which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a plan on emergency military assistance to Taiwan and other support to Taiwan's defensive capabilities, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthen Taiwan's Security Act of 2022</short-title></quote>.</text></section><section id="id0816B486CE394EE9B35A819DB2B134F1"><enum>2.</enum><header>Annual report on the ability of the United States to support defensive capabilities of Taiwan</header><subsection id="id38C3512607A549A58A86442A99FD101E"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter through fiscal year 2027, the Secretary of Defense shall submit to the appropriate committees of Congress, a report on the ability of the United States to support the defensive capabilities of Taiwan.</text></subsection><subsection id="id3F4C4D818CCC413EA2AF1630C1743394"><enum>(b)</enum><header>Elements</header><paragraph id="idAEF7E6A4E2EA4A7AA91BC0C1F3394876"><enum>(1)</enum><header>In general</header><text>The elements described in this paragraph are the following:</text><subparagraph id="id718cace99b1e4aa9adb9a6e8a2d8f437"><enum>(A)</enum><text>An assessment of the implications of current levels of pre-positioned war reserve materiel on the ability of the United States to respond to a natural disaster in or military invasion of Taiwan, with respect to—</text><clause id="id88f61008718e4c83904b9aa3420a7d94"><enum>(i)</enum><text>providing military or nonmilitary aid to the Government of Taiwan; and</text></clause><clause id="id1114e759e8074b8aaf9c45c19759641c"><enum>(ii)</enum><text>sustaining military installations and other infrastructure of the United States in the Indo-Pacific region.</text></clause></subparagraph><subparagraph id="id3de2e990381742a5b684839c05eca175"><enum>(B)</enum><text>An evaluation of the use by the United States Government of privileges available with respect to Taiwan under the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>), including war reserve stockpiles for allies and pre-positioned facilities.</text></subparagraph><subparagraph id="id9822E976018447A587752A1590FA1F64"><enum>(C)</enum><text>An assessment of ways the United States Government could employ such privileges to support the defensive capabilities of Taiwan in the event of a military invasion.</text></subparagraph><subparagraph id="idea0759477ec64cde865295d8b661d17e"><enum>(D)</enum><text>An assessment of the current intelligence, surveillance, and reconnaissance capabilities of Taiwan and any existing gaps in such capabilities.</text></subparagraph><subparagraph id="id53ebc798e544498b96a29f53cab6e5b9"><enum>(E)</enum><text>An evaluation of options to enhance such capabilities, that includes for each such option—</text><clause id="id41a06d2062204e6389ae34a080e1170c"><enum>(i)</enum><text>a description of—</text><subclause id="id06D5223EC6604FBDAB3EAAFF4EFB7621"><enum>(I)</enum><text>the gaps addressed;</text></subclause><subclause id="id5e8fa4d6d5ad48e6b705c65b3c112197"><enum>(II)</enum><text>the resources required for implementation; and</text></subclause><subclause id="idF476021B2147428982EDF233536218E3"><enum>(III)</enum><text>the potential constraints with respect to implementation;</text></subclause></clause><clause id="idb546a223573340b2836e0a6165eb6421"><enum>(ii)</enum><text>projected timeline for implementation; and</text></clause><clause id="id53d2901c943d46458bb477e976498976"><enum>(iii)</enum><text>any other consideration the Secretary of Defense considers necessary.</text></clause></subparagraph></paragraph><paragraph id="id3ED9125C8DA74C2D832317536E3F9B39"><enum>(2)</enum><header>Initial report</header><text>The initial report required by subsection (a) shall include the following:</text><subparagraph id="idDCF1B7B44F694111A428945966503E33"><enum>(A)</enum><text>The elements described in paragraph (1).</text></subparagraph><subparagraph id="id642B3A2653384B0BBFAB5BA56E832989"><enum>(B)</enum><text>The plan required by subsection (c).</text></subparagraph></paragraph><paragraph id="id82D761142F6D408C954577AB48E9D417"><enum>(3)</enum><header>Additional reports</header><text>The second and any subsequent report required by subsection (a) shall include the following:</text><subparagraph id="id092FCDD36D6E452DAE680FB1D3F18318"><enum>(A)</enum><text>The elements described in paragraph (1).</text></subparagraph><subparagraph id="idB65A985EAD56455298D2C316858B6A92"><enum>(B)</enum><text>A summary of changes to pre-positioned war reserve materiel of the United States in the Indo-Pacific region as reported by the Armed Forces since the preceding report.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5b940fd09467402fbfc1278a4b6d1fe0"><enum>(C)</enum><text>A summary of investments made by Taiwan in intelligence, surveillance, and reconnaissance capabilities since the preceding report.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idBB00864D4E124FCF922228C2684BB549"><enum>(D)</enum><text>Any updates to the plan required by subsection (c), as determined by the Secretary of Defense.