which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To extend the Secure Rural Schools and Community Self-Determination Act of 2000.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Rural Schools Reauthorization Act of 2021</short-title></quote>.</text></section><section id="id615A37D84EDE403AA280609D41E32863" changed="not-changed"><enum>2.</enum><header>Extension of Secure Rural Schools and Community Self-Determination Act of 2000</header><subsection id="id6a7c60b89fb04528b5550fed862de1e9" changed="not-changed"><enum>(a)</enum><header>Definition of full funding amount</header><text>Section 3(11) of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7102">16 U.S.C. 7102(11)</external-xref>) is amended by striking subparagraphs (D) and (E) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id71083f3c17444ec18d20ac1909cceb8e" changed="not-changed"><subparagraph id="idcceb5dfb98c14fcf9ee6239c68094afd" changed="not-changed"><enum>(D)</enum><text>for fiscal year 2017, the amount that is equal to 95 percent of the full funding amount for fiscal year 2015;</text></subparagraph><subparagraph id="id6e4e5d4703054c038307587f569fa7cc" changed="not-changed"><enum>(E)</enum><text>for each of fiscal years 2018 through 2020, the amount that is equal to 95 percent of the full funding amount for the preceding fiscal year; and</text></subparagraph><subparagraph id="id003acb6c737445f0affc5ad722e9daee" changed="not-changed"><enum>(F)</enum><text>for fiscal year 2021 and each fiscal year thereafter, the amount that is equal to the full funding amount for fiscal year 2017.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idEB93FAC14C6A4A8E88917307CFE73C83" changed="not-changed"><enum>(b)</enum><header>Secure payments for States and counties containing Federal land</header><paragraph id="idfef087ae-e8d4-43bf-ac40-e4808ca4c7bc" changed="not-changed"><enum>(1)</enum><header>Secure payments</header><text>Section 101 of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7111">16 U.S.C. 7111</external-xref>) is amended, in subsections (a) and (b), by striking <quote>2015, 2017, 2018, 2019, and 2020</quote> each place it appears and inserting <quote>2015 and 2017 through 2023</quote>.</text></paragraph><paragraph id="id3a8c4b48-0512-40b4-aef6-5c1897dd3623" changed="not-changed"><enum>(2)</enum><header>Distribution of payments to eligible counties</header><text>Section 103(d)(2) of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7113">16 U.S.C. 7113(d)(2)</external-xref>) is amended by striking <quote>2020</quote> and inserting <quote>2023</quote>.</text></paragraph></subsection><subsection id="id174df07d546e4ca299eeafef8b21ba55" changed="not-changed"><enum>(c)</enum><header>Pilot program To streamline nomination of members of resource advisory committees</header><text>Section 205 of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7125">16 U.S.C. 7125</external-xref>) is amended by striking subsection (g) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDE2BF110B8F24BE9B05769017F931999" changed="not-changed"><subsection id="id1a32d4658805415e8a3e63f5085d8809" changed="not-changed"><enum>(g)</enum><header>Resource advisory committee appointment pilot programs</header><paragraph id="id04042F31FAF0435D8D02A965D8DE70F5" changed="not-changed"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id7BB42A31C9D74A1D9B438B8A994BF154" changed="not-changed"><enum>(A)</enum><header>Applicable designee</header><text>The term <term>applicable designee</term> means the applicable regional forester.</text></subparagraph><subparagraph id="id0B4E00ECB23F4433AFDBDABA2DF8297D" changed="not-changed"><enum>(B)</enum><header>National pilot program</header><text>The term <term>national pilot program</term> means the national pilot program established under paragraph (4)(A).</text></subparagraph><subparagraph id="id527D4782F40542CCAA1081BA95B8BA7B" changed="not-changed"><enum>(C)</enum><header>Regional pilot program</header><text>The term <term>regional pilot program</term> means the regional pilot program established under paragraph (3)(A).