><text>the project milestones under subparagraph (A);</text></clause><clause id="idF206534D74BE4D42A24A0F77F2A41D62"><enum>(ii)</enum><text>the certification requirements under subparagraph (A); and</text></clause><clause id="idFADFDE00D6CE4D68AAD350BEE8211107"><enum>(iii)</enum><text>the reporting requirements under subparagraph (C);</text></clause></subparagraph><subparagraph id="idce1fb72abbae4a10a5908a1e3a4d6010"><enum>(E)</enum><text>procedures through which the Commission may recover grant funds, in whole or in part, from a grantee if the grantee defaults or does not comply with the requirements under this Act; and</text></subparagraph><subparagraph id="id67067a90b0064968adabf79840e1d4c1"><enum>(F)</enum><text>any additional methods or reporting necessary to reduce waste, fraud, and abuse within the grant program.</text></subparagraph></paragraph></subsection></section><section id="idF2B375FDF03B4379A1C3FDD9614C285D"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Commission to carry out this Act for fiscal year 2021, $15,000,000,000, to remain available until expended.</text></section></legis-body></bill>
