<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4342</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220526">May 26, 2022</action-date><action-desc><sponsor name-id="S316">Mr. Whitehouse</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to authorize a new student loan forgiveness program.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Affording Students A Path to Forgiveness Act</short-title></quote> or the <quote><short-title>ASAP Forgiveness Act</short-title></quote>.</text></section><section id="id39BE6710DE6E4828B837FBED2A6DA7B5"><enum>2.</enum><header>Loan forgiveness program for employment</header><text display-inline="no-display-inline">Section 455 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id37F7E62551264733A0CF3DB456B5CB4A"><subsection id="idF5DBF168C714446B839109E64077E982"><enum>(r)</enum><header>Loan forgiveness for employment</header><paragraph id="id87B5C7C756B94952A265C6755A4A0BA0"><enum>(1)</enum><header>In general</header><text>The Secretary shall cancel not more than $30,000 of interest and principal due, in accordance with paragraph (2), on any eligible Federal Direct Loan that is in repayment status on or after the date of enactment of this subsection for a borrower who—</text><subparagraph id="id251578F0444D4C438A85970C4ADB5CF6"><enum>(A)</enum><text>has made not less than 60 monthly payments on the eligible Federal Direct Loan pursuant to any repayment plan authorized under this Act; and</text></subparagraph><subparagraph id="idFD4AF8ADEDB648F1A70E6BC35C94EFB0"><enum>(B)</enum><text>has been employed, on a full-time or part-time basis, for 10 years after graduating from, or otherwise leaving, the institution of higher education for which the loan was made to enable the borrower to enroll.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD94F01FAC8774F1D95DC8E21A1992BA0"><enum>(2)</enum><header display-inline="yes-display-inline">Loan cancellation amount</header><text display-inline="yes-display-inline">After the conclusion of the employment period described in paragraph (1), the Secretary shall cancel the obligation to repay not more than $30,000 of principal and interest due as of the time of such cancellation, on the eligible Federal Direct Loans made to the borrower under this part.</text></paragraph><paragraph id="id8087CFECC9EE49A9B580105AF493B22C"><enum>(3)</enum><header>Eligible federal direct loan</header><text>In this subsection, the term <term>eligible Federal Direct Loan</term> means a Federal Direct Stafford Loan, Federal Direct PLUS Loan, or Federal Direct Unsubsidized Stafford Loan, or a Federal Direct Consolidation Loan.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC4E0E4DD8F014AF28189A7889C991755"><enum>(4)</enum><header display-inline="yes-display-inline">Ineligibility for double benefits</header><text display-inline="yes-display-inline">No borrower may, for the same service, receive a reduction of loan obligations under both this subsection and subsection (m) or section 428J, 428K, 428L, or 460.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