</text></subparagraph></paragraph><paragraph id="idb97ad66835ac439f8e85b80d290ae223" changed="not-changed"><enum>(2)</enum><header>Establishment of pilot programs</header><text>In accordance with paragraphs (3) and (4), the Secretary concerned shall carry out 2 pilot programs to appoint members of resource advisory committees.</text></paragraph><paragraph id="id3ac3d38d5dc640efad73b89a30d1ddd5" changed="not-changed"><enum>(3)</enum><header>Regional pilot program</header><subparagraph id="id0b9c588b327742869b4f08d342041da4" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The Secretary concerned shall carry out a regional pilot program to allow an applicable designee to appoint members of resource advisory committees.</text></subparagraph><subparagraph id="idb6a05162338c49d9af3d63a5947240e4" changed="not-changed"><enum>(B)</enum><header>Geographic limitation</header><text>The regional pilot program shall only apply to resource advisory committees chartered in—</text><clause id="idd1dcc69bff1b4850956c67e8d2ef066d" changed="not-changed"><enum>(i)</enum><text>the State of Montana; and</text></clause><clause id="id1e8bfacef7c74d10b954a65f793966d6" changed="not-changed"><enum>(ii)</enum><text>the State of Arizona.</text></clause></subparagraph><subparagraph id="id3833ef982a07475fae02951117861311" changed="not-changed"><enum>(C)</enum><header>Responsibilities of applicable designee</header><clause id="id4666b3e59a9344248671c8cdff025218" changed="not-changed"><enum>(i)</enum><header>Review</header><text>Before appointing a member of a resource advisory committee under the regional pilot program, an applicable designee shall conduct the review and analysis that would otherwise be conducted for an appointment to a resource advisory committee if the regional pilot program was not in effect, including any review and analysis with respect to civil rights and budgetary requirements.</text></clause><clause id="id2bdeba49986d430a82ea831d43b1b686" changed="not-changed"><enum>(ii)</enum><header>Savings clause</header><text>Nothing in this paragraph relieves an applicable designee from any requirement developed by the Secretary concerned for making an appointment to a resource advisory committee that is in effect on December 20, 2018, including any requirement for advertising a vacancy.</text></clause></subparagraph></paragraph><paragraph id="idf39075296d1f4b5b8f6cf9668cc74a6f" changed="not-changed"><enum>(4)</enum><header>National pilot program</header><subparagraph id="id1de1728ac7d44972acd52a60ec31f6d9" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The Secretary concerned shall carry out a national pilot program to allow the Chief of the Forest Service or the Director of the Bureau of Land Management, as applicable, to submit to the Secretary concerned nominations of individuals for appointment as members of resource advisory committees.</text></subparagraph><subparagraph id="id1bf65003c4f84b42a761426dde6f777f" changed="not-changed"><enum>(B)</enum><header>Appointment</header><text>Under the national pilot program, subject to subparagraph (C), not later than 30 days after the date on which a nomination is transmitted to the Secretary concerned under subparagraph (A), the Secretary concerned shall—</text><clause id="id8d449dd82f1147c4baac407f020e4840" changed="not-changed"><enum>(i)</enum><text>appoint the nominee to the applicable resource advisory committee; or</text></clause><clause id="iddf3a9761791745f8910fb1000a93fb8b" changed="not-changed"><enum>(ii)</enum><text>reject the nomination.</text></clause></subparagraph><subparagraph id="idc9bab3394c3949ddba3ea37a81de565e" changed="not-changed"><enum>(C)</enum><header>Automatic appointment</header><text>If the Secretary concerned does not act on a nomination in accordance with subparagraph (B) by the date described in that subparagraph, the nominee shall be deemed appointed to the applicable resource advisory committee.