which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20221018">October 18, 2022</action-date><action-desc>Reported under authority of the order of the Senate of October 14, 2022, by <sponsor name-id="S380">Mr. Peters</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to authorize the appointment of spouses of members of the Armed Forces who are on active duty, disabled, or deceased to positions in which the spouses will work remotely.</official-title></form><legis-body><section id="id25c953ea7aba4a14884644f919eb8e7d" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Spouse Employment Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id6E1EC69F86FC456AA056FB666DA77E3D" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Appointment of military spouses</header><text display-inline="no-display-inline">Section 3330d of title 5, United States Code, is amended—</text><paragraph id="id53692D9E04784C5F9A4FFAAD0650D997"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idBC6C3754B99145F38A8E7CE7321B2B2B"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph id="id4B2FA7268F214A33AD7748185FEF88EE"><enum>(B)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" id="idBAEA883EB7BD41C187F85427B97D58BA" act-name="" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="id18F3182A5D8C4BD4A326C1CBF9868038"><enum>(3)</enum><text>The term <term>remote work</term> refers to a work flexibility arrangement under which an employee— </text><subparagraph id="id5C5171684DF14375888C9334113FBB5F"><enum>(A)</enum><text>is not expected to physically report to the location from which the employee would otherwise work, considering the position of the employee; and</text></subparagraph><subparagraph id="id7C079A868BAB4D408FADEA265EF6996E"><enum>(B)</enum><text>performs the duties and responsibilities of such employee’s position, and other authorized activities, from an approved worksite— </text><clause id="idD71205EE62BA4F11AB7C55EEA82B2771"><enum>(i)</enum><text>other than the location from which the employee would otherwise work;</text></clause><clause id="id80B2C4A7B26342F383E9D292CFCB6EC5"><enum>(ii)</enum><text>that may be inside or outside the local commuting area of the location from which the employee would otherwise work; and</text></clause><clause id="id50496A4126234E89AF62E2F7F8542F18"><enum>(iii)</enum><text>that is typically the residence of the employee.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id185F04978341460C944A2EC63D8931B3"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id6609f77bebc24ecbbe048b916d1216e0"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="id2ca1f33c0a7b44f79e46496df7142f18"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id74bee6b2cba94760866246bd3b7f49a1"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8972908ace954f76853cb0cbd6c48f6a" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="id5a619009687444d49427fc42f7a5d097"><enum>(3)</enum><text>a spouse of a member of the Armed Forces who is on active duty, or a spouse of a disabled or deceased member of the Armed Forces, to a position in which that individual will engage in remote work.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id044673EC47594F1FB4BA3FD39A11EA0C"><enum>(3)</enum><text>in subsection (c)(1), by striking <quote>subsection (a)(3)</quote> and inserting <quote>subsection (a)(4)</quote>.</text></paragraph></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id2aa9162c-94f9-423d-9a01-d4576ebd9156" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Spouse Employment Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idf3a9c390-e362-46f9-8c9b-263ee66bfcdf" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Appointment of military spouses</header><text display-inline="no-display-inline">Section 3330d of title 5, United States Code, is amended—</text><paragraph id="id30c695ad-1ece-40da-b358-01288da8f405"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id198ec974-e2b8-4de6-932b-6bc84a532701"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (4); </text></subparagraph><subparagraph id="id32f477a1-2077-4bd5-82bc-46d15dcbcc5d"><enum>(B)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" id="idfb726d3a-34ed-4a8a-b894-54c768834eb5" act-name="" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="id08506841-baa7-4b18-8e5d-1b88a8e8550f"><enum>(3)</enum><text>The term <term>remote work</term> refers to a particular type of telework under which an employee is not expected to report to an officially established agency location on a regular and recurring basis.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id476D0B3771C1496EBBFA30799763F42F"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="idCB4ECA76E93A4B1FAC1395B16FA6DDF5" style="OLC" act-name="" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="id3906B61ECB154BF19757CF5533A2E67F"><enum>(5)</enum><text>The term <term>telework</term> has the meaning given the term in section 6501.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idb1b64020-1bad-40a1-bd51-08341d651d0c"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id9dc95b85-6e70-48c5-8a6b-afc98b7a5044"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="id43fd532d-ebad-4451-a738-e77d7e030a7a"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id35ec48b1-6d07-477c-9eee-ffd884cd46ee"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4a795637-dd43-45e7-83db-57e69cbe5ab0" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="ide67d8514-1410-4845-a30b-3d895b31296f"><enum>(3)</enum><text>a spouse of a member of the Armed Forces on active duty, or a spouse of a disabled or deceased member of the Armed Forces, to a position in which the spouse will engage in remote work.</text></paragraph><after-quoted-block>;