</text></subparagraph></paragraph></subsection><subsection id="id649C07403BDF4FD28239E0B83F26F95D"><enum>(c)</enum><header>Plan for emergency military assistance</header><paragraph id="idAA2687CC32F648CC87B104CAE93B48C0"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense, in close consultation with the Taiwan Ministry of Defense of Taiwan and the military forces of Taiwan, shall develop a plan for the United States to use, to the maximum extent practicable, existing authorities or programs to expedite military assistance to Taiwan necessary for Taiwan to defend itself in the event of a military invasion. </text></paragraph><paragraph id="idA8CAD4F746FB494A827F55648A95A429"><enum>(2)</enum><header>Elements</header><text>The plan required by paragraph (1) shall include the following:</text><subparagraph id="id7F965402DBBF46CAA3590B2A2AB05BC1"><enum>(A)</enum><text>A list of defense articles of the United States that may, with pre-approved authority, be transferred to Taiwan during a military invasion.</text></subparagraph><subparagraph id="id0741169638ca41528cfc137e49da8be0"><enum>(B)</enum><text>A list of measures to be prioritized to assist Taiwan during a military invasion, including—</text><clause id="id950d4806453440f1862c654a592d6ed8"><enum>(i)</enum><text>prioritization of delivery of excess defense articles to Taiwan;</text></clause><clause id="idedc73f9fbb9c45ab84b812eb50fc6386"><enum>(ii)</enum><text>use by the Secretary of Defense of the lease authority and the Special Defense Acquisition Fund established under section 51 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2795">22 U.S.C. 2795</external-xref>);</text></clause><clause id="id6f647a3c371a4f65b772999fba183c97"><enum>(iii)</enum><text>use of the presidential drawdown authority under section 506(a) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2318">22 U.S.C. 2318(a)</external-xref>);</text></clause><clause id="id1c5bd4f4796e41b6ba44fbb77aab97d9"><enum>(iv)</enum><text>use of presidential authority to lend or lease defense articles to the Government of Taiwan; and</text></clause><clause id="id20430c0f2cc147a2961c69ae52c632e1"><enum>(v)</enum><text>temporary expedited congressional review of arms sales to Taiwan.</text></clause></subparagraph><subparagraph id="idd1373a0f0c3a4f7b84edaaa16b2770ba"><enum>(C)</enum><text>An assessment of methods that could be used to deliver aid to Taiwan during a military invasion of Taiwan, including—</text><clause id="idED484023B90C456DA4B3D0D98F0D48F1"><enum>(i)</enum><text>the feasibility of employing such methods in different scenarios; and </text></clause><clause id="id4803F38AD78C4A2CA75AE46789D26EC2"><enum>(ii)</enum><text>recommendations for improving the ability of the Armed Forces to deliver assistance to Taiwan. </text></clause></subparagraph><subparagraph id="id03BF000B025A4E31AF8DBCB4CDE1C755"><enum>(D)</enum><text>An assessment of additional assistance that could be provided to Taiwan if additional authority is granted.</text></subparagraph></paragraph></subsection><subsection id="id2203EF33A21942CF8F05D1549A61264E"><enum>(d)</enum><header>Form</header><text>Each report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex. </text></subsection></section><section id="id3F0AF048062B40B794C92BB8EF2FA46C"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id4901E6C6B4BF479DB72E4D8ADA3BB0E2"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means— </text><subparagraph id="idDCD460CDA9034D52AC1C44564EADB32D"><enum>(A)</enum><text>the Committee on Armed Services, the Committee on Foreign Relations, and the Select Committee on Intelligence of the Senate; and </text></subparagraph><subparagraph id="id9C0D9AD77EF648349E4C42B45D03FD61"><enum>(B)</enum><text>the Committee on Armed Services, the Committee on Foreign Affairs, and the Permanent Select Committee on Intelligence of the House of Representatives. </text></subparagraph></paragraph><paragraph id="idE3DAB21ECEAF418B9FAE6FE2341FA931" commented="no"><enum>(2)</enum><header>Military invasion</header><text>The term <term>military invasion</term> includes—</text><subparagraph id="idA25728BB1C2540AEB4D8B62D849B0B3C" commented="no"><enum>(A)</enum><text>an amphibious landing or assault; </text></subparagraph><subparagraph id="id70DE37A66FEE4BDFB8275A987AE5FB3B" commented="no"><enum>(B)</enum><text>an airborne operation or air assault;</text></subparagraph><subparagraph id="id950A920E9ED44ACEA208EA9F26CA4623" commented="no"><enum>(C)</enum><text>an aerial bombardment or blockade;</text></subparagraph><subparagraph id="id362C4B476CCC455091CE9D7C614F9844" commented="no"><enum>(D)</enum><text>missile attacks, including rockets, ballistic missiles, cruise missiles, and hypersonic missiles; and</text></subparagraph><subparagraph id="id42EE8C4A4B6A43D8BC0A7FB495199550" commented="no"><enum>(E)</enum><text>a naval bombardment or blockade. </text></subparagraph></paragraph><paragraph commented="no" id="id603904406F67495D9E7E8D2D2DE2F9D6"><enum>(3)</enum><header>Natural disaster</header><text>The term <term>natural disaster</term> means a disaster caused by natural forces, including extreme weather events, sea-level rise, or extreme drought conditions.</text></paragraph></section></legis-body></bill>