</text></subparagraph><subparagraph id="id4511e2797842445583fff20c20675150" changed="not-changed"><enum>(D)</enum><header>Geographic limitation</header><text>The national pilot program shall apply to a resource advisory committee chartered in any State other than—</text><clause id="id625e28c90b914704a313461340f9ba90" changed="not-changed"><enum>(i)</enum><text>the State of Montana; or</text></clause><clause id="ida183fd36098646d3b6322d88f387a9da" changed="not-changed"><enum>(ii)</enum><text>the State of Arizona.</text></clause></subparagraph><subparagraph id="id5bbdb402215f4d6aa79cac08b4c3b4dc" changed="not-changed"><enum>(E)</enum><header>Savings clause</header><text>Nothing in this paragraph relieves the Secretary concerned from any requirement relating to an appointment to a resource advisory committee, including any requirement with respect to civil rights or advertising a vacancy.</text></subparagraph></paragraph><paragraph id="id5a67c3ec7f2244f89038fddbbb3c4f45" changed="not-changed"><enum>(5)</enum><header>Termination of effectiveness</header><text>The authority provided under this subsection terminates on October 1, 2023.</text></paragraph><paragraph id="id187dbf6746ed454696691fffc5025b46" changed="not-changed"><enum>(6)</enum><header>Report to Congress</header><text>Not later 180 days after the date described in paragraph (5), the Secretary concerned shall submit to Congress a report that includes—</text><subparagraph id="ide8b559fa6bbc457dacd8b507f7f26efc" changed="not-changed"><enum>(A)</enum><text>with respect to appointments made under the regional pilot program compared to appointments made under the national pilot program, a description of the extent to which—</text><clause id="id61d754d757184befb4a7a045c25543db" changed="not-changed"><enum>(i)</enum><text>appointments were faster or slower; and</text></clause><clause id="id1e27bc48e3e0444e974cfabfd4e3bd03" changed="not-changed"><enum>(ii)</enum><text>the requirements described in paragraph (3)(C)(i) differ; and</text></clause></subparagraph><subparagraph id="idbd4cf7aa18064b35b9d0c78f64412130" changed="not-changed"><enum>(B)</enum><text>a recommendation with respect to whether Congress should terminate, continue, modify, or expand the pilot programs.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb3d42533-d0e3-4658-97eb-655849519f1c" changed="not-changed"><enum>(d)</enum><header>Extension of authority To conduct special projects on Federal land</header><paragraph id="id7921A4CDB0264BA9A99ED19C2061543B" changed="not-changed"><enum>(1)</enum><header>Existing advisory committees</header><text>Section 205(a)(4) of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7125">16 U.S.C. 7125(a)(4)</external-xref>) is amended by striking <quote>December 20, 2021</quote> each place it appears and inserting <quote>December 20, 2023</quote>.</text></paragraph><paragraph id="id6CF34DB1841648048176EA41537CD4DE" changed="not-changed"><enum>(2)</enum><header>Extension of authority</header><text>Section 208 of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7128">16 U.S.C. 7128</external-xref>) is amended—</text><subparagraph id="idf1c37939-96c7-4c23-82c2-e8b89e963e94" changed="not-changed"><enum>(A)</enum><text>in subsection (a), by striking <quote>2022</quote> and inserting <quote>2025</quote>; and</text></subparagraph><subparagraph id="ideaffb26a-8a69-4e05-bd20-9de5fd8485f5" changed="not-changed"><enum>(B)</enum><text>in subsection (b), by striking <quote>2023</quote> and inserting <quote>2026</quote>.</text></subparagraph></paragraph></subsection><subsection id="id4A9EAC12A0004D15AF9CFC81EFED6F4C" changed="not-changed"><enum>(e)</enum><header>Access to broadband and other technology</header><text>Section 302(a) of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7142">16 U.S.C. 7142(a)</external-xref>) is amended—</text><paragraph id="id7B2125535AB94E7198A010E5FAC6E3FA" changed="not-changed"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id23499A301E3F4BFE9DD8BA877882FD34" changed="not-changed"><enum>(2)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id78B7E1CB36144FB488CB1AA99128081E" changed="not-changed"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7B351CA803DC4716ACF0E5C527C64116" changed="not-changed"><paragraph id="id18F6501D00EE44F4A88423E2DCB8C8E7" changed="not-changed"><enum>(5)</enum><text>to provide or expand access to—</text><subparagraph id="id91E955739FB3493EB333C9B4281A4440" changed="not-changed"><enum>(A)</enum><text>broadband telecommunications services at local schools; or</text></subparagraph><subparagraph id="id5953BB774E8E4FB4A6A61E8F95B6C6AC" changed="not-changed"><enum>(B)</enum><text>the technology and connectivity necessary for students to use a digital learning tool at or outside of a local school campus.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ide4e63b6e-5c4a-43b7-a420-f786e7439bb2" changed="not-changed"><enum>(f)</enum><header>Extension of authority To expend county funds</header><text>Section 304 of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7144">16 U.S.C. 7144</external-xref>) is amended—</text><paragraph id="id39acd448-44ff-4117-af4c-d4db06a98053" changed="not-changed"><enum>(1)</enum><text>in subsection (a), by striking <quote>2022</quote> and inserting <quote>2025</quote>; and</text></paragraph><paragraph id="idec987c1f-f49c-4276-b6aa-b6fde063c232" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text>in subsection (b), by striking <quote>2023</quote> and inserting <quote>2026</quote>.</text></paragraph></subsection><subsection id="id70C1A228207A4AC6B5B8BB5099027DB2" changed="not-changed"><enum>(g)</enum><header>Amounts obligated but unspent; prohibition on use of funds</header><text>Title III of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7141">16 U.S.C. 7141</external-xref> et seq.) is amended—</text><paragraph id="idE38F37A94F044565B1D0A57C7D75B508" changed="not-changed"><enum>(1)</enum><text>by redesignating section 304 as section 305; and</text></paragraph><paragraph id="id190EF2079FA145AEB599E720E2869198" changed="not-changed"><enum>(2)</enum><text>by inserting after section 303 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2871E84D8CE24C0E89E48760C30851C6" changed="not-changed"><section id="id6D411F60EEBF45A6A8EA20A7D3FEDDC6" changed="not-changed"><enum>304.</enum><header>Amounts obligated but unspent; prohibition on use of funds</header><subsection id="id67FFE4AFDD6644FA9906776667FBFC8A" changed="not-changed"><enum>(a)</enum><header>Amounts obligated but unspent</header><text>Any county funds that were obligated by the applicable participating county before October 1, 2017, but are unspent on October 1, 2020—</text><paragraph id="id1D4407A27D0445F6917031F767CF71DC" changed="not-changed"><enum>(1)</enum><text>may, at the option of the participating county, be deemed to have been reserved by the participating county on October 1, 2020, for expenditure in accordance with this title; and</text></paragraph><paragraph id="idDD1207C3AC674330BBE751E1FAAF34AA" changed="not-changed"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idCAD5C5B2EFD24EEE9A8F54262AB3C556" changed="not-changed"><enum>(A)</enum><text>may be used by the participating county for any authorized use under section 302(a); and</text></subparagraph><subparagraph id="id5BAD700856254D1A8049395761FBCB23" indent="up1" changed="not-changed"><enum>(B)</enum><text>on a determination by the participating county under subparagraph (A) to use the county funds, shall be available for projects initiated after October 1, 2020, subject to section 305.</text></subparagraph></paragraph></subsection><subsection id="id0DFB058CEA9E4F0DA81B01500DA0B4AC" changed="not-changed"><enum>(b)</enum><header>Prohibition on use of funds</header><text>Notwithstanding any other provision of law, effective beginning on the date of enactment of the <short-title>Secure Rural Schools Reauthorization Act of 2021</short-title>, no county funds made available under this title may be used by any participating county for any lobbying activity, regardless of the purpose for which the funds are obligated on or before that date.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
